    Shasta Co. DA classifies 4 citizen shootings as self-defense

    REDDING, Calif. - The Shasta County District Attorney's Office released their findings in four separate civilian shootings that they ruled as self-defense, on Thursday.

    District Attorney Stephanie Bridgette said that all of these shooters stayed at the scene, cooperated with law enforcement, volunteered to be interviewed by police. They also either had their CCW permit or were on their own property.

    Bridgette explained that her office looks at three factors when investigating these cases.

    Did the shooter have a reasonable belief of imminent danger of being killed or suffering great bodily injury?
    Did the shooter reasonably believed that the immediate use of deadly force was necessary to defend against the danger?
    Did the shooter used no more force than was reasonably necessary to defend against the danger?


    In the first case, Michael Lake fatally shot John Souza in an intersection in Redding after Souza confronted Lake by bashing on his car window. Lake also told officials he saw Souza reach into his waistband. Lake had his CCW permit and shot Souza once in the chest with a handgun and immediately called 911.

    Souza was found to be unarmed, but the incident was ruled as self-defense since Lake feared for his life and Souza had escalated the incident.

    Story 2

    In the second case, James Valdez was shot by his girlfriend's grandfather at the grandfather's home in Redding. The grandfather, Joshua Horak, reported that Valdez had been increasingly aggressive during his time at his house. At one point Valdez and Horak's granddaughter, along with their child together, went into the home's garage. After a short period of time, Horak went out to check on the trio and found Valdez trying to rip the baby from his granddaughter. This led to a confrontation in which Horak shot Valdez twice in the chest.

    Valdez is facing criminal charges from that day, but Horak was deemed as defending himself as well as his granddaughter and great-granddaughter.

    Story 3

    In the third case, Federico Lazo, an off-duty employee of the California Highway Patrol, shot and killed Christopher Rosa after Rosa tried to break into his home. According to the reports, Lazo was home with his wife and children when he was woken by the sounds of loud banging outside his home. Lazo did an armed sweep of his home, when he ran across Rosa who started to charge at him.

    Rosa didn't listen to Lazo's demands to stop and Lazo shot him twice, killing him. 911 was called during the shooting. Lazo was not charged because he was on his own property and believed that he and his family were in immediate danger.

    Story 4

    In the fourth case, Walter Gordon fatally shot Danial Bissell near an apartment complex that Gordon lived in. Gordon told officials he witnessed Bissell going door-to-door with a knife in his back pocket. Worried for the safety of his family and neighbors, Gordon called 911 and grabbed his shotgun. While on the phone with 911, Gordon tried to confront and stop Bissell from leaving the area (and heading to a neighborhood park) before police arrived. Bissell ultimately turned on Gordon and was able to grab ahold of the barrel on the shotgun.

    Gordon shot Bissell once, worried that he would get control of the gun and turn it against him. The DA's office ruled that in face of dealing with an erratic and unpredictable person, the shooting was reasonable.

    Bridgette noted that the past year saw an increase in shooting incidents, but that no clear reason or pattern had emerged to explain the change.

    Concealed carry license holder fatally shoots man in South Side parking lot

    A concealed carry license holder told police he fatally shot a man who tried to rob him at gunpoint Thursday night in a South Side business parking lot, according to authorities.

    The shooting happened about 8 p.m. in a parking lot shared by Target and Fifth Third Bank in the 1900 block of West 33rd Street in McKinley Park, police said.

    Officers found a 21-year-old man lying on the ground after responding to a call of a person shot, according to preliminary information from a source. The man was taken to Stroger Hospital with gunshot wounds to the back and chest and pronounced dead, police said.

    Witnesses told police a silver Nissan fled the scene after shots were fired, the source said. Officers stopped a car matching that description as it returned to the scene in the 3300 block of South Damen Avenue, according to the source.

    Two weapons — a semi-automatic gun and a revolver — were found in the car with expended shell casings.

    The driver in the Nissan, 27, told police a man walked up to his car in the parking lot and tried to rob him at gunpoint. He said he fired his gun — the semi-automatic — after a struggle in the car.

    He said he was returning to the scene to talk with officers. The man was taken into custody.

    Shooting death ruled self-defense by District Attorney

    CONCORD – No charges will be filed in the shooting death of DeShawn Tatem, according to a press release from District Attorney Roxann Vaneekhoven.

    After a review of the evidence and extensive investigation, Vaneekhoven said Sarah Shoe, the owner of Sarah’s Pet Spa on Winecoff School Road, fired the shot in self-defense. It happened Thursday, Nov. 30.

    Tatem was a leader in the Yahshua Movement, which rented space near Sarah’s Pet Spa. According to Vaneekhoven Tatem was known as “The General.”

    The press release gives extensive details of what investigators found and were told.

    Here is the complete press release from Vaneekhoven:

    “On Thursday, November 30, 2017, Sarah Shoe fired one shot at a man who had forcefully and unlawfully entered her place of business and was attacking her boyfriend while her two young grandchildren were inside her business. The man was DeShawn Tatem also known as “The General” in a group called the Yahshua Movement. The shot was fired while Ms. Shoe was on the phone with a 911 operator describing a physical fight that Mr. Tatem had gotten into moments earlier with Ms. Shoe’s boyfriend, Christopher Gray, after being told to leave their business more than a dozen times. Ms. Shoe explained to the operator that the only way she could get Tatem to leave the first time was to pull a gun on him. She described Tatem as being extremely angry when he finally left her business and he continued to yell, “Ya’ll better leave here,” on his way out.

    “Ms. Shoe called 911 as soon as she and her boyfriend got Tatem to leave their property. Approximately one and a half minutes into the 911 call Ms. Shoe tells the operator, “He’s outside again.” … “He’s out there screaming.” … “If he comes in, I’m shooting him.” During her police interview, Ms. Shoe stated that when Tatem returned with several others, she was in the right hand side of her business behind the plate glass window with her two small grandchildren. She indicated that Tatem came to that window and was banging on the window screaming, that he was going to bust the window out. At the time Ms. Shoe stated that she saw what looked like a gray metal object in Tatem’s hand.

    “According to Ms. Shoe’s boyfriend, Christopher Gray, when Tatem returned he was screaming “You better move M***** F*****, you’re dead.” He described Tatem as furious, and he noticed at least two other men with him. Mr. Gray stated that he went to lock the front door. When he got to the door he said he opened it part way to tell them to go and let Tatem know there were kids inside the business. Mr. Gray said that Tatem yelled to him, “I’m the General from Virginia, you don’t know who you just f***** with. I make one phone call and I’ll have an army down here.”

    “Mr. Gray stated that Tatem then grabbed him and shoved him against the wall inside the business and was hitting him in the face and head. He said that Tatem grabbed his shirt and pushed him down against the wall. He then said that Tatem started pulling him towards the door to go to the back where Sarah and the children were. Ms. Shoe stated that when Tatem had Chris pinned against the wall she went and got the gun again. She returned with the gun and was standing behind the open window area of the partial wall that divided the front area of the business. She said she pointed the gun at Tatem so he would stop assaulting Mr. Gray. Ms. Shoe said that Tatem was saying over and over again to shoot him. She told police that when he starting coming towards her, she had her two small grandchildren by her side and she fired the gun at him to protect them and Chris.

    “During the police interview of Mr. Gray, he stated, “When he grabbed me and pushed me into the shop and started hitting me, and I realized there were more people out there, I think she truly saved my life.” Ms. Shoe stated to the 911 operator while all this was happening, “He was attacking my boyfriend, I didn’t have a choice.” Amongst the noise that can be heard on the 911 call, Ms. Shoe’s grandchildren can be heard crying throughout this traumatic event.

    “Ms. Shoe fired the gun one time, and Mr. Tatem died as a result of the gunshot wound he sustained inside Ms. Shoe’s business. Tatem’s members of the Yahshua Movement rented space near Sarah’s Pet Spa.

    “The Concord Police Department did a thorough and complete investigation into the facts and circumstances surrounding this incident.

    “After meeting with officers who investigated this case, and reviewing the facts, statements of all witnesses, a 911 call made by Ms. Shoe, crime scene photos, physical evidence, and the law as it relates to the “Castle Doctrine” and self-defense, the Cabarrus County District Attorney’s Office will not be pursuing criminal charges against Sarah Shoe for the incident that occurred inside her business on November 30, 2017.

    “It is important to note that any case of this nature is analyzed by the facts that are specific to that case, and the law that may apply to the facts of that specific case. No two cases are exactly alike, and the District Attorney’s Office will exercise due diligence to review and evaluate the unique facts of each individual case and apply the law to that case’s specific facts.

    Garden City mom wields gun to scare off intruder

    GARDEN CITY -- A suspected prowler is in custody after police say he entered a woman's home in Garden City Friday morning.

    Sage Zumr, 18, is facing charges of unlawful entry, trespassing and resisting and obstructing officers.

    Police say Zumr got into the home, located on the 200 block of East 47th Street, at about 9 a.m. The resident was inside with her young son at the time.

    The woman confronted Zumr with a gun, and he ran away, police say. She called 911, and was able to provide officers with a description of the intruder.

    Officers searched the area and found Zumr as he was trying to ge into a different house nearby, police say. According to police, the suspect refused to listen to the officers' commands, and had to be forcibly taken into custody.

    Neither Zumr nor the officers was hurt in the arrest.

    Garden City Police Chief Rick Allen praised the homeowner and his officers.

    "Anytime someone unlawfully enters a residence while the homeowners are home, especially when children are present, the event is extremely scary and the results can be tragic. Everyone has a reasonable expectation to be safe in the confines of their own home and most will take extraordinary measures to protect their family," he said. "Luckily no one was injured in this particular case.

    This is a great example of the police, dispatch, and the community working together in order to safely solve a problem. The homeowner did an excellent job of quickly providing dispatch with relevant information and dispatch quickly relaying that information, allowing our officers to rapidly deploy and apprehend the suspect who was attempting to flee. This was a dynamic situation that could have been very dangerous; however, we were able to mitigate the danger by working together, communicating effectively and deploying expeditiously."

    It's unclear why Zumr was attempting to get into the homes. He has been booked into the Ada County Jail.

    Police: Lexington homeowner shoots woman in self-defense

    LEXINGTON, Ky. (WKYT) - A woman was shot Saturday morning, after police say she tried to force herself into a stranger's home.

    Police say it happened around 4:45 a.m. at a home on Talisman Road, in a quiet neighborhood off Lane Allen Road.

    Officials say a woman in her 40s was home alone when a woman in her 20s came banging on her door, eventually breaking through a window.

    Police say the homeowner fired a shot at the intruder.

    The woman was taken to UK Hospital with injuries that were not life-threatening, and will likely be charged with breaking and entering.

    Police believe the home was randomly targeted.

    Businessman shoots robber
    BELIZE CITY, Thurs. Dec. 14, 2017–Three robbers would have probably made a clean getaway if their victim, Dorian Usher, 36, did not open fire, injuring one of them.

    Sometime around 2 p.m. today, Usher was about to exit his family business, Monica’s Pawn Shop, situated at the corner of Cemetery Road and Elston Kerr Street, when a van pulled up and three men exited, one of them armed with a hand gun. The robbers relieved Usher of his gold chain, and were attempting to rob him of more jewelry, when he pulled out his licensed firearm and fired several shots, one of which hit one of the robbers in his hand.

    That robber was then detained and handed over to cops, who transported him to the Karl Heusner Memorial Hospital (KHMH) for treatment. The wounded man’s accomplices escaped in the waiting van with the gold chain.

    Amandala understands that the suspect, an associate of the South Side Gang (SSG), will face charges tomorrow, Friday.

    Columbus police have completed their investigation and are not pursuing criminal charges against a former Bartholomew County sheriff and Columbus City councilman who said he was forced to shoot a dog attacking his pet.

    Kenny Whipker was walking his pet beagle, Tina, on a leash at 2:15 p.m. Dec. 4 in a residential area near Ninth and Lafayette streets when Whipker said he heard growling and saw a German shepherd mix go after the beagle.

    “I tried to get in between them, but the dog latched onto my dog and bit her, and then bit her again,” said Whipker, who served as county sheriff from 1999 to 2006 and as a city councilman from 2013 to 2015.

    Whipker is a certified public safety officer in Indiana and works for the Indiana Department of Correction, carrying a 9mm handgun as part of his work, he said.

    The owner of the dog, Betty Broughton, contended Whipker shot the 1-year-old shepherd mix named Axel at point blank range as she held the dog by his chest harness and collar after telling her he was going to do it.

    A Columbus city ordinance prohibits people other than public safety officers or soldiers from firing a gun within the city limits, but the ordinance does allow a gun owner to use it for self defense. The ordinance carries a fine of $150 for a violation, with fines increasing for repeat violations.
