I recently was on probation for a paraphernalia charge. (wrong place wrong time) i do not smoke weed. with that being said I was on probation without verdict. meaning once completed it will be exspunged off my record in 6-9 months. about 2 weeks ago i finished probation. that was in indiana county. I also had a disorderly conduct in Cambria county that probation was completed for. My question is why am I on research? I appealed the ccp. Also a gun attorney told me that if I was denied they could press charges and give me a felony? I only have a misdemeanor and a summary offense. I was told by my probation officer i would be able to buy/inherit and carry.

Probation officers are not lawyers. And it's advisable that you retain a good lawyer

Sounds like a lifestyle change is in order to correct problems encountered with firearm ownership. Remember this, you are asking the government to let you exercise your 2nd amendment rights. If they do not approve of your behavior they can deny you your rights. It's not Constitutional but the Constitution no longer applies as we've seen in the repetitive way it gets trampled upon or completely ignored. Rights are only guaranteed to those that are powerful enough to affirm them.

Section 17. Probation Without Verdict.--Except as provided
in clause (1) of this subsection, the court may place a person
on probation without verdict if the person pleads nolo
contendere or guilty to any nonviolent offense under this act
and the person proves he is drug dependent.

So how did you pull this off?

thats just how it happened. i called PICS today and i told them what i said here. the person at PICS told me that if thats all that is on my record (which it is) they said it should be a simple fix.

Paraphernalia plus a seperate disorderly conduct charge spells trouble to me. As Jen said, sounds like a lifestyle change is in order. I'm as big a proponent of 2A that you can find, but you sound like trouble my friend.
Hope I'm wrong, however I'll echo the good lawyer advice.

Upon fulfillment of the terms and conditions of
probation, the court shall discharge such person and dismiss the
proceedings against him. Discharge and dismissal shall be
without adjudication of guilt and shall not constitute a
conviction for any purpose whatever, including the penalties
imposed for second or subsequent convictions: Provided, That
probation without verdict shall be available to any person only
once: And further provided, That notwithstanding any other
provision of this act, the prosecuting attorney or the court,
and the council shall keep a list of those persons placed on
probation without verdict, which list may only be used to
determine the eligibility of persons for probation without
verdict and the names on such lists may be used for no other
purpose whatsoever.
