A 62-year-old man with a gun in each hand fired at four people – including a 1-year-old boy – before a civilian with a concealed carry permit returned fire and wounded the shooter, cops told FOX19.

Thomas McCary is being held without bond on four counts of felonious assault.

McCary was arguing with a woman around 8 p.m. Sunday night and, when the woman’s brother, Patrick Ewing, approached, McCary pulled out a .38-caliber handgun and fired three shots at him, Cincinnati police said.

Ewing didn’t get hit, but he did get his own gun and returned fire, wounding McCary in the leg. Ewing had a permit to carry a concealed weapon.

Injured, McCary went into his house to get a second gun and, holding a weapon in each hand, he fired three shots in the direction of the woman, Jeaneta Walker, her 1-year-old son and a third man.

Ewing fired at McCary again to try to distract him as the victims fled indoors. McCary squeezed off a few more rounds, hitting no one, before withdrawing into his apartment, Cincinnati.com reported.

McCary was taken to the University of Cincinnati Medical Center, where he was arrested at 2:30 a.m. He was treated, released and booked into the Hamilton County Jail by 3:42 a.m. McCary is scheduled to face a judge Monday morning

CHICAGO – An armed man attempting to rob a neighborhood store was shot and killed by a customer who had a concealed carry license, Chicago police said Sunday

A masked man, later identified as 55-year-old Reginald Gildersleeve, walked into the store and currency exchange about 7 p.m. Saturday on the city's southwest side, displayed a handgun and announced a robbery to an employee, police spokesman Anthony Guglielmi said. The gunman next pointed his weapon at another employee and forced her to the back of the store.

The armed customer then fatally shot the man multiple times, according to the Chicago Sun-Times. Gildersleeve was pronounced dead on the scene at 7:10 p.m., according to police and the Cook County medical examiner's office. He had an extensive criminal history, including prior arrests for robbery, the Sun-Times reported. Gildersleeve was set to have an autopsy performed on Sunday, according to the Chicago Tribune.

It wasn't immediately clear whether the customer, who has not been identified, will face charges. Guglielmi said the case is under review by local prosecutors, but the preliminary details suggest that the customer was not at fault.

"We're looking at it as a self-defense issue at this point," he said.

Last month, a Michigan woman with a concealed carry license shot at shoplifters fleeing a Detroit-area Home Depot store, flattening a tire of their SUV. No one was hurt, and the suspected shoplifters were arrested several days later. The woman faces up to 90 days in jail after pleading no contest to a charge of reckless discharge of a firearm. Two other shootings in which citizens fired at lawbreakers or potential lawbreakers also happened in September in Michigan.

"It's a slippery slope" when it comes to the question of whether citizens who are licensed to carry guns should intervene in dangerous situations, if at all, Guglielmi said.

"You have situations like this," he said, referring to the foiled Chicago robbery in which no one else was hurt. "And you have situations that end tragically. The department is not going to advocate for what people should or shouldn't do."

When a masked man wearing a hood entered Happy’s Package store, jumped over the counter and pulled a black handgun, Alwyn Noronha — the clerk who was minding the store in Stone Mountain, Georgia — said he “reacted instinctively.”

In other words, Noronha pulled his own gun — a silver revolver.

“He shot first so I shot back,” the clerk told WAGA-TV.

Noronha — who didn’t want the station to show his face — said the gunman “found out that I was not willing to just give in to him … he started to run out, and then he shot three more times, so that’s when I shot him again.”

DeKalb County police said 22-year-old Emmanuel Henry, who was wanted in three other armed robberies, fired five shots — missing Noronha each time, WAGA reported. But Henry didn’t fare as well, as he was hit three times before running out of the store, collapsing about 5o yards away and dying at a hospital, police told the station.

“The guy had no idea who he was messing with,” Andre McGee, a regular store customer, told the station of Noronha.

“He’s a real nice guy until you go to pushing him over,” McGee added.

Noronha said he never wanted to take a life.

“I don’t want that on my conscience,” he told WAGA. “Even though people say it’s justified. I reacted instinctively and in self-defense, yes, but this is very unfortunate. I wish it had never happened.”

Detectives told WSB-TV they don’t intend to press charges over Tuesday night’s incident, as the clerk was “well within his rights to protect himself.”

Mother sticks her gun in home intruder’s face — and asks him a question that may get you cheering

Tennessee mother Elsie Lee woke up Monday morning to a strange noise in her home.

“I thought I was just dreaming something,” Lee recalled to WBBJ-TV, “and then I heard a big bang again.”

Realizing something was amiss, she told station she “got up and came running through the hallway” and “the guy was standing in the kitchen. He had just busted my door open.”

And others were waiting outside her Madison County home, WBBJ reported.

Lee told the station her only thought was “protect my son.”
So she grabbed her .45-caliber handgun as well as her shotgun.

Then Lee asked the intruder an important question after she approached him.

“I put the gun in his face and asked him if there was something I could do for him,” she told WBBJ.

The result?

“He was gone just that quick,” Lee told the station. “I chased him out the back door trying to look at the tag number on the car, something I could describe other than just him.”

Within an hour, deputies arrested Quentin Childress, 20, Jaylon Chiles, 18, Amar Johnson, 21, Kendrick McMullin, 19, and a juvenile male, WBBJ reported, adding that each is charged with aggravated burglary. They were scheduled to make their first court appearance Thursday morning.

Lee had nothing but praise for law enforcement.

“I say they were ‘Johnny on the spot,’” she told the station. “They were here within three minutes. I congratulate our sheriff’s department for what they did, and it couldn’t have been done any faster or better.”

Lee told WBBJ she doesn’t believe the burglars were armed — but she said she knows what would’ve happened had the intruder in her home decided to stick around.

“I almost killed him,” she told the station. “One of them could have been dead. Had he not ran, he would have been dead.”

Rebbie Roberson resides in Bowie County, Texas — where guns are a familiar sight and used without apology.

And this 74-year-old grandmother is no exception.

Roberson told KSLA-TV that she was about to sit down Sunday night to watch the TV news when an armed masked man wearing gloves broke into her home.

“And when I started to get up, he was in here on me with a gun facing me right to my face,” she told KSLA, adding that she had to “walk right out in front of him. I didn’t know if he was going to kill me or what.”

But Roberson wasn’t about to let the gunman get the upper hand — and grabbed her very own .38 from a table: “And when I swerved around, I pointed it at him, and he ran.”

Believe it or not, she took off after the intruder and fired her pistol. The bullet holes in her walls are evidence of that.

“I’m not sure I didn’t hit him,” Roberson told KSLA. “I don’t know yet. I sure tried. I sure was hoping. That was the scare of my life.”

Sitting in her chair and pointing her gun upward as she spoke to a reporter, Roberson was resolute.

“I tried to kill ’em,” she acknowledged to the station. “Anybody break in on me, I’m gonna kill ’em. He’s going to kill me, or I’m going to kill him.”

Roberson said she always keeps her gun close while she’s at home, and Bowie County Sheriff’s Chief Deputy Jeff Neal told KSLA he has no issue with that.

“Every citizen, according to the Texas penal code, has the right to defend themselves and their family,” Neal told the station.

Officials told KSLA they don’t believe the suspect was injured.

A number of Texas legislators are looking to pass “constitutional carry” in the state during 2017, which would grant all Texans the right to openly carry firearms without a permit if they choose.

The State Attorney's Office will not file any charges against the man who shot and killed Dakota Fields in January at the Waffle House restaurant on Palm Beach Boulevard.

Jehrardd Williams, 28, was the shooter at the Waffle House, but the reports released this week indicate Williams feared for his life when he fired three shots at Fields.


Fields and several friends were in the restaurant early in the morning on Jan. 5 after drinking the night before. The report says the group was loud and seemingly intoxicated when an argument started.

A man that was with Fields shook hands with another patron at the restaurant, but when he reached out to shake hands with Williams, Williams did not shake his hand.

In response, video surveillance shows Fields' friend punched Williams in the head.

After that, the video shows Fields appearing from outside the restaurant in the doorway. Williams retrieved a gun from his holster in his jeans and put it behind his back. Fields lunged at Williams, and Williams fired three shots at Fields - hitting him in the torso.

Fields and his friends ran out of the restaurant and got into an SUV. The SUV crashed just six miles away near downtown Fort Myers. Fields died of a gunshot wound to the torso.

Williams stayed at the restaurant and called 911, waiting for deputies to arrive.

Williams has a permit to carry the weapon.

Video shows self-defense fatal shooting of ex-soldier at Miccosukee casino

Newly released surveillance videos shows a former U.S. Army soldier threatening and then charging at a car in the Miccosukee casino parking lot, spurring a passenger to fatally open fire.

The footage was key evidence for prosecutors who dropped the murder case against two men initially arrested for the killing of Fernando Duarte on Christmas Day at the West Miami-Dade casino.

The Miami-Dade State Attorney’s Office determined that Duarte, though unarmed, was the clear aggressor and shooter Kenin Bailey acted in self-defense under Florida’s Stand Your Ground law.

The video was released Tuesday, two months after prosecutors declined to file charges against Bailey and the car’s driver, Mikey Lenard.

The slain man was Duarte, a 33-year-old burly former soldier who had been asked to leave the casino after cursing and directing racial slurs at Bailey and Lenard at the poker table. The footage shows Duarte and a friend leaving the casino, cashing out their chips and chatting amicably with security guards.

But once Duarte got his car in the parking lot, he got out of his car and “engaged” Bailey and Lenard in the parking lot, according to a report by prosecutors. Then, as Bailey and Lenard tried to drive away, Duarte twice maneuvered his car to block theirs from leaving

Lenard later told police Duarte yelled: “I am going to f--k you up and kill you,” while making a hand gesture like a gun; the footage backs up that claim.

Moments later, Duarte again blocked Lenard's car from leaving the resort parking lot. But this time, Duarte got out and charged toward their reversing car, getting so close that Bailey opened fire, shooting 13 times and hitting the man with two fatal shots.

Between Duarte’s threats, hand gestures and the possibility that he might have been reaching for a weapon, Bailey was justified in using deadly force, prosecutors concluded.

“Bailey could have reasonably believed that he and Lenard’s life was in danger and that a firearm may be used against them,” the report said.

Toxicology reports also showed that Duarte was also extremely drunk and likely high on cocaine.

The case was recorded as the first homicide arrest for the Miccosukee police department, which serves a tribe that has long chafed at the rule of state authorities, including the Miami-Dade State Attorney's Office.

The prosecution was complicated by Florida’s controversial Stand Your Ground law, which eliminated a citizen’s duty to retreat before using deadly force to counter a grave threat. But Duarte’s killing might likely have been ruled self-defense even before the 2005 law — Bailey and Lenard could have argued they were trying to escape in their reversing car when Duarte charged at them.

Police: Men Lure Couple to Vehicle Buy, Pull Out Weapons, Demand Money. Then One Victim Pulls Out a Gun of Her Own.

The trouble began after a couple responding to a Craigslist ad arrived at a meetup spot in Aiken, South Carolina, to purchase a vehicle, police told WJBF-TV.

Then the two black men who met the couple Wednesday afternoon pulled out weapons and demanded money, Aiken County Sheriff Captain Eric Abdullah told WJBF.

But one of the victims, a woman, pulled out her own gun and fatally shot one of the men, later identified as 23-year-old Frank Frazier Jr., police told the station, who died at the scene.

Witnesses said a black male with a grey hoodie fled from the road where the meeting took place, WJBF added, and police are still looking for him.

While authorities were investigating the scene, a couple admitted to the shooting and said it was in self defense, WJBF reported.

The couple said after the shooting, the other man ran off and they got in their car, called 911 and met with deputies at a nearby gas station, WRDW-TV said.

Abdullah told the station the investigation is ongoing but no charges have been filed.
