I may have posted this story earlier this week, but this article has video foot of 3 people trying to break into a house and then running away after the homeowner fires a shot. It show what a difference maker a gun can be for a homeowner.

Armed raiders flee in terror as homeowner SHOOTS at them

A homeowner aimed fire at armed robbers after they tried to force their entry into his home.

Surveillance footage taken from outside the owner's home near S 145 E Avenue and Kenosha in Broken arrow, Oklahoma, on February 12, shows the armed suspects run towards the homeowner's property and kick his door open at around 6pm.

However the robbers soon flee the scene after a shot is fired in their direction by the homeowner stood waiting by his door.

During the footage, one of the armed suspects is seen leaping forward and breaking the door down with one sharp kick as his two accomplices follow suite.

The three armed suspects hover by the door with their weapons before a shot is fired at them and hits the homeowner's truck parked in the driveway.

After the homeowner fires his bullet, the armed suspects flee the scene.

Next-door-neighbour Cash McDonald told 'I was just inside listening to my Will Smith CD.

'Neighbors came out and said they heard gunshots.'

Mr McDonald added that he and other residents on the street then rushed outside their homes but the robbers had already fled the scene.

Following the encounter, the homeowner told News On 6 off-camera that he decided to get his gun and wait by the entrance to his property after spotting the three armed men standing in his driveway.

The homeowner said he believes the robbers targeted him as they thought he had money.

A police investigation is now underway and all three suspects are still on the run.

Teen acquitted of murder in fatal shooting of off-duty Richmond County deputy
Sandy Hodson Most Popular Our Picks
It was a classic case of self defense, Na’eem Caldwell’s attorney told the jury in closing. The jury agreed, acquitting the teen in the 2017 fatal shooting of Richmond County Sheriff Deputy Gregory Cooke.

After deliberating for an hour Friday, jurors returned a verdict finding Caldwell not guilty of murder, armed robbery and weapon charges in the June 15, 2017, shooting. The jury did find Caldwell, 19, guilty of a reduced charge of theft.

“There’s no better example, no more worthy example” of self defense, Caldwell’s attorney, Keith Johnson, told the jury in his closing argument.

That tragic June afternoon, Caldwell looked through a window of his home and saw a man he didn’t know standing at the driver’s side window of his father’s car. He had a gun pointed at his father’s head, Johnson said.

Caldwell got the handgun his father had given him after being robbed two days earlier, he told the jury this week. He shot Cooke in the back and as the man turned with the gun in hand, he kept shooting, Caldwell testified.

It is the prosecutor’s burden to prove beyond a reasonable doubt that Caldwell did not act in self defense, his attorney argued to the jury. The standard for self defense is reasonable, not perfection, Johnson said.

Cooke wasn’t perfect, Assistant District Attorney McKenzie Gray told the jury in her closing. He was a married man who went to Caldwell’s home that day to see Caldwell’s mother, Regina Osborne. But he didn’t deserve to die for that, she argued.

The story that Cooke became enraged when Caldwell’s father, Stevie Caldwell, called him soldier didn’t make sense, Gray said. He was retired military and a trained law enforcement officer. What made more sense was Caldwell and his father were mad that Cooke was visiting Osborne, Gray said. Caldwell decided to back up his father, she said.

“Gregory Cooke was running for cover,” Gray said. If he had had a gun in hand he would have been firing back in self defense. “This was murder.”

Self defense was a story Caldwell and his father cooked up while Caldwell was on the run after killing Cooke and stealing his gun, Gray said. If it was self-defense Caldwell would have stayed at the scene with his parents, Gray argued.

Caldwell told the jury he and his cousin Donnelle Osborne ran when they heard his mother tell the 911 operator that the man he had shot was a sheriff’s deputy. The other officers would kill him, Caldwell said he assumed. A neighbor who called Caldwell after the shooting talked him into surrendering with the promise she would be there to ensure his safety. She told him to remove his shirt so the officers could see he was unarmed and to get down on the road with his hands up.

Caldwell and his cousin were taken into custody in Burke County. The jury saw the photograph of the teens on their knees, shirtless with the hands above their heads.

At the conclusion of the trial, Judge John Flythe sentenced Caldwell, who had several violent incidents as a juvenile, to 10 years in prison for theft, the maximum sentence possible.

Osborne, 20, faces the same charges of murder, armed robbery and possession of a firearm during the commission of a crime. He has pleaded not guilty

Los Osos resident shoots intruder trying to break into his home, sheriff says
    Kaytlyn Leslie
The San Luis Obispo County Sheriff’s Office says a Los Osos resident shot and wounded a man who was attempting to break into his home early Friday morning.

According to the Sheriff’s Office, the male resident of a house in the 1300 block of 6th Street shot the unidentified man around 2:45 a.m. Friday as the suspect was trying to get into his home.

The resident wasn’t harmed, but the alleged invader was transported to the hospital for treatment, the agency said.

Sheriff’s Office detectives spent most of the morning collecting evidence and interviewing witnesses at the scene.

Doug Ruoff, who lives next door to the Los Osos home, said his son heard shouting early Friday morning.

Ruoff said he saw police cars and fire trucks, and witnessed a person being taken away in an ambulance.

Neighbors said the street is quiet and typically safe.

Donna Sanderson, who lives on 3rd Street, said the shooting is “kind of scary” and surprising for the Baywood area.

“It is weird that something like that would happen down here in Baywood,” she said.

The investigation into the incident is ongoing.

Austin-area woman not guilty in fiancé’s fatal shooting
Ryan Autullo Most Popular Our Picks
An Austin-area woman who said she was defending herself and her daughter when she fatally shot her fiancé two years ago got to go home after a Travis County jury acquitted her of murder and all other charges Friday.

Charity Ellis of Hudson Bend had testified during her trial in district court that she was the victim of continued physical abuse and fired a shotgun at her boyfriend, Bradley Sullivan, after he came home high on drugs Dec. 31, 2017, and shoved her into a weight bench. Ellis said she thought she had struck Sullivan in the foot and not in the back, where he suffered a fatal blow. That, she explained, is why she expressed indifference about Sullivan’s well -being and spoke disrespectfully to Travis County sheriff’s deputies after the incident.

Jurors made up their minds after more than five hours of deliberations that began Thursday afternoon. They also acquitted her of two lesser felony charges, manslaughter and criminally negligent homicide. Ellis, who had been in jail since the shooting on bail set at $400,000, faced up to 99 years in prison on the murder charge.

Ellis, 50, was expressionless when visiting Judge Wilford Flowers read the verdict to a nearly empty courtroom. Her parents, who had attended the weeklong trial, were not present. Neither was Sullivan’s family. Also missing was Ellis’ defense attorney, Brian Erskine, who was traveling.

In closing arguments Thursday, Erskine argued that Sullivan’s actions on the night of the shooting continued a pattern of erratic and violent behavior that were brought on by drug abuse. A toxicologist testified that Sullivan had methamphetamine and other drugs in his system at the time of his death. Ellis’ daughter, who was then 15, testified that she was scared of Sullivan and kept a butcher knife near her bed for protection. Once, she said, she defended herself with a lighter and an aerosol can.

Erskine’s co-counsel, Jason Jarvis, released a statement commending the jury’s decision.

“Ms. Charity Ellis believed in her innocence and we held firm with her in that belief,” the statement says. “She acted in self defense and we supported her in that over the past year while she waited in jail for her day in court. The jury conscientiously reached its verdict after an exhaustive and thorough evaluation of the evidence. Because justice was served today Ms. Ellis finally gets to go home an innocent woman and will be reunited with her family.”

The trial was complicated by the absence of former Travis County medical examiner, Dr. Sam Andrews, who performed Sullivan’s autopsy. Prosecutors did not call him to testify because of concerns related to a Texas Rangers and Texas Medical Board investigation into the Lubbock County medical examiner’s office, where Andrews works now as chief medical examiner. Lubbock-based news station KCBD reported last week that the medical board issued a subpoena for records related to, among other things, complaints made against Andrews and any behavior issues he’s had. KCBD also reported that the Lubbock County district attorney’s office will not try any death cases that involve the current staff of the Lubbock County medical examiner’s office.

During his time in Austin, Andrews came under scrutiny for changing his cause-of-death findings on the day before he was set to testify in the murder trial of a man who was suspected of fatally beating his boyfriend. State District Judge David Wahlberg said he was “disgusted” by Andrews’ flip-flop and eventually excluded the doctor’s testimony. Without confirmation about how the victim died, prosecutors could not pursue their most serious charges, including murder. The defendant, Bryan Canchola, was convicted of misdemeanor assault against Stephen Sylvester and agreed to a sentence of six months in jail.

Prosecutors in Ellis’ trial elicited testimony from a medical examiner who reviewed the autopsy Andrews conducted on Sullivan. In closing arguments, Erskine told the jury that it was an “anomaly” to not have the chance to cross-examine the doctor who performed the autopsy. He then pretended to ask questions to an empty witness chair where Andrews would have been seated.

“When that came to our attention, we had communication with the Lubbock district attorney’s office about their hesitancy in using him,” Travis County District Attorney Margaret Moore said. “That’s when we decided to use the reviewing medical examiner instead.”

Travis County spokesman Hector Nieto said the investigation into Andrews has not extended to Austin.

“Neither the Texas Rangers nor the Medical Board have reached out to the medical examiner’s office regarding Dr. Andrews,” he said.

Driver fatally shoots stranger who jumped on car hood, broke window in Charlotte
    Joe Marusak
A driver in north Charlotte shot a stranger who jumped on his car hood and broke a window, police said.

The man who was shot, 21-year-old Robert Demarcus McManus, had “punched a woman in her face” as she sat in a car parked in a driveway along the same road, Gibbons Link Road, at about 8 p.m., Charlotte-Mecklenburg Police said Saturday.

Police determined the attack on the woman was unprovoked, according to the CMPD news release.

The woman did not know McManus, who had just smashed a window of an unoccupied car on nearby Nathan Road, police said.

McManus was jogging down Gibbons Link Road after punching the woman when he jumped onto the hood of a passing car, police said.

When the driver stopped, McManus smashed a window of the car, “at which time the suspect shot him,” police said.

The driver “then drove down the street for about 100 yards, stopped and immediately called 911,” the police statement said. When officers arrived, the driver surrendered.

Police found and seized the gun, according to the CMPD release.

Police said they will present the case to the Mecklenburg County District Attorney’s office, which will review the evidence and determine if the driver will be prosecuted.

The suspect’s name will not be released “unless he is formally charged with a crime in this investigation,” according to the CMPD release.

ALLENTOWN, Pa. - A man shot and killed in Allentown Saturday was part of a trio of people who were planning to commit robbery, authorities said.

Shane Gesnaker was killed Saturday after he and another man had confronted Antonio Santiago in the 1000 block of Turner Street around 2 a.m, said District Attorney Jim Martin.

The two people he was with were arrested Monday.

Andrew Eberts, 31, and Kaitlin Acierno, 28, were charged with one count each of robbery and criminal conspiracy to commit robbery. Both were taken into custody Monday.

Antonio Santiago had been heading to a friend's house in the 1000 block of Turner Street. Santiago was approached by two men as he parked his vehicle, officials said.

The men, who had their faces partially covered, forced open his car door and demanded money.

Shane Gesnaker, one of the men, was holding what was described as a black pistol. Gesnaker struck Santiago in the left side of his face.

Santiago said the men had sprayed him in the face with pepper spray or mace.

Santiago then grabbed his 9mm handgun and fired one shot at the men, who then fled. Gesnaker was struck by a bullet and fell to the ground about 50 feet from Santiago's vehicle.

Santiago was a licensed gun owner with a permit to carry.

    Gesnaker died from his injuries.

Allentown police arrived on scene and found Eberts performing CPR on Gesnaker, while Acierno was near Gesnaker.

Police found a black BB handgun in a nearby trash can.

After an investigation, police determined Gesnaker, Eberts and Acierno were planning to commit robbery on Turner Street.

After Gesnaker was shot, Acierno recovered the BB gun and discarded it in a trash can near the intersection of Russell and North Hazel Streets.

Martin said Santiago's actions were a justified use of force.
