    Delivery man shoots armed teen who tried to rob him: police
    HOUSTON, Texas (KTRK) -- A 17-year-old was shot by a food delivery driver after he attempted to rob him at gunpoint in southwest Houston, police say.

    On Monday night, the delivery driver responded to a call at the Village of Fondren Apartments in the 6200 block of West Airport.

    Police say the teen gave the delivery driver an incorrect apartment number and told him not to knock on the door.

    Authorities told ABC13 the food delivery driver was waiting on the customer who ordered the meal to come out of the apartments when he was approached by the teen with a gun.

    The suspect took the driver's wallet and the food being delivered, but did not get far before the driver shot him in the leg.

    Shortly after, the teen allegedly called police to tell them he had been shot during a drive-by shooting.

    Authorities quickly learned that the teen wasn't being truthful, and arrested him. He's since been charged with aggravated robbery.

    The driver's coworker, Wendy Zheng, says the driver delivered to the apartment complex before, and had taken an order from the alleged robber two months ago.

    The teen's mom says she's shocked and is waiting to speak with her son.

    Zheng says that her co-worker was just working to pay his way through college.

    "He's working 24/7," said Zheng.

    The driver, who's licensed to carry, only had the gun for protection.

    "He did what he had to do to save himself," Zheng said.

    Man arrested after breaking into Phoenix homes, got on top of woman
    PHOENIX (FOX 10) — Phoenix Police arrested a man after he broke into two homes and attempted to sexually abuse a woman.

    Police say Monday morning around 4:30 a.m. a 32-year-old man went into a home that had an unlocked front door near 28th Street and Osborn. The suspect has been identified by Phoenix Police officials as Francisco Meza-Beltran. He is held on charges of sexual abuse, kidnapping, assault, burglary, and trespassing.

    Before the incident involving the woman, police officials said Meza-Beltran entered another home nearby through the unlocked back door. The 52-year-old homeowner confronted the man with a handgun, and he again ran out.

    "My brain went through that whole thing," said Gage Underhill. "Is it my daughter staring at me? Did my roommate come home early? And I figured out, 'no. This is a bad guy.'"

    Underhill, who spent 26 years in military law enforcement, wasted no time pulling his gun out of his nightstand.

    "I lit him up and said, 'you need to get the blank out of the house,'" said Underhill. "So that's when he was staring down."

    The suspect then ran from the house, while Underhill checked on the rest of his family. Police officials said the suspect ran to a neighbor's house, where he made it inside a woman's bedroom, laying on top of her and attempted to sexually assault her before she was able to call for help. Police were able to arrest the suspect a shorty time later down the road. Police officials have yet to identify the suspect, as of Monday afternoon.

    Meanwhile, Underhill said the whole ordeal was like a blur.

    "It was a very scary moment," said Underhill. "I've never had to shoot someone in my life, and I thought I was going to have to this morning."

    Underhill said he is glad no one got hurt, but he also wished he was able to detain the man before he made it to his neighbor's home.

    "I know I put the fear of God in him," said Underhill. "So he's caught. So another bad guy off the streets."

    The investigation is ongoing. Phoenix Police officials also said this incident serves as a scary reminder for people to always keep their doors and windows locked.

    Armed robbery victim shoots, kills suspect at Phoenix Circle K

    PHOENIX (3TV/CBS 5) -- Phoenix police are investigating a homicide at a Circle K near 24th Street and Baseline Road.

    Phoenix police said around 1:30 a.m. on Wednesday a 19-year-old man called police to report he was the victim of an attempted armed robbery at knifepoint.

    The victim told police he was sitting in his vehicle at the fuel pump when his door opened. An unknown woman approached in an attempt to divert his attention when a man, 25 to 35 years old moved towards him.

    The suspect displayed a knife and demanded the victim's vehicle. The victim had a gun and fired several shots at the suspect.

    The suspect was pronounced dead on the scene. The female suspect fled the scene on foot. A description of the female suspect is unknown at this time.

    Jury returns not guilty verdict in Mineola murder trial

    QUITMAN, Texas (KLTV) - A Wood County jury has found Jason Walters not guilty in the fatal shooting of Chris Griffin, 18.

    Walters was on trial for first-degree murder stemming from the shooting that happened on June 15, 2014 outside the Mineola EZ Mart on North Pacific Street.

    Jurors heard several days of testimony that included multiple witnesses who were at the EZ Mart, police officers who responded to the scene, Walters’ daughter, a gang expert and the man Walters had an argument with inside the store just moments before the shooting.

    The Mineola Police Department later confirmed Griffin was not the man Walters argued with inside the store. Through testimony given last week, we learned Dietrich Flournoy was the man involved in that confrontation, which spilled out into the alley behind the store.

    Deliberations were on hold at one point Wednesday after a juror became ill and was taken to a hospital. That juror was released from the hospital and deliberations were resumed. The jury had the option of finding Walters guilty or not guilty of either murder or manslaughter.

    Walters’ defense never disputed the fact that Walters shot Griffin, but attorney Cynthia Stevens Kent argued he pulled the trigger in self-defense.

    Homeowner shoots burglary suspect on Sand Mountain
    July 17, 2019

    PISGAH, Alabama (WDEF) – A homeowner on Sand Mountain shot someone trying to steal gasoline from his shed.

    Jackson County Chief Deputy Rocky Harnen says two men broke into the shed of a homeowner on County Road 83 in Pisgah.

    He says the homeowner fired some warning shot and ordered the two men to get on the ground.

    But he says one of them got up again and came at him with a knife.

    So he shot him in the knee.

    The man who was shot was flown to a Chattanooga hospital.

    The other suspect was charged with burglary, theft and false identification.

    Police: Madison homeowner holds suspected burglar at gunpoint


    NASHVILLE, Tenn. (WKRN) — A man accused of attempting to break into a Madison home Wednesday night was reportedly held at gunpoint by the homeowner until police arrived.

    Metro police responded around 11:50 p.m. Wednesday to a burglary at a residence in the 1500 block of Hudson Road.

    When officers got to the scene, they said the homeowner was holding the would-be burglar, Marquiese Kemp, at gunpoint.

    According to police, two juveniles told someone in the home that they heard knocks on the door and the homeowner was alerted.

    Officers said the homeowner went outside and saw Kemp kicking the door as if he was trying to break in.

    The homeowner fired one shot from his pistol into the air and held the suspect until police could take him into custody.

    Kemp was booked Thursday morning into the Metro jail on a charge of attempted aggravated burglary.

    Seattle woman shoots burglary suspect

    SEATTLE - Police say an armed 41-year-old man was shot by a woman as he was trying to break into her home early Thursday.

    It happened in the 600 block of Riverside Drive in Seattle’s South Park neighborhood.

    When officers arrived, they found the homeowner on the roof and a man behind the home with a gunshot wound to the shoulder and a handgun on the ground nearby.

    Seattle police say the homeowner, who was armed with a rifle, had to be coaxed down by police so they could give the man medical aid.

    The man was taken to Harborview Medical Center with serious injuries.

    Police found multiple bullet holes in the exterior of the home that are believed to have been caused by the burglar.

    Officers interviewed and released the woman as the investigation continues.

    Police arrested a second man who fled the scene when they arrived. It is not clear if he has any connection to the incident.

    LEXINGTON, Ky. (WKYT) - Lexington police are looking for three suspects after shots were fired during an early morning burglary.

    An officer said he heard about four shots being fired in the area of Beverly Avenue around 4:20 a.m. Thursday.

    Police were then called to a home on Beverly Avenue for a report of a burglary.

    The victim told police three men broke into his home. The suspects also made it into the man's garage. Police say they may have stolen a gun as well.

    As the suspects were leaving the victim said he fired several shots at their car. He thinks he hit the car but doesn't know if anyone inside was injured.

    Police are still looking for the car and the suspects involved in the burglary.

    Richard Winegardner’s German Twp. property has been burglarized four times just since May — but the latest would end differently than all the others.

    Winegardner was taking a shower on Wednesday, when he heard a stranger in his house.He said he immediately grabbed his phone to call 9-1-1 and his gun, which was in a gym bag.In the 9-1-1 call requested by the Springfield-News Sun, Winegardner tries to juggle confronting the person in his house and giving the dispatcher needed information. “I’m being robbed right now!,” he yells.

    Winegardner said he held the man at gunpoint for as long he could — which caught the stranger off-guard.“(He) tried to talk me into believing he was a great guy and he wasn’t here to cause me any problems — which I found odd because he already broke into the house,” Winegardner told the News-Sun.

    Winegardner said at that point, the man had run out the door and tried to drive off in a gray SUV.He said he fired his gun five times at his car to try to shoot out a tire.The SUV was found across from the Upper Valley Mall shortly after the attempted burglary with the back windshield shot out, as well as bullet holes in the interior and on the bumper.The suspect, 38-year-old Jason Moak of Clark County, was found near the intersection of West First Street and Universal Drive and arrested.

    Winegardner said he was familiar with the vehicle that Moak was driving — but he had never seen the man before he was in Winegardner’s house. Winegardner lives in a very secluded area and has outfitted his entire property with game cameras after several other break-ins this year.“ I saw the car I had seen previously many times on surveillance,” Winegardner said. “It was the same vehicle that had been here twice last week.

    ”According to court documents, Moak did admit to German Twp. Police after his arrest on Wednesday that he got into Winegardner’s house through a crawl space which led to a trap door in the house. In past burglaries, a suspect entered the house in the same way. Moak has not been charged with any other burglaries at Winegardner’s property as of Thursday.A not guilty plea was entered for Moak on one count of burglary and his bond was set at $25,000. As of Thursday evening, Moak remained in the Clark County Jail

    No charges will be filed in the July 3 shooting death of a Hendersonville man following an investigation’s conclusion the shooter acted in self-defense, District Attorney Greg Newman announced Friday.

    Family members of the victim, James Franklin Stepp III, are questioning the integrity of the investigation, however, and say they don’t believe the self-defense claim.

    Stepp, 48, was shot by Greg Carl Spinella at 706 Brooklyn Ave. at 6:15 p.m. following an altercation that was caught partly on video. Stepp’s family is calling for the release of the footage, but Newman said none would be released by his office.

    Stepp’s son, Jimmy, worked for Spinella at Spinella Trucking and Excavating Inc. and was fired the day of the incident after Spinella claimed Jimmy had damaged equipment, Newman said during a news conference Friday morning at the Henderson County Courthouse. Hendersonville Police Chief Herbert Blake also attended the news conference.

    The son was asked to leave the property, then returned and had a heated verbal exchange with Spinella, which led to his firing, according to Newman.

    Stepp then went to the business and confronted Spinella, Newman said. Stepp asked Spinella to give him his son’s paycheck immediately, Newman said. Newman said Stepp was not invited onto the property and Spinella did not know who Stepp was.

    The incident quickly escalated, and Stepp punched Spinella in the head “very forcefully,” which caused Spinella to fall to the ground facedown, according to Newman, adding that Stepp continued to punch Spinella in the head.

    A witness tried to break it up before getting tangled up and falling down, which allowed Spinella to turn enough to grab the pistol near the small of his back that he legally carried, Newman said.

    After grabbing his pistol, Spinella stuck the firearm into Stepp’s chest and fired “as many times as he could fire it,” Newman said.

    Three shots were fired, and the fatal shot hit Stepp in the pelvic region. Another went into his chest and out his arm, and a third grazed his leg.

    Stepp had one firearm in his vehicle and his son had two, according to Newman. Spinella was the only person to fire any shots.

    The son had gone outside during the altercation, and upon seeing his father shot, drove him to Pardee Hospital, Newman explained. Stepp was later pronounced dead at Mission Hospital.

    Spinella went to AdventHealth with head injuries.

    Newman said HPD conducted a thorough investigation, and the evidence included some video footage, witness statements and results from an autopsy HPD officers were in attendance for. North Carolina is on the side of Spinella in the incident, according to Newman.

    ″...the law supports what this man did. It is difficult, it is tragic, yes. This is not the way we want people to handle their disputes, but the facts are compelling that this is an act of self-defense, and for that reason I will not be submitting an indictment to the grand jury,” Newman said.

    Newman said the case would not win a conviction in court, and that he and HPD were “very much in agreement” about the results of the investigation.

    “I would not be in a position as district attorney to satisfy a jury beyond a reasonable doubt that this man was not acting in self-defense; I just would not be able to do that,” Newman said.

    Newman said the footage reviewed in the investigation was from a motion-activated camera and the entire altercation is not seen in the video. He said it is not a steady stream of video and does “jump around a little bit.” Under statute the video will not be released unless a court orders it, Newman said.

    Newman said the decision took three weeks because the police department had to be careful in its approach. Spinella did not give a statement right away, and some individuals had to be called back in for statements. Newman said Stepp’s son made two statements that were conflicting.

    “North Carolina law provides that all of our people have the right to defend themselves against aggressive behavior, especially if they feel that their life is in danger or they are in danger of great bodily injury,” Newman said.

    He expressed sympathy for Stepp’s family, and acknowledged their disapproval of the decision.

    “I understand there will be people sad about this, people upset with me about this, but my duty is to not put forward any case that shouldn’t go forward,” Newman said. “It is not pleasant. It is not easy. That’s just where we are with things. That is our decision. So this case will not be prosecuted against Mr. Spinella for what happened on July 3.”

    The situation should ideally have been handled differently and not escalated to what it did, Newman said.

    “If people owe people money, or owe them an apology or own them anything, there are ways to go about that, but to go and make demands and then to punch people may have horrible and tragic consequences, as it did in this case,” Newman said.

    Newman met with Stepp’s family before the news conference Friday morning.

    Stepp family demands SBI investigation, disapproves of decision

    Members of Stepp’s family stood outside the courthouse following the news conference to make a statement and express their outrage at the decision. More than a dozen people gathered across the street holding signs that read “Justice for Pup,” referring to Stepp’s nickname.

    The family contends that Stepp went onto the property to return a borrowed air compressor, not to demand a paycheck. An attorney for Stepp’s family also said Jimmy was told by Spinella to call his dad, and that Spinella had knowledge of who Stepp was.

    Travis Rector, a former Hendersonville police officer, was one of the two witnesses at the scene, and Stepp’s family said they consider it a conflict in the investigation.

    Kim Shepherd, Stepp’s sister, said her brother’s death has been devastating to the family. She believes there were conflicts involved in an “incomplete” investigation. The family is calling for the State Bureau of Investigation to look into the shooting.

    Shepherd briefly spoke to reporters alongside her parents, Shelia and James Stepp Jr., who were visibly upset at the decision. The family’s attorney, Monica Gillett, was also present.

    “While we respect self-defense, we understand there is such a thing as imperfect self-defense, and we believe true self-defense is for an innocent party, and this person was not an innocent party,” Gillett said. “This was somebody that provoked this.”

    Gillett claims Spinella had threatened to kill Jimmy earlier in the day, and that Spinella had made statements about his desire to be in a situation that resulted in gun shots being fired. She said these claims were not investigated.

    “He was looking for something to happen, and something did happen, and now he is trying to claim self-defense and getting away with murdering somebody,” Gillett said.

    She said the next step would be to ask the Sheriff’s Office to back an SBI investigation.

    The Sheriff’s Office had received no official requests as of 4 p.m. Friday, Sheriff Lowell Griffin said.

    “I have complete confidence in the Hendersonville Police Department and extreme confidence in our District Attorney Greg Newman to make competent decisions concerning these types of cases,” Griffin said.

    If the SBI did get involved, its investigation would also be brought to Newman for a decision on whether to bring charges.

    An online petition on Change.org titled “Justice for Jim ‘Pup’ Stepp” had nearly 1,500 signatures by 2 p.m. Friday. The petition says a jury should decide innocence or guilt and cites concerns about potential conflicts of interest in the case.
