    Homeowner fatally shoots man in self-defense, chief deputy says

    PEARL RIVER COUNTY, MS (WLOX) -
    The Pearl River County Sheriff’s Department is investigating an incident that ended with a fatal shooting Thursday night. Chief Deputy Shane Tucker said it all happened at a home on Carey Byrd Rd. around 8 p.m.

    Tucker said Marty Lee, 43, went to the home armed with a rifle and was “angry with the homeowner.” Tucker said it’s unclear what Lee’s intentions were “but it wasn’t anything good.”

    According to Tucker, an argument broke out and Lee pointed his rifle at the homeowner.

    The homeowner reportedly shot one time, killing Lee. Pearl River County Coroner Derek Turnage said Lee was shot in the abdomen.

    No other shots were fired, and there were no injuries reported to the homeowner.

    Tucker said it appears the shooting was in self-defense and the homeowner was not arrested or charged.

    The investigation is ongoing. Tucker said the evidence will be presented to a grand jury.

    Burglar makes fatal mistake in SeaTac, WA
    Dies from homeowner gunfire

    (SEATAC, WA.) -- From the early information available to police yesterday, it appears a burglar made a fatal mistake in the victim selection process as he was going about his work.

    The King County Sheriff's office says an unidentified man was shot and killed by a homeowner as the man and another suspect attempted to break into a house where a man and his two children were inside.

    The other suspect fled the scene before police arrived.

    Just after 11:00 am SeaTac Police received a call of a burglary to a residence in the 17600 block of 38th Avenu South and shots being fired.

    "When deputies arrived they found a man lying next to a bedroom window dead from apparent gunshot wounds," said Sgt. Cindi West of the sheriff's office.

    "The 35 year old homeowner told police that he heard a noise in the bedroom where his two toddlers were sleeping and when he went to investigate he saw two suspects attempting to break into the window."

    The homeowner told police he fired multiple shots, hitting one of the men and the other man then ran away on foot.

    Police used the Guardian 1 helicopter, multiple patrol units and K-9 team to search for the outstanding suspect but to no avail.

    The investigation is being conducted by King County Sheriff’s detectives who will forward the case, when completed, to the King County Prosecutor’s Office for review.

    The SeaTac Police Department contracts with the King County Sheriff’s Office for police services.

    Armed citizens defending themselves and family members

    In most states the law allows the use of deadly force by a citizen, but only if the citizen is in direct and imminent danger of losing his or her life or of sustaining great bodily harm or if a family member or other citizen is in grave danger of being harmed or killed and there is no other recourse than using deadly force available to the citizen.

    When he pulled the trigger on that gun, the SeaTac homeowner became one of an estimated 6.500 people a day in America - or once every 13 seconds - who use a firearm in defense of themselves or someone else, according to the Journal of Criminal Law and Criminology (1995).

    But actually pulling the trigger and sending a bullet screaming down a barrel, as this homeowner did is a rare event in situations where guns are used defensively, although that is rarely reported in mainstream news media.

    Of the estimated 2,500,000 times every year Americans use guns to defend themselves, 92% merely brandish their weapon or fire a warning shot to scare off their attackers.

    In less than 8% of all gun defensive situations does an armed citizen wound his or her attacker, and in less than one in a thousand instances is the attacker killed, according to a 1997 National Self-Defense Survey by Gary Kleck and Aldine de Gruyter titled Targeting Guns.

    Armed citizens defending themselves have been charged with, and prosecuted for a crime when prosecutors decide that a defender's moment of "imminent danger" has passed, such as in a case where a criminal, at the sight of a gun in a homeowner's hands, turned on his heels and ran away but the homeowner opened fire anyway at the fleeing man or woman killing the person or doing great bodily harm.

    Once the threat has passed, armed citizens generally may not legally deploy lethal force.

    Use of deadly force, Castle Doctrine

    There is also the "Castle doctrine" also known as a "castle law" that may apply in situations like those at that SeaTac home.

    This is a legal doctrine in common law that states a person's "abode" or any legally occupied place such as a vehicle or home, is a place in which a person has protections and immunities permitting one, in certain circumstances, to use force (up to and including deadly force) to defend oneself against an intruder, free from legal prosecution for the consequences of the force used.

    In general, the Castle doctrine negates the duty of a person to retreat when the person is assaulted in a place where that individual "has a right to be," such as within one's own home.

    In such cases the law often finds deadly force was justified and a defense of justifiable homicide applicable, in cases "when the actor reasonably fears imminent peril of death or serious bodily harm to him or herself or another."

    The castle doctrine is not a defined law or series of laws that can be invoked, but a set of basic principles which may be incorporated in some form of the law in many jurisdictions.

    Castlegar, B.C., restaurant owner won't face charges after shooting intruder
    Intruder — who was not seriously injured — has been sentenced to 30 months in jail

    A Castlegar restaurant owner who shot an intruder who broke into his restaurant won't be facing any charges.

    Castlegar RCMP Sgt. Laurel Mathew says the incident took place on Sept. 3 at around 4:40 a.m. PT. The owner of Chameleon restaurant was sleeping in his living space above the restaurant when he heard smashing and glass breaking.

    He went to investigate, she explained, taking his .22 revolver to protect himself.

    "He went downstairs and was confronted by an intruder who bear sprayed him in the face, incapacitating him," she said.

    As he was being sprayed, the owner fired his gun. The suspect managed to run away and the owner called police.

    A few days later, after receiving a number of tips from the public, police were able to nab a suspect, 35-year-old Brandon Malkinson of Nelson.

    Malkinson had been wounded by the gunshot but stayed four days in the Kootenays without going to a doctor or hospital.

    "[After his arrest] he was taken to the doctor by the police, checked over and found to be fit for incarceration," Mathew said, adding he did not have serious injuries.

    30 months in jail for intruder

    Malkinson was charged with numerous offences including breaking and entering and breaching a probation order.

    He was found guilty, Sept. 11. Two days later, he was sentenced to 30 months in jail.

    Mathew says police will not be charging the owner.

    "We considered all the facts and circumstances," she explained.

    "He took a significant blast of bear spray to the face which incapacitated him. At that point, he's protecting himself from who knows what at that point ... His use of force was reasonable under these circumstances."

    A farmer who confronted an armed trespasser with a rifle and turned him in to police has been left shaking his head after officers came back and seized all of his guns.
    Father-of-three David Dunstan was asleep on his rural property at Bungawannah in New South Wales when his dogs started barking at 3:30am on Thursday.
    Upon seeing a strange man, Mr Dunstan unlocked his gun cupboard and grabbed the nearest firearm - an unloaded .22 calibre rifle.

    Mr Dunstan said the intruder proclaimed he 'didn't want any trouble' after spotting the weapon.
    Mr Dunstan's wife called the direct line of the local police.
    Mr Dunstan told Daily Mail Australia he used the gun 'as a prop' to calm the man down and force him into his vehicle.


    Officers from Albury Police Station 15 kilometres away met the farmer on the road and took the man into custody.
    But later on Thursday, officers returned to the property and confiscated Mr Dunstan's three firearms - all of which are registered.
    'I'm just shaking my head thinking "What else could I have done?" It's a bloody joke,' said Mr Dunstan.

    'The gun wasn't loaded and I didn't even point it at the bloke, didn't need to, he calmed right down when he saw it.'
    'What was I supposed to do? By the time the police got here, would they have taken 15 minutes? 20 minutes? I've got three kids in the house.'

    Police confirmed they seized three firearms from a Bungawannah property.
    Officers from Albury Local Area Command arrested an 18-year-old man and charged him with aggravated break and enter with intent - armed, and enter building/land with intent to commit an indictable offence.
    The man appeared at Albury Local Court on Thursday and was refused bail to appear at the same court on November 6, 2017.

    Woman says neighbor who shot her ex-husband during assault saved her life

    DENVER — A woman being assaulted by her ex-husband says a good Samaritan saved her life by stepping in to help Saturday. The ex-husband is now recovering from a gunshot wound to the leg.

    It happened around 11:30 a.m. in the 7100 Block of East Mississippi Avenue.

    The victim says what was supposed to be a child custody exchange between her and her ex-husband turned violent when he started verbally and physically attacking her.

    Neighbors say they heard the argument on the front lawn.

    “We just heard screaming and yelling,” said Jaskisse Scott, who was playing outside with friends.

    The victim said the ex-husband had her on the ground nearly choking her to death.

    That’s when a neighbor came outside to intervene.

    The victim says she told the ex-husband to get off of her. When he didn’t, the neighbor pulled a gun and shot the ex-husband in the leg.

    “They were like, I’ve been shot, I’ve been shot,” said Melissa Tombaugh, who was inside her apartment watching TV when she heard the yelling.

    Police took both the good Samaritan and the ex-husband into custody.

    The victim says she’s thankful the man stepped in, she believes saving her life. She also says police told her the man will most likely not be charged.

    The ex-husband is being treated for non-life treatening injuries. He could face charges.

    Police have not released his name. ​

    Witness describes robbery attempt at Preston Highway business that left suspect hospitalized

    LOUISVILLE, Ky. (WDRB) -- Shots rang out on Preston Highway Saturday morning after LMPD says a man tried to hold up a motorcycle shop - but the robbery attempt backfired.

    The tables were definitely turned on the would-be robber after he went into a motorcycle shop with a gun -- and came out on a stretcher.

    Nicole Smith, who manages the Dollar General Store next door to Wide Open Powersports, says she is no stranger to gunfire.

    "I'm from Detroit," Smith said, "so I'm used to the gunshots."

    But even Smith wasn't prepared for what happened Saturday morning. She says she was in the storeroom around 7 a.m. getting ready to restock the shelves when "next thing I know I hear pow, pow pow! I'm like wait a minute, that sounded close."

    Her instincts were dead on.

    That's around the time LMPD says a man walked into Wide Open Powersports next door and tried to rob the place.

    While police wouldn't confirm the name of the business, Smith told us she knows the owner of the business, and says he told her exactly what happened.

    "He was shaken up," Smith said. "He said that he feared for his life."

    The whole exchange went down in the loading area behind the shop.

    Smith says the owner told her the suspect "held his son at gunpoint and was having him take stuff out of the store to put it in his own truck and basically wanted him to get in and pull off."

    But the owner's son reportedly left the keys to the truck inside the store and went back in to get them -- a move Smith says may have saved his life.

    "He said that he went back in, got the keys, came back out and shot him," Smith said.

    LMPD spokesman Dwight Mitchell confirms the suspect was shot. Mitchell says the suspect was taken to University Hospital but his injuries were not considered life-threatening. Meanwhile, police looked for clues.

    "They came over to review our cameras but you really can't see anything from the angle ours is," Smith said.

    After Saturday's incident, Smith is warning her workers to be extra vigilant.

    "I try to tell all my workers to make good decisions, try to stay safe," Smith said. "We're not here by ourselves. There are always two or three of us."

    As far as Smith's advice for any would-be robber: "You're able body to go up and pull a gun to rob somebody, you're able body to go up and lift something, do something to make sure you're making your money, you're making a living."

    Smith says it's not the first time someone has tried to rob Wide Open Powersports, and that's why the owner eventually got a gun to protect himself.

    LMPD has not yet released the suspect's name, and there's no word on when he'll be released from the hospital

    Police say employee shot man trying to rob business on Preston Highway

    LOUISVILLE, Ky. (WDRB) -- Police say a man who tried to rob a Preston Highway business early Saturday ended up in the hospital instead after an employee shot him.

    According to LMPD spokesman Dwight Mitchell, police were called to reports of a robbery and shooting at a business in the 8600 block of Preston Highway around 7 a.m.

    Mitchell says after the suspect entered the business and announced his intentions to rob it, "an altercation ensued between an employee and the perpetrator which resulted in the perpetrator being shot."

    Mitchell says the suspect was taken to University Hospital but his injuries do not appear to be life-threatening.

    No one else was injured in the shooting.

    Investigation into Thursday night shooting death led to no arrests

    A Poplarville man was shot Thursday evening after he went to a home in the Henleyfield Community to confront the residents.

    Personnel with the Pearl River County Sheriff’s Department received the call at about 8 p.m. that night that a man had been shot outside a home on Carey Byrd Road, said Chief Deputy Shane Tucker.
    Emergency responders arrived to find 43-year-old Marty Lee of 463 Derby Whitesand Rd., Poplarville suffering from a gunshot to his abdomen, Tucker said.

    “He expired a short time later,” Tucker said.
    Investigation into the incident so far shows that before the shooting occurred, Lee went to the home with a gun to confront a resident. At some point during the incident, Lee pointed the gun at one of the residents, prompting another resident to shoot him once in the abdomen, Tucker said.

    While the investigation into the shooting is ongoing, Tucker said it currently appears to be a case of self-defense since Lee brought a gun to the home and allegedly made threats, so no arrests have been made at press time.
    “Even absent the Castle Doctrine, anytime you feel your life or another’s life is in jeopardy, lethal force is authorized,” Tucker said.
    Pearl River County Coroner Derek Turnage said Lee’s cause of death was due to a gunshot to the abdomen.

    Man dies after being shot by security guard in North Philadelphia

    GERMANTOWN (WPVI) -- Police say a man has died after he was shot by a security guard at a corner bar in the North Philadelphia.

    The shooting happpened shortly after 11 p.m. Friday at Germantown Avenue and Cumberland Street.

    Police say that man opened fire right in front of the security guard, hitting a man and woman in their legs. That's when the guard opened fire.

    "Right in front of him he observed this male fire on people that were walking down the street, and that's how we believe this woman and man were shot in their legs," said Captain Drew Techner.

    The 30-year-old man who was shot by the guard was dropped off by an unknown person at Temple University Hospital where he later died.

    The 30-year-old man and 25-year-old woman who were shot in their legs also showed up at the hospital for treatment where they are listed in stable condition.

    Police say they recovered a handgun they believe belonged to the man who died.

    Authorities say the security guard is cooperating with the investigation.

    Not an armed citizen making a difference, but I think stories like this illustrate what most of us know, and some unfortunately find out to late. But if this person and his family are attacked again, he can now be a armed citizen who can make a difference.

    I had to go buy a gun,’ grandfather says after attack at home

    An attack on a grandfather and grandmother in their Griffin apartment appears to be part of a crime trend in that area.

    After he heard a knock at his door, the grandfather, whose name was withheld, opened the door and “I got knocked out,” he told Channel 2 Action News.

    “I remember (the attacker) got right here and said, ‘Give me your money, give me your money,’” he told the news station.
    The attacker repeatedly punched the man on the head, and when his wife begged him to stop, the man attacked her.

    “She was fighting for her life,” he said.

    It was the fourth violent crime to happen at the Griffin Crossings complex this year, and police have responded to two dozen calls that include theft and burglary.

    “People are really reluctant to talk to us,” Mike Natale of the Griffin Police Department said. “We’re trying to bridge that gap as far as letting people understand we’re here for them.”

    The fear is evident with the grandfather. He and his wife have moved because they think they may have been targeted because of their age.

    “I was scared,” the grandfather said. “I had to go buy a gun.

    “Everybody over there, the only security they have is to buy a gun.”

    Sounds like a jealous ex had a fun and used it, and the current boyfriend had to go inside and get his gun to defend himself. In the end the ex who came to his house wound up dead, not the current or the girlfriend.

    Possible domestic dispute in Athens leaves three people shot, one dead

    Domestic incident in Athens leaves one dead, two injured

    ATHENS, Ala. -- The Athens Police Department responded to an overnight shooting that involved three people. All three people were shot and one of the victims was pronounced dead at the scene.

    Athens police say they responded to a call around 4 a.m. Sunday morning about a shooting in the 2400 block McClung Lane.

    When officers arrived on scene they found one shot man, already dead, lying in the street. Officers also found one woman and one man on the porch of a residence, the woman had been shot in her leg and the man had been shot in the arm. They were transported by ambulance to Athens Limestone Hospital where they were treated and later released.

    The incident is being investigated as a domestic dispute. Police say they've been told that an ex-boyfriend of the woman came to the residence on McClung Lane and confronted her about her current boyfriend. After an argument, a gun was pulled and shots were fired by the ex-boyfriend. The new boyfriend ran back in his house got his pistol and shot the ex-boyfriend. Neither the dead man nor the woman lived at the residence.

    The investigation is ongoing and the family of the dead man has not been notified, so no further information can be released at this time.
