Security guard at Dallas Apple store kills armed robber wearing body armor
The shooting occurred around 2:30 a.m. at the Apple store in the 3100 block of Knox Street.

A retired Dallas police officer working security shot and killed an armed man in body armor who was trying to rob an Apple store Tuesday morning, police said.

The shooting occurred around 2:30 a.m. at the Apple store in the 3100 block of Knox Street. According to police, a man armed with an assault rifle tried to break into the rear of the building and then tried to disarm the security guard.

The guard fired multiple times and hit the suspect, who ran a short distance away before collapsing, police said.

The man died later at a hospital. His name has not yet been released.

The Apple store didn't open Tuesday and will remain closed until at least Wednesday.

Vanessa Cantu had hoped to buy some AirPods but was turned away by a sign on the door.

"That's scary, and crazy," said the 35-year-old Realtor, noting how safe the neighborhood usually is. "So that makes it even scarier."

Matt Bardwell, a mural artist who waits tables at the nearby Chuy's on McKinney Avenue, said the bloody break-in was out of character for the Knox-Henderson area.

"Serious crimes like that don't usually happen in this neighborhood," the 43-year-old said. "Every once in a while, though."

Apple released a written statement Tuesday afternoon saying the fatal shooting was a "tragedy."

"We are grateful that no one else was involved," the company said. "We are committed to providing a secure environment for all who enter our stores."

Uber driver who fatally shot drunken passenger not guilty

The Uber driver who fatally shot a drunken, unruly passenger was found not guilty of murder by a Colorado jury on Thursday.

Michael Hancock, 31, picked up Hyun Kim, 45, outside a karaoke bar in June 2018. Hancock said that during the ride, Kim made unwanted sexual advances and attacked him when he threatened to pull over -- the crux of a self-defense defense.

When Hancock arrived at Kim’s destination two miles away, surveillance video showed Kim-- who had a blood alcohol content level of .308 when the autopsy was performed -- did not get out of the car.

Uber records showed that by the time Hancock shot Kim, the car had traveled about 70 miles from the spot Kim was picked up.

Defense lawyers said Hancock demanded that Kim enter another address into the Uber app. They said Kim touched Hancock more than once on the leg and became aggressive. Kim punched the driver in the face and reached for the steering wheel and ignition. Prosecutors said Hancock stopped the car, went to the front passenger side where Kim was sitting, and fired 10 bullets from his semi-automatic handgun. At least five struck Kim.

A witness called 911 and Hancock’s defense said Hancock got on the phone, told dispatchers he had been attacked and asked first responders to hurry so Kim might live, according to KMGH-TV.

Defense lawyer Johnna Stuart said Hancock tried to jump out of his still-rolling car, but Kim attempted to pull him back by his dreadlocks, prompting Hancock to grab the gun.

Prosecutors said it was possible Kim did not get out at his destination because he was passed out and Hancock drove around to increase the fare. They acknowledged that Kim likely provoked a fight in the car, but said he could have woken up startled and upset about being driven around in the car. Hancock did have an injury above his eyebrow after the killing, but prosecutors said it was not serious enough for him to have reasonably feared for his life.

Uber records showed no previous altercations for either man.

Deputy District Attorney Brenna Zortman said she believed Hancock was sorry for shooting Kim but said the killing was deliberate. “Regret does not negate intent," she said.

As the not-guilty verdict was read, Hancock’s family hugged, sobbed and cheered. The attorney who represents Kim's kin said they plan to file a wrongful-death lawsuit against Uber.

Two named, third wanted in fatal Yeadon robbery attempt
    By Kevin Tustin ktustin@21st-centurymedia.comOct 8, 2019
YEADON — Yeadon police have issued arrest warrants against two Philadelphia residents for a robbery attempt that left one of the would-be robbers dead.

Police Chief Anthony Paparo announced Monday that Tyrone "Chub" Madison, 26, and Jhimeia "Mimi" Harrell, 37, are wanted for weapons offenses and robbery following the shooting death of Omar Thompson, one of at least four potential suspects involved in a robbery attempt against a 23-year-old man in an alleyway behind the Parkview Court Apartments on the 2500 block of Alfred Drive last month. Thompson's death has been ruled an act of justifiable homicide.

According to Paparo, the 23-year-old arranged online and through text a meetup around 11:20 p.m. on Sept. 18 for the suspects to buy some hair extensions from the budding entrepreneur. Harrell, and another woman only known to police as "Bernie," allegedly met with the soon-to-be robbery victim and had some banter about the price of the hair. "Bernie" said she had to get money and left while Harrell walked to the back of the man’s car, police said.

“The victim at that point looked in his rearview mirror and observed a male running behind his car, which was Omar Thompson,” said Paparo. “Omar literally jumps in the front driver’s side window and is on top of the victim, forcing a handgun into his stomach and demanding all of the property that the victim had brought with him.”

The victim was licensed to carry a firearm and used his gun to fire three shots, the first hitting Thompson in the head, killing him instantly. Due to Thompson’s large size, he was passed out dead on the victim who was pinned to his seat unable to escape. The victim got the car door open and pushed Thompson out of the window, all the while the car, still in drive, is rolling down the alley, “creating more panic for him.” He caught up with his car and drove off. He called 911 about the incident and was told to go to a safe place, which was the Clifton Heights Police Department. Police met him there and he was cooperative.

At 11:23 p.m., 911 was called for a report of shots fired in the alley behind the apartment building.

A witness to the crime told police that he saw a male walking back to a cream-colored Buick with Harrell and carrying a handgun. According to Paparo, Madison told police that he was at the end of the alley when he heard the shots, ran up to find Thompson dead and then ran for cover.

“We believe that he was at the scene, at the car and when the shooting occurred Omar landed on the ground, Tyrone took the gun lying on the ground and that’s what witness saw,” said Paparo.

The victim’s gun was accounted for, but the firearm allegedly used by Thompson and recovered by Madison has not yet been found.

As police were doing investigatory stops of people in the immediate area of the shooting, police made contact with a man who turned out to be Madison.

“During the course of the conversation it was learned that he was from the Philadelphia area and was visiting relatives in the Darby area and he heard shots and ran for safety,” said Paparo. “That was not true.”

His first interaction with police that night was captured on body camera worn by an officer.

“When you watch the dynamics of the body cam video he seems to be very interested in what’s going on and listening intensively as police are putting out information over the police radio,” Paparo added.

Sometime that night a woman who turned out to be Thompson’s ex-girlfriend inquired about him and she heard about his death from Madison.

“Within minutes of the shooting and Omar being killed he went to her home, which is also in Yeadon, and let her know that Omar had just got smoked,” said Paparo.

When Paparo personally called Madison around 2 a.m., he, “acted like it was the first time he heard his friend was deceased.”

“Unbeknownst to me, because I didn’t have the reports yet, my officers already stopped him so and he was already in a police report,” said Paparo. “He was already lying in the initial contact I had with him.”

Unsure of his involvement in the crime at the time, police took further information from Madison when he went to the police station and gave “pertinent information” that led to the discover of Jhimeia "Mimi" Harrell. She had contacted her friend, only known to police as ‘Bernie,’ about getting hair extensions from the 23-year-old. Police used texts message between Harrell and "Bernie" to link their connection to the victim and robbery.

Harrell supposedly told police she did not know Thompson, but was reportedly at his funeral.

Because the shooting death of Thompson was ruled justifiable homicide, other homicide charges cannot be filed against Harrell, Madison or "Bernie."

“At this point we’re looking at firearm violations and robbery,” said Paparo.

Police are still trying to solidify "Bernie’s" true identity to issue a warrant against her. He plead at Monday’s press conference for "Bernie" to turn herself in because, “the door is slowly closing” on her time to talk with police.

Even though the 23-year-old victim killed someone to protect himself, Paparo said he was like a deer in headlights in understanding the gravity of the situation.

“I told him, ‘You did what you had to do to save your life,’” said Paparo. “’You don’t know this, but there was another guy in the back of your car and you just didn’t see him because you were fighting with Omar.’ With that, he just broke down.”

The victim, and Paparo, believe that had he not killed Thompson, Madison may have killed the 23-year-old.

Man who killed ex-boyfriend of woman he met online found not guilty of murder

MASONTOWN, Pa. - A man who killed the ex-boyfriend of a woman he met on a dating app was found not guilty of murder.

Christopher Shellhammer testified on Wednesday about the night he went to Kelly French's Masontown home, the woman he said he met on a dating app.

He said it was their fourth date and he was scared of her ex-boyfriend, Michael Hendrich, who punched him in the face the last time he pulled up to her house.

Shellhammer was on trial for murdering French's ex-boyfriend that night. Police said he shot and killed Hendrich inside the home.

He told jurors that after he sat down at the dining room table, Hendrich came around the corner, pumped his chest and said, "Now what did you want to do with my old lady?"

Shellhammer said that's when he pulled out his gun and said, "It's time for me to leave."

Shellhammer testified he made it to the front door, but it was locked and they cornered him and punched him.

He said that is when Hendrich told French to grab his gun, so he had to fire.

During cross-examination, the prosecutor asked, "You pulled a gun on an unarmed man?" and Shellhammer said, "I pulled a gun on two aggressive people who had me scared."

Man Who Killed Sex Offender Has Murder Charges Dropped
A Birmingham man successfully used a Stand Your Ground defense to get murder charges dropped against him.

BIRMINGHAM, AL — A Birmingham man who killed a convicted sex offender had murder charges against him dropped by a Jefferson County jury this week. Stacey Gordon was found not guilty on three charges of capital murder after shooting-and-killing 53-year-old Michael Shane Stepp. in 2017.

Victor Revill, Gordin's attorney, argued Gordon acted in self-defense during this Stand Your Ground case, after Stepp reportedly tried to lure Gordon into his car.

Dennis Robertson, who was formerly employed with the Mobile Police Department and the Mobile County Sheriff's Office, testified in a March hearing about an investigation he conducted in 1987 and 1988 into a "predator sex ring" involving Stepp, in which Stepp and others lured teenage boys with money or drugs in exchange for sexual favors. An Alabama Media Group report said some of the sex ring victims were younger than 16, and the oldest victims were 18 or 19.

Stepp, while driving, reportedly approached Gordon three times on the night of the shooting, Revill said. Stepp kept asking Gordon if he needed help and gave Gordon his phone number. When Stepp later approached and saw Gordon still walking, he asked Gordon if he needed a ride home. Thinking Stepp was a good Samaritan, Revill said Gordon accepted the ride.

After Gordon realized Stepp was not taking him home, he reportedly asked Stepp to let him out of the car. At this time, Gordon said Stepp refused and said he was going to take Gordon somewhere to have sex.

    Subscribe
Gordin then pulled out his gun and when Stepp appeared to be reaching for something in his car, Gordon shot Stepp.

"He was in fear for his life," Revill said. "Had he not defended himself, he may not be here today."

Homeowner catches burglar in the act. He holds him at gunpoint, cops say

What some call the “castle doctrine” is ensconced in the law: If someone breaks or is breaking into your home, you can shoot them, legally, as long as you “reasonably” believe such force is required to stop the “unlawful entry into or attack upon By Mike Haskey
    Manatee
A Manatee County homeowner caught a burglar in the act and held him at gunpoint until sheriff’s deputies arrived to take him into custody, according to an arrest report.

Deputies say Joseph Scott entered the homeowner’s garage in the 25000 block of State Road 64 East and was caught rummaging through shelves just before 10 p.m. Wednesday.

According to the report, the homeowner’s son spotted a “strange green bicycle and a red back pack,” near the garage and alerted his father.

Deputies say the homeowner grabbed his gun and found Scott inside the garage and ordered him to stay still. The homeowner asked Scott what he was doing and Scott pointed to a pile of wood he had been taking from the garage and placing outside, according to the report.

The homeowner said Scott wasn’t making a lot of sense as he tried to question him further so he continued to hold him at gunpoint until deputies arrived.

Scott was booked into the Manatee County jail on a felony burglary charge and remains in custody pending a future court date.
