This is not a process for amateurs. Do a search on the site and you will find a couple of threads on the subject of an old 302 barring you from buying a firearm. A couple of the participants are attorneys. Use one of them or someone else who has experience with the process. Pay no attention to their location. Phones and FAX cancel distance. Do it now and don't waste whatever time you have to appeal or respond.

Your post is rudely accusatory, uninformed, and not at all helpful.


The OP needs to get the records from the facility to determine if it was or was not a 302 commitment.
The problem here is probably going to be getting the info before the time to appeal is expired.
If the records show that there was a 302, then the OP's life just got complicated. Now it must be determined if the 302 was even valid - and by that I mean determine if it was done legally.
Not everyone who is 302'd knows it, and not all 302 commitments are done legally.

Get the records and start scouring them.

Need a lawyer as one could question the fact that the person was 16 (a legal minor?) so does a lifelong ban alright if he is not legally able to give consent or realize he needs help? And secondly, for an incident that happened before you could enter contracts etc. is a person expected to know the type of their commitment? Is the 302 (if it was a 302) done because a responsible adult wouldn't give permission or so that the state would pay for treatment?

Definitely need a gun lawyer to help you. IANAL

You're at step 1 of a very long frustrating and expensive process. You'll need to physically go to the hospital where this occurred and find the records department. If it has been longer than 10 years there's a high probability that they've purged the records but still have a copy on microfilm. If they don't have the physical records chances are you'll need to get with a lawyer and have them get the copy off the microfilm.

This is not a quick process if you need to get a lawyer involved to get the documents and will likely exceed the time for the challenge. A lawyer should advise what to do in the event the hospital doesn't have any records on file and how to proceed with the appeal.

Hopefully the PSP won't come after you for incorrect info on the form.
