    Authorities say no charges will be filed in Allentown killing

    Lehigh County District Attorney Jim Martin said no charges will be filed in the Aug. 26 killing of an Allentown man, saying the shooting “appears to have been justified as self-defense,” according to a news release issued Wednesday.

    Alberto Montanez, 35, was shot at 5:40 a.m. in the 1100 block of West Allen Street and pronounced dead at the scene, according to the Lehigh County coroner’s office.

    Authorities provided no further details about the circumstances that led up to the killing, other than to say the shooting appears to have been justified and “no criminal charges can be proven beyond a reasonable doubt,” the news release states. Montanez lived in the 1900 block of E. Cedar Street, authorities say.

    Authorities did not release the identity of the shooter, but said a “full, complete and extensive investigation” was completed by Allentown police Detective Amaury Almonte and Detective Joseph Vasquez with the county’s homicide task force.

    The shooting happened in a neighborhood of row homes just a few blocks from the Union West End Cemetery.

    Springfield homeowner says he shot intruder

    Springfield police are investigating after a man who lives in the 1800 block of East Keys Avenue said he shot an intruder Wednesday afternoon.

    Police were dispatched to East Keys Avenue at 12:44 p.m. Wednesday for a report of a home invasion. Upon arrival, the man said he shot someone after he forced his way into his home.

    The intruder was dropped off at Memorial Medical Center to be treated for a gunshot wound and is currently in stable condition, police said.

    No arrests have been made, and police continue to investigate.

    A pensioner said that he had no choice but to shoot at a burglar trying to get into his caravan otherwise he would have been killed. Reuben Gregory, 72, said that the intruder was armed with a machete and a homemade grenade at his home in woodland in Colnbrook, Berkshire.

    He said he did not intend to hurt Wayne Digby but it was a case of kill or be killed. When police arrived they found a machete, mallet, cable ties, and a Molotov cocktail made out of half a tennis ball, a flammable liquid and a rag. Mr Gregory said: ‘He came for trouble, he came to harm us, no question about it. I told the police at the time and I’ll tell you again, I only wanted to scare him away, that’s all I wanted to do. I wouldn’t want to harm or injure anybody. ‘That’s not who we are, we’re just normal, ordinary people. If I wanted to hurt people I wouldn’t wait to be broken into – I’d go out and do it.

    ‘That’s why I put the gun down and fired it on the deck. If I’d pointed it up I thought I might have hit him so I pointed it down low, but the police said he must have been crouching just in front of the door which is how I hit him.’ A case against Mr Gregory was dropped, but he said that his life has been ruined.

    He said: ‘When I was locked up in Maidenhead police station I was as sick as a pig, I couldn’t eat, I couldn’t sleep. The only thing I had in there was a cup of tea. ‘It’s not nice knowing you’ve hurt someone and that’s something I think about everyday. He should have woken up, alive, in his bed that morning. ‘All I ever wanted to do was scare him off. I’m really sorry that he died, I didn’t know the person. ‘The whole thing has completely destroyed my life. It was just one second that changed my sister’s and my lives for ever.’

    He added: ‘He would have killed us, definitely, that’s why he was here. If he’d have got through the door I wouldn’t be telling you this today – me and my sister Cathy would both be dead. He meant to kill us. ‘Why would he have brought all that stuff if he didn’t want to use it. He took time to plan to do us harm. I can’t believe that anyone could do that.’ Bare foot man defends putting his trotters on train seat He claimed that up to four people were involved in the plot to attack his caravan but when they managed to get out of their home, there was only one man left.

    Speaking about what happened on the night of the shooting, he said: ‘After hearing noises outside I poked my shotgun through a hole in the door.. I listened but it was all quiet,’ he explained. ‘I held it there for as long as I dared and then I pulled the trigger, that was it. ‘It took me a couple of minutes just to get out the caravan because of what the burglar had done to the door and then my sister and I walked down the path towards the Colnbrook bypass. ‘I had been fast asleep in the caravan at the time but I woke up and my sister Cathy was screaming her head off – she was shouting “Get away from the caravan, leave us alone”. ‘The people outside were laughing, they were enjoying themselves and that’s the honest gospel truth.

    ‘I looked over and there was a person’s arm through the bottom of the caravan door. He was holding a knife and was thrusting it back and forth – if it had cut you it would have gone straight through you. It was a big knife. ‘Then it all went quiet. I listened at the door to make sure there was nobody there and that was it.’ Revealing that it’s not the first time he had been targeted he said: ‘About four years after my father died, around 1983, me and my brother were out and three people came here in the day time,’ he explained. ‘They tied my mother up and took all of her jewellery and any money we had at that point. The only reason I have the shotgun is for my own protection.

    Attorney for woman who shot Knightdale shoplifting suspect says it was self-defense

    KNIGHTDALE, N.C. (WNCN) — The attorney for the woman who shot a fleeing Knightdale shoplifting suspect when he entered her office building on Sept. 18 said in a statement that the shooting was an act of self-defense justified by the law.

    Damon Chetson, of The Chetson Firm, PLLC, based in Raleigh, wrote that the events of that day “[were] entirely a consequence of Deondrea Branch’s own actions that day.”

    Branch, 24, of Clayton, is accused of stealing 10 bras worth $150 from the Walmart located in the 7000 block of Knightdale Boulevard and then running from Knightdale police officers. Branch entered an office building near the Walmart after fleeing, police said.



    Chetson wrote that Branch then broke down a “150-lb solid core door, bent the deadbolt securing it and stormed into” the office of 54-year-old Connie Wells. Wells was working alone in the office, police said.

    According to the attorney, Branch trapped Wells in her personal office and ignored Wells when she screamed at him to “STOP!” It was at that point that Wells “lawfully exercised her right to self-defense with her legally-possessed firearm” and shot Branch in the neck.

    Chetson wrote that Wells “feared Branch would assault, kill, or do her other harm. Another step and Branch would have been on top of her.”

    Police have not released any information regarding what occurred inside the building once Branch got inside other than to say that Wells shot him in the neck.

    “North Carolina recognizes a right of self-defense, enshrined in part in common law that dates back hundreds of years and in the Castle Doctrine which allows a person to defend themselves
    from attack in a person’s home or business,” Chetson wrote.

    CBS North Carolina spoke with Branch’s father, Willie Mitchener Jr., on Sept. 20.

    Mitchener said that although shoplifting is a crime, his son shouldn’t have been shot.

    “A crime is a crime, but there are levels to everything. Shoplifting is not right, by no means, but that is no fashion in comparison to your life,” Mitchener said.


    Mitchener said his son was not armed and that he’s never owned a gun.

    Police wouldn’t comment on that.

    “He is a great kid. In life you make bad choices,” Mitchener said.

    Chetson and police confirm that Wells has cooperated with authorities. No charges have been filed against Wells at this time.

    At last check, Branch was still being treated at WakeMed. Mitchener said his son may never walk again.

    Police have not said what charges Branch will face once he’s released from the hospital.

    Clerk who shot would-be robber cleared of wrongdoing, prosecutor says

    CINCINNATI -- The corner store clerk who shot and killed a would-be robber has been cleared of any wrongdoing, Hamilton County Prosecutor Joe Deters said Wednesday.

    Hananiah Israel, 34, entered Sam's Quick Market on Harrison Avenue in South Fairmount at about 9:30 p.m. Sept. 20. He pointed a pistol at the clerks and demanded money, according to Deters.

    One of the clerks threw cash across the counter while the other shouted for Israel to put down the gun, according to Deters. The clerk then fired one shot, hitting Israel.

    He later died at University of Cincinnati Medical Center, Deters said.

    Deters said Wednesday he was not even taking the case to a grand jury.

    "If you enter a store with a weapon to rob it, you have forfeited your right not to be shot," he said. "And these clerks were lucky they weren't victims themselves. They were clearly defending themselves."

    Burglar who ran from Arkansas property after being confronted by armed neighbor gets 10 years in prison

    A burglar arrested last year after he was confronted by an armed neighbor has been sentenced to a decade behind bars, the Hot Springs Sentinel-Record reported Thursday.

    Trevor Peret Richards, 26, pleaded guilty Monday in Garland County Circuit Court to a felony count of residential burglary in the Dec. 8 break-in at a residence along Bald Mountain Road east of Hot Springs.

    According to a probable cause affidavit cited by the newspaper, a nearby resident saw Richards park and walk toward a home. The neighbor walked behind the home and saw Richards leaving from a sliding-glass door, the affidavit said, at which point the neighbor fired a handgun once into the ground.

    The neighbor later pointed the gun at Richards when the burglar tried to return to his vehicle. Richards fled into the woods and was later arrested about a mile away.

    Shots fired during Marion County home invasion

    Marion County, S.C. (WPDE) — Shots were fired Wednesday night during a home invasion on Olivet Cemetery Road in the Rains community of Marion County, according to Marion County Sheriff Brian Wallace.

    Wallace said three people confronted the homeowner, then left the house.
    He added homeowner pursued the burglars and that's when one of them fired several shots at the homeowner.
    The homeowner fired back, Wallace said.

    No one was injured.

    Sheriff: Homeowner fires on thieves, hits one in leg

    Two people are in custody after an early morning shooting Tuesday off S.C. Highway 252 near Honea Path in Abbeville County.

    A homeowner fired on two men who were attempting to steal a trailer from his yard and hit one in the leg, according to Abbeville County Sheriff Ray Watson.

    Both men were arrested and charged, Watson said.

    The two men had stolen a motorcycle earlier, Watson said.

    Watson said his office was unable to release the men's names at this time. The incident remains under investigation.

    2 arrested in home invasion that ended in shooting

    Two people have been arrested, and a third is likely to be arrested after he recovers from a gunshot wound, Springfield police said, following a botched home invasion Wednesday.

    Stacey D. Martin, 43, of the 900 block of South College Street, and Katelyn A. Tosi, 22, of Massachusetts, face possible charges of home invasion, battery and theft of a firearm.

    The name of the third person, currently in stable condition at Memorial Medical Center, has not been released.

    The incident occurred in the 1800 block of East Keys Avenue at 12:44 p.m. Wednesday.

    The East Keys resident, police said, reported one man, accompanied by Martin and Tosi, forced his way into his house armed with a gun.

    He struggled with the intruder but was able to get away, retrieve his rifle and fire one shot at the intruder. After the gunshot, police said, Martin and Tosi charged inside and wrestled the rifle away.


    All three then fled with both weapons and dropped the gunshot victim off at Memorial Medical Center. Officers located the vehicle and arrested Martin and Tosi. The East Keys resident was not arrested.

    Police declined to discuss a motive for the home invasion Thursday.

    Raytown police looking for burglary suspects after shootout with homeowner


    Raytown police are searching for an armed man — and another person — who exchanged gunfire with the owner of a home the man is suspected of trying to burglarize.

    The incident was reported about 10:40 a.m. Saturday in the 8500 block of East 85th Street.

    Police said a homeowner saw a man burglarizing his home when the man produced a handgun and fired shots at the homeowner.

    The homeowner, police said, fired shots back at the man. The homeowner was not injured.


    A second suspect was in a car parked near-by. Police do not know if the suspects were hit by gunfire. They fled the area after the exchange of gunfire, police said.
