    Constitution, motherfukah!

    It enumerates what can the state do and what citizen CAN'T. If certain government's right isnt enumerated, then government is prohibited from doing it. And if citizen isnt expressly denied certain right, then he can do it. Cop is a government agent and scope of his authority should be enumerated.

    Please go back to Civics or Government class.

    The Constitution says what the Gov CAN do, they make laws that restrict what a citizen may do based on the Constitution, so no law is needed to OC, a law would be needed to prohibit OC. Laws are made within the confines of what the Gov CAN do and if it is out of their range then the SCOTUS will or should based on your view, rule it unconstitutional.

    Not a flame just 12th grade civics.
