Santander to get 1.5 Million grant from the state

According to WFMZ news, Santander arena in Reading will be getting 1.5 Million from Gov. Wolf. So if Santander gets the money from the state. A.K.A. the tax payer, will C.C. then be legal? If they refuse to allow C.C. would that be a preemption violation? I don't quite understand the grant process works when the State gives money to a private company.

No, It is still private. If the State Had bought it outright then we would have something to talk about.
