    By Stephen English senglish@star-telegram.comFORT WORTH

Fort Worth police say a homeowner shot a half-naked man who was breaking into his house early Saturday morning.
An unidentified, half-dressed man who broke into a house early Saturday morning is in the hospital after the homeowner shot him, police say.

The incident happened shortly after 3 a.m. in the 6600 block of Sheridan Road in south Fort Worth, police say.

Police received a call that a black male who wasn’t wearing pants or underwear had broken into the home, according to police records.

“The homeowner shot the suspect that was attempting to enter the home in the chest,” police spokesman Brad Perez said.

“The suspect is expected to survive his injuries. I was advised that he was wearing a shirt only.”

The suspect remained in the intensive care unit of John Peter Smith Hospital on Saturday morning, authorities said.

Perez said the suspect is expected to be booked and charged once he’s out of the hospital. He has a gunshot wound on the left side of his chest, Perez said.

Man killed, business owner injured during parking lot confrontation
    Jackie Kent
ALBUQUERQUE, N.M. (AP) - An Albuquerque business owner shot and killed a person casing vehicles in his company parking lot, according to Albuquerque Police. Now, APD is investigating what led up to the deadly encounter.

It happened Friday night near Jefferson and I-25 at Chavez Concrete Contractors.

Police say they were called to Chavez Concrete Contractors around 9 p.m. on Friday near Jefferson and I-25. The owner reported someone was in his lot casing vehicles.

After that call, police said the business owner and the suspect had a confrontation and gunfire was exchanged.

Police said the business owner was shot and injured but he also shot at the man, killing him.

Officers found the man dead inside a construction vehicle in the lot.

"The business owner was involved in the gunfight with this individual that's deceased so we're talking to him about what happened," Ofc. Simon Drobik said. "At this time it'll be forwarded over to the DA's office."

Police have not identified the man who was killed.

Officers said they collected a lot of evidence at the scene and will be talking to any witnesses and reviewing the surveillance video.

KRQE News 13 reached out to Chavez Concrete Contractors but did not hear back.

It is the second case of a home or business owner taking action against an intruder in just over a month. In early October, a Foothills homeowner shot and killed a suspected burglar.

Homeowner holds burglar at gunpoint until police arrive
By Gene Coleman Email the author Published 5:59 pm Sunday, November 11, 2018
NATCHEZ — A homeowner held a burglar at gunpoint Saturday morning at his private dwelling until police came for the arrest.

Natchez police said the suspect, Joshua McCloud, 28, of 224 Luck Road, Ferriday, faces charges on four counts of burglary, one within a dwelling and the other three for vehicular burglary, and a misdemeanor charge of malicious mischief.

The offenses took place at 217 High St., authorities said.

The homeowner, Michael Blattner, said he was asleep at approximately 7 to 8 a.m. Saturday when his wife heard what she said sounded like someone rapping a doorknocker.

Blattner, who lives in a gated, private house, said he doubted anyone would scale the gates to get inside, but upon investigation found the doors to their Chevrolet Suburban open.

“I went out to investigate and I brought my pistol. I happened to glance into the garage and saw the door of my other car open and the guy in it,” Blattner said. “I had the gun on him and made him lay on the ground.

“This guy came about two seconds away from being shot, because I told him if he even flinched I was going to shoot him.”

Blattner said McCloud complied until police arrived. Blattner said recordings from his home surveillance cameras later showed that McCloud had found a set of keys in one of the cars and was trying to use the keys to get inside the house.

McCloud was arrested at approximately 10 a.m. Saturday and brought to the Natchez Police Department for questioning.

Blattner said he has always felt safe in Natchez, but this was an unfortunate incident.

“This is the first time it’s ever happened in the 10 years we’ve been here,” Blattner said. “The police did a wonderful job. They were here in five or 10 minutes with five or six cars here, but the whole time they were here the tourist busses were passing by. It’s just another unfortunate incident that doesn’t help our tourism and economy,” Blattner said.

Shooting of 59-year-old man in Austin ruled self-defense

Five people — including three newborn babies — were stabbed at an overnight day care center inside a New York City home early Friday, and a woman who had slashed her wrist and was found in the basement was taken into custody, police said. The victims were listed in critical but stable condition.

An investigation into a shooting that fatally wounded a man Sunday night during a domestic-related altercation in the Austin neighborhood has been closed after investigators determined it was committed in self-defense.

Henry Ratcliff Jr, 59, was involved in a “domestic-related altercation” about 7:50 p.m. in the 4800 bock of West Gladys Avenue when he was shot multiple times in the abdomen, according to Chicago police and the Cook County medical examiner’s office.

Ratcliff was taken to Stroger Hospital, where he died early the next morning, authorities said.

Detectives spoke to a person of interest in the case, but released her without charges. The shooting was determined to have been committed in self-defense and the case was closed, police said Tuesday.

    No charges in fatal shooting
ANTONITO—12th Judicial District Attorney Crista Newmyer-Olsen released her office’s decision on Wednesday not to file charges against Antonito business owner Felix Gallegos for the fatal shooting of Byron Duran, 26, of Antonito at Gallegos’ business on the early morning of September 1.

Newmyer-Olsen stated, “No charges will be filed against Felix Gallegos related to the shooting death of Byron Duran. This decision was made following analysis of the case by my office and an independent review.”

The DA’s office notified Duran’s family and Gallegos’ attorney of the decision.

The Colorado Bureau of Investigation (CBI) at the request of the Antonito Police Department investigated the Sept. 1st incident in Antonito. During the course of their investigation they reviewed reports, video and surveillance recordings, photographs, interviews and September 3 autopsy reports.

About 5 a.m. on the morning of Saturday, September 1, Gallegos, the owner of the G6 Hamburger Stand at 210 Main Street in Antonito, went to the restaurant in response to a security alert. His wife called 9-1-1, and he also later called 9-1-1 after shooting Duran.

Gallegos told authorities that when he arrived he saw someone running around inside the hamburger stand. He told the intruder to stay inside the building and that police were on their way. Meanwhile, Gallegos remained outside the building about 15 feet from the door. Gallegos was armed.

At some point, according to Gallegos’ report to authorities, the intruder ran out of the door and towards Gallegos. Not knowing if the intruder was armed, perhaps with one of the kitchen knives from the restaurant, Gallegos fired at him, striking him twice and ultimately killing him.

At the time Gallegos did not know the intruder’s identity. When he learned later who it was, he told authorities he was acquainted with Duran and his family.

In the letter supporting her decision not to charge Gallegos, Newmyer-Olsen stated that the CBI investigation revealed that the damage from the bullets, the positions of casings and the autopsy performed on Duran were consistent with Gallegos’ account of the shooting.

CBI also analyzed surveillance video footage from the hamburger stand on the morning of the incident. It showed Duran entering the building through the order window, crawling around under the window height and going through the cash register, shelves and other items. The footage showed him moving to the back of the restaurant, where there were no windows, and standing up and walking around. At some point Duran disconnected the surveillance recording device.

The autopsy revealed that Duran had been shot twice, once to the chest and secondly to the lower right thoracic back. Toxicology analysis at the time of the autopsy indicated Duran had amphetamines and opiates in his system at the time of his death, Newmyer-Olsen stated.

The DA cited Colorado law, court cases and Colorado Supreme Court rulings that “affirmed that an innocent victim of an assault is not bound to retreat before using deadly force when the use of such force is reasonable under the circumstances.”

She added, “It is our conclusion based upon the applicable law and the facts and circumstances of this case, that a jury is likely to conclude that Felix Gallegos’ actions meet the legal requirement of the affirmative defense contained … It is equally clear the People would be unable to disprove the affirmative defense beyond a reasonable doubt … and the People are not filing criminal charges against Felix Gallegos.”

Police: Deadly shooting at Atlanta park was self-defense
    Updated 9 hours ago Nov 15, 2018

A man acted in self-defense when he fatally shot another man at a northwest Atlanta park Saturday night, police said.

Based on the investigation, police are treating the shooting as self-defense and have not made any arrests, police spokeswoman Lisa Bender said Wednesday in a statement.

“The case will be forwarded to the Fulton County DA’s office for further investigation,” she said.

RELATED: Man fatally shot at Atlanta park ID’d

The victim was found dead when officers arrived at Washington Park on Ollie Street at about 8:15 p.m., police spokesman Sgt. John Chafee said in a statement. He was identified by the Fulton County Medical Examiner’s office as Brian Bell, 41, of Decatur.

A preliminary investigation into the shooting indicates Bell got into an argument and physical fight with another man inside the park, Chafee said. They separated, but they were involved in another confrontation a short time later.

At some point, police said, “one of the males produced a firearm and shot the other.”

Police said they recovered the gun and briefly detained one man for questioning. He was later released, and no charges were filed.
