    Teen who fatally shot his drunk dad to protect his mother from abuse will NOT be charged, police say
    Police in California has confirmed that they will not charge a 16-year-old in the fatal shooting of his father after they concluded that he acted in self-defense. It was determined that the boy, whose name has been withheld because of his juvenile status, had shot and killed his 54-year-old father, Javier Vera, to protect his mother from physical abuse.

    According to a news release by the Fresno County Sheriff's Office, dispatchers received a call of an injured person inside a home on the 6800 block of W. Clinton Avenue in Fresno at around 4:30 p.m. on Saturday. On arrival, responding officers found Vera had been shot and later succumbed to his injuries.

    The officers learned that Vera, who had allegedly been drinking at the time, and his wife had been involved in a verbal argument that escalated into a physical confrontation. It reached a point where the 54-year-old began to strangle the woman, which prompted the 16-year-old to retaliate in turn.

    A short time later, the teen discharged the gun, striking his father. He then dialed 911 to report the incident to the sheriff's office, following which the murder weapon was secured, and the boy was taken into custody. Sheriff's homicide detectives who later arrived at the scene had obtained a warrant to search the premises and questioned both the mother and the son.

    Speaking about the incident, the sheriff's office public information officer Tony Botti revealed to Your Central Valley that there was evidence of long-term domestic violence between the couple. He said, "[The boy was] visibly shaken up. Scary situation, your mom and dad are in this fight, next thing you know you end up taking your dad's life."

    "There are people out in our community who are experiencing things… where husbands are beating up wives, or maybe even wives are being abusive to husbands. It's time to speak up," he continued.

    The teen later recounted the incident to the detectives, who determined that his act of shooting his father was done only to defend his mother's life. He was subsequently released from custody and allowed to go back home with his mother. He was not placed under arrest, though the Fresno County District Attorney's Office will now review the case to determine if any criminal charges are warranted.

    Members of the Crime Scene Unit have processed the home for evidence. The Coroner's Office will schedule an autopsy and work with crime scene technicians for further processing of Vera's body.     UPDATE: Clarksville man who fatally shot alleged attacker not facing charges
    CLARKSVILLE — Police have not yet identified the man they say was killed Tuesday after a bystander intervened during an alleged domestic violence incident at a Clarksville apartment complex.

    Police responded to a report of shots fired in the 600 block of Harvard Drive in River Chase apartments just after 10 p.m. Tuesday. There, they found a deceased man with “multiple gun shot wounds,” according to a news release.

    After talking with witnesses, police determined a domestic dispute started in an apartment which led to the man chasing a woman into the parking lot, beating and kicking her and her daughter, who is under 10 years old.

    A neighbor intervened and held the man at gunpoint, reportedly to stop the attack. The woman and her daughter were able to escape, at which time the suspect reportedly went after the neighbor. The neighbor shot the suspect after multiple warnings, according to police. The shooter is not currently facing charges, although the case remains under investigation, said Clarksville Police Chief Mark Palmer.

    Both victims were transported to a hospital in Louisville and treated for minor injuries. Palmer said they were in stable condition as of Wednesday afternoon.

    The actions of the shooter are protected under Indiana's Stand Your Ground Law, which states that individuals do not need to back down from threats against their person or others while in a public place, Palmer said.

    Palmer wouldn't comment on whether what the individual did in the situation was correct, but he said him being there may very likely have prevented further violence.

    "I do believe that had the individual not stepped in, it would have been far worse for the female that was being attacked," Palmer said. "It could have been a life-threatening situation for [her] or the child."

    He said people who witness a domestic incident or other abuse should contact police as soon as possible, and if they do feel they have to step in — because a person is in imminent danger of being seriously injured or killed —they should take their own safety into account.

    "Use common sense and use the safest means that are available to you to help somebody, if that's the only option you have," Palmer said.

    Melissa (Wynn) Westen lives in the apartment complex near where the shooting happened Tuesday. She said she and her husband were watching TV when she thought she heard someone scream. Soon after, she said they heard gunshots.

    "I asked my husband to turn the TV down and we heard what we thought as just kids playing outside," Weston said in a text message.

    They turned the TV volume back up and then heard four to five "very loud booms," she said.

    "We both knew it wasn't just a car backfiring as we hear sometimes, living this close to the interstate."

    The next minute, she looked outside and saw police lights.

    "This all happened within two minutes or less," she said. Westen and her husband have lived in the apartment for 10 years; she said they've never seen anything like this happen.

    "My thoughts and prayers go out to all involved," she said. "It's so scary that these kinds of things happen in the world today. But for it to happen in my own neighborhood — and literally backyard — is horrifying."

    A letter from apartment manager Rob Cissell was sent to residents following the incident, expressing condolences for those involved and asking residents to alert police or management if there is ever a situation with safety. An apartment official provided a copy of the letter to the News and Tribune.

    "Although we strive to maintain a safe, quiet and crime-free community, you never know when something could go wrong," it reads, in part. "Thus we always as our residents to speak up and notify the Clarksville Police, our courtesy police officer or the office if there is ever a concern."

    He also asked residents to keep the families in their thoughts and "please take care of yourselves and be good to others."

    Pending autopsy and toxicology reports may offer more information into the case, "to see if there could be outside influences on the suspect or if he was under the influence of anything," Palmer said. "Or if this was... an anger issue."

    Law enforcement: Fatal Idaho shooting may be self-defense

    SPIRIT LAKE, Idaho (AP) - Law enforcement officials in northern Idaho say a fatal shooting last Friday appears to have been done in self-defense.

    Deputies from the Bonner County Sheriff's Office and a Priest River Police officer were sent to the home where the shooting occurred Friday evening after a disturbance was reported. While en route, dispatchers told them that a 41-year-old woman had shot a 39-year-old man who was attacking her and her 70-year-old mother.

    Bystanders attempted life-saving measures on the man until emergency workers arrived and took over, but the man did not survive.

    The Bonner County Sheriff's office says Joshua Matthew Cole of Spirit Lake died in the incident.

    Sheriff's Captain Tim Hemphill said in a prepared statement that the initial investigation indicates the 41-year-old woman was acting in defense of herself and her mother, and witness statements support that finding.

    The investigation remains open. Officials declined to release the names of the women or other details about the shooting.

    ALBUQUERQUE, N.M. — The man who was shot and killed breaking into a foothills home earlier this month has been identified as 22-year-old Clayton Jenkins.

    According to a search warrant affidavit filed in 2nd Judicial District Court, around 5:30 a.m. on Oct. 4 a woman called police to say her boyfriend, Christopher Rivera, had shot a man who was breaking into their home in the 400 block of Avital NE, near Tramway and Copper. She said the man was now lying in the driveway.

    When officers arrived they said they found Jenkins dead with a blue plastic putty knife — commonly used to break into cars and homes — near his body. There were “defects” to his back, according to the affidavit.

    Jenkins does not have any criminal history in New Mexico, according to online court records.

    When detectives interviewed Rivera he told them the home’s security system alerted them to someone trying to break in so he armed himself with a handgun and went to check the garage.

    “The unknown male had an object in his hand,” the detective wrote in the affidavit. “Christopher yelled at the intruder to get down on the ground and the male yelled something back at him. Christopher identified the object in the intruder’s hand as a rock and fired his handgun twice.”

    Rivera was not arrested and the case was forwarded to the District Attorney’s Office to determine if charges should be filed or if the shooting was in self-defense.

    Police: Man, 71, shoots intruder trying to break into South Side home

    A 71-year-old man shot and wounded a man Thursday who Chicago police said was trying to break into his South Side home.

    The resident wounded the 29-year-old man around 10:45 a.m. in the 8700 block of South Euclid Avenue in the Calumet Heights neighborhood, police said.

    Police arrived at the man's home and detained the would-be burglar before he was transported to the University of Chicago Medical Center for treatment. He was listed in good condition, but criminal charges were expected to be filed against him, police said.

    The resident owned a concealed carry license, according to police, though Chicago residents need only a firearm owner's ID card to possess a firearm inside their home.

    Burglary Suspect Shot At By Broken Arrow Homeowner Arrested In Missouri

    BROKEN ARROW, Oklahoma - A homeowner from Broken Arrow shoots at a woman breaking into her home.

    Police say the suspect had lost a child, then acquired a therapy dog to help her cope, but she had to give the dog to a rescue group after it bit someone.

    They say she became obsessed with getting her dog back and believed it had been adopted by the victim.

    The homeowner, Lori, says she was getting ready to leave her house for the day when she heard someone banging on her window, trying to break in. She says that, by the time she got her gun and came back to check, there was a woman coming through the window with a hammer in one hand and a gun in the other.

    She says the woman was screaming that she wanted her dog back and was willing to kill to get it.

    “I said, ‘If you move any more, I’m going to shoot you,’ and she did. She moved forward and I did, I shot at her,” said Lori.

    Lori says the suspect kept coming and she fired again. Then, she says, the suspect broke a dining room window.

    She says she told the woman that she wasn’t trying to scare or injure her, but to kill her.

    “Thinking every time I tell her I’m trying to kill her that will click something in her head,” stated Lori.

    The bullets narrowly missed their target. During the incident, Lori had 911 on speaker phone and when they said officers were arriving, the suspect left.

    Lori says she’s glad she didn’t kill the intruder “because taking a life is a big deal, I don’t care what the situation is.”

    The woman was on the run from August 22nd, when this happened, until being arrested in Missouri last week.

    She’s now charged with attempted robbery and burglary.

    Police say the dog had been euthanized and was not the one Lori and her sister had adopted.

    Lori says she hopes someone will hear her story and start thinking about what could happen to them and form a plan and practice that plan, in the hopes they’ll never need it.

    A Bend man was “hunted” in his own home by a neighbor wielding an AR-15 before he shot and killed the intruder in a double-fatality shooting that rocked a quiet north Bend neighborhood this weekend, according to Deschutes County District Attorney John Hummel.

    Hummel said at around 12:30 a.m. Saturday, Kyle Scott Adams, 33, was alone in his home at 20774 N.E. Sierra Dr. when he was awoken by his neighbor, Tyler William Herrick, 33, standing in his bedroom.

    Herrick spoke “unintelligible gibberish” to him, and Adams demanded that he leave, Hummel told The Bulletin.

    After Herrick left, Adams texted his roommate Brennan Willey Pebbles, 31, to tell him what had happened. Pebbles left work at Worthy Brewing immediately and went home.

    As Adams and Pebbles were sitting in their living room discussing the break-in, Herrick returned to their property and, standing outside the living room window, fired his AR-15 into the house, striking Adams in the head and sending Pebbles diving for cover, according to Hummel.

    While Pebbles fled upstairs to retrieve his handgun, Herrick fired at the front door to gain entry. It wouldn’t unlock.

    Hummel said Herrick climbed through the shattered window and “methodically” walked room-to-room hunting Pebbles, who was hiding in the bathroom of the master bedroom upstairs.

    When Herrick entered the master bedroom, Pebbles shot and killed him.

    Hummel said Herrick had no reason to be in his neighbor’s home and no justification to fire on them.

    “Adams and Pebbles had done nothing to entice Herrick or cause him to fire,” Hummel said.

    Pebbles will not face charges in a case Hummel called one of the most senseless and shocking in his career.

    “My heart goes out to the guy,” Hummel said.

    As to what motivated Herrick to kill, Hummel said it’s not known, though it could have been a “monumental mental health collapse.”

    “We don’t know yet, but we won’t stop digging,” Hummel said.

    On Monday afternoon, two of Adams’ relatives loaded personal items into vehicles at the back of his house. The front door and living room window were boarded up, but otherwise there were few signs of bloodshed.

    Lizbeth Torres, who lives next door, said her 15-year-old son was home alone prior to the incident and heard someone ring their doorbell around 11:45 p.m.

    “I think it was that guy,” she said. “I think he came here first.”

    Many neighbors in the McCall Landing subdivision, where the homes are located, reported hearing the gunshots that night. They said rumors about what happened have swirled on the neighborhood-based social network Nextdoor.

    Several residents took issue with the contention that the victims’ home was the frequent scene of wild parties.

    “This isn’t that kind of neighborhood,” said Brittany Fagundas, who lives several houses down. “What’s so weird is people here don’t really interact or talk with each other at all. What are you going to beef about?”

    McCall Landing resident Sue Falltrick said she worked with Adams at Market of Choice in Bend, where he was a manager-in-training.

    “I didn’t know him real well, but he was a really upbeat, really nice guy,” she said. “It’s really shocking. Everybody at work is just shocked.”

    Torres said she works with Pebbles at Worthy Brewing.

    Herrick worked as an associate manager at Merkle in Bend and previously worked for seven years for G5, according to his LinkedIn page. He graduated from Summit High School in 2004 and attended Oregon State University.

    Herrick owned his home at 20778 N.E. Sierra Drive, according to county property records.

    Torres, her husband and son moved into their house five months ago — a starter home after years as renters, she said. Their front porch is currently adorned with inflatable Halloween displays and other decorations.

    Torres said her family now lives on edge. She fears the sound of her doorbell.

    “We’re kind of freaked out,” she said.

    Robbery and shooting at pharmacy owned by former Mayor of Lancaster

    LANCASTER, Pa (WHTM) - - Lancaster City Police are investigating a shooting at Smithgall's Pharmacy on West Lemon Street.

    According to Lancaster Police two people came in to the pharmacy to rob it around 2:40 pm. Detectives said one of the suspects then showed a handgun.

    Lancaster City Police Chief, Jarrad Berkihiser said a clerk fired at the suspects and hit one of them. That person was taken to the hospital according to Berkihiser.

    The other suspect was able to get away. Berkihiser would only say that the person police are looking for was dressed in all black clothing at the time of the robbery.

    Berkihiser also said police were able to recover the handgun they believe was used in the robbery.

    Police said a person inside the pharmacy was checked out at the scene but was not taken to the hospital. Police did not say who that person was.

    The pharmacy is owned by former Lancaster Mayor Charlie Smithgall.

    Lancaster Online reported that Smithgall walked out of the pharmacy and waived before getting on a stretcher.

    Berkihiser said he did not think the pharmacy was targeted because of Smithgall's political affiliation.

    Police: Attempted robbery at PNC Bank

    An attempted bank robbery yesterday apparently was foiled by a customer.

    Neshannock Township police were dispatched at 2:28 p.m. yesterday afternoon for a bank robbery attempt at PNC Bank, located at 2808 Wilmington Road.

    Police report the suspect as a tall thin, black male, who fled the scene in a silver Toyota Corolla with Ohio license plates.

    Witnesses told police that the suspect entered the bank wearing some type of mask over his face and instructed the teller to put all the money into a bag that he was holding. At this point, police were told, a customer inside the bank pulled a firearm and demanded the suspect to drop the bag and lay on the floor.

    The suspect did as he was ordered, police said, and then jumped up and fled from the bank into a wooded area.

    Police later learned that a vehicle was waiting several blocks away.

    No money was obtained, nor was anyone injured in the incident.

    FATAL SHOOTING IN JOSEPHINE COUNTY POSSIBLE 'SELF DEFENSE'

    An elderly man was on his property along Foothill Blvd when he shot another man to death, claiming it was done in self defense.

    GRANTS PASS, Ore. — The fatal shooting of a man in Josephine County may have been a case of self defense, according to the Oregon State Police (OSP).

    Troopers responded to a home in the 4000-block of Foothill Boulevard around 6:20 p.m. on Wednesday. When they arrived, OSP says that they found a dead man on the deck of the home.

    Upon interviewing the elderly residents, OSP says that the husband claimed that he had shot the man in self defense.

    OSP has confirmed that the resident is not being charged with a crime at this time, however investigation from OSP detectives and the Josephine County District Attorney's Office continues. OSP reports that the elderly residents have been cooperatiing with investigators.
