    Probable cause is required for an *arrest*. "Reasonable suspicion" is required to make a 'Terry stop'.

    Presumed innocent applies to the officer unless there is probable cause. The difficulty is in what they decide is 'probable cause'

    I don't see how these arguments apply to the statute.

    If one is asked lawfully to provide an LTCF at the time of the encounter, and the LTCF is expired, at the time less than six months, how does the officer presume eligibility, which is part of the statute?

    Here is a question: given how CHEAP an LTCF is to renew, is it REALLY WORTH saving a few dollars to stretch out your renewal to the absolute maximum and risk having some huge complications later (whether they're justified or not), vs just renewing a little early and considering that "lost time" you paid for just the price of piece of mind?

    I mean, damn. How cheap can you be? We're talking about a FEW DOLLARS at most here.

    He can't presume *ineligibility*, thus the default is pretty clear (at least to me). This applies across the board, it's not required to be spelled out in any given statute. It's one of the checks and balances built into "the system".

    So if one were found in violation of PA 6106, should the officer charge this person with a felony or a misdemeanor?

    Depends if they are (were) eligible to be licensed in the first place.

    Never had one, or expired more than six months, but legally eligible and carrying without anyway when required = M1.

    Not legally eligible to begin with = F3.

    Either way, a conviction will strip your rights.

    I see it like this, He doesn't presume eligibility, he determines whether or not he wants to charge you. Just like an officer can choose not to charge you for a moving violation. If he decides to charge you Title 18, Section 6106 b(12) provides a defense against the offence defined in § 6106. Firearms not to be carried without a license which would be a misdemeanor of the first degree.
