Jesse Zamora said he had never before been in a situation where he might have to use his gun in public.

But after a 47-year-old Oakville pastor asked if he was armed during the chaos of shots being fired at the Tumwater Walmart on Sunday, Zamora, 37, responded with "yes," and "let's go."

Zamora and the Oakville man, who has yet to be identified, then exited the store to confront Tim O. Day, 44, of McCleary.

Tim Day was shot and killed by a 47-year-old Oakville man on Sunday after Day shot a 48-year-old man while attempting to carjack his vehicle outside Walmart in Tumwater. Jesse Zamora was next to the Oakville man when it happened.

Before Day had arrived at Walmart, he had tried to carjack a vehicle in Olympia, crashed his own vehicle in Tumwater, and fired shots in the area to carjack another vehicle. During that shooting in the area of Tyee Drive and Israel Road Southwest, a 16-year-old boy's thumb was grazed with a bullet, according to media reports.

Day then took off for Walmart.

Meanwhile, Zamora -- who lives in Kennewick but is currently is working in the Olympia area -- said he was shopping with his wife at the big box store. When he heard two shots, he asked his wife if it sounded like gunfire.

"No," she replied.

Minutes later, people started running, with some saying "shooter," Zamora said.

Zamora said he told his wife to run, then spotted Day running with his gun in the air.

Day, according to Tumwater police, had entered the store and headed for the sporting goods section where he fired shots at an ammunition display case, removed ammunition and left the store.

By then, Zamora had pulled out his handgun and was joined by the Oakville man.

Both saw Day try to carjack a vehicle in the parking lot that belonged to a 48-year-old man. That man was shot twice by Day and later flown to Harborview Medical Center in Seattle where he remains in critical condition with paralysis and organ damage, spokeswoman Susan Gregg said.

Zamora said he never pointed his gun at Day, but the Oakville man did.

"I know he said something along the lines of 'Put your gun down,'" Zamora said.

Then Zamora heard gunshots and watched Day die. "He gasped for air and he kept looking at me," Zamora said.

Zamora said he believes Day was on the verge of shooting more people. Based on Day's behavior, he felt compelled to act.

"That's why we did what we did," he said.

Tumwater police spokeswoman Laura Wohl said Tuesday that the department never wants to see anybody put themselves in harm's way. However, her understanding was that the Oakville man was familiar with firearms and how to use them safely, she said.

"In this situation, we are glad more people weren't hurt," she said.

Bystander Fatally Shoots Gunman At Washington Walmart, 2 Others Injured

TUMWATER, Wash. (AP) – A gunman wounded two people before being fatally shot by a bystander at a Walmart store in Washington state Sunday evening.

The incident happened about 5 p.m. in Tumwater.

KOMO-TV reports that a witness says people were in line when they heard gunfire in the store. The station reports that as people fled the store, the gunman followed and shots were heard outside.

Police tell the station that the gunman then attempted to carjack someone and was shot by a bystander.

One shooting victim was flown by helicopter to a hospital, while another was being treated for a non-life threatening injury.

Police are investigating four scenes connected with the shooting.

Tumwater is in Thurston County and near Olympia.

He says she pulled gun. She said he was trying to run her off the road. No charges were filed. If her story is the true one, pulling the gun may have been what ended the conflict.

No arrest after man says woman pulled gun on him, daughter in road-rage case

CLERMONT, Fla. - A Lake County man said his Father's Day took a turn for the worse when another driver pulled a gun on him and his daughter in a case of road rage.

Ceasar Martinez said he was shocked when police didn’t arrest the gun-toting driver.

He said he was driving on Florida’s Turnpike on Sunday when he cut another driver off by mistake.

Martinez said the other driver got angry and the two exchanged words.

When he got off the exit on Highway 50, he said both of them were stopped at a red light and she pulled out a gun.

“It was Father’s Day. I have my 12-year-old daughter with me. What a way to end Father's Day, with a lady pulling a gun,” said Martinez.

He said the road-rage incident went on for a few miles, and then he called 911.

According to the police report, officers stopped to talk with the other driver at a gas station. They found the woman did have a gun in her car, but she told the officer Martinez was trying to run her off the road

She told the officers that she did take her gun out of the glove box and showed it to him because she was in fear for her life.

“No way. I have my 12-year-old with me. How could I have done that? That's a sick person that would do something like that,” Martinez said.

The driver told the officers she never actually pointed the gun at Martinez.

The officer did not arrest the woman and wrote in the report that there was no threat.

“I told the officer, ‘So now people can just drive around pointing guns at people?’ And I didn't get an answer. He said it's my word against her word,” said Martinez.

Channel 9 reached out to the other driver, but has not heard back.

One dead in Anderson County shooting, self-defense claimed as reason

One person has died after a possible self-defense shooting in Anderson County, said Deputy Anderson County Coroner Don McCown.

The Anderson County Sheriff's Office also is investigating the shooting, which happened around 7 p.m. Tuesday at Stanmoore Drive, a small road near Neals Creek, between Anderson and Belton.

McCown said the shooting victim, 37-year-old Roger Andre Anderson, had returned to a home on Stanmoore Drive, where he had not lived for several years.

The alleged shooter has told investigators it was done in self-defense, McCown said.

Anderson's death is ruled a homicide, which is how coroners classify most deaths that are not accidental or due to disease, he said.

Anderson was driven to AnMed Health Medical Center, where he died in surgery at 8:14 p.m.

The death remains under investigation by both the Sheriff's Office and the Coroner's Office.

Shooting may have been self defense
A shooting on Post Oak Valley Road that sent one man to the hospital may have been a case of self defense.

“You have a right to protect yourself in your home,” Roane County Sheriff Jack Stockton said.

The incident happened on Friday around 11:45 p.m. According to Stockton, Grant McNeal was at his home when Evan Gardner came over and kicked his door in.

“McNeal owed Gardner some money,” Stockton said. “Gardner came to get it, and made a phone call before and told him he was coming to get it. When the guy came down there, Gardner allegedly kicked the door open and then McNeal shot him.”

Gardner initially went to Roane Medical Center in a personal vehicle and was later taken to the University of Tennessee Medical Center. Stockton said one of his detectives interviewed Gardner at the hospital on Monday.

No charges had been filed against McNeal as of Tuesday morning.

“The case will probably be handed over to the attorney general’s office for review,” Stockton said.

The castle doctrine could come into play in the case.

“Under the castle doctrine, you’re safe at home and have a right to protect yourself,” Stockton said.

Two people were taken to the hospital after a dispute ended in gunshots.

It happened in the 700 block of Whispering Oaks Lane in Jefferson just before 10 p.m. Saturday.

The Kanawha County Sheriff's Department says two neighbors had gotten into an argument that lead to a fight.

During the physical altercation, one of them fired several shots. One hit the other person, deputies say.

Both involved were taken to the hospital with non-life-threatening injuries.

Deputies say the shooter was cooperative, saying he was acting in self defense.

No names have been released.

The incident is under investigation.

Judge drops charges against victim, suspect in Eagles Trace Apartments shooting

Charges against a man accused in Monday’s shooting at Eagles Trace Apartments were dismissed Thursday in Columbus Recorder’s Court.

Jasaan Alexis Marion, 19, was facing one count of reckless conduct and aggravated assault in the 6:18 p.m. shooting at 2001 Torch Hill Road. Police Detective Delante’ Odom asked Judge Michael Joyner to dismiss the charges during a 9 a.m. hearing.

Marion’s defense attorney Stacey Jackson said he’s pleased with the news. After warrants were issued for Marion, Odom continued the investigation and interviewed more witnesses, including Marion on Wednesday, Jackson said.

Based on the investigation, he believed or made the determination that it was a self defense case. “It basically means my client had not violated the law,” he said. “I was pleased.”

Police said the shooting was sparked from an ongoing dispute between Marion and another man. The shooting between the two men left Marion and a third man injured.

The gunfire erupted in the parking lot near the mail boxes at the apartment complex, police said.

Marion was taken into custody on Tuesday after he was treated at Piedmont Columbus Regional Midtown Campus and released. Police are still looking for the other suspect.

Orange City man shot, killed by mother’s boyfriend

An Orange City man was shot and killed by his mother’s boyfriend Friday and both the shooter and mother insisted that the the shooting was in self-defense, authorities said.

Detectives said they plan to consult with the State Attorney’s Office before making a final determination on whether to file charges.

The deceased man was identified as Jason A. Sargent, 43, and the shooter was identified as Marc Lemay, 58, Both men lived in the same house.

Volusia County sheriff’s spokesman Andrew Gant said deputies responded around 3:30 a.m. at 720 Highland Drive following reports of a shooting.

A deputy performed CPR on Sargent until Orange City Fire Rescue and paramedics arrived on scene, but they were unable to save him, according to the Sheriff’s Office.

Gant said Lemay remained on the scene after the shooting and detectives interviewed him and his girlfriend, Faith Alexander.

Lemay and Alexander both told detectives that Lemay, who weighs 170 pounds, fired at Sargent, who weighed 240 pounds, in self-defense.

Court documents show that Sargent was arrested in September 2017 on allegations he head-butted his then-girlfriend after the two had argued about her leaving for Maine. Lemay and Alexander were in the house when the incident occurred, but were asleep in their room.

The State Attorney’s Office decided later that month not to prosecute Sargent, records show.

David A. Fenner waived his preliminary hearing today and was bound over to a grand jury, according to court documents.

Fenner's bond was continued.

UPDATE @ 10:12 a.m. (June 1)

David A. Fenner was video arraigned in Miami County Municipal Court from the Miami County Jail. He was released from the hospital Wednesday after being shot three times in a home invasion shooting. Bond set at $75,000 cash, and Fenner was in a wheelchair due to being shot in the legs and hand.

He was booked into jail on counts of burglary and possession of criminal tools. Fenner had been found to have a backpack full of tools including a flashlight, wire cutters, chisel, wrench, screwdriver and razor blade.

UPDATE @ 11:45 a.m. (May 30)

David Fenner, 38, suffered gunshots in both legs and his hand and remains a patient at Miami Valley Hospital.

Authorities tell us Fenner is known to law enforcement from previous thefts and burglaries dating back to the 1990s and that he was a suspect in recent burglaries in the same neighborhood where he was shot on Kessler-Frederick Road.

Once he is released from the hospital, the suspect is expected to be booked into the Miami County Jail on suspicion of aggravated burglary and possession of criminal tools.

UPDATE @ 3:11 p.m. (May 29)

A 911 caller reported a man trying to break into her home on Kessler-Frederick Road Monday morning.

“We’ve got a robber,” the caller said. “I need you to get here fast...I’m upstairs with my kids.”

The caller told dispatchers she was home with four children and her husband when the intruder tried to get in.

“It’s the guy that does all the Kessler-Frederick robberies,” the caller said.

Deputies are working to determine if the suspect is the same person involved in other home and vehicle burglaries reported in the same area, according to Miami County Sheriff’s Lt. Eric Lachey.

A second caller told 911 operators that they heard some shots and people arguing.

“We’ve had some problems with people breaking in around here,” the second caller said.

A third caller described hearing two gunshots.

“I heard two gunshots and then a man scream no, and a third gunshot then nothing,” the third caller said.

UPDATE @ 7:23 a.m.

A male suspect attempting to break into a Kessler Frederick Road was shot three times by the homeowner, according to police.

“He was shot in the hand, and in the leg,” said Miami County Lieutenant Eric Lachey.

The suspect was transported to the hospital for injuries that were not life threatening.

The suspect accessed the home through a pet door, according to deputies.

Lachey said there have been previous home and vehicle breakins in the area.

“We have been looking for a suspect for some time,” he said. “This could be our suspect.”

UPDATE: 5:55 a.m.

Deputies said a homeowner shot a suspect following a home invasion attempt at a home on Kessler Frederick Road in Miami County.

The condition of the person shot was not available.

Deputies said detectives are expected to arrive on the scene to investigate shortly.

SCENE: Police say homeowner shoots break-in suspect in Miami County

One person has been shot in the leg outside a home in the 4600 block of Kessler Frederick Road in Miami County.

Deputies were responding to a report of a home break-in attempt when the found the person shot.

We’re working to find out from deputies if the person shot is the suspect in the home break-in.

Medics have been requested after deputies found one person with gunshot wounds on Kessler Frederick Road in Miami County.

Deputies were first dispatched to a home in the 4600 block of Kessler Frederick Road around 5 a.m. after a woman reported hearing someone attempting to break into their home.

Initial reports indicate while deputies were responding to the call, a second call came into dispatchers from neighbors reporting gunshots in the area.

A Louisville man was arrested Tuesday night after his mother was attacked by a naked intruder, police said.

Police say Lugene Floyd Jr., 19, was in his kitchen with his brother Saturday when another man entered the home naked and attempted to sexually assault their mother, according to court records. Records do not say where the man entered the home.

Floyd's brother retrieved a gun and fatally shot the intruder, who was identified by WDRB News as Darryl Turbin Jr.

After the man was shot, Floyd took the gun from his brother and fled the scene prior to police's arrival, court records show.

Floyd was charged with evidence tampering and was taken to Louisville Metro Corrections.

In an unrelated earlier case, he was charged in February with trafficking marijuana while carrying a deadly weapon, fleeing or evading police and evidence tampering.

Woman in 7th Ward fatal shooting fired gun at man who attacked her, police say

A man attacked a woman minutes before she fatally shot him in the 7th Ward Wednesday morning (June 20), according to initial police reports from the New Orleans Police Department.

The woman attempted to pull out of her driveway in the 700 block of Miro Street around 7 a.m., but was blocked by the man, later identified as 53-year-old William Jones. Jones followed the woman into her house, where he punched her numerous times. The woman pulled out a handgun and shot him three times, police said.

Jones was transported to the hospital via EMS, where he later died from his injuries.

Officers responded to reports of the gunfire just after 7 a.m. and found Jones wounded inside of the Miro Street home.

At 6:10 p.m., police announced Jones had died at the hospital. Police have described the shooting as a domestic homicide.

No arrests had been made in the case as of Wednesday night.

When asked for more details regarding the woman and the man's relationship, NOPD spokeswoman Ambria Washington said, "At this time this case is being investigated as a homicide and the investigation is still ongoing."
