Toilet-Lashing Woman 'Vindicated'

SCRANTON, LACKAWANNA COUNTY- Dawn Herb said the $19 thousand payout from Scranton was vindication. Herb was cited last year after delivering an obscenity-laced lashing on her overflowing toilet in mid-October.

Herb was cleared earlier this year by a district magistrate. She had planned to sue the city on grounds the police department violated her right to free speech. The $19 thousand settlement was finalized Tuesday.

Herb said her patience had "run out" as her toilet was gushing water all over the floor, seeping through the ceiling in her Luzerne Street kitchen. An off-duty Scranton police officer, who lived next door, heard the hollering and reported it to the department. An officer came by and issued a written citation.

The story grabbed headlines around the country and sparked water-cooler discussion. Herb said her case was based on the First Amendment and nothing more.

Scranton city leaders were not available for comment.
