North OC Man Opens Fire On Burglars
GARDEN GROVE, CA - A Garden Grove homeowner fired at two burglars who were attempting to break int through the sliding glass door of his Garden Grove home Friday morning, authorities said.

Officers were sent at 11:15 a.m. to the home in the 9500 block of Imperial Avenue regarding a break-in, according to Garden Grove police Lt. Carl Whitney.

The homeowner called 911 as the two men were breaking into the residence, Whitney said.

The burglars busted in through a glass rear-sliding door and were confronted by the gun-toting homeowner, who fired several rounds at the suspects, Whitney said.

The two men ran away through the backyard and made their getaway in an older model Audi sedan, Whitney said. The silver getaway car had paper plates and there was a third suspect behind the wheel, Whitney said.

It was unknown as of this report if any of the suspects were shot.

Police have notified area doctors, but have had no reports of gunshot victims, Whitney said.

A witness may have seen the suspects in Yorba Linda less than an hour before the break-in, said Carrie Braun of the Orange County Sheriff's Department.

"A woman called deputies at 10:30 a.m. to report she saw a man in the neighborhood with something covering his face," Braun said. "She said that when they made eye contact, he apparently realized she was on the phone and fled in a silver Audi with paper plates."

Watch: California jewelry store owner thwarts smash-and-grab attempt by pulling a gun
Smash-and-grab thieves stormed a jewelry store armed with hammers and pepper spray, but to their surprise the owner had a gun, KCAL-TV reported.

    Were they caught?

Police are still looking for the duo that attempted to rob Dana Kathryn Jewelry in Studio City, California, on May 25, the report states.

Special: Seniors can collect $480 per week from this unusual 'side job'
Security footage obtained by KCAL shows a man spraying a canister of pepper spray at the owner and two customers. Another man pulled out a hammer and began bashing the jewelry cases.

Victoria Offerman told the TV station she ran into the store after hearing the commotion from a business located next door.

“We all work so hard and it’s not fair for someone to come in and take what’s not theirs,” said Offerman, who works at Emerald Forest.

At one point, one of the suspects swung a hammer at the store owner while she was out of the security camera’s view.

“That changed the game there. Turned basically from a smash and grab burglary into a robbery,” Los Angeles Police Department Detective Jennifer Hammer told the TV station.

The suspects did not steal any merchandise because their hammers could not break through the cases, according to the report.

One of them tried to hammer his way out of the front door when he realized the door was locked and he had to be “buzzed out.”

By that time, the owner was able to pull out her registered gun and fire off a shot before they escaped, according to the report.

The pepper spray was so thick in the air that police had to wear protective suits, the TV station reported.

“It was a heavy duty pepper spray. It’s not your usual small canister. It’s like the kind you would use for a bear,” said Hammer.

The store owner declined to be interviewed on air, KCAL reported.

Offerman told the TV station that people in the shopping center are sticking together.

“I believe in the power of this community and that if everyone can see this video and see these men,” said Offerman. “If anyone recognizes them to bring these men to justice.”

Hall District Attorney rules fatal June 2017 shooting as ‘justifiable self-defense’

Rusk won’t face prosecution in shooting of daughter’s boyfriend

    03302018 SHERIFF BADGE.jpg
    Updated: July 14, 2018, 12:31 p.m.

A Hall County man will not face charges after District Attorney Lee Darragh’s review of a fatal shooting last June in Gainesville.

Darragh wrote a letter to Sheriff Gerald Couch and the investigator in the case saying he would not pursue prosecution of Floyd Rusk in the shooting of Thomas McNulty Jr., 25.

Hall County Sheriff’s Office authorities said the incident was reported after 4:30 a.m. June 4, 2017, at a home on Jet-Wright Road off of Dawsonville Highway.

The Times obtained the letter through an open records request to the sheriff’s office and received the document last week.

In a summary of the facts listed in Darragh’s letter to the sheriff’s office, McNulty shot his then 22-year-old girlfriend, Jessica Rusk in the back. The sheriff’s office said this happened following an argument.

“McNulty immediately thereafter tried to forcibly enter the bedroom occupied by Floyd Rusk and his wife Martha,” according to the letter.

The letter states Floyd Rusk opened the door as his daughter cried for help.

“It is clear from all of the evidence reviewed that in justifiable defense of himself, his wife, his daughter (who had already been shot by McNulty and his infant grandchild in a nearby bedroom, Floyd Rusk shot McNulty twice, once in the upper shoulder and once in the abdomen,” Darragh’s letter stated.

Darragh wrote the evidence showed Rusk “reasonably believed that such force was necessary to defend himself and other persons to prevent death or great bodily injury from McNulty’s imminent use of unlawful force.”

“While it is certainly a tragedy that a young adult like McNulty would lose his life from those gunshot wounds, it is equally clear that Floyd Rusk in inflicting those wounds was not criminally responsible, having acted in justifiable self defense and defense of others,” Darragh wrote.

The sheriff’s office closed the case July 5.

According to the FBI’s crime statistics, there were 331 cases of justifiable homicide in 2016 defined as the “killing of a felon, during the commission of a felony, by a private citizen.”

Firearms were used in 276 of those cases.

“It’s certainly not unheard of. It’s not that rare, just because there are some cases where it’s just apparent from the facts where any lawyer who looks at it and reads the code section on justification in Georgia would have to conclude that it was justified,” said assistant public defender Matt Leipold on the frequency of homicide cases closed out without any arrest or charges.

Man With Concealed Carry Permit Returned Fire In Avondale Shootout, Police Say

AVONDALE — Two vehicles exchanged gunfire near the intersection of Pulaski Road and Belmont Avenue Friday night, according to witnesses.

“I was sitting in my local corner bar when I heard about eight shots,” said Dominic Gwinn. He lives in the area and was hanging out at Belford Tavern, 3200 N. Pulaski Rd., when he said he and other patrons heard gunfire. “By the time me and several others ran outside it was already over.”

The shots rang out around 10:48 p.m. on Friday when there were about a dozen people at the bar, Gwinn said. After the shooting witnesses said one of the vehicles headed north on Pulaski.

Early Saturday morning Ronald Westbrooks, a police spokesperson, said it appeared the shooting had involved three men in their early 20s who had been driving in one vehicle when a silver sedan with three other men pulled alongside them.

The three men in the sedan reportedly began flashing gang signs before one of them drew a gun and began firing, Westbrooks said.

“However the 21-year-old victim, who is a concealed carry holder, displayed his own weapon and returned fire,” said Westbrooks. “Neither party was shot and no injuries have been reported.”

The gunfire happened across the street from a BP gas station at 3968 W. Belmont Ave. that appears to have at least one surveillance camera facing the intersection. Additionally, the intersection has a red light camera that faces south on Pulaski.

As of early Saturday morning, no one was in custody and Area North detectives were still investigating.

“I’m kind of surprised this happened here. It’s usually a quiet neighborhood,” Gwinn said “There hasn’t been much gang activity

Off-duty cop shoots teenage crook dead and wounds armed gunman

An off-duty cop in Brazil, who had just dropped his girlfriend home, reacted quickly during a surprise late night hijacking, using a distraction to shoot dead a teenage gunman and injure his armed accomplice.

The 18-year-old, named locally as Pablo Pereira Gomes, was shot in the groin and died on the spot.

The other bandit, Lucas Matos de Oliveira, 22, ran off but was hit twice in the stomach.

He was taken to Santa Casa de Misericordia Hospital and placed under police arrest following emergency surgery.

The cop and his girlfriend escaped unharmed.

The officer, who has not been named for security reasons, was held up by the teen assailant who did not realise his target was a serving policeman carrying a loaded weapon.

Video surveillance cameras situated on an apartment block in Vitoria, south east Brazil, show the officer sitting on his Kawasaki Ninja motorbike on May 10.

He had just dropped his girlfriend home when a bandit suddenly appeared brandishing a weapon and demanding the bike.

The cop calmly followed the orders issued by the attacker and climbed off his bike then got down on the ground.

While the young thug kept his pistol trained on him, his side-kick lifted up the motorbike, which had been dropped on its side, and climbed on.

Despite the cop showing no resistance, he was hit repeatedly over the head with the butt of the gun as the hoodie-wearing accomplice joined in the assault.

But in the middle of the assault, a van rounded the corner at the bottom of the road and the headlights appeared to blind the gangsters, which is when the officer sprang into action.

While the passing van momentarily distracted the pair, the cop jumped up, drew his weapon and rapidly fired off three shots, all of which hit the pair.

According to investigators, the cop shouted a warning to the hoodlums to drop their weapons, but Gomes apparently turned as if to fire and Oliveira reportedly reached for a gun in his waistband while jumping off the bike.

It later emerged the teen was carrying a replica.

He was felled by a single shot to the groin and died where he was despite paramedics efforts to save him.

Detectives said the adolescent had a criminal record with 16 arrests for drug trafficking.

Crane operator José Conceição, who was visiting a friend in the building heard the commotion and rushed down to see what was going on.

He said to reporters: 'Suddenly we heard a few gun shots and came down to see what had happened and to see if we could help.

'The boy was already down on the ground at that point and the other one had run off.

'It was very scary. I don't live in the area but in a neighbourhood that doesn't have this level of violence so I'm not accustomed to seeing this type of incident.

'But my friend told me the area has been hit by a crime wave which has made him scared to go out.'

An update on the injured suspect's state of health has not been released.

Farha confirms no charges in fatal shooting during home invasion
QUINCY -- Adams County States Attorney Gary Farha says no charges will be filed in a fatal shooting during an alleged home invasion in rural Adams County.

Farha previously had said that he didn't anticipate charges in the shooting that killed 19-year-old Logan M. Graham. He made the final determination after reviewing reports from the Illinois State Police and Adams County Sheriff's Department.

The Sheriff's Department said deputies responded to a possible home invasion in progress about 2:45 p.m. May 28 at the home near Ill. 104 and East 1330th Street.

Prior to deputies arriving, the department said a white male, later identified as Graham, left the scene by vehicle. Deputies found the vehicle, and a short chase ensued without the subject stopping.

Graham reportedly went back to the original address, and when deputies arrived, they found him with a gunshot wound to the abdomen.

The Illinois State Police said Graham was confronted by the homeowner while gaining entry into the residence after Graham made threats of violence. The homeowner reportedly fired a shotgun at Graham, who later died at Blessing Hospital.
