Monroe County gun license permit application process challenged

The Monroe County Sheriff’s Office no longer uses postcards in its mailings pertaining to gun license permit applications, according to court records in a potential $40 million lawsuit challenging the county’s application process.
The four unidentified local plaintiffs in the suit filed last year by Berks County attorney Joshua Prince contend that Monroe County Sheriff Todd Martin’s office illegally disclosed confidential information about at least 12,584 gun permit applicants during a five-year period. The plaintiffs seek statutory damages of $1,000 per each alleged disclosure of an applicant’s identity, plus attorney fees.
Prince has asked that all Monroe County applicants during the five-year period for a license to carry firearms (LTCF) be certified as a class so that he can seek damages on their behalf as well as for his four clients.
Prince contends that each instance in which the office sent postcards — rather than sealed envelopes — for mailings approving, denying or revoking individual gun license permits, and in obtaining background information from references, violates state law by making the disclosures public. Information on the postcards is visible to postal employees and roommates of an applicant or a reference, the plaintiffs assert.
Wyoming County judge to preside
The case was assigned to Wyoming County President Judge Russell D. Shurtleff to avoid a potential conflict of interest from a Monroe County judge hearing the case. The judge granted Prince’s motion to keep secret the identities of the four Monroe County plaintiffs who applied for and received gun permits.
Shurtleff also ordered that legal filings in the case be sealed, though recent written arguments regarding Prince’s motion for an immediate preliminary injunction barring continued use of the county’s gun permit application process have been posted in the public court file.
“The sheriff’s office no longer uses postcards to notify applicants of the status of their permit applications or to seek opinions from references,” wrote Stroudsburg attorney Gerard Geiger, who represents Monroe County and the sheriff’s office. “The sheriff’s office uses the application form prescribed by the Pennsylvania State Police. That form includes a request for references.”
Prince contends that several provisions of the county’s application process for a license to carry a firearm — including requiring applicants to provide two references — violate the law. He said county requirements that applicants must have a permanent physical address, disclose a copy of one of their tax forms and, if on disability, disclose documentation from a doctor on the nature of the disability or medications being taken for it, also are unlawful.
“All plaintiffs and the putative class are fearful that their confidential and private information that defendants are requiring and maintaining may be disclosed, either purposely or inadvertently, by defendants, including to employees who lack any legal right to review, inspect or otherwise know the information on that documentation,” Prince wrote.
Prince said the application form created by the Pennsylvania State Police and cited as used by the sheriff’s office “is devoid of anything within it that requires a permanent address.” He wrote that a separate part of the form allows residents of other states to apply for a gun permit in Pennsylvania.
But Geiger argues the Monroe County Sheriff’s Office is following the law by not processing applications of non-residents.
“The sheriff’s office does not process non-resident applications because the statute specifically says that the sheriff of the county where the applicant resides must process the application,” Geiger wrote.
Warehousing confidential information
Geiger said the office asks for tax returns only for establishing an applicant’s legal residence and that any financial information on the form can be redacted by the applicant. He said requested Social Security disability information is used to determine an applicant’s fitness to carry a firearm.
“If submissions reflect that a person is on disability or medications that might affect the applicant’s ability to handle a firearm safely, the sheriff’s office requests permission to contact the applicant’s physician to verify this ability,” Geiger wrote.
Prince argues that an applicant’s medical information is confidential and that the sheriff’s office has no reason to demand it. He said the office has conceded that it has no medical staff to interpret the medical reports collected.
“Rather, they are merely warehousing all of this confidential medical information for no purpose other than to dissuade and discriminate against individuals with disabilities, in violation of the Americans with Disabilities Act ... from procuring LTCFs,” Prince charged.
Sheriff Martin’s predecessor, former Sheriff Forrest Sebring, created the county’s permit application process, Geiger wrote. The same sheriff’s deputy has been processing permit applications for the past 21 years and all information collected is kept in a locked cabinet, Geiger added.
Geiger contends the four unidentified plaintiffs have no legal standing to challenge the county’s gun permit application process because all four already have been issued five-year licenses to carry firearms. Geiger said the earliest any defendant can legally challenge the process is October 2018, when at least one of the applicant’s permits expires and that person would have to reapply.
It is unknown when Judge Shurtleff will rule on Prince’s request for a preliminary injunction barring the sheriff’s office from enforcing its gun permit application policies.How can you have any cookies if you don't drink your milk?

OP, just FYI, the instructions say you should redact all financial information.
A photocopy of your most recent Local 1% Earned Income Tax Form, (i.e. Berkheimer Assoc.) NOT your
W-2 form or your property taxes. If you are not familiar with this tax, contact the appropriate agency below
to register as a tax payer. Request a letter stating you have done so and bring that in upon submission.
Exception - Retirees must provide a copy of their Federal Income Tax Return; Pa. State Tax Return; or
Social Security Statement (with all financial information blacked out) reflecting their proof of Monroe
County residency. Other documents may also be considered.

Townships and Boroughs located in Monroe County. A copy of this form will be accepted (with all financial
information blacked out) reflecting proof of Monroe County residency.
Personally i don't think it's that big of a deal to give a redacted income tax form. i have a bigger problem with their requirement for references to be monroe county residents when the state only requires 2 references that are not family. Also, they have a habit of losing the returned referral cards.
