    Gun-toting great-grandma: 86-year-old homeowner scares off would-be burglars | abc13.com
    HOUSTON, Texas (KTRK) --
An 86-year-old great grandmother says she would have shot intruders at her home Wednesday if they broke in.

They ran when realized they were looking through a window down the barrel of her revolver.

"I heard this one knock on the door," said Isabelle Frazier.

She says she looked out the dining room window to see a vehicle parked in front of her home. The vehicle had some of its doors open.

Frazier said someone then returned to the vehicle, stuffing something in his pocket before they drove off.

Intuition told her to be concerned, nonetheless.

She ran to her bedroom to retrieve the gun from her nightstand.

"Pull the drawer out in a hurry, pop this out. I did have my finger on the trigger," she recalled.

As she returned to the living room, she saw somebody by the back kitchen window.

"I headed towards the fence and I thought, 'Wow! I see the tops of two more heads out there,'" she said.

    So, she followed her instinct.

"I leaned over like this...and when I did (tap the window), alerted him, and he looked up, and I was eye to eye to him. There wasn't any doubt when he saw this gun pointed right at him," she remembered.

Frazier says the men ran, piling into a gray SUV they'd backed into her driveway and took off.

Frazier, a grandmother of six, great-grandmother of three, is also a breast cancer survivor.

She says she did what she had to do, and she'd do it again.

"I definitely would not have hesitated. The only thing that would have kept me from it was I didn't want to ruin our windows and our doors with that gun," Frazier said.

The first suspect is described as a tall Hispanic male, approximately 18-20 years old, with thick dark hair, dark pants and a white long sleeve t-shirt with a dark design on it. The second is a light-skin black male, approximately 18-24 years old, with curly hair. The third suspect is a black or Hispanic male, approximately 18-24 years old.

No charges in Klamath Falls shooting

Klamath Falls, Ore. – No charges will be filed in connection with a fatal shooting that happened in Klamath Falls in early March.

The shooting took place at a home on Worden Avenue March 7th.

Klamath Falls Police Chief David Henslee spoke with NBC5 shortly after the shooting occurred: “When we arrived on scene, we found a male victim – we started CPR, tried to resuscitate him, but unfortunately that was not successful – and he has passed away.”

Klamath County District Attorney Eve Costello says after reviewing police reports, the woman who fired the shot will not be charged. “We determined that we did not need to use a grand jury. After full investigation it was determined that it was a justified shooting.”

Costello says the shooting followed an extended period of domestic abuse. “It was justified self-defense use of force on her part.”

Police say the man died after being shot in the torso with a handgun.

The names of the woman who fired the shot, or the man who was killed have not been released.

District Attorney Costello called the situation ‘tragic’.

Man acquitted in fatal 2016 shooting inside Gentilly townhome

A man charged in a fatal shooting inside a Gentilly townhome in 2016 was acquitted of manslaughter after a one-day judge trial last week.

Henry Wilson was charged with killing 26-year-old Billy Dukes on Jan 12. 2016, following what police said was "a verbal altercation that quickly turned violent."

Wilson, 31, maintained he shot Dukes in self-defense. He told police he arrived at the townhome he shared with relatives in the 4300 block of Sybil Street late after work. Once inside, he found a cousin had brought Dukes over. He said Dukes appeared high on pills.

The two began arguing, apparently over a year-old borrowed money dispute, Wilson told police. The argument subsided and then reignited several times until shortly after 3 a.m.

At a bond reduction hearing a month after the shooting, NOPD homicide detective Maggie McCourt testified that Wilson told police Dukes began waving a pistol around in the kitchen, threatening him. Wilson said he feared for his life, retrieved his own handgun from a sofa in the front room, and fired at Dukes in self-defense.

Wilson's attorney, Kevin Boshea, said Dukes waved a loaded pistol at Wilson for at least two hours before Wilson reacted. Boshea said six other people were inside the house at the time, adding Wilson feared for both his safety and the safety of everyone else inside.

McCourt said at the bond reduction hearing that Wilson never fled the crime scene, and immediately accepted responsibility for Dukes' death when he gave his statement to police.

She said at the hearing that Dukes was shot four times -- once in the arm and three times in the back. A trail of bullet casings led to the stairway upon which Dukes attempted to flee.

"I'm not an expert," McCourt testified, "but I would say the evidence lines up with that (Wilson) was chasing the subject."

Court records show Wilson testified in his own defense at his trial before Criminal District Judge Ben Willard on May 17. Willard found him not guilty that same day, according to court records.

Boshea said Kirk Patterson, Wilson's cousin who invited Dukes over to the house, testified he tried to get Dukes to leave more than once before the shooting.

He said Wilson has expressed remorse from the beginning, and all he wanted to do that night was relax after a long night of work. The last thing he wanted to do was pull a gun on anyone, Boshea said.

Wilson, who worked at Brennan's restaurant and in the film industry before his arrest, had no criminal history.

District Attorney Leon Cannizzaro called the judge's verdict "disappointing and disturbing."

"If the judge follows the explanation offered by the defense, then it's OK to kill someone just because they won't leave you alone? The victim in this case never fired his weapon and he was shot at least three times from behind, with the entry point of a fourth shot deemed inconclusive. I think it is very hard to justify this killing as self-defense, given the facts of the case."

Man charged with killing neighbor over lake access acquitted in Chisago County

CENTER CITY, Minn. — A man charged with killing his neighbor over a lake access dispute has been acquitted in Chisago County.

Forty-four-year-old Carl Anderson was facing the possibility of more than two decades in prison had he been found guilty of second-degree murder. Anderson was the one who called 911 after shooting 62-year-old Donn Johnson in February 2017. Anderson and Johnson lived on adjacent properties on Sunrise Lake.

Anderson claimed self-defense in the shooting.

According to the charges, Anderson told police that he had given several people permission to fish at his mother’s property on Sunrise Lake. While stopping at an area bait shop, an employee told Anderson that Johnson had called, complaining about anglers’ vehicles being parked on his property.

Anderson drove to the lake and encountered Johnson on Lindo Trail. Anderson told police that Johnson was agitated and approached him as he was seated in his pickup truck. Anderson said Johnson then accused him of stealing a ladder and made a threatening statement, leading him to shoot Johnson once in the chest.

Prosecutors say Anderson should have driven away when Johnson confronted him.

Anderson said he told Johnson twice to stop when he threatened to kill him, then grabbed his pistol and shot him.

A jury acquitted Anderson after deliberating for about 4 hours Tuesday.

Accused Burglar Shot By Homeowner Indicted By Grand Jury
Donavan Simmons was shot in the head after he broke into a Woodstock home in November 2017.

Accused Burglar Shot By Homeowner Indicted By Grand Jury
WOODSTOCK, GA — The man who allegedly broke into a Cherokee County residence and was shot by the homeowner has been indicted in connection to the November 2017 incident. A Cherokee County grand jury last week indicted Donavan Simmons on one count each of burglary in the first degree, terroristic threats and possession of a schedule IV controlled substances with intent to distribute, according to court records.

Simmons appeared on the Cherokee Sheriff's Office's radar when deputies were dispatched to a call of a burglary in progress around 2:40 a.m. Nov. 16 at a home on Santa Fe Trail, which is located off Highway 92.

Deputies arrived at the scene to find the suspect, Simmons, lying in the backyard of the home with a gunshot wound to the head, said sheriff's office spokesperson Sgt. Marianne Kelley. Sgt. Kelley said Simmons was treated at the scene and transported to an area hospital for follow-up care.

"The homeowner advised that the suspect was making entry into the basement area of his home when he shot in the general direction of the suspect," she added.

According to warrants, Simmons threatened to shoot the homeowner in the presence of his wife as he forced entry into the home. He is also accused of having 54 alprazolam tablets on his person at the time of his arrest.

Simmons was arrested and initially posted bail. However, a few weeks after being freed, a search was conducted of his home on Nov. 29, 2017, and deputies unearthed multiple firearms and more than an ounce of marijuana, a violation of his bond conditions, court records show. Cherokee County Superior Court Judge David Cannon Jr. revoked Simmons' bond in early January and he remains in custody.

Simmons, who was 19 at the time of his arrest, is set to be arraigned in Cherokee County Superior Court at 9 a.m. Wednesday, May 31 in Courtroom 2D.

It’s a rare sight when law enforcement arrive at the scene of a crime where the suspect is being held at gunpoint by a neighbor.
Brazos County sheriff’s deputy Nathan Dennis says a neighbor to a burglary victim called in a report of suspicious activity and later fired two shots into the ground to stop the suspect.

The gunfire from a 22 caliber rifle was in a pasture north of Kurten Wednesday afternoon.

According to the arrest report, 17 year old Eric Derrow of Clay told the deputy who arrested him that he kicked in a door of the victim’s home to look for gasoline.

Derrow was released from the Brazos County jail Friday after posting a $5,000 dollar bond.
