    The Hillsborough State Attorney’s Office said evidence supported Brody Missler’s account of the Nov. 24 shooting as his father Timothy went for a gun.

    TAMPA — The son of a retired U.S. Marine lieutenant colonel will not face criminal charges in the father’s shooting death at the family’s Lithia home last year.

    A review by the Hillsborough State Attorney’s Office released Tuesday found that evidence supported the account 23-year-old Brody Missler gave to investigators after shooting his father Timothy two days before Thanksgiving. Brody Missler said he feared for his safety because his father reached for a gun during an argument at their home in FishHawk Ranch.

    “Our review determined that the evidence is consistent with the victim’s assertion that Timothy Missler moved to arm himself with a firearm while intoxicated, emotionally disturbed, and having recently been both verbally and physically aggressive toward the victim,” said a summary of the review by the office of Hillsborough State Attorney Andrew Warren.

    Brody Missler told his father not to arm himself but the man “ignored the warnings and picked up the firearm,” the review said. “In response, the victim shot Missler, which caused Missler to fall to the floor with his arm underneath his body.”

    Uncertain whether Missler was still armed, the review said, Brody Missler fired again, causing the fatal wound.

    The review did not name Brody Missler because of Marsy’s Law, a voter-approved amendment to the state Constitution that was meant to protect crime victims but that deprives the public of information long available under Florida’s public records law.

    Warren’s office said the shooter was the victim of an aggravated assault. The Tampa Bay Times previously identified Brody Missler as the shooter based on a search warrant affidavit filed by the Hillsborough County Sheriff’s Office.

    The Sheriff’s Office and State Attorney’s Office made the right decision after a thorough investigation, said Anthony Rickman, Brody Missler’s attorney.

    “This was a tragic situation where my client had to act in self-defense,” Rickman said. “Brody had to make a split-second decision. It’s not something he wanted to do, it’s not something he ever envisioned doing. It’s something he had to do.”

    Rickman said investigators considered the shooting in the context of escalating family tension.

    Man killed in *self defense* shooting

    A Rineyville man was shot and killed Saturday night after police say he began shooting into a home on Village Drive in Elizabethtown following an altercation.

    Irving White, 29, was killed when a man he had been in an argument with a few minutes earlier began to shoot back, striking him, Elizabethtown police say.

    White was shot outside a residence in the 500 block of Village Drive.

    According to an EPD news release, White arrived alone at the residence where there were two adult males inside the home. An altercation occurred between White and the individuals inside, according to an EPD news release.

    After the confrontation, White went to his vehicle and moments later began firing shots into the home, police say. One of the individuals from inside of the home returned fire, striking White. After being shot, White got back into his vehicle and attempted to drive away but after traveling a short distance succumbed to his injuries.

    He was pronounced dead at the scene by the Hardin County Coro*ner*s Office. A postmortem examination will be performed. The investigation is ongoing.

    Elizabethtown police officers were called to the residence around 10:30 p.m. Saturday in regards to the shooting.

    WILDWOOD, Mo. – An 18-year-old Wildwood resident will not be charged for shooting two people Wednesday night after investigators determined the shooting was in self-defense.

    According to the St. Louis County Police Department, the shooting happened just after 7:50 p.m. in the 1100 block of Eagle Creek Road.

    When officers arrived at the residence, they found a 17-year-old dead with at least one gunshot wound. Another man had been shot and was rushed to a local hospital. His injury was not life-threatening.

    Detectives said the shooting wasn’t random. The victims and residents were known to one another.

    Police said the 18-year-old was confronted in his home by two intruders looking to purchase marijuana. Because the pair forcefully entered the residence, the 18-year-old was able to invoke his right to self-defense under the Castle Doctrine.

    Mobile gas station shooting to be treated as self defense

    According to Mobile Police, on Wednesday, December 23, 2020 at 7:07 p.m., police responded to the Chevron Service Station, 3110 Dauphin Island Parkway in reference to a shooting.

    Upon arrival, officers located the male victim suffering from gunshot wounds. The victim's ex-girlfriend stated that she was riding with four of her friends, two females, two males and her friend*s two-year-old child when they spotted the victim off of Club House Road.

    She said that the victim attempted to run them off of the roadway, so they drove to the Chevron Station to get some help.

    The victim followed them to the Chevron station, blocked them in, exited his vehicle, walked to their vehicle confronted them and was shot.

    The victim was transported to the hospital for life-threatening injuries.

    Mobile Police have identified the shooter and this case is being treated as self-defense.

    Deadly Hiawatha Shoot out a case of self-defense, County Attorney rules

    HIAWATHA, Iowa (KCRG) - No one will be charged with the shooting death of a Hiawatha man in a shootout that wounded three other people after the Linn County Attorney ruled it a case of self-defense.

    Joshua Lathrop died in a shooting on May 30th at the Sunset Village Mobile Home Park in Hiawatha.

    Three other people were shot but survived in what Linn County Attorney Jerry Vander Sanden described as a “frenzied gun battle” involving 25 shots with bullets also hitting a trailer and vehicle in the area.

    Lathrop’s family told KCRG-TV9 in September they were frustrated no one had been arrested since police knew the shooter who killed Lathrop was also wounded in the gun battle.

    However, Vander Sanden said the shootout was justified under Iowa’s “Force-Reasonable or Deadly-Defenses” law and ruled no one will face charges directly related to the shooting.

    According to Vander Sanden, two of the shooters, Tyler Bell and his brother Terrone Bell, came to the trailer park after hearing Tyler Bell’s girlfriend had been attacked by two men. Vander Sanden said both Bell brothers came armed with handguns and yelling something to the effect of “gonna get somebody.”

    After being warned the Bells were in the area with guns, Joshua Lathrop confronted the Bells. Vander Sanden said Lathrop’s blood alcohol content was .212 and witnesses described him as “S*** faced” and “in the mood to fight.”

    During the ensuing argument between Terrone Bell and Lathrop, Vander Sanden says Lathrop blocked Bell from leaving. Several residents also joined the argument, bringing with them bats and handguns.

    The argument came to a head when Lathrop punched Bell. Terrone Bell said he believed one of Lathrop’s friends, Truman Harris, was going to shoot him. That’s when Bell pulled his gun and possibly fired a shot. That touched off what investigators determined was two volleys of gunfire.

    In the end, Lathrop was fatally wounded with a bullet piercing his lungs and another in his arm. Ballistics determined Bell fired the fatal shot into Lathrop’s chest and Harris had fired the shot that hit Lathrop’s arm.

    Terrone Bell suffered multiple gunshot wounds, Tyler Bell was shot four times and Lathrop’s friend, Chad Harris, was shot three times.

    Vander Sanden said the investigation was plagued by conflicting witness statements, including an unclear picture of who shot first.

    Vander Sanden ruled “without question, that Joshua Lathrop was the catalyst of this violent encounter.” He noted Lathrop was the initial physical aggressor, prevented Bell from leaving before punching him, which touched off the gun battle.

    Vander Sanden said Terrone Bell fired in self-defense. He says Truman Harris also fired in self-defense, including shots that hit Lathrop, entered a nearby trailer and a parked vehicle. Vander Sanden found Chad Harris also fired in self-defense after the shooting started.

    Tyler Bell will face one charge of carrying a firearm in public without a permit to carry.

    According to the Linn County Attorney’s Office, the guns used by Terrone Bell, Truman Harris and Chad Harris in the shooting were all legally obtained and possessed. The gun in Tyler Bell’s possession was provided to him by his brother, Terrone Bell.

    They said Tyler Bell never discharged this gun and placed it in his vehicle before the exchange of gunfire took place. That gun was legally purchased, but Tyler Bell did not have a legal permit to carry a firearm in a public place.

    Reno Police: One person shot and killed near S. Virginia St., Plumb Ln. intersection.
    One person is dead after a shooting in Reno on Wednesday night.

    Reno Police responded to the intersection of Plumb and South Virginia St. just before 9 p.m. on the report of a shooting near the Motel 6. When police arrived, the found a teenager with a gunshot wound to the head. He was pronounced dead a short time later.

    Minutes after the shooting, someone called police saying they were involved in the shooting and left the scene.

    Reno Police believe this shooting was an act of self-defense to a crime that was being committed.

    Authorities have identified the man killed as 18-year-old Anthony Cussimonio of Reno.

    Anyone who may have been a witness or has any information is asked to call the Reno Police Department or Secret Witness at 775-322-4900.

    Wyoming County Sheriff’s Dept: Shooting was in self-defense

    BAILEYSVILLE, W.Va. (WVVA) The Wyoming County Sheriff's Dept. is investigating after a shooting in Baileysville on Saturday night.

    According to a spokesperson for the department, one man died as a result of the incident. However, at this time they believe the shooting was in self defense.

    Deputies said the incident remains under investigation.

    The Wyoming County Sheriff's Dept. is taking the lead on the investigation.

    A man who shot and killed another man at a Putnam Drive apartment fired in self defense after he was threatened, according to the Tallahassee Police Department.

    The shooting happened around 4:30 p.m. Monday at the Blue Cascade complex off South Monroe Street. When officers arrived, they found a man dead from a gunshot wound.

    "The preliminary investigation determined that the decedent and the victim were in a dispute when the decedent forcibly entered the victim*s apartment making threats," TPD said in a news release.

    TPD, which consulted with the State Attorney's Office, found that the victim, who was also the shooter, acted in self-defense under Florida's Stand Your Ground law, the department said.

    TPD identified the dead man as Cody McKinney, 29. The department did not release the name of the man who shot him because of Marsy's Law, the victim's right amendment

    ALBUQUERQUE, N.M. — Detectives released the name of the man fatally shot in Southwest Albuquerque Saturday evening as well as details of what they say led up to the incident.
    Jayme Fuller, a Bernalillo County Sheriff’s spokeswoman, said the case is being looked at as a self-defense shooting that left 31-year-old Jamie Roman dead.

    “Investigators have referred this case to the DA’s Office for review, and no charges have been filed at this time,” she said.

    Fuller said deputies responded around 5:30 p.m. to a shooting at the Wells Fargo ATM at Bridge and Sunset SW. A woman told dispatch her husband was assaulted by a man wielding a machete after withdrawing money and “shot the attacker in self-defense.”

    She said arriving deputies found Roman dead inside of his vehicle. The shooter fired at least one round and had remained at the scene to speak to investigators.

    “Footage from the scene has been requested, and the investigation is ongoing,” Fuller said.
