    Doctors Want to Reinstate Gun Maker Lawsuit

    They say makers of military-style rifles should be held liable for injuries the rifles cause.

    HARTFORD, Conn. (AP) — A group of doctors who treated mass shooting victims is asking the state Supreme Court to reinstate a lawsuit against the maker of the rifle used in the Sandy Hook Elementary School massacre.


    Lawyers for the 10 doctors said Tuesday that they planned to file a friend-of-the-court brief asking the justices to overturn a lower-court decision in October that dismissed the lawsuit against Remington Outdoor Co., of Madison, North Carolina. They said makers of military-style rifles should be held liable for injuries the rifles cause, a claim Remington contested.

    The doctors include emergency room physicians and trauma surgeons who treated patients shot by military-style rifles including AR-15s in attacks at the Newtown school, in San Bernardino, California, and in Colorado at Columbine High School and an Aurora movie theater.

    "These military weapons are completely distinct from handguns and rifles used for hunting or self-defense," lawyers for the doctors said in their brief. "They can cause enormous human carnage, destruction and chaos with their high energy and rapid fire bullets that leave gaping holes and turn surrounding tissue and organs into goo in large numbers of victims in a matter of seconds."

    Gunman Adam Lanza used a Bushmaster AR-15-style rifle to kill 20 first-graders and six educators at the Newtown school in December 2012. He had killed his mother before going to the school, and he killed himself as police arrived at the school.

    The lawsuit against Remington, Bushmaster's parent company, was filed in state court by a survivor and relatives of nine people killed in the Newtown shooting. The lawsuit said the Bushmaster rifle is too dangerous to sell to the public and its maker should be held liable for the Newtown shooting under a negligent entrustment law.

    Lawyers for Remington said the rifle was made, distributed and sold legally.

    A judge in October sided with Remington's argument that the lawsuit was barred by a federal law that shields gun manufacturers from most lawsuits over criminal use of their products. That decision was appealed to the state Supreme Court, with the plaintiffs saying the lawsuit was allowed under an exemption to the federal law.

    No doubt the Trial Lawyers are backing this. Yet, when a drunk driver kills someone, they don't sue the car manufacturer. Maybe, every car capable of 80 MPH should be banned. It's for the children.

    Assigning damages for hybrids should be interesting. I've got components from Lancer Systems, ALG, DPMS, YHM, BCM, Anderson and so on in mine.

    Count the lies in this:

    If your side of the debate needs to tell lies in order to have a strong argument, then you're on the wrong side of the argument.

    Literally millions of these guns have been sold to millions of citizens, and the number misused in spree shootings can be listed on one sheet of paper. We shouldn't be such tyrants that we ban a product because 1 out of 100,000 may be misused by the mentally ill. The 1st Amendment religious freedom is not limited by what a religious cult might do, protection for the press is not limited by what a liar might do, and the 2nd Amendment isn't limited by what a suicidal loon might do.

    If you want to save lives, then work at preventing unwed pregnancies and single-parent homes. Boys produced by that dynamic are more dangerous per capita than AR-15's. And crack down on Muslims, do a calculation of the number of Muslims in this country and compare it to the number of mass attacks committed by Muslims in this country, then see whether we're willing to restrict religious liberty or gun rights for American citizens based on a small percentage of abuses.

    Tell me Mister Trial Lawyer (not you GL001, the jerks representing these Drs.) what EXACTLY is a military-style weapon??? Wow, wasn't a Winchester Model 94 (equivalent model) used by the US Army in the 19th and 20th century? Isn't the US Army a military group? How about a Winchester pump shotgun (Trench gun in WWI)? How about a Springfield 03A3 (a bolt action rifle like what is used to hunt with today), or how about a Colt SAA (Single Action ARMY). And on and on and on, ad nauseum.

    Any decent defense attorney who does a just a little research can put these jerks against the ropes in 10 seconds flat.

    This is nothing but a free shot at getting some more news out of the Shady Hook shooting...

    Any lawyer, with the right mind, would never allow that emotional drivel to be released, unless there was an ulterior motive behind the propaganda release.
