Reinstatement of conceal carry

In April I made the mistake of leaving my firearm in my vehicle and then driving to Maryland the next day. I had a medical event (hypotension) and a police office stopped To help.

I was cooperated with the police but was charged with a firearm in a car which is a misdemeanor charge. I accepted a PBJ, completed a gun safety class and paid a fine of $50 for court fees.

Am I shit out of luck getting my permit back? If not how long should I wait before I try to get it back? What should I put in my letter to my sheriff?

Better then a bar of soap in the shower. Maryland is a weird state. Other then Baltimore, PG and Montgomery the state is very conservative.

It all sounds great! Very glad for you. Making damned sure of the expungement is good advice. It's not necessarily automatic. Good to learn Mary Land is conservative albeit the Dem strongholds.

After successfully completing PBJ , the * charge * disappears from the record. The record of an Arrest would remain, pending Expungment , if desired.

But take careful notice - Violations of 4-203 ( which includes not only what is thought of as "carry" , but also unloaded and encased, unless going to specific approved destinations) is a 3 Year Misdemeanor , and thus would make you Prohibited under Federal law.

What is the distribution of the record of charge? What is the distribution of the record of arrest? Was OP fingerprinted and photographed? If so, what is that distribution? With a potential of 3 years, everything has to be accounted for. If it all stays in Adams county, it's a hell of a relief.

There was no arrest and the only reason I was fingerprinted was for probation. So once it's expunged it's gone.

I'm confused. You speak of "my lawyer said" so you apparently do or did have a lawyer for this matter. If you were taken into custody by Maryland LE and transported to processing facilities and were not free to leave at any time, you were arrested.

Under PBJ you have agreed that you will plead nolo contender at completion of probation. Nolo contender is legalese meaning "no contest", amounting to you stipulating that the prosecution could and would present evidence sufficient to prove your having done the crime had you entered a plea of not guilty and caused a trial to be conducted. Nolo contender has been called the soft guilty plea.

I asked about the distribution of the fingerprints. I'm assuming they remained local and distribution to state and FBI would occur only if you violated probation.

It looks like PBJ was designed to save the courts from listing minor but numerous arrests that wind up pleaded down anyway. It also looks like it was not intended for gun violations but is being used...probably by officers exercising discretion on case-by-case basis. That's great, but I would still be concerned that the federal laws may remain unaffected. Good luck. Let us know in a year?

I am confused. You first said you were charged with a misdemeanor and now say you were cited. I thought they were different animals.
