The race appears to be at "The Wall", which according to the results of my Google-fu is a public street area, not private property. It looks to be part of Philadelphia, which is "a city of the first class", so you would need a LTCF, but if it is a public area they can't ban legally carried firearms.
Again, I'm not a lawyer, I just watch one on TV. Denny Crane!

if they get a permit and close the area off for the event, they actually can ban guns at the event.
just like they can ban bringing in your own water.
and, yeah, you would also not find me at any such event.

Sure they could ban guns but it would'nt be against the law to bring one, would it? It seems to me that if someone did bring a gun(or water) The most they could do is deny entry or, If the person is already at the event, Ask them to leave. Now if the person refused to leave that would be different but could just showing up with a gun (and LTCF) be an arrestable offense?

I do not think this is correct. It is public property (owned by the city/etc)
As such it is subject to 18Pa.C.S.6120. A contract with a private entity does not override state preemption as far as I can tell.
There is no preemption statute for carrying water... but there is for carrying firearms

it wouldn't be the municipality "banning" carrying at the event, though...it would be the event organizers, so i don't see how preemption would apply.
as someone else pointed out, it wouldn't be illegal, but they could ask you to leave and then charge you with trespassing if you don't.
i think for the purposes of controlling access, etc., the permitted area effectively becomes private property controlled by the permitee. at least that's how it has worked when i have permitted public sports fields. of course, i never tried to ban guns at any of the events i organized.Last edited by LittleRedToyota; September 7th, 2008 at 12:40 AM.
