    Prosecutor: Homeowner justified in fatally shooting Lansing man during attempted burglary

    SEBEWA TWP. — A 69-year-old Ionia County homeowner who fatally shot a Lansing man will not be charged with the man's death, prosecutors say.

    Justin Eddy, 40, was shot and killed during a reported attempted home burglary in Sebewa Township, near Portland, in early January.

    Ionia County Prosecutor Kyle Butler ruled Monday that the homeowner acted in self-defense when he shot Eddy, and chose not to issue charges.

    A man, later identified as Eddy, forced his way into a home in the 4000 block of East Musgrove Highway occupied by a married couple, a 69-year-old man and a 63-year-old woman, just after 10:30 p.m. Jan 1.

    He told the couple he was being chased by someone who was trying to kill him, according to the news release. He had arrived at the couple's home in a pickup that had been stolen from a home about two miles east, according to the news release. He abandoned his own pickup at that location, leaving the engine running and headlights on.

    The man grabbed his gun and went outside with Eddy, while his wife stayed inside and called 911. They were not able to find anyone outside.

    The man told Eddy "Don't come in here," just before the 911 call ended, according to the news release. The police investigation showed Eddy went back inside the home and smashed the cell phone and asked for the gun several times.

    Eddy struck the man in the face and pushed him down to the ground and attempted to take the gun from the man's waistband before the man shot and killed Eddy, according to the news release.

    He was pronounced dead at 11:36 p.m. Toxicology reports showed Eddy had a blood alcohol content of 0.25 and the presence of fentanyl in his system, supporting his "erratic behavior," according to the release. He had struggled with drug abuse and had recent contacts with police and the Michigan Department of Health and Human Services.

    Although Eddy was not armed at the time of his death, the male homeowner was "nonetheless in reasonable fear of death or great bodily harm" when Eddy was in his house, Butler said in the news release.

    Unicoi County shooting appears to be a case of self-defense
    Unicoi County —
    New details tonight on a shooting in Unicoi County.

    Sheriff Mike Hensley said Saturday night's shooting that killed one person appears to be a case of self-defense.

    Police say 49-year-old Larry Junior Morton was shot and killed at a home on Simerly Creek Road.

    Hensley says evidence indicates that Morton was in a dispute with his neighbor.

    The sheriff says Morton became threatening and police say his neighbor shot him.

    "He did have two small children. Him and his wife had been divorced and he had custody. They're now with the grandmother and the grandfather," says Hensley.

    Hensley has declined to release the name of the neighbor at this point.

    The TBI is assisting the county sheriff in the investigation

    As of now, there are no charges.

    Woman says driver tried to run her over before Detroit shooting

    Police are investigating the death of a woman shot while driving her car on Detroit's east side as a possible case of self defense.

    The shooter was a 37-year-old woman who said the driver, a 47-year-old woman, tried to run her over multiple times shortly before 7:10 p.m. near Fordham and Hayes, police said.

    The 37-year-old had a license to carry the weapon and remained on the scene when police arrived.

    Police: Brunswick homeowner shoots suspected intruder
    The unnamed resident is not expected to face criminal charges

    BRUNSWICK, Ga. - A Brunswick homeowner confronted and shot a man accused of trying to break into his home Monday evening, authorities said.

    Multiple agencies were called to the Johnston Street home about 10:30 p.m. Monday in response to a reported burglary, according to the Glynn County Police Department.

    The intruder was gone by the time police arrived, but an officer later found 49-year-old Troy Rogers lying on the ground near Johnston and Sixth streets with a gunshot wound.

    Rogers was airlifted to UF Health Jacksonville, where he was listed as stable as of Tuesday afternoon.

    The unnamed homeowner was not hurt and is not expected to face any charges, according to police.

    Rapper Bun B Shoots Suspected Armed Home Intruder Who Threatened His Wife at Gunpoint: Reports

    Rapper Bun B was involved in a shootout with a suspected home intruder at his Houston home on Tuesday, April 23, according to reports.

    Houston Police told KTRK that Bun B’s wife, Queenie, answered the door at around 5:45 p.m. yesterday to find a masked man holding a gun on the other side.

    The suspect, identified as DeMonte Jackson, demanded property from Queenie, who offered up a family Audi parked in the garage, reported TMZ.

    While Queenie directed the suspect to the car, Bun B, who had heard the commotion, grabbed his gun and came downstairs to confront the Jackson in the garage, according to police. Several shots were reportedly fired before Jackson fled on foot, leaving behind his gun.

    Jackson later showed up at a hospital for treatment for a gunshot wound, police said. He was subsequently arrested and is now facing two counts of aggravated robbery with a weapon and one count burglary, according to the news website.

    Bun B, whose real name is Bernard Freeman, is best known for being a member of the rap duo UnderGround Kingz and releasing a number of solo albums.

    Other Homeowners Using Guns as Self-Defense

    In a similar case, a Texas homeowner used a gun to protect his home after five men—some who were armed with large guns—broke into his home in January.

    The homeowner grabbed his gun and shot at the suspected home invaders. One of the suspects was left dead in front of the house. One fled on foot, while the others, some who were injured, fled in an SUV.

    The SUV crashed into a nearby pole and a second suspect was found dead inside, reported Fox News, citing police. A third suspect collapsed onto the street and later died.

    The other two suspects who were wounded and had fled the scene were taken to the hospital.

    “The homeowner appears to have defended himself,” Houston Police Department homicide detective Travis Miller told KTRK-TV. The homeowner was not injured.

    Homeowner returns fire on burglary suspects killing 1, critically injuring the other in Hampton County

    HAMPTON CO., SC (WTOC) - Hampton Police are investigating a shooting incident on Locust Street W. near the Hampton County Dispatch Center.

    According to the Hampton Police Department, at approximately 9:30 p.m., HPD officers responded to a shooting incident in the 100 block of Locust Street West. The preliminary investigation revealed that two suspects forced entry into the residence and opened fire on the homeowner.

    Police say the homeowner, who has a concealed weapons permit, defended himself and returned fire striking both suspects.

    Officials say 20-year-old Brison Simmons, of Beaufort, was pronounced dead at the scene.

    The second suspect, who has been identified but his name is being withheld at this time, fled the scene after being shot and stopped at the McDonald’s on US-278 for help, according to HPD. They say he was treated by Hampton County Emergency Services and later airlifted to MUSC in Charleston, SC where he is currently listed in critical condition.

    The homeowner was transported to an area hospital for treatment of a gunshot wound and was later released.

    “You shouldn’t break into places anyway, but it’s not a good idea to be breaking into somewhere right across the street from the police department,” said Laura Bryan.

    Bryan says the neighborhood is normally a quiet one, but when she got there Wednesday morning to cut the grass, she saw all the yellow tape still up. Her brother also lives near where the shooting happened.

    “All he said was it sounded like fireworks went off and an alarm went off, and the next thing he knew, the police were out here, and he never comes outside because he was a little scared,” she said. “You shouldn’t be breaking into homes, you shouldn’t be causing that type of disturbance. These people were just sitting in their home minding their own business, and you come in on them. Expect to get shot.”

    The South Carolina Law Enforcement Division’s Crime Scene Unit was called to assist in the investigation.

    Hampton Police Department officials say no shooting occurred at McDonald’s or anywhere else in town. This was all one incident that occurred at one location.

    The investigation is ongoing.

    Police: Two arrested in Garrard County burglary, one shot by homeowner
    April 24, 2019

    GARRARD COUNTY, Ky. (WTVQ) -In Garrard County, an accused burglar got more than he bargained for when he was shot by the homeowner.

    Police say they received a call just after 3 a.m. Wednesday about a burglary in progress at the Old US 27 BBQ building on Old Lexington Road. The property owner lives on site, according to police.

    Officers found Joseph Bickett running from the scene and were able to arrest him after a short foot chase. Police also found Dale Parker while he was trying to leave the home. Officers say the two men are related.

    Police say Parker and Bickett illegally entered the home and climbed onto the roof and forcibly opened a kitchen window.

    The home owner reported several men inside his home and went to his bedroom.

    Officers say the homeowner was armed and fired one shot at Parker when he entered, hitting him in the upper shoulder. The homeowner said Parker was armed with a metal pipe and scissors.

    Garrard EMS took Parker to UK hospital for treatment of the gun shot wound.

    Parker was charged with Burglary First Degree, Criminal Trespass, Terroristic threatening and Menacing. Bickett was charged with Burglary Second Degree and Criminal trespass.

    Both were booked in the Lincoln County Jail.

    Hillsborough homeowner shoots intruder, suspects on the run
    HILLSBOROUGH COUNTY, FL (WFLA) - A Hillsborough County family is shaken up after deputies said two men wearing masks broke through the front door of their home in Town N' Country Wednesday.

    Deputies said the homeowner shot one of the suspects but the men still got away and are on the run.

    A new front door was put on the home Wednesday several hours after the intruders broke-in.

    Deputies said two Spanish- speaking men with medium builds broke into the front door of the home in the 7000 block of Lawnview Court around 3 a.m.

    Amanda Granit with the Hillsborough County Sheriff's Office described what happened next. "The husband does what I think many of us would do in this situation and grabs a shotgun," said Granit. "He was able to confront these suspects and fired once, hitting at least one of the suspects. "

    A neighbor who's lived in the area for several decades says this kind of violence doesn't happen out there.

    “I hope they catch them. Sooner or later they will. They're going to have to go to the hospital to get a bullet out, I imagined. I can't imagine anybody breaking into that house in particular because it's at the end of the cul de sac,” said neighbor Houston White.

    White said the people who live in the home are quiet and are good neighbors.

    Deputies are looking for an older model Dodge Dakota. They released surveillance pictures of the truck late Wednesday afternoon..

    The men headed toward Hanley Road after the homeowner shot one of the suspects, according to deputies.

    Granit says detectives are monitoring local hospitals to see if either of the men show up for treatment. They're also analyzing the blood the men left at the scene.

    "We know they left a trail of blood, that will be collected," said Granit. "It will be ran through our system to see if it comes up with any matches and possibly that could lead us to a suspect. "

    Anyone with information is asked to contact the Hillsborough County Sheriff’s Office.

    Not guilty on all counts.

    That was the jury’s verdict Wednesday in the Columbus murder trial of Eddie Clayton, who claimed self-defense in the 2017 fatal shooting of Robert Lockhart.

    The jury deliberated about three hours before reaching a verdict at 2:37 p.m.

    “He’ll be released,” defense attorney Mark Shelnutt later said of Clayton, who was held in jail 15 months awaiting trial.

    “He’s never going to get that back, obviously,” Shelnutt said of Clayton’s jail time. Clayton’s defense team earlier persuaded a judge to set a bond for Clayton, but he didn’t have the funds to pay it. “When you’re talking about bonds in excess of $100,000, people just don’t have that kind of money laying around.”

    In claiming self-defense, Clayton maintained he had to shoot Robert Lockhart four times during a fight that started over cigarettes during a July 22, 2017 party at Clayton’s home on Grant Road.

    The evidence showed Lockhart attacked Clayton first, hitting him in the back of the head and struggling with him in the kitchen before other guests broke up the fight. That’s when Clayton went to his bedroom to get a 9-millimeter semi-automatic pistol, and returned to the kitchen to confront Lockhart, witnesses said.

    Clayton claimed Lockhart immediately attacked him a second time, so he shot Lockhart in the leg as Lockhart charged at him, and had to keep shooting the much larger man to stop the assault. When Lockhart stopped fighting, Clayton stopped shooting, leaving six bullets in the gun that held 13.

    “He only used the force necessary to get the attacker off of him, so to us, it was a real clear case,” Shelnutt said Wednesday evening.

    Clayton’s injuries from Lockhart’s assault were evident in photographs taken afterward, the attorney said. “He was hurt. He had a burst eardrum. He had a cut over his eye. You could clearly see from his mugshot that he was hurt…. He suffered great bodily injury.”

    Clayton that night was hosting a birthday party for his girlfriend, Ardella McKinley. She and Mario McKinley are siblings to Lyzenzia Lockhart, Robert Lockhart’s wife, and all were at Clayton’s home, along with a third man who lived with Clayton, and three children.

    Around midnight, the men went to a nearby store to buy alcohol and other supplies. Clayton and Lockhart chipped in together on a pack of cigarettes, and Lockhart gave some to a woman he saw at the store. Clayton criticized him for that, and the ensuing argument is what led Lockhart to assault him later.

    The jury found Clayton not guilty on these charges:

    Malice or intentional murder
    Felony murder for killing Lockhart while committing felony aggravated assault
    Aggravated assault
    Using a gun to commit a felony
    He claimed self-defense under what’s commonly called Georgia’s “stand your ground” law, which states in part:

    “A person is justified in using force which is intended or likely to cause death or great bodily harm only if he or she reasonably believes that such force is necessary to prevent death or great bodily injury to himself or herself or a third person or to prevent the commission of a forcible felony.”

    The law’s exceptions say the person claiming self-defense can’t be the instigator of the violence, or be committing a felony, or be engaged in mutual combat, unless he or she withdraws from the fight and effectively communicates that.

    “I think the case from start to finish was a very clear-cut case of self-defense,” Shelnutt said. “I mean, here’s a person who never had a history of any kind of violence. He’s got a weapon in his home … for protection, and the only reason he got it out was he was being attacked, literally beaten in his home.”

    78-year-old man fatally shoots intruder in St. Louis home

    ST. LOUIS (AP) — Authorities say a 78-year-old man fatally shot an intruder who forced his way into a St. Louis home during a domestic dispute.

    The St. Louis Post-Dispatch reports that 24-year-old Cameron Campbell was shot in the abdomen around 1 p.m. Tuesday. He died at a hospital.

    St. Louis Police Lt. Scott Aubuchon says all of the family members are cooperating with investigators. He wouldn't disclose the relationship between Campbell and the man who killed him during a fight.

    Police aren't saying whether the older man will face charges.
