    this guy doesn't sound like an "upstanding" citizen. But he legally used a firearm in self defense when his life was in danger.

    Would-Be Robber Shot and Killed; Victims Face Drug Charges

    GREENWOOD, Ind. -- Police still don't have an ID on a man who was shot and killed after trying to rob a couple in their house last night in Greenwood.

    Assistant Chief Matt Fillenwarth with Greenwood Police Department says the suspect approached the house of 21-year-olds Ryan Endress and Katie Whitaker after they said goodbye to a guest at their front door.

    When the suspect tried to rob them, Endress grabbed his gun and fired shots; the suspect returned fire. Endress was shot in the thigh and Whitaker was wounded in the arm.

    "The suspect suffered one fatal gunshot wound," Fillenwarth said Tuesday afternoon. "He ran out of the house towards a car that was waiting for him. Before he could get to the car, he collapsed in the street and died."

    The suspect has not been identified. An autopsy is scheduled for Wednesday.

    Fillenwarth says they have reason to believe the robbery was not random.

    "Statements from the victims indicate this was a drug related robbery," said Fillenwarth. "There [were] several drugs found inside the house."

    Johnson County prosecutor Brad Cooper says both Endress and Whitaker will face charges of drug possession with intent to distribute after police found marijuana, acid, and other controlled substances inside their house.

    Cooper says Endress will not face charges for shooting and killing the intruder, as there is enough evidence to support a claim of self-defense.

    Deadly Days Inn shooting was self defense, Spg. Co. deputies say

    SPARTANBURG CO., SC (WSPA) – The shooting death of two teens in a motel room in Spartanburg County was self-defense, according to the Sheriff’s Office.

    Deputies say three people entered the motel room intending to rob the man inside while a fourth drove the other three to the scene.

    The Sheriff’s Office says they pointed a gun at the victim and assaulted him before he was able to reach his gun and defend himself.

    Spartanburg County deputies say the two deaths appear to be justifiable homicides. Earlier in the day, the Spartanburg County Coroner ruled the two deaths homicides.

    The two men who died were identified as 18-year-old Bryson Miller and 19-year-old Kejuante Clarke, according to the coroner’s office.

    The shooting happened at the Days Inn motel on Outlet Road.

    A third suspect has been identified by the Sheriff’s Office as 17-year-old Ja-Quill Walik Tabbar Morgan of Spartanburg.
    He is wanted on charges of first degree Burglary, Attempted Armed Robbery, and Possession of a Weapon During the Commission of a Violent Crime.

    Anyone with information on the location of Morgan is asked to call Crime Stoppers at 1-888-CRIME-SC.

    The Sheriff’s Office says the identity of the shooter will not be released because he and his family have been receiving death threats over social media.

    The identity of the fourth suspect is not known at this time.

    No charges in store shooting

    The Little B Convenience Store clerk who fatally shot an armed robber in June will not be prosecuted, according to an agreement from Lunenburg County Commonwealth’s Attorney Robert Clement and a multi-jurisdictional grand jury.

    The shooting occurred June 15 when Milton T. Gaither, 34, of Dinwiddie, attempted to rob the store shortly after 9 p.m.

    “Gaither was wearing a mask, displayed a handgun and demanded money from the cash register,” said State Police spokeswoman Corinne Geller shortly after the incident. “As Gaither fled the store, shots were fired.”


    According to Geller, the fatal shooting, which was being investigated by the agency, comes after the robber “displayed a handgun and demanded money from the cash register. As the armed robber fled the store, shots were fired,” Geller said.

    Clement said he called the grand jury, which consists citizens from the counties of Campbell, Charlotte, Halifax, Lunenburg, Mecklenburg and Pittsylvania, to meet on Sept. 11 in Lunenburg to allow citizens to be a part of the process in determining whether charges should be placed.

    Clement said he submitted all of the evidence from the state investigation regarding the incident that occurred on the night of June 15. In a press release, Clement said he also submitted the jury instructions for the four different degrees of homicide and the instructions for self-defense.

    “After hearing the sworn testimony of six eyewitnesses, the investigating State Police agent, a Victoria police officer and the store clerk himself, and after viewing the videos that had been obtained from the store’s surveillance system and from a neighboring restaurant, the multi-jurisdiction grand jury, after due deliberation, returned its finding that the clerk of the store acted in self-defense and that the killing was justified, and that the store clerk should not be indicted for any crime,” Clement said.

    Clement said he would not release the name of the store clerk for safety reasons.

    Gaither had known affiliation with the “Fifth Ward Gang” out of Petersburg according to State Agent Dawn Leslie, said Clement, and had an extensive criminal record of six felonies, including drug distribution near school property, burglary, grand larceny, auto larceny, probation violations and misdemeanor assaults.
    According to Clement, one eyewitness was in the store — a customer right at the counter — when Gaither came in wearing a black hoodie pulled up over his head and a black mask. The clerk and the witness testified that Gaither stuck the handgun to the clerk’s face, hitting him with the muzzle of the gun in the forehead, causing the clerk to step back.

    “The videos clearly showed every move by Gaither from three different camera angles acting aggressively,” Clement said. “The clerk gave him the money from the register, then Gaither demanded the change. He appeared to step away, but then came back and demanded the money from the lottery register.”


    According to Clement, after getting that in the bag, Gaither walked away toward the front door, but then came back again and demanded Newport cigarettes.

    “After grabbing those, he left out the front door,” said Clement.

    According to Clement, the clerk said he feared that the robber might return once again, so he grabbed a .380 handgun at the register and went to the front door, hoping to see which way the robber went so he could tell the police. He had also told his cousin with whom he had been on the phone before the robbery to call 911.

    “When he pushed open the front door, he was shocked to see the robber still in the parking lot about 15-20 feet away, picking up money he had dropped,” Clement said. “The clerk shot upward into the air as a warning shot which is clearly seen in the video. The clerk said the defendant looked back at him and pointed the gun over his shoulder and fired at him. The clerk said he then fired back about four or five times as Gaither ran away.”

    According to Clement, Gaither ran across the remainder of the parking lot, across Main Street and down to Sixth Street in front of the Nazarene Church where he fell to the ground.

    “Sgt. Daniel Medlin, of the Victoria Police Department, said he took the gun of Gaither, which was in the street to his side, checked it, and found that one bullet had been discharged,” Clement said. “It was in the position in the cylinder of the revolver to have been fired and moved to the next round.”

    According to Clement, one witness said she and her husband were in their car in front of Little B when they heard the shots.

    “They turned around and found Gaither lying in the street. The woman said his gun was in his hand, and she kicked it aside and tried to assist Gaither,” Clement said. “One older male witness said he was coming down the street at the time of the shooting and saw Gaither actually shoot his gun toward the Little B store, and then heard other shots.”

    According to Clement, an autopsy was conducted, and the preliminary determination is that Gaither had been struck in the back by a bullet, which is what killed him. He also had a second bullet wound to the buttocks which did not completely penetrate the flesh and actually fell out when he was turned over.

    Clement said he appreciated the cooperation of the witnesses, including the store clerk, who was represented by Robert Hawthorne Jr. and his associate, Brittany Dean, who were allowed by law to sit in for the testimony of their client, but were not allowed to speak up or participate other than to advise their client if necessary.

    What was it that Gunlawyer once said..... something along the lines of "The criminal justice system mostly hates gunowners". This guy exemplifies that. Found innocent and still paying the price on a few different levels.

    'Santa shooter' says he's paying the price after being found innocent

    DETROIT (WJBK) - He became known as the "Santa shooter" for firing at a man who was coming after his female friend while dressed in a Christmas costume.

    Marcus Weldon was acquitted as it was found he acted in self-defense. But more than a year later, he's still having trouble returning to a life of normalcy

    Someone dropped the ball in Marcus Weldon's case and he's the one paying the price for it after a jury found he did nothing wrong in a self-defense shooting that captured headlines.

    Had it not been for a routine traffic stop, Weldon would not have known he was still trapped in the court system.

    "The officer informed me I was under some restriction of bond that I had some PPO or something in my name," Weldon said. "He asked if I had any firearms and if he could search the car."

    More than a year after being exonerated in a self-defense shooting, Marcus Weldon is still aiming for justice.

    He learned the Third Circuit Court and consequently, Michigan State Police, still had him listed as being free on bond after a state trooper pulled him over a few weeks ago.

    That bond should have been cleared the day a Wayne County jury found him not guilty on seven felony charges.

    "There's no way there should be a 15-month lag from the time he was exonerated till even today it's still not completely set," Weldon said.

    Weldon and his lawyer Terry Johnson thought they got the bond situation cleared up last summer after he applied for his CPL but was denied because of the error in the court and law enforcement records.

    But when Weldon applied for his CPL a second time about six months later, he ran into the same problem.

    "We're thinking it's a simple mistake," said his attorney. "Someone just didn't check the box. We thought we had it corrected and we go back and they still don't do the job they're supposed to do. And Mr. Weldon, as a result of this, can't carry a concealed firearm, is still considered out on bond."

    And that's not all. Weldon cannot leave the country or even the state under those bond conditions without risking arrest and being thrown in jail. It is something he was unaware of, when he traveled to Atlanta for the NRA convention in May.

    "I really shouldn't have been out of the state, which I didn't know," he said. "I could have ended up in a county jail. In Atlanta.

    The 3rd circuit court clerk’s office gave different explanations for the yearlong mix up

    First saying it had no clue why Weldon’s bond wasn't cleared, and then blaming the person who posted the bond for not coming in to release it, then finally suggesting Michigan state police did not update its records. This is something MSP denies.

    Johnson ran into the same issue during a visit to the court Thursday.

    "One department would say something, 'Well we did our job and another would say well we did our job,'" his attorney said. "'Well you got to go over here, you got to go to 36th District court.' it was a lot of finger pointing. We're hoping that we finally got it right.”

    Until then Weldon has a message for the court system that dropped the ball in his case.

    "Do what's right," he said. "It's unbelievable. Is this justice? Is this really justice?"

    We reached out to the Wayne County Clerk's office they are vowing to get to the bottom of this issue. Weldon cannot apply for his CPL again until January.

    And he still has not gotten his firearm back after being cleared in that self-defense shooting in December of 2014.

    Dog shot near First Dam expected to recover

    LOGAN — Police report that a dog that was shot Saturday afternoon near First Dam is expected to make a full recovery. The pit bull was hit by a man who claimed it rushed at him and started fighting with his own dog.

    Logan City Police Lt. Tyson Budge said the man told officers he was playing fetch with his retriever at the Ray Hugie Hydro Park around 5 p.m. A group of people with two pit bulls on leashes came to the park. They advised the man to put his dog on a leash. After doing so, the two pit bulls rushed toward him, dragging a woman who was trying to hold them back.
    The man reportedly pulled out a handgun and fired several shots after the two dogs began fighting and biting his dog. He told officers that he fired the gun in the direction of the dogs but hadn’t intended to hit either of them.

    One of the pit bulls was struck, the bullet entering its shoulder and out of its neck. The dog was taken to a veterinary clinic for treatment.
    Budge said it appears the man was acting in self-defense. He did have a permit to carry a concealed weapon.
    No citations were issued but the County Attorney’s Office is expected to review the investigation.

    PICKENS COUNTY, S.C. —
    A man was fatally shot after he went into a home uninvited with a gun, according to Chief Deputy Creed Hashe with the Pickens County Sheriff’s Office.

    Deputies got a report about 9 p.m. Tuesday of a man who had been shot at a home on Walker Street, Hashe said.


    He said deputies found man in the home with multiple injuries consistent with gunshot wounds and the man was taken to the hospital, where he died.

    Witnesses told deputies that the man, who did not live there, came to the home armed with a gun and a confrontation started between him and another person, according to Hashe.

    The witnesses told deputies multiple rounds were fired. At least five adults were in the home when the shots were fired, Hashe said.

    Hashe said detectives found two handguns along with spent shell casings inside the home.

    No arrests have been made and the victim has not been identified.

    LaPlace homeowner shoots, kills suspected home intruder: sheriff

    A suspected home intruder was shot and killed Tuesday night (Sept. 12) in LaPlace by the homeowner, according to the St. John the Baptist Parish Sheriff's Office. The shooting happened around 8 p.m. in the 3000 block of Cambridge Drive, the sheriff's office reports.

    The man, identified by authorities as 27-year-old Kalvin Ferrygood of Garyville, was transported to a New Orleans hospital where he later died, according to the sheriff's office.

    The homeowner, a 32-year-old man who has not been identified nor arrested, told authorities that he opened his backdoor after he heard people talking in the backyard. Ferrygood was shot after authorities say he entered the house through the back door.

    Sheriff Mike Tregre said a surveillance video of the incident shows the suspect 'bumrushed" the home owner.

    "The subject just rushed into him, trying to force his way in," Tregre said. "The home owner opened fire, striking the intruder."

    Although multiple shots were fired by the homeowner, Tregre said the suspect was hit once in the abdomen.

    A hand gun was found outside the home near the back door, Tregre said. Investigators are attempting to trace its origins, he said.

    Investigators also are looking for other suspects. Tregre said the homeowner, had just returned home when he heard "voices" in his backyard, which has a fence.


    "We're trying to identify who that other person is," Tregre said.

    Authorities say the homeowner was not arrested based on his statement to police, information from a witness and physical evidence at the scene, including the surveillance video.

    The district attorney's office will review the case and determine whether to file charges.

    79-year-old Winston-Salem homeowner shoots intruder in head

    WINSTON-SALEM, N.C. — A man has life-threatening injuries after a Winston-Salem homeowner shot him in the head during an attempted home invasion Saturday afternoon, according to a press release.

    At about 2:30 p.m., officers went to a home in the 3000 block of Old Vineyard Road. Upon arrival, they found 26-year-old Lourenco Marcus Reed inside the apartment with a gunshot wound to the head.

    Following an investigation, officers determined that 79-year-old James Thomas Noah and 77-year-old Barbara Ella Melton were in their apartment when there was a knock on the door.

    When Melton opened the door, Reed and an unidentified man forced their way into the residence and began assaulting Noah with a blunt object.

    Eventually, Noah was able to draw his handgun from his waistband and shoot Reed in the head, the release says.

    The unidentified man fled the apartment in an unknown direction.

    Forsyth County District Attorney Jim O’Neil determined that no criminal charges will be sought against Noah.

    APolice: Man fatally shot after entering ex-girlfriend’s home

    UXIER, Ky. (AP) - A Kentucky man has died after Kentucky State Police say his ex-girlfriend shot him when he entered her home.


    News outlets report troopers say 35-year-old Brandon Endicott entered Krystal Shepherd’s home in a Floyd County trailer park Tuesday morning. KSP says Shepherd shot Endicott, who left and was found dead in a neighboring yard. A stray bullet went into a neighboring trailer.

    Shepherd had placed a warrant for assault for Endicott last week. Court records say Endicott had repeatedly hit and used his knee to strike Shepherd in the face, resulting in 16 stitches and broken bones.


    Floyd County Coroner Greg Nelson says Endicott’s body was sent to the State Medical Examiner’s Office for an autopsy.

    Shepherd has not been charged. The case will be presented to a grand jury.

    PD: Armed homeowner in north Phoenix fires shot, suspect flees house

    PHOENIX - An armed homeowner in north Phoenix fired a shot at an armed intruder forcing him to run from his home.

    Phoenix police report that on Saturday, a man later identified as 44-year-old Virgil Edward Hughes, forced his way into a home near 35th and Dunlap avenues. Police say he broke the door jam and rushed into the home.

    The homeowner reported that he saw a handgun on the Hughes’ hip, grabbed his gun and fired one shot, missing Hughes but hitting the wall.

    Hughes continued running into the home crashing into the door before turning around and running out the front door.

    Police located Hughes in the area and say he was in possession of methamphetamine.

    Hughes is from Cottonwood, Arizona and was arrested for burglary and drug possession.
