Am I safe in thinking that this is currently legal?

The NCIC (national criminal instant check) system is a federal database that virtually any law enforcement agency can access. Not necessarily any LEO as some agencies get access for more employees than others.
At my federal agency only 10-15% (my personal guess) of us have access to the system.

In theory IF the gun is properly stowed AND you don't get out of your car AT ALL (not even for gas) it's -technically- legal per the Firearms Owners Protection Act (FOPA).
But as to the sweet payday, I think the only person with that would be the lawyer you'd have to pay huge fees to get your ass out of jail/trouble. NY, for example, overtly considers FOPA an "affirmative defense" not an absolution. You'd still have to (likely) spend time in jail until you could make bail, then go to court, then -prove- you were fully FOPA compliant and then -hopefully- you'd get let off.
Getting a civil payout? LOL.
Theory and practice/reality. Two entirely different things.
