    Blotter: Woman's stepfather defends her with licensed pistol

    A day-long feud between roommates ended Sunday when the female victim's stepfather pulled his licensed pistol on the suspect in self-defense, according to Denton police spokesman Shane Kizer.

    The suspect, 31-year-old Chad Knapp, was taken to Denton City Jail on charges of assault causing bodily injury and deadly conduct.

    The fight started at about 3 a.m. Sunday at an apartment in the 900 block of North Austin Street, where police said Knapp and the 23-year-old victim lived. Kizer said the man had taken some of the woman's Adderall pills, which are used to treat attention deficit hyperactivity disorder and narcolepsy.

    Police said the man was kicking and throwing things before he tried to leave the apartment through a back window with the pills. The woman followed the man to the front of the apartment as Knapp got into his vehicle.

    The woman, Kizer said, tried to grab the medication in the car when the suspect "pushed her so hard that she was thrown backward into a brick wall," he said. When she fell to the ground, the man pulled out of the parking lot and started to drive away. A nearby witness then jumped onto the hood of his car to stop him, Kizer said.

    The witness fell off the car when the suspect turned onto a nearby street. She suffered a small abrasion on her hand, Kizer said.

    The victim was taken to Texas Health Presbyterian Hospital Denton, where police noticed bruises on the woman's arm consistent with someone grabbing her. Her head was hurting, Kizer said, and she suffered several abrasions or her back.

    After she was released from the hospital, the woman returned to the complex at about 8 p.m. with her stepfather, who had a license to carry a concealed weapon. She forgot her apartment key, and she was trying to open the door when the suspect approached her with a hammer, Kizer said.

    The suspect, Kizer said, was "yelling and cussing"and holding the hammer when the victim's stepfather pulled out his pistol. The suspect later told police that a man broke in his door and put a gun to his face, denying any physical altercation earlier in the day, police said.

    Knapp was arrested and taken to Denton City Jail.

    Argument leads to shooting in downtown Ferguson; shooter claims self-defense

    FERGUSON • A man was shot multiple times Tuesday afternoon in downtown Ferguson after an argument with the shooter, who claimed self-defense, police said.

    The victim, who appears to be in his 30s, was in critical condition and unstable at a hospital Tuesday night, police said.

    Witnesses told investigators the shooting stemmed from an argument between the victim and shooter just before 1 p.m. near South Florissant and Carson roads, police said.

    Officers who responded found the victim lying next to his parked vehicle on South Florissant Road, police said. He had multiple gunshot wounds.

    The shooter fled the scene in his vehicle but called police minutes later from a nearby location and said he shot a man in self-defense, police said. He told detectives the victim moved toward him aggressively and he thought the victim was drawing a gun.

    The shooter and victim did not appear to know each other, police said.


    The video could not be loaded, either because the server or network failed or because the format is not supported.
    Police recovered the gun from the shooter, who fully cooperated with investigators, police said.

    Detectives are consulting with the St. Louis County Prosecutor's Office in the investigation, police said.

    The intersection of South Florissant and Carson roads is in Historic Downtown Ferguson around the corner from Ferguson City Hall and just two blocks from the Ferguson police station.

    The incident was the second shooting after an argument on a roadway in the St. Louis area in less than a week. A driver on an exit road off Highway 40 (Interstate 64) in Richmond Heights shot another driver Nov. 14 after an argument at a stop light.

    The injured man was hit in the arm and taken to a hospital with non-life threatening injuries. The shooter fled.

    Man charged in self-defense shooting strikes plea deal

    SALT LAKE CITY — A man charged in connection with a self-defense shooting when three men attempted to rob him has pleaded guilty to a lesser offense.

    Daniel Christopher Simon, 26, pleaded guilty last week to attempted possession of a dangerous weapon by a restricted person, reduced from a second-degree felony to a class A misdemeanor. He was given credit the same day for time previously served in jail and the case was closed.

    Simon did not face any charges for shooting 30-year-old Jesse Ray Rakes, but because of a prior felony conviction, he was prohibited from having a gun, according to prosecutors.

    Rakes died as a result of his injuries.

    According to police, on Aug. 28, 2016, Rakes approached Simon and his girlfriend near 550 W. 300 South and asked for help jump-starting his car.

    Simon moved his vehicle into position to hook jumper cables to Rakes' vehicle, and two men — Michael Sean Polk, 35, and Matthew Gordon Eyre, 36 — got out of the car.

    That's when Rakes told Simon "that this is a robbery, displayed a gun and demanded all of their property," according to court documents.

    Eyre later told police that Rakes "liked Simon's car and wanted to take it," the charges state.

    Simon walked to the passenger side of his car where his girlfriend handed him a gun, according to charging documents. Rakes then pulled out his own gun and Simon shot him in the hip, police said.

    Simon got back in his car and attempted to drive away, but Polk allegedly rammed Simon's car, causing Polk's car to flip. Simon and his girlfriend then drove around the corner and waited for police to arrive.

    After Polk's car crashed, between 15 and 30 people who were standing near the Rio Grande Depot rushed to the vehicle. But rather than offer help, the majority of the people looted items, including Rakes' wallet, according to police.

    Polk, a documented member of the Soldiers of Aryan Culture gang, and Eyre, a documented member of the Silent Aryan Warriors gang, were charged with aggravated robbery, a first-degree felony.

    Eyre was found guilty by a jury last month, but his attorneys are now petitioning for a mistrial claiming video of a police interview with Eyre was wrongly given to the jury to watch during deliberations. Prosecutors are opposing the motion, arguing that defense attorneys agreed that all exhibits, including the recorded interview, could be presented to the jury.

    Sentencing for Eyre is set for Dec. 8.

    Polk pleaded guilty to two counts of aggravated assault, a third-degree felony, in a deal with prosecutors. He was sentenced up to five years in prison for each charge, with the terms running concurrent to each other but consecutive to any other sentences.

    Phoenix police: Woman kills intruder in attempted armed robbery

    Phoenix police say a woman shot and killed a man who tried to force his way into her home Tuesday night.

    According to Mercedes Fortune with Phoenix PD, witnesses reported that the suspect grabbed the victim and entered her residence near 7th Street and Union Hills Drive at around 11 p.m.

    Fortune said the victim tried to close the door but the suspect forced his way in. The victim grabbed a handgun and shot the suspect. The suspect fled the residence and was found by police at a nearby hospital where he was pronounced dead.

    Fortune said early indication is that this was an attempted armed robbery. The shooting is still under investigation.

    GREENSBORO, N.C. — A 20-year-old man is behind bars after police say he got in an argument with his friend, backed over him with his truck, then broke into a nearby home where he collapsed, according to WGHP.

    Evidence collected at the scene, along with a series of interviews, revealed an unusual series of events that resulted in the death of Jamison Logan Horvath, 22, of Greensboro, according to a news release from police.

    Police were dispatched to 1348 Seminole Drive at 5:13 a.m. after an anonymous caller contacted 911 about a man, later identified as 20-year-old Jacob Montgomery Stowe, who had entered the home and then fled when confronted by its occupants.

    Responding officers saw a man matching the description provided by the homeowners, and after a brief foot pursuit, took Stowe into custody.

    Jamie Rettie, the homeowner, said her son Jordan Clay helped save the entire family.

    Clay said he heard Stowe trying to kick in the back door. That's when Clay grabbed his gun and met Stowe in the kitchen.

    Clay held the suspect at gun point and told him to leave.


    "When he's coming in all I could think of is my life, my wife's life plus my parents are in danger," Clay said.

    He said Stowe looked dazed and possibly under the influence.

    "He said, 'Where's James?' is the only thing he said and I told him, 'Wrong house,'" Clay said. "I have no idea who that was."

    Other officers on scene discovered Horvath in the yard of an adjacent home after Clay's 12-year-old sister Heather Rettie pointed him out. Police and medical personnel performed first aid, but he succumbed to his injuries and was pronounced deceased at the scene.

    Rettie said she and other neighbors have seen Stowe before in the neighborhood.

    Police said the incident began when Stowe and Horvath were arguing while in Stowe’s truck. Horvath exited the vehicle and Stowe backed in to him, causing critical injuries. Horvath staggered to a nearby property where he collapsed.

    Stowe, of Greensboro, is charged with first-degree murder, first-degree breaking and entering, felony death by motor vehicle, driving while impaired and driving after consuming while under 21.

    Arrest made in attempted Halloween robbery

    This week an arrest was made in connection with a failed Halloween night robbery.

    On Halloween Cpl. Pilkington, of Rogers County Sheriff's Office, was sent to Riverwood Drive in reference to an attempted first degree robbery.

    Pilkington was told there were three males, all "older teenagers" in the area who were not in costume but that one was wearing a bandana over his face.

    "The males were acting strange and said they were hungry, so I offered them more candy. They wanted to come inside and continued looking in my home. They then asked to have the pumpkins on the front porch and I told them no, I'm using those for Thanksgiving. The males talked about taking the pumpkins and how the pumpkin seeds taste good baked. The males left walking southbound into the neighborhood singing a song about getting high on marijuana," the man reportedly told law enforcement.

    The alleged victims reportedly told law enforcement three males came to their residence to trick-or-treat. One of the males was later identified as Joshua Godfrey.

    "Two presented pillowcases to accept candy, but when Godfrey was offered candy he stated 'no, I'm trying to lose weight,'" the victims stated, according to the affidavit.

    Godfrey, according to the victims, appeared to be concealing a gun in the waistband of his pants.

    The victims recalled Godfrey saying something about taking their dog with him.

    Records show the three males returned to the residence a few hours later and knocked on the door of the un-lit residence.

    Godfrey was said to have what appeared to be a gun concealed but pointed at the homeowner.

    "He demanded a neon Budweiser sign hanging on the wall in the adjacent room," the victim reported. "The sign is not visible from the front door."

    The homeowner said he retrieved a gun and told the three males to leave. The homeowner told law enforcement it was at that moment that Godfrey "charged him" and he shoved Godfrey back to create distance.

    Out of self defense, he said, he pointed the gun at Godfrey, who still refused to leave.

    Eventually the homeowner reportedly threatened to shoot and Godfrey left the residence.

    Investigation, including surveillance footage, led law enforcement to learn Godfrey's identity and location.

    Cpl. Pilkington reports speaking with Godfrey's father and "informing him that Joshua was going to be questioned about an incident that occurred in the Riverwood addition."

    "I turned to leave and he said 'Joshua don't have a gun but he has a BB gun that resembles a gun.' I asked why he told me this. He stated 'well, you said the incident involved a weapon,'" Pilkington reported, adding that he hadn't disclosed the incident involved a weapon.

    When asked, the man told law enforcement the BB gun did resemble a handgun.

    In his interview with law enforcement Godfrey reportedly said he had been in Riverwood "ding don't ditching" with his friends.

    He allegedly told law enforcement he'd seen the reflection of the neon sign in the window and began to "pester" the homeowner about it.

    Godfrey said he joked with the homeowner about a bully stealing his candy and wanting $100 for it back.

    Records quote Godfrey in telling law enforcement the homeowner retrieved a gun and ultimately "stepped off the porch and put his hands on Godfrey's chest."

    "[The homeowner] pulled out a gun to the side of him and does a John Wayne maneuver and somewhat points the gun at him," Godfrey said.

    To law enforcement, Godfrey disclosed that he told the homeowner "just shoot me" because "he does not value his life…but is not suicidal."

    Godfrey allegedly admitted to having his hands on his waistband in a manner that would make someone believe he was concealing a gun.

    "He said his pants are loose and that is why he had his hands there, holding his pants up," Pilkington said. "He stated that he lifted both hands and his pants dropped to his knees. He said he took a couple steps backward and then turned and walked off with his hands in the air and his pants around his knees."

    Godfrey is facing a felony charge of attempted first degree robbery. Bond was set at $40,000 and Godfrey was ordered to have no contact with the alleged victims.

    A gas station clerk shot and wounded a man attempting an armed robbery, Douglasville Police said.

    The incident occurred at the Chevron station at 6590 Bankhead Hwy. in Douglasville Wednesday night just before 9:30 p.m.

    A man armed with a gun attempted to hold up the station but the clerk pulled his own weapon and shot the suspect once, police said.

    Police found the suspect outside the station suffering from a single gunshot wound. Douglas County EMS transported the suspect to a nearby hospital for treatment, police said, but gave no details on his condition.

    The clerk was unharmed and is cooperating with the investigation, police said.

    FBI: Customer fired at LANB bank robber

    The FBI confirmed Wednesday that a bank customer shot at a suspected bank robber on Tuesday outside the Los Alamos National Bank branch in White Rock.

    Further information regarding the customer wasn’t made available.

    Several witnesses reported hearing shots a bit before noon on Tuesday. An armed man dressed in all black, with his face covered, reportedly held up the bank and received an undisclosed amount of money.

    Herman Manzanares, owner of Herman’s Auto next door to the bank in White Rock, said he and his employees heard the shots.

    “We saw the guy run around to Rover and we saw the man who shot at him go back into the bank. We called 911 and so did the bank,” Manzanares said.

    A few minutes later police arrived; traffic snarled as heavily armed police sought the suspect.

    The small town – a bedroom community for nearby Los Alamos – shut down with residents asked to stay inside and school children locked inside their schools.

    “It was just chaos,” Manzanares said.

    Also Wednesday, the Los Alamos Police Department announced they are asking anyone in White Rock who may have any video or image surveillance – from anywhere in town – to contact them immediately.

    “LAPD criminal investigators would like to receive a copy of the footage as soon as possible,” according to the press release.

    A HOUSEBREAKING suspect is under police watch at Addington Hospital after he attempted to attack a La Lucia homeowner on the corner of Braemar and Davallen Avenue. According to Capt Raymond Deokaran, spokesman for the Durban North SAPS, the incident occurred just after midnight on Thursday. The homeowner, who chased after the suspects shot one of them in the leg after he attempted to stab him.

    “Two suspects had attempted to break into a property on Braemar Avenue. The tenant of the home heard a noise and went to investigate. He then spotted two men crawling through a toilet window. He shouted at the men who jumped back out the window and fled the scene of the break-in.

    “However, the resident drove after them and attempted to apprehend the suspects. He cornered them at the Davallen, Braemar intersection and pulled out his firearm. One of the suspects, armed with a knife approached him. Fearing for his life, he fired a warning shot and when that didn’t work on the advancing attacker, he shot the suspect in the leg,” he said.

    Deokaran added the suspect will be charged with housebreaking. Nothing was taken during the break-in.

    The second suspect is still at large and was able to flee on foot.
