    Brings up an interesting question. 11E on the 4473 form asks, Are you a user et cetera. Obviously in the present tense. It does not ask Are you or have you ever been. Point being, records may show an arrest citing a drug violation and having been charged with such, and records also reflect the drug charge was reduced to a violation very broad in nature not specifying drug involvement. The records still indicate drugs were involved in 2011, 6 or more years ago.

    Since the question is in the present tense, it would appear that a person who has "kicked the habit" would be of good standing and can honestly answer no to question 11E. How does one prove it, should a sheriff have reservations?. May I suggest voluntarily getting a blood test done and having the results in hand before applying for the LTCF? Then the question would be, attach it to the application, ask for an appointment to speak with the sheriff and show him the proof, or wait and see before submitting it.

    That is interesting. The other end of catch-22.

    67 differing MOs among 67 different sheriffs. The deputy assigned LTCF is going to have a set of instructions. One may be, any sign of drug involvement...reject.
    That kicks off the need for appeal, potentially delaying the issuance for 45 days. Personally, knowing the potential my history carries, I would start out with a request to speak to the sheriff. I think that would nip it in the bud.
