    The family of the boy shot in the face by a homeowner on Buffalo's East Side isn't calling for charges against the shooter.

    The boy – who is celebrating his 13th birthday today – lost his right eye, has shotgun pellets embedded in his brain and has a collapsed lung after he was hit by a shotgun blast in the face and chest outside a home on Quincy Street just before noon Friday.

    Family members haven't been able to hear the boy's side of the story yet, since he's heavily sedated and lying in Oishei Children's Hospital hooked up to a feeding tube and a machine that's breathing for him. But they admit he was doing something he shouldn't have been doing when he was shot.

    The boy's family isn't sure whether the boy and his friend intended to burglarize 61-year-old Edward Bald's home, or whether they were vandalizing it, said Tearra Perry, the boy's aunt.

    But either way, they were doing something to the man's property, she said.

    "Everyone's a victim here," she said. "This man had a right to protect his property and his home."

    Bald said a rock was thrown through a first-floor bedroom window of his home and that he then fired his .20-gauge shotgun out the window.

    Bald told The Buffalo News on Friday he "sent a warning shot out the hole they already put in the window." He said he didn't know anyone had been hit until he saw blood in his backyard.

    The boy, whose name was withheld by police, crawled from the scene and left a trail of blood that ended three houses away, where a friend found him and called for help, the boy's aunt said.

    He was taken to Erie County Medical Center and was transferred to Children's Hospital late Friday night. The boy has undergone more than 10 hours of surgery, but further procedures are on hold because of potential complications and risks. One of the pellets is lodged in his carotid artery. He has a blood clot, his esophagus was damaged, and he has a swelling on the brain, Perry said.

    "It splattered through his face and lungs," she said of the gunshot.

    Buffalo police did not provide details about the boy's injuries except to say they were non-life-threatening.

    Bald told The News he called police to report the shooting and what he described as an attempted break-in.

    Police interviewed Bald at the scene but did not arrest him.

    Buffalo police spokesman Michael J. DeGeorge declined to say Friday if anyone — Bald or the injured boy — would be charged. DeGeorge could not be reached Monday morning.

    The boy's family doesn't want to focus on the legality of the shooting at this point, but they are asking for prayers from the community, Perry said. She said the family is praying for any heartaches caused by wrongdoing of their boy and apologize for his actions.

    Perry also said the family is praying that Bald can forgive her nephew, who is expected to spend at least the next month in the hospital.

    "We just want prayers," she said. "We believe that there's power in prayer."

    Buffalo police have interviewed another youth who may have been involved, Perry said. Authorities have not said whether they expect to file any charges against Bald or the youth.

    Bald reported to police in July 2015 that someone opened a bathroom window at his home after cutting a screen and popping it out of the jamb, according to a police report. Bald also reported in December 2004 someone tried breaking into his home by breaking a window, according to another police report.

    There have been three homicides this year within three blocks of the home on Quincy, off Broadway, where the boy was shot. A 43-year-old man was fatally shot Feb. 19 at Ashley and Krupp streets; the body of a 23-year-old man was found fatally shot May 20 at Quincy and Ashley streets; and a 22-year-old man was killed July 18 on Deshler Street.

    A Winston County hunter was able to help investigators find a suspect in a Moulton theft case by holding him at gunpoint until authorities arrived.

    An Elkmont man is facing a theft charge in Lawrence County after a Winston County hunter recognized the man sleeping in a vehicle that was reportedly stolen.

    Moulton police say the suspect, Steven Lewter, stole someone's truck at a Murphy USA Friday night after being stranded by another person at Walmart. The man took the truck and traveled south on Alabama Highway 157.

    Early Saturday morning, police say a hunter in Winston County spotted the truck with the suspect inside the vehicle. Investigators say the hunter knew the man and recognized the truck. This is when the hunter held Lewter at gunpoint and notified Winston County authorities of the situation.

    Lewter was booked in the Lawrence County Jail on a theft of property charge, and he was also being held for a possible parole violation as of Saturday.

    Police thanked the hunter for his role in catching the suspect.

    Eros burglary

    According to an arrest affidavit for Tommy Foster Jr., 40, Plum Hill Road, deputies were dispatched to a home on a Plum Hill Road in reference to a burglary in progress Friday.

    The caller said Foster forced entry into her home and was in her living room being held at gunpoint. Before deputies arrived, Foster fled the scene in a black Ford truck.

    Deputies reported meeting the truck at the end of Plum Hill Road and stopped it. Foster was in the front passenger seat but refused commands to exit the vehicle. He was subsequently removed and placed in restraints.

    The victim told officers she was sleeping in the back room at her home and heard a loud bang. She said she grabbed her rifle, walked into the living room and saw Foster walking into the kitchen.

    Per the report, Foster said, "They are going to kill me."

    The victim pointed her gun at Foster and attempted to detain him until deputies arrived, but Foster fled through the door he used to enter the home.

    The affidavit states Foster admitted to being under the influence of bath salts. Ambulance service was requested and Foster was cleared by the technicians before being taken into custody.

    As officers attempted to place Foster in the patrol unit, he began kicking two deputies in the chest and legs. It took six deputies to force him back in the unit.

    Foster was booked into Ouachita Correctional Center on charges of simple burglary, resisting an officer and battery of a police officer.

    West Monroe burglary

    The second incident occurred in West Monroe on Saturday.

    Deputies were dispatched to Oliece Drive on a burglary complaint. When they arrived the suspect, later identified as Drake King, 38, Washington Street, was being held at gunpoint by the victim.

    The victim told deputies he heard a noise and found King attempting to pry open the back door of his home.

    King told deputies he was running from people who were trying to get him. He said he went to the back door of the home and found a piece of metal in the yard.

    Per the report, King said he pried the door from the bottom to make the alarm go off, and he was trying to get inside to hide from the people after him.

    King was booked on one count of attempted simple burglary.

    WILMINGTON -- A Marine killed early Sunday on North Front Street was shot to death by a tenant after possibly trying to break into a business, Wilmington Mayor Bill Saffo said Monday.

    Cpl. Edwin Estrada, 27, died after being shot about 6:15 a.m. near the back door of businesses at the corner of Grace and Front streets, according to the Wilmington Police Department.

    “(The victim) was attempting to get into the premise or the business and the gentleman confronted him with a gun and killed him,” Saffo said. “Preliminarily it looks like self defense.”

    New Hanover County dispatch records indicate a gunshot was registered by ShotSpotter at at 6:10 a.m. in the 300 block of Water Street, the road directly behind the location of the shooting.

    The Wilmington Police Department refuses to release any further details.


    Capt. John Roberts, spokesman with Second Marine Aircraft Wing, said Estrada was promoted to corporal in July. He was stationed with Marine Heavy Helicopter Squadron 464, Marine Aircraft Group 29 in New River.

    Estrada, originally from Los Angeles, joined the Marine Corps in 2014.

    On Saturday, the Wilmington Convention Center hosted a Marine Corps Ball. It’s not clear if Estrada attended that event.

    Don’t know if this is an armed citizen worthy story or not. But maybe a good example of why to keep a backup weapon.

    Gunfire, 2 Crashes At Zuma As Homeowner Chases Armed Burglar
    A series of gunshots as a homeowner with a shotgun chases a burglar up the PCH.

    And homeowners on Bush Drive are warned that the burglar has a handgun … and escaped into their neighborhood.

    Ventura County Sheriff's deputies say all this began at about 1:45 this morning … when a homeowner found a burglar at a house up in the Ventura county section of Malibu.

    The homeowner tells Fox 11 news that he went outside with a handgun to confront the burglar.

    But there was a struggle and the burglar ended up with the handgun … firing three shots at the homeowner.

    As the burglar drove off in a pickup truck … the homeowner went inside to get a 12 gauge shotgun … and the chase was on … two pickup trucks and guns blazing.

    East on PCH into Malibu … with the bad guy leaning out the window to fire shots at the pursuing homeowner.

    At the Zuma Beach lifeguard headquarters … the bad guy slammed on the brakes … and the homeowners’s pickup truck was smashed.

    The bad guy kept going … he turned up Busch Drive and crash his pick up into a recreational vehicle parked on the side.

    The burglar then drove off on all-terrain vehicle … which had been in the bed of the pickup truck.

    The burglar … the A T V … and the handgun are all missing.

    The L- A County sheriff sent out a helicopter and there was a big manhunt.

    All of this was reported by Fox 11 … which broke this story.

    So to repeat … a homeowner lost his handgun in a struggle with a burglar … then kept chasing this crook with guns blazing through Malibu … for a property crime.

    The burglar got loose at 2 in the morning … on Busch Drive.

    Ventura County sheriff’s deputies are investigating.

    Sullivan Police are investigating an attempted burglary at Sullivan Bowl, 645 Missouri Avenue, in which the suspect was confronted by the business owner who was armed with a gun, Friday, Nov. 10.
    Sullivan Police were called to the business at 4:17 a.m. when the owner notified law enforcement that a suspect threw a brick through his business window.

    Homeowner shoots intruders, deputies say

    FLORAL CITY (FOX 13) - A homeowner shot two intruders in Floral City, deputies said.

    On Monday, just before 2 p.m., the homeowner woke up from his afternoon nap when he heard at least one person entering his camper, according to Citrus County deputies. A “disturbance” then took place and the homeowner shot two people at the scene -- one inside the camper and another outside.

    Deputies said all parties involved were males and it was an isolated incident. Two subjects were airlifted to Ocala with gunshot wounds. Their identities and extent of injury were not reported.

    While the investigation is ongoing, Citrus County investigators know there was a disagreement between the homeowner and subjects who were shot. It has not been determined whether any charges will be filed, or whether they knew each other.

    Gas station owner pulls gun on suspect

    LAKE COUNTY, Fl. (WOFL FOX 35) - A Lake County gas station manager says he pulled a gun on a man after he caught him with a skimmer at the gas pump.

    The incident happened Saturday afternoon at the business off County Road 48 in Yalaha.
    Jaykumar Patel says he was working behind the counter when a truck pulled up to pump three.
    “I saw the error coming on my register,” Patel explained.

    He says he got suspicious when he saw the error because over the past couple weeks, someone has been messing with the security seals on his pumps.

    Surveillance video shows Patel walking outside. He says he spotted the guy standing with his car door open and the door to the pump open with wires coming out.

    “I figured out that he’s trying to get credit card numbers so I kick on his door. So, he tried to scare me so I went back and I pulled the gun out from my pocket and just pointed it on him,” Patel said.

    He says the suspect started backing up the truck and then peeled out but he still got a license plate number and called 911.

    Lake County deputies say a Howey in the Hills officer stopped the truck about eight miles away. They say 43-year-old Lazaro Castro was arrested for use of a scanning device to defraud.
    Patel says he’ll continue to carry a gun at work and keep an eye out for criminals.

    “I tried to make my message strong. But it now depends on them – what they want to do,” Patel said.

    Investigators say Castro was already on probation out of Orange County for similar charges. A woman was with him at the gas station in Lake County, but she is not facing charges.

    SAO PAULO, Brazil (NBC News) – Security cameras in Brazil captured the moment where a police officer shot and killed two robbers while holding his infant son.

    Sao Paulo State Police Sergeant Rafael Souza is being called a hero in Brazilian media after the November 19 incident.

    Souza was off-duty and at the store with his wife and young son. When he saw the robbery happen, he responded like any police officer would, and intervened.

    According to police, one of the suspects pointed a gun at Souza, so he opened fire, keeping his son close to his side.

    After the shooting, Souza is seen handing his son safely off to his wife.

    Both suspects died at the scene.
