As a member or former member of the military did he forget his oath of office to defend and protect the US Constitution?

He probably believes in that "living Constitution" thing..... whatever some Liberal Court Justice thinks things mean today.

One would think after the Dredd Scott decision that people quit having endless faith in the US Supreme Court but.....

He'd probably jump right on board with England's "knife ban" as well. After all, Guns-already-banned-London has now surpassed NYC in murders. It's common sense. Kitchen cutlerly is dangerous and no one needs them.
