    Default National Reciprocity - a question for people smarter than me

    If travel between the states is protected by the Privileges and Immunities clause of the Constitution, whereas one state is not allowed to discriminate against travellers from another state, AND possession of a firearm for self protection has been determined to be an individual right under Heller, why then is concealed carry between the states not protected by the Privileges and Immunities clause?

    The short answer is because the Supreme Court hasn't said so.

    Only because they continue to reject these cases when they come to them simply because they would be forced to up hold the constitution.

    Gun laws are a mish-mash. From what I gather, SCOTUS wants clear and concise matters that they can consider in triage manner. That may be difficult to conform to in gun cases. On the flip side, some cases are wisely not sent to them because the outcome holds potential for set-back.

    Letter (in part and paraphrased) from Congressman Brian Fitzpatrick:

    As a fellow gun owner and supporter of the Second Amendment, re concealed carry reciprocity....

    I am firmly committed to the Second Amendment, have fought over-reach by any federal agency....

    ....firm belief in the concept of reciprocity....

    (verbatim): I look forward to supporting final passage of reciprocity legislation coming back from the Senate. My concerns with the House legislation stemmed from extraneous provisions included in that bill which undermined the goals of a clean reciprocity bill. To that end, I have opened conversations with Senate leadership to advance a solution so Congress continues with the goal of taking our time to seize this opportunity to pass not the quickest, but the most effective, consensus reciprocity measures possible. (end verbatim).

    To my read, consensus reciprocity measures means input from all states, leading to compromise...states with 40 hours training comes down to 20, states with no training comes up to 20, and so-on.

    No need for a lawyer or smartie to answer this one. It's because the rogue territories do not comply with federal law or the Constitution. I hear all the time from people

    and they are. Any state who forgoes the ratification of the Constitution does NOT deserve representation in Congress.

    ...and yet all of this pontificating is a waste of time...If you want the right results go to court. Having the Legislature argue this is just going to end up with more infringements. We need to be fighting this in COURT!

    The last time that I checked Congress enacted laws, not the Judicial branch.
