    Intruder killed by homeowner had 4 burglary convictions, records show

    Muscogee Superior Court records show the intruder a Kingsberry Street resident shot in self-defense Monday had four burglary convictions.

    Columbus police called to a shooting at 9:50 p.m. said they found 23-year-old Derrick Keyvon Cureton dead at the scene in the 5300 block of Kingsberry Street.

    “The initial investigation indicates that the homeowner was confronted by an intruder and defended himself,” police wrote in a news release, asking anyone with more information on the incident to call Sgt. Michael Dahnke at 706-225-4296.

    Court records indicate Cureton had a history of break-ins, with burglary convictions in 2010, 2011, 2012 and 2013.



    A prosecutor filing notice she would seek recidivist punishment after his most recent offense wrote that Cureton’s burglary cases dated back to his breaking into a man’s home on Oct. 22, 2010. No additional details of that case were available.

    Records show that on Aug. 26, 2011, he and an accomplice were accused of breaking into a home in the 2100 block of Snelling Drive. He pleaded guilty and was sentenced to five years with 12 months to serve and the rest on probation.

    On Feb. 9, 2012, he was charged with burglary for breaking into a woman’s home in the 800 block of Englewood Drive. An indictment further accused him of second-degree criminal damage for kicking another woman’s door, requiring $500 in repairs, and of misdemeanor obstruction for running from the police, both on June 18, 2012.

    He was sentenced to five years, with 16 months to serve and the rest on probation, according to court filings.

    On Nov. 22, 2012, he was accused of battery with physical harm for hitting a Phenix City man in the head. That may have happened in the Muscogee County Jail, as sheriff’s deputies investigated, and the case was handled in Municipal Court like others originating with the sheriff’s office. He was sentenced to serve 12 months’ probation and 60 days in jail.

    On June 16, 2013, Cureton and a second suspect were accused of breaking into a woman’s home in the 400 block of Pinecrest Drive. He was arrested for violating probation the following July 1.

    After Cureton pleaded guilty to first-degree burglary, Judge John Allen sentenced him Dec. 16, 2013, to 15 years in prison with five to serve and the rest on probation.

    POLICE: Louisville suspect shot in chest by victim he tried to rob



    LOUISVILLE, Ky. (WDRB) -- An alleged robber has been arrested months after police say he was shot in the chest by the man he was trying to rob.

    According to an arrest warrant, it happened on Nov. 22, 2016. Police say a man called them to report that he'd just shot 19-year-old (now 20-year-old) Keith Dawson after Dawson tried to rob him.

    Police say the victim told them Dawson walked up to him, pulled a handgun and demanded cash. At that point, the victim said, he gave Dawson $200, and Dawson pistol-whipped him.

    The victim says he then pulled his own handgun and fired several shots at Dawson, hitting him in the chest.

    Dawson was transported to University of Louisville Hospital for treatment of his injuries.

    Police say they later determined that the gun Dawson used to commit the robbery had been reported to Shively Police as stolen.

    The victim was able to identify Dawson through a photo, according to an arrest warrant, which was issued on Jan. 31, 2017.

    Dawson was taken into custody by Louisville Metro Police on Wednesday night. He is charged with receipt of stolen property (a firearm) and first-degree robbery.

    Dawson is currently being held in Louisville Metro Corrections.

    BOARDMAN, Ohio (WKBN) – Police said a man living in Boardman held a break-in suspect at gunpoint until officers arrived.

    The man — a CCW holder — reported that he spotted two suspects going through his neighbor’s car on Devonshire Drive just before 2 a.m. Thursday. He then grabbed his gun and ordered them to get on the ground until officers arrived.

    According to a police report, one of the suspects managed to run away when the man yelled for his girlfriend to call the police.

    The other suspect — a 17-year-old boy — was arrested when officers arrived. He admitted that he and his friend, who he refused to name, were breaking into cars in the area, according to the report.

    The owner of the car said nothing was missing, but the contents of her glove box were scattered across the front passenger seat.

    The teenager is charged with theft, criminal trespass, possession of criminal tools, obstructing official business and a curfew violation. Police said he refused to answer an officer’s questions and was turned over to his mother.

    Police said three other vehicles on Devonshire Drive had been ransacked, although nothing was missing.

    I would not call this a typical armed citizen story. Sounds like both people were consuming drugs before the incident. I am including it because sometimes there is discussion on the forum about whether self defense applies if the shooter is doing something illegal. It depends on the overall situation. In this case doing something illegal did not negate self defense. But there are other situations where doing something illegal does negate self defense. For instance, breaking into someone's house and then killing them when they try to defend themselves. I generally steer clear of if it's not clear case of an upstanding citizen defending themselves but thought this was interesting.

    District Attorney Jim O’Neill has determined that a man who shot and killed another man on Sunday acted in self-defense and will not face any charges, authorities said Thursday.

    Geraldnal Levon Glenn, 53, of Northwoods Circle, died in the 500 block of North Martin Luther King Jr. Drive, police said.

    Investigators gathered evidence at the scene and conducted interviews of witnesses, police said.

    The findings indicated that Larry Donnell Granby, 60, was assaulted by Glenn before the shooting.

    Witnesses told detectives that Glenn was arguing with Granby when Glenn produced a knife and charged toward Granby, police said.

    Granby then grabbed his shotgun and fired once at Glenn, killing him, police said. Witnesses also told officers that alcohol and illegal drugs were being consumed in the apartment in the Claremont Townhomes before the argument between the men.

    Officers arrived shortly after 6:30 p.m. at the apartment in Claremont Townhomes after receiving a report of someone being shot there, police said. Officers found Glenn unresponsive and lying on the ground.

    Attempts to revive Glenn were unsuccessful, and emergency medical technicians pronounced him dead at the scene.

    Investigators presented the evidence that they gathered to O’Neill, police said. O’Neill then determined that Granby acted in self-defense in order to repel Glenn’s attack.

    As a result, no charges will be filed against Granby, police said.

    Monroe police say a fatal shooting last weekend appears to have been done in self-defense.

    “Based on all the information gathered to this point it appears that Colin Bailey acted in self-defense. No charges are pending against Colin Bailey and he is not in custody,” said Monroe police Officer Josh King in a statement.

    Bailey, 19, allegedly shot and killed his father Aug. 5 during a domestic disturbance at their Teil Tree Court home.


    Christopher Bailey, 46, was shot once by Colin Bailey at about 12:19 a.m. Aug. 5, according to police.

    Christopher Bailey was taken to Atrium Medical Center, where he died about an hour later, according to the Warren County Coroner’s Office.

    Police: Armed robbery suspect shot by homeowner in Stockbridge home invasion

    STOCKBRIDGE — A 31-year-old man suspected in a Stockbridge armed robbery is dead following a Tuesday night home invasion and shooting, according to the Henry County Police Department.

    Robert MacDonald was found shot and killed at a home on Kinsey Drive late Tuesday. A homeowner's adult son held MacDonald at gunpoint after he allegedly broke into the home, and after calling for help, MacDonald was shot in his chest by the man's father.

    The Police Department announced MacDonald’s death in a press release Wednesday afternoon. His description matched that of an armed robbery suspect who reportedly held a knife to an employee at a Stockbridge Dollar General one hour before the home invasion, a spokesman stated in the release.

    Officers were called to the East Atlanta Road business at about 9:42 p.m. Tuesday to reports of a robbery, “where the suspect held a knife to an employee and told her to give him the money in the register,” Capt. Mike Ireland stated.

    “The suspect took the money and ran and jumped into the bed of a truck that was waiting outside,” Ireland stated in the release. “A uniform officer who was responding to the scene attempted to stop the vehicle. The male jumped from the bed of the truck and fled.”

    While detectives were still on scene at the Dollar General, another call came in to 911 dispatch at about 10:40 p.m. A man matching the description of the armed robbery suspect had broken into the Kinsey Drive home and was shot, according to police.

    The homeowner told responding officers that he was alerted to the intruder by his dogs barking. After checking the exterior of his home and finding nothing, the man then returned to his bedroom. He reportedly then heard glass break.

    The man's son came face-to-face with MacDonald in a hallway.

    “The suspect approached him in a threatening manner,” Ireland stated, "had cuts on his hands and advised him he was running from the police.”

    Grabbing a nearby shotgun, the son held the man at gunpoint and called for help. His father heard the outcry and came out of his room with a handgun, firing a shot toward MacDonald and striking him in his chest.

    According to police, the men immediately called 911 to report the home invasion and shooting. The homeowner's wife was also in the home at the time of the incident.

    MacDonald was pronounced dead at the scene. No other suspects have been identified in the armed robbery.

    “The incident is still under investigation,” Ireland stated.

    Man shot in groin charged with assault with a deadly weapon

    MILL SPRING – Following an investigation into a domestic incident that involved the shooting of a Rutherford County man on County Line Road on Monday, Aug. 7, the Polk County Sheriff’s Office charged the man who was shot with assault with a deadly weapon.

    Joshua Cuthbertson, 24, of Rutherford County, was charged this week with assault with a deadly weapon with intent to kill and violation of a protection order, according to the Polk County Sheriff’s Office.

    Capt. B.J. Bayne said officers received a report of a shooting around 12:24 a.m. Aug. 6 at the residence of 956 Polk County Line Road.

    Bayne said Cuthbertson was aware that a domestic protection order had been issued against him, which stated that he was to have no contact with his ex-girlfriend, nor could he be at her residence of 956 Polk County Line Road.

    “Cuthbertson waited outside for the individuals at the residence,” Bayne said, “and with him he brought a container of gasoline and a baseball bat. As animals alerted of something outside, Keith Self came out of the residence to check why the animals were barking.”

    Self reportedly smelled a strong odor of gasoline at his vehicle and went to investigate and discovered Cuthbertson hiding behind his vehicle.

    An altercation between Self and Cuthbertson ensued with Cuthbertson attacking Self with the baseball bat, according to Bayne, hitting Self multiple times in the head.

    Self then fired a gun in self-defense, Bayne said.

    Cuthbertson was shot three times, once in the shoulder, once in the groin area and once in the buttocks, according to reports.

    Self reportedly gave first aid to Cuthbertson following the shooting until emergency personnel arrived on scene.

    Cuthbertson was transported to Spartanburg Regional Medical Center for his injuries. He was charged while still in the hospital this week. Cuthbertson has had a couple of surgeries this week but is expected to recover, according to reports.

    Due to Cuthbertson still being in the hospital, no bond has yet been set.

    Pinellas mom shoots intruder who attacked her and neighbor

    TARPON SPRINGS, Fla. (WFLA) – Deputies say a Tarpon Springs mother was attacked early Saturday morning by an intruder she had shot just moments before while trying to protect her 3-year-old child and a neighbor.

    Investigators believe Daniel Morley, 18, was under the influence of drugs or alcohol when he attacked the two women and forced his way into one woman’s condo.

    At 3:56 a.m. on Saturday, Pinellas County Sheriff’s Office deputies responded to a condo at 1344 Pine Ridge Circle East, after receiving a report of a suspicious person yelling and knocking on doors.

    When deputies arrived, they saw 18-year-old Daniel Morley, standing on the second story balcony wearing only boxer shorts. Deputies say Morley fit the description of the suspicious person described in the 911 call. After seeing deputies, Morley ran to the third floor and entered a residence.

    When deputies approached the condo, they heard yelling and banging on the walls inside the residence. Deputies say they knocked on the door and announced their presence. In the meantime, dispatchers told the deputies that someone at the condo was armed with a gun.

    Deputies say Morley opened the door to the residence covered in blood. Morley began attacking the deputies, who used an electronic control device to try and subdue Morley; however, the device had little or no effect. After a violent struggle with deputies, Morley was handcuffed and taken into custody.

    Deputies then checked the condo and found the victims, 31-year-old Brittany Cheek and her 3-year-old child, locked in the bathroom.

    Cheek told deputies what happened. She said she initially heard yelling outside of her apartment. When she looked out of her door’s peephole, she saw Morley physically attacking her neighbor, 52-year-old Susan Bass.

    Fearing for Bass’s safety, Cheek armed herself with her handgun and confronted Morley demanding he leave Bass alone.

    Morley immediately lunged at Cheek, who was standing inside the doorway of her condo. Deputies say Cheek was in fear for her and her 3-year-old’s life when she fired her handgun multiple times striking Morley in the leg.

    Morley then forced his way into Cheek’s apartment and physically attacked her in front of her 3-year-old child.

    When Cheek’s neighbors tried to intervene, Morley fought with them, allowing Cheek and her child time to hide in the bathroom until deputies arrived.

    Cheek’s neighbor, Susan Bass then told deputies what happened. She said that Morley was banging on her door, and appeared to be bleeding from his head. Bass thought he might be hurt and needed some help, so she opened her door. Morley began to make incoherent statements, about God and the devil, and would not allow Bass to close her door. He then became agitated and physically attacked her.

    Bass said she did not know Morley.

    Paramedics treated Bass and Cheek for minor injuries. Deputies say Cheek’s 3-year-old child was knocked down during the attack and received minor injuries.

    Corporal Noble Katzer and Deputy Matthew Ware suffered minor injuries. Deputy Peter Lamborghini suffered injuries to his hands during the violent struggle with Morley.

    Morley was treated at the scene for a gunshot wound to his leg. He was transported to Bayonet Point Hospital and was admitted for serious, but non-life-threatening injuries.

    Deputies say none of the victims knew Morley but they believe Morley was impaired at the time of the incident.

    Morley was charged with two counts of Simple Battery, two counts of Burglary with Assault or Battery, one count of Battery on Law Enforcement Officer, and three counts of Resisting with Violence.

    Morley was transported to the Pinellas County Jail after he was released from the hospital on Sunday. His bond was set at $301,000.

    Prince George's Co. Police investigate fatal shooting after home break-in

    PRINCE GEORGE'S CO., Md. (ABC7) — A home invasion left a suspect dead and the home’s occupant in the hospital.
    Prince George’s County Police are still investigating, but say at around 12:30 p.m., two suspects entered a home in the 12600 block of Lusby Lane in Brandywine and then gunshots rang out. One of the suspects was shot and killed. The other one ran away. One of the home’s occupants suffered non-life threatening injuries.

    The neighborhood is quiet and tucked away. It’s close to open fields and almost seems like a forgotten part of Prince George’s County. Longtime resident William Mouling Sr. says things aren’t the way they used to be.
    “Twenty years ago when I moved here nobody knew where Brandywine was. Now we’ve got new developments, new communities, new kids and it’s growing by leaps and bounds,” Mouling said.

    Mouling said he was shocked to hear someone lost their life in his neighborhood.
    “I was set back when I came into my community today and saw the Prince George’s County Police officers and the tape surrounding this home it just set me back.”

    Even though police aren’t releasing any names just yet, Mouling is relieved to learn it wasn’t the home’s occupant who was killed.
    “They have been here for a very long time. I watched their kids grow up in that house. I’m just glad it wasn’t any of the kids.”

    Police: Man shot while breaking into sister’s home in Dighton

    DIGHTON, Mass. (WPRI) — A New Hampshire man was shot Wednesday while trying to break into a family member’s home in Dighton, according to the town’s police department.

    Police said they responded to Wheeler Street at about 6:40 p.m. after receiving a call from a woman inside the home.

    The caller told police the man was her estranged brother and said he first crashed his car into the vehicles in the driveway then shattered a sliding glass door in the rear of the home in an attempt to get inside.

    The woman’s husband then shot her brother in the abdomen, according to police.

    The suspect, identified as Ronald Whitmore, Jr., was found by police in a backyard pool when they arrived on scene. Responding officers pulled Whitmore out and began treating his wound before an ambulance arrived to transport him to Rhode Island Hospital. Police said his wound is not life-threatening.

    Whitmore, 46, of Bristol, New Hampshire, is facing charges of breaking and entering during the daytime for a felony, home invasion, assault with a deadly weapon and operating to endanger.

    No charges are being filed against the homeowner, according to police.

    The incident remains under investigation. Gregg Miliote, a spokesperson for the Bristol County District Attorney’s office, said the DA’s office and Massachusetts State Police are assisting with the investigation.
