Three armed Cleveland home invasion suspects shot during shootout in home, police say

CLEVELAND, Ohio -- Three home invasion suspects stormed into one of their ex-boyfriends home and all three ended with injuries from gunshot wounds, according to Cleveland police.

The women -- ages 32, 50 and 28 -- forced their way into the home with an assortment of different weapons, police said.

All three were arrested, but no formal charges have been filed in the case. A fourth person with them has not been identified, police said.

A 32-year-old man and 33-year-old woman inside the home were not hurt, police said.

The home invasion happened about 8 p.m. at a home in the 11500 block of Harvey Avenue, near East 114th Street in the city's Buckeye-Woodhill neighborhood.

The three women, all relatives, broke into the home and fired shots at the couple inside. At least one of the two residents fired back, police said. Investigators are still trying to determine exactly who fired shots during the shootout.

Police arrived and found all three women still at the house. One of the woman was in the front yard with a gunshot wound to the stomach, according to police. The other two women were inside the home.

The 32-year-old woman who was shot is the ex-girlfriend of the 32-year-old resident of the home, police said.

Prosecutor: Springfield homeowner 'absolutely within his rights' to shoot intruder

SPRINGFIELD -- A prosecutor on Thursday in Hampden Superior Court said Springfield resident Sean McCarthy was "absolutely within his rights as a homeowner" when he shot and injured Jordan Eady on Feb. 7, 2015.

McCarthy was not charged with any crime, as police said the shooting was justified. McCarthy is a licensed gun owner.

Eady, 26, who was shot in the torso and arm by McCarthy, and his brother, Jovan Eady, 24, are on trial. The Eady brothers live in East Longmeadow with their father. Jordan Eady was treated and released after the shooting.

Lawyers for the Eady brothers, in closing arguments in the jury-waived trial in front of Judge Tina S. Page, said McCarthy was panicked and shot Jordan Eady through a glass storm door. They contend no one was trying to break into McCarthy's home.

Both Anthony C. Bonavita, lawyer for Jordan Eady, and Joe A. Smith III, lawyer for Jovan Eady, argued McCarthy staged the scene to make it look like Jordan Eady broke down the Forest Park home's door and got inside.

Smith said the Eady brothers' car was stuck in the snow and they were looking for help.

Jordan Eady, 26, and his brother Jovan Eady, 24, both of East Longmeadow, are charged with unarmed burglary and other counts for a Feb. 7, 2015, incident in Springfield.

Both Eady brothers are on trial for four charges: unarmed burglary and assault, malicious damage of property over $250, wanton destruction of property over $250 and threatening to commit a crime.

Page dismissed two charges against Jovan Eady -- threat to commit a crime and malicious damage to property -- because there was not enough evidence presented by the prosecution.

Page took the case under advisement and said lawyers will be contacted when she has a decision. She said there are a lot of photos in evidence and she needs to look at them very carefully.

Assistant District Attorney Robert A. Schmidt said "Mr. McCarthy didn't create the situation." He said there would not have been time to stage any scene as the defense suggested.

Schmidt said McCarthy acted "as calmly and intelligently as he could" while fearing for his own life and the life of his 3-year-old daughter.

"This isn't someone who's going to -- oops -- shoot someone through a door," Schmidt said.

He said Jordan Eady kicked in the main door, came into the house and assaulted McCarthy. McCarthy testified Jordan Eady lunged at him. McCarthy testified Jordan Eady ran through the glass storm door to get out after McCarthy shot him.

Evidence introduced at the trial showed Jordan Eady's blood was at a spot about three feet inside the house. Schmidt said that proves Jordan Eady broke in the home.

The defense lawyers said the blood was there because Jordan Eady fell through the glass storm door after being shot through that door while he was outside.

McCarthy testified he heard one of the brothers threaten to "light it up." He said he didn't know what that meant but figured it wasn't good.

The defense lawyers said McCarthy did not include that threat in his initial police statement. They said he made up that statement in a further effort to justify his shooting of Jordan Eady.

Report: Man shot by homeowner had JUST been pulled over by deputies

A man walking home after a traffic stop was shot in the chest and arm Sunday evening. An incident report released by the Charleston County Sheriff's Office portrays him as more of a suspect than a victim.

The report states 24-year-old Herbert Palmer Jr. was pulled over on Highway 78 near the fairgrounds, after traveling at a high rate of speed and nearly crashing into the back of another vehicle. Deputies say Palmer was uncooperative with the traffic stop, provided his ID, but refused to provide insurance and registration documentation.

Deputies say Palmer was told to walk home by his mother, who came to the scene and took possession of the Infinity SUV registered in her name.

Moments later, officers were dispatched to 4400 Elderwood Drive, about two blocks from the initial stop, where they were told Palmer was shot. According to the report, Palmer was taken to a local hospital by someone after breaking a window at a home.

A 68-year-old woman told deputies she shot Palmer because he came into her yard, broke her window and attempted to force his way into her house. The woman had not been charged as of Tuesday morning. Officials also have not indicated if charges are sought against her.

It's currently unknown what charges Palmer may face. Deputies say he's still receiving treatment at the hospital.
Jail records show Palmer's been arrested at least 10 times in Charleston County. Among charges are drug possession, drug distribution, forgery and illegal betting.

A day after the shooting in the Ladson neighborhood, those living in the community were visibly shaken and said they were fed up.
"I'm sick of it, and something needs to be done," said Buster Weeks.

According to a crime map used by the Charleston County Sheriff's Office, in the last year, the area within a half mile of Elderwood Drive has been victim to about 60 reported crimes. Among those, a shooting in December 2016 and 16 cases of motor vehicle theft.

Guilty plea entered in armed robbery case

A Kaufman County man has pleaded guilty in connection with an armed robbery in February during which shots were fired.

Shon Paul Armstrong is the second suspect indicted in the case to plead guilty.

Armstrong, 20, of Terrell, was one of three individuals indicted in April by the Hunt County grand jury on charges of aggravated assault with a deadly weapon. Armstrong pleaded guilty to the charge Tuesday during a hearing in the 196th District Court. Under a plea bargain arrangement, Armstrong was placed on 10 years of deferred adjudication probation.

Deferred adjudication probation carries no finding of guilt, although those defendants who are found to have violated a deferred probation are subject to being sentenced to the maximum punishment.

Aggravated robbery is a first degree felony, punishable upon conviction by a maximum sentence of from five to 99 years in prison and an optional fine of up to $10,000.

Michael James Bell, 18, pleaded guilty to the same charge Aug. 18 and was sentenced to 10 years in prison.

A third suspect, Christopher Truman Wilson of Terrell, has a hearing scheduled Sept. 27.

The Hunt County Sheriff’s Office reported that at approximately 3:40 a.m. Feb. 8, a call of a burglary in progress was received in the 10500 block of County Road 2466, known as the Grande Verde area in the southwestern part of the county, during which gun shots had been exchanged between the homeowner and possible suspects.

Upon arrival, deputies located Bell lying face down in a ditch close to where the call was reported, wearing a brown colored ski mask. Bell had no visible injuries and claimed no injuries.

The homeowner reported she has awakened to find unknown subjects burglarizing her vehicle, retrieved a firearm, then yelled for the subjects to stop, before firing at least one round in the direction of the suspects. The homeowner reported that one of the subjects had returned fire as they fled the area.

FATAL SHOOTING OF SUSPECTED HOME INTRUDER NEAR DOWNEY

DOWNEY — A suspected intruder was fatally shot by a resident early Friday morning in rural Bannock County, authorities said.

The Bannock County Sheriff’s Office reports the shooting occurred during what appears to be a home invasion at a residence on Idaho Highway 40 just west of Downey.

A man was reportedly forcing his way through the door of the residence around 4:30 a.m. Friday when the man living in the house opened fire, the Sheriff’s Office said. The suspected intruder was struck by the gunfire and died at the scene — prior to the arrival of responding sheriff’s deputies.

The Sheriff’s Office is not yet commenting on whether the intruder was armed.

The names of the intruder and the home’s occupant have not yet been released.

The Sheriff’s Office confirmed the intruder was from southeast Idaho. His next of kin have not yet been tracked down.

As of Friday afternoon Sheriff’s Office detectives were still at the residence investigating the incident.

Authorities said it’s too early to say whether the man who resides at the house will face any charges for killing the suspected intruder. Typically in Idaho residents who use a firearm to defend themselves in their homes from intruders are not criminally prosecuted.

The Sheriff’s Office did want to make it clear that “there is no evidence indicating any further threat” to public safety as a result of the apparent home invasion.

Springfield judge acquits brothers of burglary and assault in case where homeowner shot one of them

Posted on September 8, 2017 at 1:00 PM

SPRINGFIELD - A Hampden Superior Court judge on Friday found two brothers not guilty of unarmed burglary and assault in a case where one of the brothers was shot by a homeowner.

Judge Tina S. Page found Jordan Eady, 27 - who was shot in the torso and arm by homeowner Sean McCarthy, and his brother - Jovan Eady, 24, not guilty of that crime after a jury waived trial.

The brothers are from East Longmeadow.

Page found Jordan Eady guilty of wanton destruction of property over $250, the only charge with a guilty finding. That charge referred to the door on McCarthy's home.

She acquitted him of malicious damage of property and threat to commit a crime.

Page found Jovan Eady not guilty of wanton destruction of property over $250.

Prosecutor says homeowner was justified in shooting intruders
Jordan Eady, 26, and Jovan Eady, 24, of East Longmeadow, are charged with unarmed burglary and other counts for an incident on Feb. 7, 2015, in Springfield.

She sentenced Jordan Eady to two years probation. Conditions of probation are to stay away from Sean McCarthy and his Webber Street home in Springfield, remain drug and alcohol free, and attend three Alcoholics Anonymous meetings per week for the first six months of probation.

He must pay $500 in restitution immediately.

Assistant District Attorney Robert Schmidt asked Page to sentence Jordan Eady to two and one half years in jail with 18 months to be served and the rest suspended with probation.

Schmidt had said in closing arguments McCarthy was "absolutely within his rights as a homeowner" when he shot and injured Jordan Eady on Feb. 7, 2015. He said Jordan Eady broke into McCarthy's house and assaulted him.

McCarthy was not charged with any crime, as police said the shooting was justified. McCarthy is a licensed gun owner.

Lawyers for the Eady brothers said McCarthy was panicked and shot Jordan Eady through a glass storm door.

They said the Eady brothers' car was stuck in the snow and they were looking for help.

McCarthy, in a victim impact statement to Page, said he and his family are still coping with the after effects of the incident. He said he was home with his 3-year-old daughter at the time and she is still coping with the fear she experienced.

"Having to pull that trigger that night was the last thing I wanted to do," he said.

"We did nothing, your honor," McCarthy said. "We were home sleeping."

Page said, "I had to struggle with this case."

She said she had to follow the law and what the evidence supported.

Page told McCarthy her findings aren't meant to diminish his fears during the "awful, awful incident."

She said the defendants created the situation which never should have happened.

Bonavita said Jordan Eady is sorry it happened. He said Jordan Eady's record contains an operating under the influence conviction in 2011 and misuse of a credit card which was continued without a finding.

Page said to Jordan Eady she was going to use a word she doesn't like to use - stupid.

She said it appears when he gets into trouble he is high or drunk. She said while he is on probation she prefers he does community service - which she said he needs - in lieu of paying the $65 monthly probation fee.
