Woman shoots family member after he threatens to “kill family”
    CAPE CORAL
A family argument ended with one person shot in Cape Coral on Wednesday.

At 7:00 p.m., Cape Coral Police responded to a call about a shooting.

On July 18, 2018 at approximately 7 PM, Cape Coral Police responded to a call for service reference to a shooting.

A woman shot one of her family members after a heated argument escalated, according to Cape Coral Police.

The woman said that Tyler Dale, 18, said he was going to kill the family and began to walk toward a room where there was a firearm, police said.

One of the family members described a “well-founded fear” that Dale intended to carry out his threat to kill the family, so she shot him with a 9mm firearm, police said.

The Investigative Services Bureau of the Cape Coral Police Department responded and took over the investigation which is ongoing.

Dale was transported to the hospital, was medically cleared after treatment. He was then transferred to Lee County Jail. Dale was charged with simple assault with intent to do violence.

    State police investigating Aliquippa homicide
    Tom Davidson

    Updated 5 hours ago

The Beaver County Coroner’s Office identified the man killed Wednesday in a double shooting in Aliquippa as 32-year-old Terrell Henson.

Henson died of gunshot wounds to the head and chest and Coroner David Gabauer ruled the death a homicide. State police are investigating instead of Aliquippa’s department, which has placed three officers — including its chief and assistant chief — on leave over the past two months.

Dana Lamar Penny, 36, of Aliquippa, is wanted on homicide and a litany of other charges in connection with Wednesday’s shooting.

State police allege in a criminal complaint that Henson and Penny identified themselves as federal Drug Enforcement Administration agents when they approached a house on the city’s Third Avenue and confronted Briona Hicks, who was smoking on a front porch.

“DEA surveillance, wire tap,” the men told Hicks, according to the complaint.

Hicks told police she had been waiting for a ride-share service to arrive to take her to her boyfriend’s home in Coraopolis when Henson and Penny came onto the porch. She identified Penny, but told police she didn’t know Henson.

The men, both wearing shirts that said “DEA,” forced their way into the house and attempted to handcuff Hicks. As one of the men held a gun to Hicks’ head, she screamed for her mother Margie Gilliam, who had been sleeping upstairs with three children, police said.

When the men tried to drag Hicks out of the house, her brother and next-door neighbor Anthony Farley tried to come in the front door. Henson shot Farley, who returned fire and wounded Henson, police said.

Henson was pronounced dead at the Third Avenue house. Farley is recovering at UPMC Mercy hospital, police said.

Video surveillance of the home confirms that two men entered the house, there was a physical altercation and Penny could be seen with a handgun in his left hand.

Penny remained at large Thursday and faces charges including homicide, burglary, aggravated assault, criminal trespass, unlawful restraint, simple assault and carrying a firearm without a license. He has two previous felony drug convictions that prohibit him from carrying or owning a gun, police said.

    Farley was not charged.

State police ask anyone with information on Penny’s whereabouts to call them at 724-773-7400.

When asked why his department was not handling the investigation, Aliquippa’s acting police Chief Robert Sealock said, “We’re extremely short-handed and (have) limited resources and that’s pretty much it. I’m going to make that policy for now, to involve (state police) in our homicide and other major incidents.”

Aliquippa placed Chief Don Couch on paid leave for unspecified reasons June 6. Assistant Chief Joseph Perciavalle III was named acting chief but suspended two days later after authorities said he sent explicit sexual material in a group message that included the teenage daughter of Sgt. Kenneth Watkins, who was placed on leave following the May 13 murder of 33-year-old Rachael DelTondo. Watkins’ daughter had been with DelTondo minutes before she was killed.

In one of his first orders of business when he became acting chief last month, Sealock recused Aliquippa’s department from the DelTondo investigation but said the department “will be focusing our resources on other investigations and looking out for the safety and welfare of our citizens. Our efforts will be concentrated on moving forward and continuing to be active within the city of Aliquippa.”

Desert Hot Springs teen found injured in Yucaipa was shot during burglary, officials say

Homicides were reported across the Coachella Valley in 2017. Desert Hot Springs had the most killings and it was followed by Palm Springs. Colin Atagi/The Desert Sun

A Desert Hot Springs teenager, found this past weekend behind a Yucaipa convenience store suffering from a gunshot wound, is believed to have been shot while trying to burglarize a home, investigators said Thursday.

The shooter is a 69-year-old homeowner, according to the San Bernardino County Sheriff's Department, which added that the man reported the attempted burglary about 30 minutes after the shooting occurred.

Authorities said the homeowner, whose name has not been released, did not tell them he had shot someone. Further investigation will determine if the homeowner will face any charges, officials added.

The latest details were released days after investigators first announced someone had left the injured 16-year-old behind a 7-Eleven at Yucaipa Boulevard and 14th Street Saturday night.

According to the sheriff's department, the teenager and two other male suspects were trying to enter a home in the 33-000 block of Wallace Way through a backyard window when the homeowner confronted them.

The homeowner, who was armed with a handgun, opened fire as the trio fled, officials said, adding that the teen was hit in the abdomen.

Paramedics rushed him to Loma Linda University Medical Center, where he underwent surgery. He remained hospitalized Thursday, in stable condition.

The teen's name has not been released.

Investigators are still looking for two males and a female who are believed to have left the teenager behind the store before they fled.

They drove a Ford Mustang GT that was later found at an unspecified location in Indio.

Sheriff's officials say evidence related to the attempted burglary was found inside the car, but they didn't clarify how they found the car or if it was abandoned.

The Wallace Way home was searched on Tuesday and investigators found evidence that confirmed a gun had been fired.

The case will be presented to the San Bernardino County District Attorney's Office once the investigation is complete.

Police: Woman fatally shoots husband in backyard of east valley residence
    LAS VEGAS (KSNV) —

The Las Vegas Metropolitan Police Department is investigating a deadly shooting near East Harmon Avenue and Sandhill Road, where it appears the victim of domestic violence shot and killed her husband.

Police say were called to the house at least once before and the woman had a restraining order against her husband, although it is unclear whether it was active.

Police said the woman called 911 to report the shooting. She said her husband was in the shed. He called her out to the shed and threatened her with a gun and she shot him.

    He died at Sunrise Hospital.

It is unclear why he was on the property but police say they are investigating this homicide as self-defense.

“Any time a person is threatened or if they are threatened with a firearm, that person does have the right to defend themselves,” said Lt. Ray Spencer.

The woman’s neighbors said they didn’t even know she was married.

“I have only ever met the woman. I have never seen the guy,” said Tarah Leeland. She also said she was not surprised she did not know what was going on inside the home.

“It is kind of a more private issue. Something that is not really discussed or talked about, unfortunately," she said.

That is exactly why Safe Nest said it has a pilot program underway where advocates go to domestic calls with officers.

Amber Batchelor, the Vice President of Advocacy and Prevention Services with Safe Nest said, “It is an earlier intervention, right. We are getting it further upstream.”

She said each domestic violence case is different and therefore safety plans have to be well-thought out because protective orders do not always work.

“There are some characteristics of abusers that you sort of know, they are probably going to violate that order," said Bathchelor.

Those safety plans can be created with a trained advocate at S

Hernando sheriff: Two dead after three shootings in Hudson, Spring Hill
    Public safety
    Updated: July 19, 2018 at 07:27 PM
SPRING HILL — A string of shootings in Pasco and Hernando counties Thursday left two people dead, including the suspected shooter, and another person seriously injured, authorities said.

Theodore Parker, 41, shot at a woman at her home on Chestnut Drive in Hudson at about 2:38 p.m., Pasco County sheriff’s officials said. The woman sustained a bullet graze wound on her neck, Pasco sheriff’s officials said, and called 911. The woman, whose identity was not released, was expected to survive, Pasco officials said.

About five minutes later, the same person who terrorized Chestnut Drive arrived at a home on Olson Road in Spring Hill, where he shot and killed one person, Hernando Sheriff Al Nienhuis said in a video posted to the agency’s Facebook account. Detectives did not release the identity of the shooting victim.

Investigators believe the shooter knew the people at both locations, and neither of the first two shootings was random.

    The violence didn’t stop there.

Hernando deputies believe the same person from the two earlier incidents went minutes later to a nearby smoke shop, which Nienhuis did not name but described as being near the Pizza Hut at 2903 Commercial Way. Deputies believe he tried to rob the store.

The man shot the owner, who had his own gun and returned fire, hitting the intruder, Nienhuis said. The store owner, whose name deputies withheld, was taken to a hospital with significant injuries but had been talking with deputies. His condition was unknown Thursday night.

"We believe it was totally self defense," Neinhuis said.

The would-be robber left the store after being shot and collapsed in the parking lot outside the store owner’s car. He was pronounced dead at a hospital.

Investigators did not know if the suspect had been a customer of the smoke shop, but they do not think he knew the owner. They were still working to determine what fueled the rampage.

"It was a pretty harrowing 15 or 20 minutes," Nienhuis said.

BBQ food truck operator catches Jacksonville man accused of stealing, eating food for months

A food truck operator said a crook broke in and ate her food for two months straight.

“He loved to eat, ribs, chicken, he was eating very good,” Jovette Williams said.

Issac Palmer, 24, might be smiling now, but he could be enjoying jail cuisine for a while.

“That’s what’s so frustrating about this to see him smiling about it. You’re not my child,” she said.

Williams said Palmer was breaking into her food truck, Smoke in the City BBQ, off University Boulevard every night they were open, Wednesday through Sunday, for two months.

He would leave us his trays. He would fix a food tray and would leave it in the trash can for us to find the next day,” Williams said.

She said she lost about a $100 a week.

“It’s like he was using this as his own private restaurant and hotel,” she said.

Williams said she tried to catch the thief a couple of times, but couldn’t, until late Wednesday night. She and her husband spotted the man crawling out from the back door. Williams said she then pulled out her gun and yelled for the man to get on the ground.

“Get on the ground, get on the ground, stop what you’re doing, spread eagle,” Williams said.

She held him there until police got there. Williams said she and her husband are giving people, but not to crooks.

“It’s my stuff that I worked hard for that I have to replace,” she said.

And she hopes he enjoys his new dinner menu.

“I’m hoping they do him justice so he will get nice and fat in jail,” Williams said.

No charges will be filed against shooter in fatal May incident
    Friday, July 20th 2018, 4:48 pm EDT
    WILMINGTON, NC (WECT) -
No charges will be filed against the person who fatally shot a Wilmington man in May.

According to a news release from the District Attorney's Office, the shooter acted in self-defense when he fired a shot at Fuquan Wright in the 1000 block of Martin Street. Wright later died from the gunshot wound.

"The Wilmington Police Department and my office have worked hand-in-hand throughout the investigation into the shooting of Mr. Wright," District Attorney Ben David said in the news release. "After reviewing all of the evidence and the applicable law, I have determined that the shooting of Mr. Wright was done in self-defense and was legally justified.

"Therefore, no charges will be filed against the shooter of Mr. Wright."

On May 28 around 2:30 p.m., a man called 911 saying he had been tased and fired his gun at the attacker.

Once on the scene, WPD officers interviewed the shooter, who said William Earl Baker III came to his house earlier in the day to buy a small amount of marijuana from the shooter.

Baker and Wright came back to the shooter's home, which the shooter found strange. Before opening the door, the shooter grabbed his pistol and after the shooter and Wright engaged in a brief conversation during which Wright asked for the shooter's phone number, Wright lunged forward and tased the shooter in the chest.

The shooter fired a shot at Wright, shattering a glass door, and Wright and Baker fled the scene.

During their investigation at the scene, WPD officers found a shell casing discharged from the shooter's gun and confirmed an injury consistent with a Taser on the shooter's upper chest.

Wright was brought to New Hanover Regional Medical Center at 2:33 p.m. by Demonta Mosely and Quoron Kea, who were both interviewed at the hospital and denied any knowledge of how Wright got shot or the circumstances surrounding the shooting. Wright was pronounced dead at 2:48 p.m.

Officers identified a single gunshot wound on the left side of Wright's chest and found pieces of glass on Wright's neck and clothing.

"North Carolina law gives the right for one person to take another’s life under the law of self-defense in two circumstances: when a person reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself/herself or another; or, under the circumstances found in the Defense of Habitation Law, codified under N.C. General Statute 14-51.2 et. seq.," the news release reads.

It went on to state a homeowner need not guess the intention of the intruder and that the law provides that a "person who unlawfully and by force enters or attempts to enter a person’s home, motor vehicle, or workplace is presumed to be doing so with the intent to commit an unlawful act involving force or violence.”

Police release video of pawn shop clerk fatally shooting robber

Editor's note: The video contains graphic content that some may find disturbing. Viewer discretion is advised.

BOUNTIFUL — Newly released surveillance video shows how a quick-acting Bountiful pawn shop clerk managed to fatally shoot one of two would-be robbers in a confrontation that lasted only 38 seconds.

In the video released Friday by Bountiful police, a man appears in dark clothing at the threshold, pointing a gun at the clerk, who had been wheeling a small bicycle toward the shop door at Bountiful Pawn, 135 S. 500 West, on May 4.

The footage shows a second man enter with a black bag and a hammer, walking to another part of the store. As the first man with a gun turns to try to close the front door, the clerk appears to take advantage of the distraction and quickly retreats to a side room. Police have said the clerk, whose name has not been released, had just been ordered at gunpoint to lie on the ground but instead ran to the side room, immediately pulled out his own concealed gun and turned to face the robber who followed him to the room

In the video, the clerk raises his own gun and appears to fire before the two struggle on the floor at the back of the room. The clerk frees himself from the robber and leaves the side room, his right hand covered in what appears to be blood. The second man with the bag is seen running from the store just moments before the clerk left the side room.

Bountiful Police Lt. Dave Edwards said the clerk only had a 1- or 2-second window to decide whether to pull the trigger.

"The suspect could have left. He could have left the store then, but instead he continued to pursue (the clerk), and immediately as he comes around the corner again, points the gun again. The clerk defends himself," Edwards said.

    Related:

"The suspect continues after the shots have been fired and attacks the store clerk," the lieutenant added.

The suspect, identified as Kleydys Arbolaez-Hernandez, 40, of Denver, continued to try and strangle the clerk as he bled and eventually died from the gunshot wound, Edwards said.

The video released Friday on YouTube has been edited to blur the face of the shop clerk and has no sound. The two other men's faces were covered with clothing and hats.

"Clearly, the clerk trained and prepared for this day," Edwards said. "In speaking with the clerk, I know that he's deeply saddened that this had to occur."

The other alleged robber, Alexander Cutino Sanchez, 31, of Houston, was indicted by a federal grand jury in June on 11 counts of robbery and 11 counts of using a firearm during a violent crime for what prosecutors said was a string of aggravated robberies throughout Utah from January to May, in addition to the Bountiful incident.

Sanchez also has been named as a suspect in several robberies in Oklahoma, Colorado and Texas. He was arrested in Texas on May 31 after fleeing Utah following the pawn shop shooting.
