That's a fun read, especially the part where the Attorney General's lawyers do not even understand the law.

Question- Would this ban qualify as a 'taking'? I know the public wouldn't 'use' the property but since it is being done to 'protect the public' and for the benefit of the 'public' the people having their property taken should be remunerated.

Do you mean "taking" as in the 5th amendment style? Good question. Let's hope someone answers it. When the gov makes something illegal to have that was once legal so they have to pay you for that something?

It was a good read and it helped explain from the judges perspective the issues which everyday Americans would have in trying to follow the law. The judge was not pleased with the DA's lack of understanding hpow this law interacts with the other laws being implemented in CA...

I think in 4 years time, most of these infringements against Californians will be overturned. Just a hunch...

Gee I wonder if he was this mad about the will of the people being overturned when the voter ban on gay marriage was struck down.
