    A West End man is in jail after police said he shot at a man 13 times during an argument at a Queensgate gas station.

    The shooting took place Nov. 18 at the Marathon gas station at W. 8th and Linn streets, court documents show.

    Police said that Altonieo Thornton fired 13 rounds at another man during an argument. The other man had a concealed carry permit and fired once at Thornton, striking him in the forearm, police said.

    Court documents state that the second man's shot was fired in self-defense.


    Thornton, 23, is charged with felonious assault and discharge of a firearm on or near prohibited premises. He is scheduled to appear in court Tuesday.

    Deadly CVS shooting was Craigslist deal that went bad, police say

    Gunfire in a CVS pharmacy in that left one man dead and two others under investigation began with a Craigslist sale that went horribly wrong, police said Thursday.

    It was the second online sale to end in violence in South Florida in two weeks.

    Matthew Jay Barry, 37, of Davie makes a living buying goods online. On Wednesday, he chose at 4610 S. University Drive to buy an for $280 from Andre Derek Smith, 20, of , Davie Police Major Dale Engle said Thursday.

    Smith showed up with a friend who police did not name. The sale took place in the parking lot, but Smith apparently didn’t want the transaction to end, Engle said.

    “They tried to get the phone back,” Engle said. “First it was, ‘Well, I need to download my s,’” Engle said. “So Barry takes the SIM card out and he gives them the SIM card.”

    They made another request, and Barry felt uncomfortable.

    “He felt like they were going to rob him,” Engle said.

    Barry warned Smith and his friend that he had a gun. They told Barry they also had a weapon, but police haven’t found it yet.

    “From the interviews th at we received,I think that Barry felt they were going to try and get the phone back after there was the exchange of money for the phone, and that these two individuals may flee with both the money and the phone,” Engle said. “But that is purely speculation on my part.”

    The store had about a dozen shoppers inside when the shooting happened just before 1 p.m. The store is south of the intersection at Griffin Road, a neighborhood that has three colleges nearby and is especially busy at lunchtime.

    After retreating inside the CVS, Barry repeatedly asked clerks to call 911.

    He “made discreet requests several times as he traveled through the front of the store, with Mr. Smith pursuing him,” Engle said. “The surveillance video clearly shows that Mr. Barry enters the store and that Mr. Smith is right behind him. It looks like Mr. Barry is attempting to get away from Smith.”

    Barry, who has a valid concealed carry permit, pushed Smith and pulled out a handgun, Engle said.

    Barry fired several times, striking Smith, according to Engle. No one else in the store was injured. Davie Fire Rescue paramedics took Smith to Memorial Regional Hospital in Hollywood where he died Wednesday night.


    Engle said he didn’t think one could rule out applying , which provides immunity from prosecution for shooters who find themselves in self-defense situations. But, the police spokesman added, the investigation is continuing.

    Neither Barry nor Smith’s friend was arrested or charged with any offense. The next step in the case was a search of Smith’s car, police said.

    Once the investigation is completed, detectives will present the case to the Broward state attorney’s office for review, Engle said.

    He did not reveal how many shots were fired or the type of weapon Barry used.

    As people turn to cellphone applications and websites to trade personal belongings, they may risk their personal safety, police say.

    In North Lauderdale on Oct. 22, a woman using the cellphone application OfferUp was as she and a friend tried to sell an iPhone.

    The deal began on a residential street and moved to an ATM before she was shot. The injury that was not life-threatening, the Broward Sheriff’s Office said. The agency arrested a 24-year-old man on suspicion of committing attempted murder and armed robbery.

    Police departments around the country have invited the public to carry out online transactions in their lobbies or parking lots in an effort to prevent such violence.

    “Our lobby is videotaped and has audio, and is a safe place for people to complete these transactions,” Engle said.

    Davie police have investigated other encounters that began as online trades and turned into robberies when the parties met face-to-face, but none have resulted in fatal gunfire.

    “Be careful,” Engle said.

    Craigslist didn’t immediately reply to a request for comment.

    Springfield gas station robbery thwarted when manager pulls gun, police say

    When a customer raised a maroon towel to his face, police say a Springfield gas station manager grew suspicious.

    The customer allegedly raised his shirt to show a gun a tucked in his waistband.

    But police say the manager had already drawn his 9-millimeter handgun.

    By the time officers arrived at the gas station at about 1 a.m. on Dec. 9, the would-be robber was lying face down on the ground while the manager held him at gunpoint, court documents say.

    The incident is described in a probable cause statement used to charge Anthony Hetherington, 18, with first-degree attempted robbery.

    According to the statement, the gun tucked into Hetherington's waistband turned out to be a BB gun.

    The statement said the attempted robbery took place at the Fast 'N Friendly at 427 S. Glenstone Ave.

    After his arrest, Hetherington told investigators that he was smoking marijuana with a friend before deciding to walk to a nearby gas station with the BB gun, the statement said.

    Police allegedly found $120 in cash, two baggies believed to contain marijuana and a glass pipe in his pocket.

    Court records show Hetherington posted his $15,000 bond. He does not have an attorney listed in online court records.

    Attempts to reach the manager were unsuccessful.

    Oscar and Mario Romero were in their AREA Oklahoma City rooms Monday morning when home surveillance video caught someone at the front door.

    The person kicked in the door, and the Romeros and their parents heard the noise.

    “They just came and scared the crap out of us,” Mario said. “They got him at gunpoint, asking him for money.”

    The home-invader pistol-whipped Oscar, and a gunfight broke out. The home soon was riddled with bullets and shattered glass after a second burglar broke in through the back.

    “I got out of my bed, grabbed my handgun,” Mario said.

    Mario then exchanged gunfire with one of the burglars.

    “His partner had a gun on my father, and that’s when I pointed a gun at him and he shot me,” Mario said. “I went to the floor, but I was able to return fire.”

    He was shot in the pelvis, and the blood-stained floor and piles of broken glass throughout the home are a painful reminder of how deadly Monday’s break-in could have been.

    “It’s getting too common, and people need to start arming themselves,” Mario said. “We would have been 6-feet under or seriously injured.”

    The Romeros believe a third person was involved in the break-in.

    Suspect shot after home invasion attempt at Columbus mobile home

    COLUMBUS, GA (WTVM) - The Columbus Police Department responded to a shooting Monday night at the Seabreeze mobile home community off Crystal Drive.

    Investigators say a man shot a suspect who was trying to break into his home.

    CPD also said the suspect tried to break into the unit through the back door.

    "That's wrong," one neighbor said. "You have a lot of break-ins, but it's not right."

    Police later determined the man living in the home reacted to sounds coming from the back door. When he saw the suspect, police said, he fired his weapon at the intruder.

    The neighbor, who remains anonymous, says this kind of crime should convince other people to install a security system for their homes.

    "Cameras can be for safety. You can catch their face," he said,"or their body when they break in your house."

    Columbus police said the intruder was shot twice. Hours later, investigators found the suspect bleeding from the two bullet wounds. That suspect was sent to an area hospital for treatment.

    Burglary suspects on the run Sunday in south Morrow County picked the wrong canyon for a getaway.

    Daniel Faustino Arce, 28, and Desireea Delane Devin, 23, ended up behind bars after pheasant hunters on TREO Ranches, Heppner, held the desperate duo at gunpoint until officers arrived. Morrow County District Attorney Justin Nelson said a dogged neighbor also played a key role in their capture.

    Nelson said Roger Britt of Heppner spotted a neighbor’s garage open on the 54400 block of Upper Rhea Creek Road and their Jeep Cherokee taking off. Britt found that suspicious, Nelson said, and decided to follow.

    That became a car chase, and the suspects fired one round at Britt. Nelson said Britt broke off and decided to bring in law enforcement.

    Meanwhile, he said, the Jeep thieves broke into a shed on the 60100 block of Valby Road and stole gas cans. From there, they ended up stuck in a ditch and tried to set fire to the Jeep on property belonging to TREO Ranches, where owner Phil Carlson was conducting a pheasant hunt.

    Carlson and his crew drew guns on Arce and Devin until officers from Oregon State Police and the Morrow County Sheriff’s Office arrived. Carlson did not return a call for comment from the East Oregonian, but he posted photos of the apprehension on his Facebook page.

    Police booked the pair into the Umatilla County Jail, Pendleton, and Nelson’s office arraigned them Monday on the following: three counts of first-degree robbery; two counts second-degree burglary; and one count each of first-degree burglary, unauthorized use of a vehicle, third- and first-degree theft, unlawful use of a weapon, and first-degree criminal mischief.

    Nelson said Devin stated during the hearing she lives in Madras and Arce told the court he lives with her. Neither has a real connection to the area.

    “There’s more to the story that we don’t know,” Nelson said, and the sheriff’s office is continuing the investigation and hopes to find the gun they fired at Britt as well as more items from the thefts.

    State court records show Arce began serving two years of probation in August 2016 in Jefferson County for methamphetamine possession, which he violated this past August. Devin faced meth and hydrocodone possession, unlawful possession of a gun and driving under the influence of intoxicants in 2014 in Jefferson County. She took a deal and pleaded guilty to the meth possession and entered drug court and a DUII diversion program. Devin completed diversion in November 2015 and the court dismissed the DUII case against her.

    Nelson said his next step is to take the case to a grand jury for an indictment, which he aims to bring Friday during the next hearing in the case.

    CHICAGO (CBS) — An off-duty Chicago Police officer shot a person Monday evening during an attempted carjacking in the Bronzeville neighborhood on the South Side, police said.

    The shooting happened just before 7 p.m. in the 3600 block of South Prairie, according to police spokesman Anthony Guglielmi.

    The person tried to steal the off-duty officer’s vehicle and was shot during the encounter, Guglielmi said.

    The officer was not hurt.

    The person who was shot was taken to Northwestern Memorial Hospital in serious condition, Guglielmi said.
    Good thing carjackers only target Chicago LEOs and not average citizens.

    I hate to see this. Because he's a cop he has the luxury of living today. And that isn't to say I don't appreciate the job they do. Just makes me sick that the average person isn't afforded the same right.

    Not a traditional self defense situation. This person was in a drug deal gone wrong and was guilty of other crimes. I am including it in the thread because it does give some insight into self defense laws.

    A Grand Junction drug dealer who avoided a murder charge earlier this year after prosecutors determined his fatal shooting of another man was in self-defense has been sentenced to 16 years in prison for other crimes.

    John Daniel Stene, 27, was arrested shortly after the June 17 shooting of 37-year-old Travis Carothers on a street just north of Bookcliff Middle School. Stene — a probationer who initially fled the scene but was later captured by law enforcement using the ankle monitor device that Stene recharged while on the run — told investigators in an interview that Carothers had been robbing him at gunpoint while wearing a mask before Stene reached for his own gun and shot him.

    Mesa County prosecutors declined to file murder charges based on Stene's statement and other evidence that the shooting was in self-defense.

    Stene was charged instead with several other counts. In October, he pleaded guilty to vehicular eluding, possession of methamphetamine with intent to distribute and possession of a weapon by a previous offender in an agreement that allowed District Judge Lance Timbreza to sentence him to 10 to 16 years in prison.

    On Tuesday, almost six months to the day after Carothers' death, prosecutor Mark Hand asked Timbreza to impose the full 16 years.

    "Guns and drugs are a terrible scourge on this community," Hand said, noting that Stene's interaction with Carothers started when Stene came to the neighborhood to discuss a potential drug deal, and escalated when Carothers apparently tried to capitalize on an opportunity for some "quick cash."

    Hand said that, while Stene's story of self-defense was credible, he should be held accountable for his actions.

    "The end result of this tragic event resulted in the death of a father, a son and a friend of many people," Hand said.

    Carothers' family — many of whom have openly opposed prosecutors' charging decision — filled more than half the courtroom. Rebecca Erman, Travis Carothers' wife, said her husband was a devoted father.

    "I never met someone who tried so hard in life and just could never catch a break," Erman said through tears. "The thing I loved most about him is his love for our baby girl."

    Erman said Carothers' death shattered her family.

    "I'm not asking for an apology, but asking that you acknowledge your wrongdoing and the pain you have caused," she told Stene.

    Defense attorney J.R. Davis asked Timbreza to order a mid-range sentence, although he added Stene himself was ready to accept 16 years.

    "Mr. Stene knows that another man is dead," Davis said. "He knows that he is the one that pulled the trigger. He knows that by all accounts that he's the lucky one in this situation."

    Before Timbreza imposed the 16-year prison sentence, Stene spoke briefly.

    "I am truly, deeply sorry for my actions," he said.

    A person with a permit to carry a concealed gun has been released without charges after shooting a man Monday night at a Near West Side store.
    About 5:30 p.m., a 55-year-old man who was naked except for the socks he was wearing caused a “disturbance” outside a retail store in the first block of South Western Avenue, according to Chicago Police.

    The naked 55-year-old broke a glass and was acting menacingly toward others when the concealed carry holder fired a shot, striking the man in the leg, police said.

    The 55-year-old was taken to Mount Sinai Hospital in critical condition and remained hospitalized Tuesday, police said. Charges were pending.

    A 55-year-old man "causing a disturbance outside a retail store" was shot Monday by a person with a license to carry a concealed weapon in the Tri-Taylor Neighborhood on Chicago’s South Side, police said.

    The person who opened fire was a patron inside the store, police said. The incident occurred about 5:30 p.m. in the 0-100 block of South Western Avenue.

    The 55-year-old was hit in the leg and was taken to Mt. Sinai Hospital in critical condition.

    Police originally said the man who was shot was not the intended target, but later issued an update stating that he was in fact who the shooter was aiming for.

    Police tape and squad cars with lights flashing could be seen outside of a T-Mobile phone store and a sandwich shop.

    Authorities did not say which store the shooting occurred in, but officers could be seen inside of the T-Mobile. Officers stood infront of a broken window at the phone store.

    No other details were immediately available.

    Cleveland homeowner fatally shoots robber during break-in, police say

    CLEVELAND, Ohio -- A 41-year-old homeowner shot and killed a robbery suspect Wednesday after the man broke into his home, police said.

    The homeowner was not arrested. A Cuyahoga County grand jury will decide whether to bring charges against the homeowner or whether the shooting was in self-defense.

    The shooting happened about 3 a.m. at a home in the 10600 block of Elgin Avenue, south of St. Clair Avenue in the city's Glenville neighborhood, according to police.

    A 20-year-old man broke into the home, police said. The homeowner shot the man several times, killing him, according to police.

    Officers found the home invasion suspect in the home near a staircase, according to police.

    The names of the homeowner and the man who died have not released.
