Remington Tac-14 Classification?
Hey just seeing if anyone else has heard of the reclassification of the Remington tac-14 by Pennsylvania classifying it as a pistol? Just had my LGS call me and saying I had to come in and fill out the pistol copy for the State police. Any information would be helpful. Thanks

I bought the mossberg version a couple months ago and it is classified as a firearm.

I had purchased two Tac-14’s about 5 months ago. Then just this morning my local shop called and said you have to come in as soon as possible to get the pistol forms filled out in order to send them to the state police. Supposedly it’s making its way out to gun shops slowly from the state police.

Both the Mossberg 590 and the Remington Tac-14 are classed as handguns by PA (confirmed with the PSP Firearms Unit) and as such, the SP4-113 (Application/Record of Sale) will have to be filled out along witht e ATF 4473 when one is transferred to a buyer be it an original buyer or a private sale.

Well, at the beginning, there was a lot of confusion and discussion between Mossberg and the ATF when they first introduced it and the ATF hemmed and hawed for a good while before they decided on what it was. There are a lot of states that due to the wording in their firearm laws said it is not legal (Ohio right now is arguing how to class them so you can't buy one there yet). Once Mossberg cleared the path, then Remington jumped in with their model.
However, that doesn't mean that the BATFE can't reverse its ruling, think about how many times the shoulder brace issue was settled then reversed and then rereversed before the latest ruling.Ron USAF Ret E-8 FFL01/SOT3 NRA Benefactor Member

It's not a handgun, it's a "firearm" for this purpose:
"Firearm." Any pistol or revolver with a barrel length less than 15 inches, any shotgun with a barrel length less than 18 inches or any rifle with a barrel length less than 16 inches, or any pistol, revolver, rifle or shotgun with an overall length of less than 26 inches. The barrel length of a firearm shall be determined by measuring from the muzzle of the barrel to the face of the closed action, bolt or cylinder, whichever is applicable.
We could try to argue that it's not a "shotgun" since it has no buttstock, but right now it's being treated as a shotgun with a 14" barrel, and that's a "firearm".
Note that for other purposes, the definition of "firearm" is different. For example, in Section 6105, Persons Not to Possess, it's MUCH broader and includes anything that goes "bang" and spits out a projectile:
(i) Firearm.--As used in this section only, the term "firearm" shall include any weapons which are designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon.Attorney Phil Kline, AKA gunlawyer001@gmail.com
