I read this story this morning. It sure sounds like she is toast.

Years ago, Ayoob gave a great definition of the narrow situation that justifies lethal force, and I memorized: "The Immediate and otherwise unavoidable danger of death or grave bodily harm to the innocent." I don't think this woman's case fulfills the 'unavoidable' clause, since reports say she actually got out of her car, went back into it, and came back out with the gun to confront the hobo. This was avoidable, and she chose to not avoid it.

I don't give a shit what she did in her past, what her current employment is or her hopes and dreams. The version of events as described by police seems the most probable and with that she is guilty as charged.
