Rabid skunk attacks fenced-in dogs in Whitefield

    https://bangordailynews.com/2017/12/...in-whitefield/
A rabid skunk attacked two dogs inside a fenced-in area and attempted to enter a house on Hilton Road in Whitefield earlier this week, but the homeowner shot and killed it in her dooryard.

Nicole Sciascia has two dogs: Caspian, 3, a Great Pyrenees mountain dog, and Luna, 1½, a blue tick coonhound-Great Pyrenees mix. The dogs were in the enclosure around 10 p.m. Monday when a skunk sprayed them from the other side of the fence.

Sciascia heard the hound start to bark and howl, and ran to the front porch. She saw the skunk and went inside to get her .380-caliber pistol. When she went back outside, the skunk was in the driveway going toward the road.

She went inside again to change her clothes and get the bathroom ready to bathe the dogs.

After about 10 minutes, she went to the back door, where the dogs enter and exit the enclosure through a doggie door. The skunk was chasing the dogs, which weigh 100-plus pounds each, around the enclosure and trying to get in the doggie door.

Sciascia managed to get the “terrified” dogs inside and secure them in a room upstairs.

She then went outside with her pistol, where the skunk was running around at random, “like a chicken with its head cut off,” she said. She shot and killed the skunk just feet from the front door.

“I shot it right in front of the doorway,” she said. “I didn’t really have a choice. It was right there and it wasn’t giving up.”

She later took the skunk’s carcass to the Maine Health and Environmental Testing Laboratory in Augusta, where the skunk tested positive for rabies Tuesday, Dec. 5. An employee of the laboratory confirmed the positive test.

The dogs do not have any visible bites or scratches, according to Sciascia. One dog was up-to-date on its shots while the other was a few weeks past due, but both have since received booster shots.

The vet advised Sciascia to monitor the dogs for symptoms for 45 days and encouraged her to share the story of the attack.

Sciascia doesn’t know whether the skunk dug a hole under the fence or scaled the fence to get into the enclosure. She hopes her story will help other pet owners avoid the “false sense of security” she had with her dogs inside the fence.

The Health and Environmental Testing Laboratory has confirmed two other cases of rabies in Lincoln County this year, in a raccoon from Bremen tested June 26 and a skunk from Waldoboro tested Dec. 1.

The Waldoboro skunk killed a domestic duck and injured at least one other, according to the lab employee. The skunk arrived at the lab with porcupine quills in it. Quills are a strong indicator of rabies, as a healthy skunk would be unlikely to attack a porcupine.

In 2016, there were four cases in the county: a skunk in Waldoboro on Feb. 1, a skunk in Whitefield on Aug. 8, a cow in Whitefield on Aug. 31, and a skunk in Jefferson on Sept. 27, according to the laboratory.

    *

Rabies is spread when a rabid animal bites or scratches a person or animal, or when a rabid animal’s saliva or neural tissue comes into contact with a person or animal’s mouth, nose, or eyes, or enters a cut in the skin, according to the Maine Division of Infectious Disease. Rabies affects the brain and spinal cord and can cause death if left untreated.

Self-defense prevails as Erie man acquitted of homicide

    http://www.goerie.com/news/20171208/...ed-of-homicide
Marquis Knight was accused of killing Allen Basham in April 2016 in what the DA said was a gang-related shooting.

Marquis P. Knight said he shot at Allen Basham because Basham fired first during a gunfight on Erie’s west side in 2016. “Fight or flight” is how Knight testified about his reaction.

A jury found that Knight’s reaction was justified and that he shot the 19-year-old Basham in self-defense.

Knight, 28, was acquitted of all charges on Friday in his homicide trial — a case in which the Erie County District Attorney’s Office highlighted what it said was violence between gangs on the city’s east and west sides.

The defense countered with Knight’s argument that he was in danger and had no choice but to fire back at Basham with the .40-caliber handgun that Knight was licensed to carry.

“The initial aggressor was Mr. Basham,” Knight’s court-appointed lawyer, Eric Hackwelder, said following the verdict, reached at around 1 p.m. Friday. The jury of seven men and five women deliberated about six hours over two days.

Knight was found not guilty of homicide, aggravated assault, recklessly endangering another person and possession of an instrument of crime.

Erie County Judge John J. Mead after the verdict ordered Knight released from the Erie County Prison, where he had been held without bond, because he was accused of homicide, since Erie police charged him on Sept. 29, 2016. Knight was making arrangements for his release and was not immediately available for comment after the verdict.

His father, Mark Knight, praised the jury’s acceptance of self-defense.

“I always tell my kids: I’d rather be judged by 12 than carried by six,” he said.

As his son said from the witness stand, Mark Knight said Marquis Knight was never in a gang and that he had no choice but to defend himself against Basham, who was shot three times and died from a gunshot wound to the back.

The shooting occurred outside a party in the 1100 block of West 26th Street, between Raspberry and Cranberry streets, shortly after 3 a.m. on April 16, 2016. Evidence showed that Basham fired at least twice at Marquis Knight’s car. Marquis Knight testified he had no idea why Basham was upset with him.

Mark Knight said his family has been close to Basham’s family for years, and that the fatal shooting was a tragedy for all involved.

“No one deserved this,” Knight said.

“It was a sad situation for both families,” said Marquis Knight’s friend John Blanks, who was in the packed courtroom throughout the trial, which started with jury selection on Monday. “But at the end of the day, self-defense — the law proved itself.”

District Attorney Jack Daneri sought a conviction for first-degree murder or third-degree murder or voluntary manslaughter. The shooting, he said, occurred during the course of a larger shootout in which a number of people fired more than 40 shots. Daneri told the jury in his closing argument that the violence was gang-related.

Basham was wearing a T-shirt for Four Nation, an eastside Erie gang. Daneri, citing police evidence, said Knight was affiliated with gangs or groups on the west side, such as the 1800.

Daneri said a blood trail, the pattern of spent shell casings and other evidence showed that Knight fired at Basham while Basham was running toward an alley. Daneri said Knight was not justified in killing someone who was fleeing.

Several of Basham’s supporters left the courthouse without commenting on Friday. Daneri said he was disappointed in the verdict but said he respected how much time the jurors spent on the case.

Daneri said the prosecution “knew we had some rough spots” in the case. He spoke of the high burden required for the prosecution to overcome a contention of self-defense.

“In Pennsylvania, we have to disprove by a reasonable doubt that the defendant was not justified,” he said.

Hackwelder, Knight’s lawyer, said the pattern of shell casings and the blood evidence proved Knight was on the defensive for a legitimate reason. In a case in which no one disputed that the accused shooter and the gunshot victim both opened fire, the evidence “supported our theory better,” Hackwelder said.

    http://www.goerie.com/news/20171207/...homicide-trial

Knight was licensed to carry the gun and testified that he is a member of the National Rifle Association. He testified that he did not turn the gun over to authorities because he had been advised not to by a lawyer who represented him before Hackwelder.

Jurors acquit Crafton man in Canton shooting

    https://observer-reporter.com/news/l...977b8603d.html
A Washington County jury on Thursday found a Crafton man not guilty in a nonfatal 2015 shooting in the basement of a Canton Township home.

Jurors acquitted Michael Suehr, 59, of Crafton on a charge of aggravated assault following a trial that began Tuesday before Judge Gary Gilman. The case stemmed from an Aug. 8, 2015, incident in which state police said Suehr shot his girlfriend's adult son, John Dingle, during a dispute in the basement of her Canton Township home.

“I always believed it was self-defense, and that’s how the jury saw it,” said Joseph Horowitz, Suehr's attorney. “And I appreciate the jury’s consideration of the case.”

Horowitz said his client was the one who called 911.

State police Trooper Thomas Kress Jr. wrote in an affidavit of probable cause that police arrived that evening to find Suehr in the driveway of Peggy Dingle's Hilltop Lane home with his hands up. He reportedly told police he had a gun in his pocket, and police found a handgun in his front pants pocket.

Police found John Dingle lying on the basement floor with a wound from a bullet that had hit him in the stomach before lodging in his leg.

Dingle reportedly told police that night that Suehr had pulled a handgun and shot him during an argument over a washing machine. During his trial, both sides agreed he'd pushed Suehr or initiated some other form of aggressive physical contact with him, but differed over subsequent events that ended with Suehr shooting the other man.

Horowitz said Suehr had gotten caught up in a fight between Dingle and his mother. Suehr and his girlfriend said on the stand that her son had knocked her out. Suehr testified he then pulled out the gun and told Suehr to leave the house before Dingle lunged at him and Suehr shot him. Dingle maintained he'd merely pushed his mother out of the way and denied rushing at Suehr.

Horowitz said jurors deliberated about half an hour before coming back with the verdict.

"We respect the jury's decision and appreciate the work of the state police on the case," said Assistant District Attorney John Paul Lewis.

Armed Jurupa Valley homeowner stops burglary suspect, officials say; San Bernardino man arrested

    http://www.pe.com/2017/12/09/armed-j...-man-arrested/
JURUPA VALLEY >> A 70-year-old armed homeowner was able to stop a would-be burglar Friday afternoon, holding him at gunpoint until authorities arrived.

The Riverside County Sheriff’s Department received a call Friday afternoon from a 63-year-old female in the 5300 block of Riverview Drive who said her husband, who had a permit to carry a gun, had gone outside to investigate what they believed was a burglary in process.

Once outside, the 70-year-old homeowner found a suspect trying to break inside with a crowbar.

Deputies arrived within four minutes of receiving the call and arrested Jose Rodriguez, 34, of San Bernardino, on suspicion of burglary, possession of burglary tools, and an outstanding arrest warrant.

Rodriguez was booked into the Robert Presley Detention Center. Bail was set at $75,000.

Police: East Chicago robbery suspect shot in head by security guard

    http://www.nwitimes.com/news/local/c...1b3604346.html
EAST CHICAGO — A security guard shot and wounded a man Thursday as the man robbed a cellphone store, police said.

Employees told East Chicago police the man entered Metro PCS, 3723 Main St., just before 6:25 p.m., pulled out a gun and ordered them to open the register and give him "all the money," Detective Sgt. Terence Fife said.

The man — whose face was covered with a scarf — waved a handgun randomly at two store employees, police said. The employees told police they opened the register drawer, and the man began to take money from the drawer.

During the robbery, a security guard shot the man in the head, police said.

East Chicago police arrived and found the man lying on the floor inside the building, Fife said. Money and a black and silver handgun were lying near him.

The man was taken by ambulance to St. Catherine Hospital and later transferred to Loyola University Medical Center in Maywood, police said.

Statements regarding the case were still being taken and the investigation was ongoing, Fife said. The wounded man had not yet been identified, he said.

Dayton dog shot by neighbor is in good condition

The owner of a dog shot in the leg by a neighbor Saturday afternoon was cited for the dog getting loose.

    http://www.whio.com/news/crime--law/...TmS6Bc9J2nA9L/
A woman called police around 1:45 p.m. and said three or four shots were fired at her dog, which she described to dispatchers as a “non-aggressive pit bull,” according to a Dayton police report.

    >> Pig cruelty allegations: appeals court rules against owners

The police report states a neighbor was whistling to bring the dog into his yard, according to what the complainant told police.

When police responded to a home in the 400 block of Red Haw Drive, they found the family’s pit bull-American bulldog mix named Tank was shot in one of his right legs, with the bullet going all the way through.

The officers’ assessment of Tank coincided with the owner’s description of the dog’s demeanor.

"Tank was wagging his tail and was extremely friendly," an officer noted in the report. "While we were outside with Tank a neighboring cat came over. Tank did not chase or bark at the cat."

    >> High bond set for man accused of setting cat on fire in Middletown

A resident two doors down who shot Tank had a valid CCW permit. He told police the dog came into his yard and that he feared it would attack him or his two poodles. He said he fired two shots from about five feet away, and that the dog then ran away, the report stated.

The neighbor told police Tank is the offspring of a dog that two years ago killed his dog.

Tank’s owner Cameron Walker did tell this newsroom that Tank’s father had killed another dog in the past, but that Tank is not violent, which police on scene agreed Tank was friendly.

Tank had a valid dog license, but the Montgomery County Animal Resource Center cited Tank's owner for having a loose dog.
