    Austin Police: 'License To Carry' shooting appears to be self-defense
    When Austin Police arrived at the Arbors of Austin apartment complex on Mearns Meadow Saturday evening, they found 21-year-old Darwin Jimenez suffering from a gunshot wound.

    "They immediately began resuscitation efforts however Jimenez succumbed to his injuries and was pronounced deceased at 5:20 pm," said Detective Angie Jones.

    During a Tuesday morning press conference Detective Jones told Fox 7 this all started when a white vehicle pulled in behind a maroon vehicle in the Arbors parking lot.

    "At some point there was a verbal altercation between the individuals in the maroon vehicle and the individual in the white vehicle," she said. "It was something about driving through the parking lot. So we're still gathering information on that," Jones said.

    Austin Police say the man in the white vehicle pulled into a parking spot and got out. Jimenez and another guy with him got out and kept arguing.

    "Based on witness statements, Jimenez had a gun in his hand at that time. Shots were fired," she said.

    Detective Jones says that's when the man in the white vehicle, who is licensed to carry, got his own handgun from his car and fired back, a shot that ultimately killed Jimenez. Police say the man who they didn't name, was never hit by Jimenez's gunfire.

    "You find yourself in a situation like that, there are a couple of things that we tell people to do. If there's a way that you can leave, then leave," said License to Carry instructor Michael Cargill with Central Texas Gunworks.

    Cargill says there are steps LTC-holders are taught to take before bringing a firearm into the situation.

    "But if it does happen, it gets to that point and you have to defend yourself then you stop that threat. And then you dial 911 and then call your attorney and let your attorney talk for you," Cargill said.

    Austin Police say the License to Carry-holder is cooperating with the investigation.

    "If you're not committing a crime then you can stand your ground and get to defend yourself. So it seems like everything fit exactly what the license-holder is supposed to do and he did the right thing," Cargill said.

    Police say no one is charged in the case yet. They say it will be up to a grand jury to decide if any charges will be filed.

    But Austin Police say if you know anything more about the incident, give them a call.

    Investigator says shooting looks like self-defense

    MOULTRIE, Ga. — A Colquitt County man shot in the leg Saturday night in an apparent case of self-defense was himself arrested after being treated at the hospital.

    Officers who responded at about 10:02 p.m. to a report of a man damaging a residence found Alton Paul Olliff on the side of the road at his 808 Causey Road address where the incident occurred.

    Witnesses told police that Olliff was shot after he brandished a knife.

    “This was all in connection with some people at a gathering,” Colquitt County Sheriff’s Office Lt. Mike Murfin said. “We believe that the intoxicant alcohol was involved.”

    At some point, Murfin said, Olliff tried to attack some of the other people at the residence. One of those people was William Massey.

    “He charged the person several times,” Murfin said. “He was subsequently shot above the right knee. As a result of Mr. Olliff charging at William Massey, (Massey), in order to defend himself discharged a firearm.”

    A knife believed to be the one brandished at the residence was recovered.

    No one other than Olliff was injured. Olliff, 31, was treated at Colquitt Regional Medical Center and then transported to Colquitt County Jail.

    He has been charged with aggravated assault, terroristic threats and acts, battery (family violence) and cruelty to children.

    Sheriff: Teen who shot, killed other teen in Catawba County acted in self defense

    CATAWBA COUNTY, NC (WBTV) -
    Investigators say a teen who shot and killed another teen in Catawba County Wednesday night acted in self defense and will not be charged.

    The shooting happened around 6 p.m. at a home on the 4000 block of Fairview Drive. A 17-year-old went into the home and pulled a gun on a teen inside, according to deputies. The person inside, also a 17-year-old, then shot the teen multiple times.

    Deputies found a vehicle that was stopped on the side of Startown Road, near the Lincoln County line, with the 17-year-old shot inside. He was taken to Carolinas Medical Center-Lincoln where he died a short time later.

    Deputies did not say whether the teen and the alleged shooter knew each other.

    The sheriff said Thursday afternoon that the case had been determined to be self defense and that no charges would be filed against the alleged shooter.

    No names have been released.

    Two men armed with knives and a screw-driver broke into a home in Park Road, Umtentweni during the early hours of this morning (Thursday).

    Neil and Lynn-Dee van Eeden and their 17-year-old son, Josh were sleeping when the men quietly cut the burglar bars with bolt-cutters and climbed through the lounge window into the house and proceeded to make their way down the passage and into Neil’s bedroom.

    Neil woke-up with the two men, wearing hats, in his bedroom, telling him to ‘keep cool’. One of the men had one of Neil’s socks wrapped around his face.

    When the family’s boerboel come through to the bedroom, the intruders attempted to stab the dog.

    A calm Neil asked the men if he could put the dog in his bedroom. They agreed, and made their way to Joshua’s room where they helped themselves to his laptop and cellphone.

    They demanded money, and asked Neil for a bag.

    When the men realised they had taken only one of a pair of takkies, they insisted that Neil retrieve the other from the bedroom.

    Deciding enough was enough, Neil went back into his bedroom, closed the door to keep the dogs inside, and took his gun from the safe.

    When the intruder saw the gun, he went for me and that’s when I shot him. This is what worried me – if they couldn’t find money what would they have done, tied us up and slit our throats? – Neil.

    Neil said the injured man stumbled back and fell into Josh’s room, where he lay for a while.


    The wounded man staggered into Josh’s room, were he lay for a while.

    The other man, who was busy filling the bag with laptops, clothes and other household goods, abandoned the bag, opened the sliding door in the lounge and fled.

    By this time, Lynn-Dee had emerged from her bedroom to see the wounded man stumbling down the passage, shouting ‘please don’t shoot me, please don’t shoot me…’

    “Out of sheer fright, Josh and I grabbed coffee cups and threw them at him,” said Lynn-Dee.

    Lynn-Dee phoned her level-headed friend Sally Heaver for help, just before 3am.

    Sally in turn quickly contacted the police and posted a message on a local WhatsApp group saying the family needed help.

    Police spokesman, Vincent Pandarum said the wounded man had managed to run a few hundred metres before collapsing and dying.

    Reflecting on the ordeal, Lynn-Dee said the men were starting to get aggressive as things weren’t going as planned – suddenly there were dogs, no money, not everyone in the same room and it was taking longer than anticipated.

    Josh hadn’t seen his mother during this ordeal and was worried that she had been targeted.

    “It could have been so much worse,” added Josh.

    Capt Pandarum said a case of house robbery would be investigated, and an inquest docket opened in relation to the death of the suspect.

    No arrests have been made at this stage.

    Homeowner holds burglary suspect at gunpoint in Cherokee County

    A burglary suspect is in jail after being held at gunpoint by a homeowner in Cherokee County.

    The sheriff's office says a resident of Jamestown called deputies to report she saw two people inside her home. Deputies arrived on scene and arrested the 20-year-old suspect who was being held at gunpoint by the homeowner. He is being charged with second degree burglary and three counts of third degree burglary in connection with earlier crimes.

    A second suspect ran away from the scene upon seeing the homeowner.

    Tampa gas station clerk shoots attempted robber

    TAMPA, Fla. (WFLA) — A clerk shot an armed man who tried to rob a Tampa gas station early Friday morning.

    Police say a suspect walked into the Sunoco gas station on the corner of East Hillsborough Avenue & 34th Street just after 2 a.m. and tried to rob the clerk with a handgun.

    But the clerk pulled out his own handgun, firing at the suspect multiple times, hitting him once in the leg.

    Police say they found shell casings near the front of the store leading into the parking lot.

    “All that we don’t know exactly,” said Tampa Police Department Lt. Ricardo Urbinas. “What part of it was following a struggle, whether it continued into the store or into the parking lot, all those microdetails, we’re still trying to figure all that out.”

    After the shooting, police said the suspect ran to the Shell gas station nearby, collapsing in the parking lot. The clerk followed him across the street and held him there at gunpoint until police arrived.

    “This is sort of typical self-defense stuff,” said Lt. Urbinas. “If somebody’s threatening you with a firearm, anybody — a clerk, the general public — you have a right to defend yourself. And you can use deadly force if you’re faced with deadly force.”

    Both weapons were found in the Shell gas station parking lot. Though it’s still early in the investigation, Lt. Urbinas said it looks like the suspect was using a BB gun or pellet gun.

    “That doesn’t change the facts of the case,” said Lt. Urbinas. “The clerk wouldn’t have known that when the gun was pointed at his face and he still has a right to defend himself.”

    The suspect was taken to a nearby hospital with a gunshot wound to the leg and is expected to survive. The clerk suffered minor injuries in the scuffle.

    A 20-year-old man was arrested in connection with a home invasion reported last month in North Myrtle Beach that involved suspects exchanging gunfire with a homeowner, according to officials.

    Jiah Haki Amari Clarke of Longs is charged with attempted murder and first-degree burglary, according to police records.

    The charges stem from an invasion incident reported Jan. 14 at a mobile home on the 1000 block of 14th Avenue South in North Myrtle Beach. Officers were called about 5 a.m. that day in reference to an ongoing burglary with shots fired.

    As police drove to the home, dispatchers told them the homeowner fired at two suspects dressed in dark clothing. The two suspects fired back before dropping a gun and running, the police report states.

    Authorities spoke with the victim who told them he was home with his girlfriend and infant son when the burglary and shooting happened. Police checked everyone for injuries and none are noted in the report.

    Investigating officers found a gun on the living room floor, and they were told by the victim it was the weapon used by the suspects. Officers noted “multiple empty shell casings” were seen on the floor, and also said there were bullet holes in the rear of the home that appeared to be from the suspects firing back at the victim.

    Police also found a gun on the living room couch that the victim said he used to fire at the suspects, according to the report.

    Authorities previously arrested Miracle Evans, 25, of Little River in connection with attempted murder and first-degree burglary on Jan. 29.

    Her bond was set at a total of $30,000, and she was released on home detention, according to jail records.

    Jury acquits ND man in double murder trial

    WILLISTON -- After spending more than 500 days in jail, including months in solitary confinement, Lamar Putney walked out of the Williams County Correctional Center in Williston a free man Thursday, Feb. 8, just before 5 p.m.

    Putney, 33, was found not guilty of two counts of murder after a nine-day trial and three hours of jury deliberation. He was accused of murder after a May 2016 shooting at his apartment left Diandre Lott and Donzell Washington dead. Putney told police he shot the men in self-defense when they tried to rob him. He was released on the day of the shooting, but arrested four months later, on Sept. 14, 2016.

    As Putney left the jail to greet waiting friends and family standing in the snow, members of the jury, who were still in the Williams County Courthouse, waved in congratulations.

    Putney said that before the verdict was read he believed he would be acquitted.

    “I had complete faith in my prayers,” he said. “I had complete faith in the prayers of my family. I had complete faith in my attorneys.”

    His wife, Mehvish Ali Putney, was among those at the door of the jail to greet him. She said she was grateful the jury looked at the evidence and decided that Putney acted in self-defense.

    “I get to take him home,” she said. “I’m happy my son gets his dad home.”

    On the stand Wednesday, Putney testified that protecting his son was one of the reasons he shot Lott and Washington.

    Outside the jail Thursday, Putney said his son was foremost in his mind now.

    “(I’m) definitely going to spend a lot of time with my son,” he said.

    Putney’s cousin, Danielle Davis, who traveled from Delaware to be in the courtroom throughout the second week of the trial, said her family never had any doubt Putney had acted reasonably. She was relieved and happy when the verdict came back not guilty on both counts.

    “It just means everything to have him back,” she said.

    Defense attorney Jeff Nehring said that as he waited for the verdict to be read, he was nervous, and was happy with the result. He and co-counsel Hernando Perez spent weeks preparing for the trial.

    Nehring re-iterated what he told the jury during his closing argument — that the prosecution’s evidence didn’t really tell the story.

    “This was obviously a case of reasonable self-defense,” he said.

    As the verdict was read, Putney offered little reaction beyond moving his eyes upward. Nehring said he was impressed with the confidence and calmness Putney showed throughout the proceeding.

    “Lamar was amazing,” he said.

    Putney’s relief was clear as he left the jail. He said he had been treated well by the correctional staff, but criticized the decision to put him in what the jail referred to as “administrative segregation.”

    The Williams County State’s Attorney’s Office claimed Putney had endangered at least one witness by distributing material that was supposed to be kept under seal. Madden made a similar claim last month, asking Northwest District Judge Kirsten Sjue to hold Putney in contempt.

    Sjue eventually decided not to hold him in contempt, but did limit who Putney was allowed to have contact with until the trial was over.

    Putney said the claims made by prosecutors didn’t have any evidence to back them up.

    He said he was glad the jurors followed the evidence and the judge’s instructions on the law and was happy for the verdict.

    “It just proves anyone can get a fair trial anywhere,” he said.

    Before he left the jail to be with friends and family, he struck a hopeful tone.

    “It’s what I had to go through to get me to where I’m going,” he said.

    man who fatally shot a 25-year-old in a Bloomfield neighborhood last September will not face criminal charges because the shooting was in self defense, the Macon Judicial Circuit District Attorney's Office said in a news release Friday.

    Emmanuel Lee Stroud Jr. was shot once in the stomach late Sept. 16. He died hours later at a hospital.

    Tecovelin Starling, 36, was with Stroud at the intersection of Edwina and Walmar drives just before midnight. He also had been shot in the leg.

    In a news release sent shortly after Stroud's death, the Bibb County Sheriff's Office said the gunfire occurred as the two men were walking down the street and "someone started shooting."

    Further investigation "revealed evidence that Stroud shot Starling and then Starling shot Stroud in self-defense," the District Attorney's Office news release said.

    Stroud was the 20th person in Bibb County and the second person in his family to be slain last year.

    Emmanuel Stroud Sr., 57, was shot to death in June. Two teens were recently arrested and charged with his murder.

    NC man shoots, kills coyote to protect 6-year-old daughter, dog

    ORANGE COUNTY, N.C. - A North Carolina man said he shot and killed a coyote after it came dangerously close to his 6-year-old daughter and dog.

    Ian Vigus said that shortly after he came home from work in Orange County, he heard his dog barking near where his daughter was playing.

    Vigus said his dog was spooked by a coyote, so he took both the dog and his daughter inside and grabbed his rifle.

    “As he started to lope off, I shot him and killed him,” Vigus said. “I just wanted to protect my family and protect my livestock.

    Orange County officials said there have been several recent reports of coyotes in the area.

    Earlier this week in Huntersville, a family came face-to-face with a coyote that officials said was rabid.

    In a video that the Schroter family recorded of the encounter, the coyote can be seen snarling at them.
