Re: Carry policies in public places.
Malls put a lot of restrictions in their leases. You can bet good money there is a "comply with all mall regulations" clause in their leases.
You shop at Home Depot for BJs? Which location is that?
No. However, there is the "public square" doctrine that is being applied.

The idea being that if you are a certain kind of public place, such as a mall, the public somehow requires the right to exercise certain activities on that private property that are unrelated to the desires of that private property owner. I wonder if this concept can be applied to concealed carry...or open carry for that matter.

Re: Carry policies in public places.
"but if it's public" inferring that when you are at a township building with a no gun sign, in a township park. recycling center. etc. public properties.
you still leave when asked, but come back with vengeance. (when the courts are in our favor)
i find them uncomfortable but otherwise +1 it changes your entire appearance, much less threatening with one. especially if you have yourself a nice white flat billed baseball cap.
aisle 12, next to the plungers. -_- i was saying HD and BJ's are both typically firearm friendly.
to the IWB guy, yes it sucks. keeps it tighter to your side than OWB but is less comfortable. trade that "hanging" feeling for pressure points on your ass cheek and hip. desantis leather here. There is no way to make it out alive...

Re: Carry policies in public places.
Gotcha, assumed that you were implying malls were public property.
Some people just plain suck.
If you're gonna be dumb ya gotta be tough.

Re: Carry policies in public places.
He said "but when it's public property, come back with a lawyer and raise hell on them. preemption and all."
That statement in and of itself is accurate.
However you're right about malls and private property and pre-emption not applying, and I do think he's confusing 'open to the public' and 'public property' (i.e. implying malls are 'public property', which they aren't) and your point needed to be made.
But IF a place is in fact 'public property' and carry is not statutorily barred at the state level (i.e. courthouses), then I do NOT think "just leave if you're asked" applies.
It might still be wise to leave if asked, depending on the context and who's asking. A misinformed cop telling me to leave, I'd probably go rather than try to 'convince' him (after noting his badge for a subsequent complaint). Some yutz tells me "hey man, you better leave before someone notices your gun, there's no guns allowed in state parks" or similar... not so much. (I'd probably say something like, "Thanks for your concern, but it's okay, I have a firearms license" and leave it at that...)

PS - While I wrote this, subsequent posts make it clear fallenleader was NOT mistaking 'open to the public' and 'public property'... Had I properly remembered it was him I was referencing, I'd have known better. Sorry FL.Last edited by KCJones; February 27th, 2017 at 10:19 PM. Reason: added PS
