The DoD does need to be held accountable for that error IMO.
The entire DoD or the persons that were directly responsible for the failure?

Failure to report a disposition did work out in the shooter's favor, but I don't know how that can be a basis of a suit considering that it wasn't the only way for the shooter to get his hands on a gun. Guns are stolen and used in crimes by prohibited persons. The speculation that he would not have acted if the prohibition were in force is unprovable. Does a court try a case based upon speculation?

He could have have killed everyone in the church with 5 gallons of gas and twenty bucks worth of chain and padlocks..just sayin.
If you are deemed well enough to not be locked up in an institution, you should be allowed the means to defend yourself. The same goes for felons, if the ptb think one is ok to integrate back into society, then they should be allowed the means to protect themselves. The problem with mentally handicapped is directly attributable to liberals and the mass release of violent, dangerous patients because they feel bad for them.
The problem with releasing violent criminals into society is due to the war on drugs and the overcrowding of prisons, and of course leftists feeling bad for locking scumbags up.
Go sell crazy some where else, we're all stocked up here.

I'm very well aware of the fact that this guy probably would have found another means of carrying out his murderous plot, regardless of whether or not he could legally purchase firearms. However, do you really want people who FRACTURED AN INFANTS SKULL to be able to legally purchase firearms? I don't. We'll just have to agree to disagree on this.

Wouldn't it be funny if the state of Texas filed a brief opposing NY, philly and San Fran stating that they have no business sticking their noses into a Texas issue.

San Fransisco is unable to stop "homeless" homeless people from defecating in the Streets. They've had so much human waste on the sidewalks that someone put up a "poop map" so that visitors can avoid sidewalks covered in waste.

If Frisco can't stop people from crapping in the street like dogs how can they accuse the DOD of not doing it's job?

In the early 2000s Philly arrested on in five murderers. Not charged, arrested for murder.

Pennsylvania has had a handgun registry for years. PA State Police puts your purchases into a computer. That's a registry. Lot more than Texas or other nearby States. Philly Politicians like to blame the NRA for their problems.

New York? One commenter on Hot Air blames NYC's falling murder rate on a combination of "gentrification" and "targeted policing".

I think that Police State tactics have worked too. When Bloomberg was Mayor he asked the NY State National Guard to stay off of NYC streets.

Here Bloomberg talks about how "His" NYPD doesn't help from the NY State national guard. "The only people we want on the street with guns is the NYPD".

It's a publicity stunt, at least that's how I see it.
