    You can argue whether it was smart or not to shoot the gun in the air, but doing so got rid of the threat.

    Winona woman fires gun to chase away attackers

    WINONA — A woman being attacked fired a weapon Friday in Winona.

    Winona Police Chief Paul Bostrack said no one was hurt Friday when the victim, a 26-year-old woman, was allegedly being assaulted by a group of people with whom she has been having an ongoing dispute.


    According to a Winona police report, the woman came out of a residence in the 1700 block of West Seventh Street and was putting a child in the back seat of a car when she was approached by a group of men and women who argued with her, punched her and hit her with a pole.

    During the fight and argument, the woman's cousin used pepper spray to try to disperse the crowd. When that did not work, the woman told police she did not feel safe, so she removed a gun from her purse and fired three shots in the air, according to the report. At that time, the alleged assailants fled.

    When police arrived, no one was outside, but witnesses directed police to the home where the woman went after the fight. She told police she had fired the shots and handed over a 9 mm Smith and Wesson handgun. The gun had ammunition similar to the spent casings found outside. Bostrack said the woman has a license to carry a firearm.

    Currently, no one is under arrest, and no one has been charged. Bostrack said the county attorney's office will determine whether to charge those who allegedly assaulted the woman or charge the woman with discharging a firearm.

    Homeowner shoots at intruder during home invasion

    BACKUS, Minn. (Valley News Live) Police in northern Minnesota are looking for a man who broke into a home Saturday near Backus.

    The Cass County Sheriff's Office says deputies responded to a report of an intruder. When they arrived they learned a man had made entry into the home but ran off when the homeowner shot at him.

    The intruder is described as white and about 6 feet 5 inches tall with a very large body. At the time of the incident, the intruder was wearing all black clothing.

    The Sheriff’s Office requests that anyone with information regarding the incident or any suspicious activity, please contact the Cass County Sheriff’s Office at 218-547-1424 or 800-450-2677.

    The incident remains under investigation.

    29-year-old ex-boyfriend was killed in self-defense, Athens police say

    A weekend shooting that killed a 29-year-old man is believed to be an act of self-defense, the Athens police chief said.

    Christopher Demond Carter, of Harvest, was killed by his ex-girlfriend's new boyfriend on McClung Lane after shooting and injuring the couple, according to Chief Floyd Johnson.

    After Carter showed up at the boyfriend's home just east of Elkmont Road, an argument erupted and shots were fired. Police were called the scene just before 4 a.m. Sunday. Johnson said Carter shot his ex-girlfriend and her boyfriend -- hitting the woman's leg and the man's arm. Then, the boyfriend went into the house, grabbed a pistol and shot Carter, Johnson said. Carter died in the street.

    "I think this is a case of self-defense," Johnson told AL.com.

    The boyfriend and girlfriend were treated and released from Athens-Limestone Hospital.

    When police arrived, one man was dead and two others had non-life threatening injuries

    "I (met) with our investigators this morning; we went over evidence collected and statements taken in the case," Johnson said in a news release. "Our investigation will be continuing for several weeks to come. We have evidence that will have to be sent for examination and analyses."

    Johnson said once the investigation is complete, the case will be handed to Limestone County District Attorney Brian Jones for presentation to a grand jury. A grand jury will be asked to determine whether the boyfriend should be charged in Carter's death.

    APD: Armed robber shot by store clerk in NE Albuquerque

    Albuquerque Police are on scene of a shooting near Candelaria and Eubank. Police say a person was trying to rob a Circle K store at the intersection and was shot by a clerk at the scene.

    Police say the person who was shot was transported to a local hospital and is currently in critical condition. APD also says the subject may have also been involved in another armed robbery earlier in the day

    Marysville police applaud homeowner’s handling of confrontation with wanted man

    MARYSVILLE, Wash. – Marysville police said a homeowner did everything right when he came face-to-face with a criminal on the lam Monday morning, putting his conceal-and-carry permit to the test.

    The homeowner, Joe Hemrich, said it took the decade of training with his pistol to teach him not to pull the trigger on the man.

    “I swing the door open and say, hey! He turned and that’s when I said, put your hands in the air,” Hemrich said.


    Marysville homeowner confronts wanted man

    Just after midnight Sunday, Hemrich was staring straight into the eyes of a man with whom police said had four warrants out for his arrest.

    Hemrich said he didn’t know that at the time -- all he knew in that moment was this man was holding a baton and was four feet away from his child’s bedroom.

    “Up until two weeks ago, we had 70-degree nights, so those windows are open at night,” he said.

    The father of three held his stance in the doorway, holding the pistol he owned and trained with for 12 years.

    “This the first time in my life it has ever come out of a holster, when I wasn’t at a range,” he said. “I train so I know exactly where it is, exactly how to pull it out, whether my finger is going on the trigger.”

    Hemrich said it’s that extensive training and comfort with his weapon that allowed him to focus on the man in front of him, not on his gun, “which is why no one got shot last night,” he said.

    Hemrich said he’s heard the horror stories of what can happen in situations where homeowners confront criminals. He said when it comes to weapons, good Samaritans can wind up hurting others.

    “You have to know how to use it. If not, you’re just a liability,” he said, talking about his gun.

    Last week, a Bonney Lake homeowner received more than eight years in prison for accidentally killing his neighbor with a stray bullet. The man fired at a man stealing his car. It’s cases like that, said Hemrich, that were in the back of his mind in his situation.

    “I carry a firearm to protect myself, my family, my community with the intentions of never having to use it,” he said.

    Surveillance video captured Hemrich walk the suspect at gunpoint to the front of his yard, ordering the man to the ground and holding him until police arrived.

    “I could see quite clearly there was a good-size knife sticking out the top of his backpack,” he said.

    The entire altercation from when he confronted the man, to when police arrived lasted about five minutes, he said, adding that it was the longest five minutes of his life.

    Marysville police said Hemrich did everything right in Monday morning’s altercation. They said most importantly, Hemrich complied with officer’s commands when they arrived on scene.

    The suspect was reported to be a 23-year-old transient with four warrants for his arrest.

    Man Held at Gunpoint After Stealing Guns

    According to the criminal complaint, on September 14, officers were sent to a residence in Perry Township for a report of an individual in physical custody by the homeowner for possession of stolen firearms. Upon arrival officers saw Pete Lopez, 42, of New Castle, lying on the ground being secured by the homeowner.

    Investigation revealed Lopez had stolen firearms from the homeowner while he was staying at the residence off and on for a few weeks with the homeowners daughter. The homeowner suspected Lopez was the thief and had asked him to return the guns, to which Lopez stated he didn’t know anything about. Eventually Lopez stated he had found the guns and that they were sold to a New Castle drug dealer in exchange for $350.00 worth of narcotics. Lopez also stated he had told the dealer that he had to get the firearms back to the rightful owner and offered $200.00 for the guns. Lopez drove the stolen guns back to the victim at which time the victim took one of the stolen guns out from the trunk, loaded a chamber into it and told Lopez to get on the ground while they waited for police to arrive. Lopez later changed his story stating he had stolen the guns [four shotguns] during the middle of the night while the daughter and homeowner were sleeping and the firearms remained in his trunk until they were returned. He said he stole them to try and sell them but did not have any luck finding a buyer.

    The officer discovered that Lopez had prior convictions of robbery, burglary, and firearms not to be carried without license which would prohibit him from controlling or possessing firearms. Lopez is now facing felony charges of theft, receiving stolen property, and persons not to possess, use, control, sell or transfer firearms.

    18-year-old man dies after he was shot in an attempted robbery near 41st and L Streets

    An 18-year-old man has died after he was shot in an attempted robbery late Monday near 41st and L Streets, Omaha police said.

    Paramedics worked to revive the man, identified as Jose Mario Velazquez, en route to Creighton University Medical Center-Bergan Mercy.

    Velazquez was declared dead at the hospital.

    An employee at Bizarre Tobacco & Accessories, 4037 L St., told police he shot at two people who were attempting to rob the store about 11 p.m., officials said.

    Police still are looking for the second robbery suspect, who reportedly ran to the north. Anyone with information should call 444-5656 or Crime Stoppers at 444-STOP.

    Michael Jackson, who lives about a block away, said he was working in his garage at the time and heard five shots that he thought were fireworks. Then he saw police arrive.


    Velazquez's family members, contacted at their South Omaha home, were visibly upset Tuesday morning and declined to speak at length to a reporter. Velazquez's brother said Jose attended Omaha South High and worked in masonry.

    Omaha Public Schools' records listed him as attending Bryan High School.

    In November 2005, the co-owner of the now-closed Benson Jewelry & Loan, at 61st and Maple Streets, shot an 18-year-old robber to death and severely injured another 17-year-old robber. The Douglas County attorney said at the time that the co-owner shot to protect himself. No charges were filed against him.

    ATLANTA (CBS46) -
    Police have one suspect in custody and are searching for three others after a man was shot while delivering food.

    The victim was flagged down by two females near the intersection of Mellrich Avenue and Wisteria Way in Atlanta when two men came up from behind. One of the men shot the victim in the back. The victim fired back and struck one of the men in the leg. Officers later arrested that man a short distance away from the initial scene.

    Police are currently looking for the two woman and other man. No description has been given.

    Robbery is believed to be a motive for the shooting.

    The delivery driver and suspect that were shot both sustained non life-threatening injuries.

    Firearm holder challenges robbers who shot woman at Mandeville lottery outlet

    MANCHESTER, Jamaica — A young woman, now nursing a gunshot wound, may well be still alive because of the intervention of a licensed firearm holder, who foiled an attempted robbery at a lottery ticket outlet in Hillside, on the outskirts of this Mandeville town on Tuesday night.

    According to the police, there was a similar robbery at another lottery outlet earlier in the afternoon at George’s Valley, also on the outskirts of Mandeville.

    Reports are that, in the Hillside incident, a gunman brandished a gun about 7:35 pm and ordered the shop attendant to turn over money. However, the young woman ran. The gunman fired a single shot hitting her in the buttocks.

    A licensed firearm holder, who was at the business place, challenged the armed robber and there was an exchange of gunshots. The gunman fled the scene.

    Police said the licensed firearm holder was not hurt and they are unsure if the gun assailant was shot.

    Earlier, about 5:45 pm, two gunmen robbed a lottery ticket attendant of cash in George’s Valley. The police suspect the two incidents are related.

    Hempford Wade, Deputy Superintendent of Police in charge of criminal investigations in Manchester, said investigators were making progress.

    “We are getting intelligence that we are following up on and we are hoping that we can make arrests,” Wade said.

    NEW DETAILS: Armed runner stopped sex assault on trails near Rainey Street, records show

    Court paperwork filed Tuesday said an armed good Samaritan stopped an attack on a runner on a popular trail near Rainey Street last week.

    Police have accused Richard Jordon McEachern, 22, of forcing a runner to the ground Friday and sexually assaulting her on the Ann and Roy Butler Hike and Bike Trail near East Avenue and Cummings Street on Friday around 5:46 a.m.


    Austin runners are on edge after a woman was attacked by a man while running around Lady Bird Lake last week. American-Statesman Staff
    Police who responded to the incident found a woman on the trail with no shorts or shoes but being tended to by other runners. News of the attack had sparked fear and anger this week among Austin runners.
