    Tues. 11:30 a.m.: Woman fires weapon at would-be thief

    WARREN – A Willard Avenue Southeast woman fired her personal handgun at a male who punched her in her eye and tried to rob her as she exited her garage Monday just before noon.

    The 40-year-old woman received an apparent minor injury. A police report does not indicate whether the suspect, described as being tall and wearing a red shirt and tan pants, was hit by the gunfire.

    The woman said she had just come home to the 700 block and pulled her car into the garage. As she exited the garage around 11:50 a.m., she was about to set her purse down when the male approached her from behind.

    She pulled out her handgun, for which she has a valid concealed carry license, according to the report. “The suspect then punched her in the left eye and tried to steal her purse,” the report states.

    The male ran away down the driveway, and the woman called 911. While sitting on the porch waiting for police, the male came back through the bushes. She told him to get away or she would shoot, but he continued forward, so she fired at him.

    He fled through the bushes. Police were unable to locate him. The woman refused medical treatment for her eye, which was red and swollen. Nothing was stolen from her.

    Stanislaus County prosecutors say McKayla Dollard was shot to death a few months ago in a downtown alley, but she wasn’t the intended target that day.

    Investigators believe Dollard and two others planned to ambush another woman, who fired a gun in self-defense, fatally wounding Dollard. The suspected shooter has not been found. Dollard’s alleged accomplices have been convicted for their involvement in the crime.

    On Aug. 30, Caroline Clayton, 25, and Dallas Rampley, 34, both of Modesto, pleaded no contest to involuntary manslaughter and assault with a deadly weapon not a gun, the Stanislaus County District Attorney’s Office announced in a news release Thursday.

    The assault charge is considered a strike under the state’s “Three Strikes” law, which can be used to lengthen a prison sentence if either defendant is convicted of another felony.

    Superior Court Judge Scott Steffen sentenced Clayton to five years in prison and Rampley to three years in prison. Prosecutors said Clayton and Rampley could not be convicted of murder because of a change in state law a year ago.

    In September 2018, then Gov. Jerry Brown signed into law Senate Bill 1437, which limits prosecutors’ ability to use the “felony murder rule” to charge accomplices to a homicide.

    Previously, prosecutors could charge suspects with murder if their crime resulted in the death of one of their accomplices. The change in the law became effective in January.

    Deputy District Attorney John R. Mayne prosecuted Clayton and Rampley. Modesto police Detective Joshua Lawrence was the lead investigator in the homicide case.

    The shooting occurred about 6:30 a.m. June 11 in an alley off of D Street, between Sixth and Seventh streets. A dispatcher said someone was screaming and yelling for help. Officers arrived at the scene and found Dollard. The 30-year-old Modesto woman was pronounced dead at the scene.

    Prosecutors said detectives later learned that Rampley, Clayton and Dollard on that day had all planned to beat up Tabitha Leslie.

    Rampley drove Leslie to the location near Sixth Street. Prosecutors said Rampley knew that Clayton and Dollard were waiting there to beat up Leslie, and they had a bat handle. Leslie, who had previous confrontations with Clayton, had a handgun with her.

    Mayne said that at some point Clayton and Dollard became aware that Leslie had a gun, and they were upset that Rampley hadn’t told them that.

    But Clayton and Dollard decided to continue with their plan to beat up Leslie, according to prosecutors. Leslie then fired the gun and shot Dollard.

    Leslie left the area and has not been seen since. Detectives have not been able to question her. Prosecutors said the detectives believe Leslie was defending herself against an attack when she fired the handgun, but they would still like to speak to her about what led to the shooting.

    On Friday afternoon, Clayton was serving her prison sentence at Central California Women’s Facility in Chowchilla and Rampley was serving his sentence at North Kern State Prison in Delano.

    Passenger shoots man who attempted to steal girlfriend's vehicle in Walgreens parking lot
    HOUSTON, Texas (KTRK) -- A man shot an attempted carjacker who allegedly tried to steal his girlfriend's vehicle in northwest Houston.

    Deputies say the attempted carjacking happened in a Walgreens parking lot near Antoine and Gulf Bank around 8:30 p.m.

    The man told deputies he was sitting inside of his girlfriend's vehicle when another man opened the driver's side door, sat down and then told him to get out of the vehicle.

    "They sit in a vehicle or they just walk through hiding, looking for somebody who is in a vehicle to carjack them, or they wait until they come out to carjack them. Be extremely aware of your surroundings," Harris County Sheriff's deputy K.W. Cote said.

    Deputies say the attempted carjacker appeared to have a gun and pointed it at the man, telling him to get out of the vehicle.

    While exiting the vehicle, the victim pulled out his own gun and shot the carjacker in the stomach.

    "The bad thing is, this guy didn't see the guy (carjacker) until he got into the car. You want to look around anytime you get out of a car. Look around you and see who else is around you, see who's watching you because there's always somebody watching you," Cote said.

    The suspect is expected to survive, and he will face criminal charges.

    The man who defended himself will not face any charges.

    - Authorities are investigating a deadly triple shooting in Rockdale County.

    It happened early Monday morning at a residence on White Oak Court.

    According to investigators, three men were shot and killed by the homeowner just after 4 a.m.

    Upon arrival, deputies found the three men suffering from gunshot wounds. One was pronounced dead at the scene and the two others were taken to the hospital where they were later pronounced dead.

    A neighbor told FOX 5's Aungelique Proctor he heard the shots and hit the floor. He described the shooting as a "gun battle" before he heard one of the men pleading for his life right outside his window.

    "He had his left hand on the bullet wound and he said 'Help me, I'm dying," homeowner Brian Jenkins said. "To imagine seeing someone who was just shot laying on your lawn, that's what bothered me and I'm torn up behind that."

    People who arrived on the scene told FOX 5 that they were family members of the three masked men and said the three were teenagers.

    Deputies are working to confirm the circumstances around the shooting. Investigators said the men who were shot don't live at the home, and they arrived with their faces covered.

    Deputies cleared the scene at 3 p.m. A man answered the door at the house on White Oak Court and said the homeowner who did the shooting was distraught and did not want to talk with reporters.

    The house has two no trespassing signs on the property that go on to say "violators may be shot".

    Texas Showboat Drive-In Theater Shooting Leaves One Dead

    Deputies and local firefighters responded to a shooting at a drive-In theater in Hockley Texas, on Monday morning where a failed robbery attempt left one suspect is dead.

    The manager of the theatre opened fire on two masked suspects who attempted to rob the theater on Monday morning, local news reported.

    The incident happened around 2:30 a.m. at Showboat Drive-In theatre in Hockley. According to preliminary information, two men had sneaked into the theatre while it was still open.

    They came out and started rummaging around for things assuming the theater was empty. However, two managers were still upstairs, finishing up their shift, when they heard some noise and decided to come down and check.

    “While they were upstairs alone, they heard some rummaging or something going on downstairs. They came down and immediately found one male that was apparently hiding, possibly in the closet, some type of utility closet,” Harris County Sheriff Ed Gonzalez told reporters.

    It was then that a second suspect, who had a bat and was wearing gloves, confronted them. According to deputies, the suspect began hitting one of the managers with the bat forcing her to draw her gun and open fire.

    "At least one of them had a bat and hit her a couple times. That's when she pulled her gun out (and opened fire),” the Harris County Sheriff's Office said.

    The suspect was shot at least once and died at the scene. The other suspect took off running. Gonzalez said though suspect fled on foot, there could have been a car waiting for him in the parking lot. The search for the second suspect is underway.

    “These folks are just trying to run a business out here— brings up nostalgia from here, I remember coming to a drive-in theater similar to this when I was growing up,” Gonzalez told CW39 Houston. “It’s pretty isolated out here, so they did what they needed to, to protect themselves.”

    Family identifies 2 teens accused in attempted robbery who were killed

    CONYERS, Ga. — Family members identified two of the three teens killed after authorities claim the teens were involved in an attempted armed robbery in Rockdale County early Monday morning.

    The Rockdale County Sheriff's Office said the teens, two 16-year-old boys and a 15-year-old, were killed during an exchange of gunfire. A Sheriff's spokesman said late Monday afternoon that the teens were attempting to rob three people in the front yard of a home, and one of the teens opened fire on the alleged robbery victims.

    The incident happened just after 4 a.m. off Flat Shoals Road on White Oak Court in Conyers.

    Family members identified two of the teens killed as 16-year-old Isaiah Reid and his 15-year-old sibling Jaime Hernandez.

    “They was loving, they was brothers," said LaShawn Thornton, their aunt, Monday evening, speaking of how close they were to each other.

    Rockdale County Sheriff Eric Levett told 11Alive News earlier Monday that the three teens had come to rob the homeowner and his family in the middle of the night.

    “When deputies arrived, they did find masks on the [faces of the deceased] young men," Sheriff Levett said.

    The Sheriff's spokesman said late Monday afternoon that investigators had concluded that "the three now deceased individuals had their faces covered as they approached the residence and attempted to rob three individuals in the front yard. One of the attempted robbery suspects brandished a handgun and fired shots at the residents before one of the intended robbery victims returned fire. The victims of the attempted robbery were all uninjured, but the three attempted robbery suspects were all shot during the exchange of gunfire and succumbed to their injuries, one on scene and two at a local hospital after being transported."

    The brothers' aunt, Thornton, said the family is aching for answers, wondering why the teens went out in the middle of the night wearing masks, wondering why they would have confronted the other family, wondering if the teens had been shot in the back as they were running away, wondering why the three members of the other family--the homeowner, his mother and one other person--were outside in their front yard at 4:00 a.m., wondering why the teens would have walked all the way down that street to the last house in the cul-de-sac, wondering what ballistics tests will show, anxious to get answers about everything.

    "I hope that someone can come forward and let us know what’s going on. Because this is, like, devastating to my family. There are three teens that are dead, now," she said. “And we all loved them.”

    The homeowner, getting word to 11Alive through a neighbor, said he is not ready to comment.

    The sheriff said his office is still investigating, to decide whether the homeowner will face any charges or if this will turn out to be a case of self-defense.

    11Alive Legal Analyst Latonia Hines explained how the "stand your ground law" works.

    "Basically what stand your ground allows for is that you can defend your habitation, property and others with possibly using deadly force," she said.

    "It's going to require a lot of investigation here," she added. " You've got to look at the facts you've got to look at they're talking to the individual who did the shooting, you're also looking at the shell casings to figure out if this really matches what the witness statements are."

    Neighbors react to shootings in Statesboro that happened within hours of each other

    STATESBORO, Ga. (WSAV) – This weekend the city experienced two shootings, that injured two people and left one person dead.

    Authorities said the first shooting happened late Saturday night when an armed man entered an apartment at Cambridge at Southern: The Pines, and the person who lived there defended himself against the intruder with his own gun.

    Gunfire was exchanged and the intruder along another roommate both went to the hospital with gunshot wounds.

    Fox that attacked Maine men showed signs of rabies

    BELFAST, Maine (BDN) -- An Appleton man shot a gray fox to death after the animal attacked him in his yard around noon Sunday.

    Maine state authorities are testing the fox to determine if it was rabid, and even though the results were not available Monday, Heidi Blood, the animal control officer for the town, said she had a “sneaky suspicion” that the test will come back positive.

    “They’re opportunistic animals, but certainly, taking on a person is not normal behavior for them,” she said of foxes.

    The fox had been seen hanging around the neighborhood before it attacked, according to Donald Burke of Appleton, who also was attacked — but not bitten — on Sunday.

    “No one had a clue it would turn on people,” he said.

    But when Burke went for a walk on Appleton Ridge with his black Labrador retriever, Bella, they were startled when they came across the fox behind a stone wall. The dog went after it, and the fox turned on the dog and then came after the man.

    “It grabbed my pant leg. I kicked it, then the fox ran away,” he said. “It happened so quick.”

    Burke then alerted the neighboring family.

    “I said, ‘Wait till you hear what just happened,’ and the girl started pointing,” Burke said. “The fox was in the dooryard, about 30 feet from the house. I said, ‘That’s the fox that attacked me.’”

    The neighbor went to get a gun and the fox went after him, too. The man tripped over the fox and they ended up on the ground together, and the man was bitten on the leg before he could kill the animal.

    The fox was fully grown, Burke said. He estimated it weighed at least 20 pounds. He credits his dog with helping him warn the neighborhood about the fox.

    “She was protecting me,” Burke said. “If she hadn’t made me go for a walk, we wouldn’t have been aware that the fox was out there, and the neighbors could have just come home [to the fox]. Bella is going to be treated like a queen from now on.”

    Rabies has been on the minds of Mainers over the past couple of years, with high-profile cases making headlines in the state and beyond. Those include the Hope woman who drowned a rabid raccoon in a puddle in 2017, a Searsmont couple that used a shovel to kill another rabid raccoon that had attacked their puppy last year and a 95-year-old Brunswick man who beat a rabid fox to death with a board in June 2018.

    Rabies, a disease that’s caused by a virus, affects the brain and spinal cord and can cause death if left untreated. It is spread when a rabid animal bites or scratches a person or animal, or if the animal’s saliva or neural tissue comes in contact with a person or animal’s mouth, nose or eyes, or enters a cut in the skin, according to the Maine Center for Disease Control and Prevention.

    In Maine, the most commonly infected animals are skunks, raccoons, bats and foxes, but it can infect any animal that has hair. In an unusual example, a river otter that bit a woman on a Rockland beach in 2018 tested positive for rabies.

    To prevent exposure to rabies, authorities suggest avoiding contact with wild animals and make sure cats and dogs are up-to-date on rabies vaccination. That’s critical, according to Blood, the animal control officer.

    “Err on the side of caution,” she said.

    Suspect killed during attempted robbery in Rowan County

    ROWAN COUNTY, N.C. - No murder charges will be filed in the shooting death of a Salisbury man during an attempted robbery in Rowan County last week, officials said.

    Robin Worth Jr., 35, was found dead from a single gunshot wound in the front yard of 5920 Foster Road in Woodleaf early Saturday morning. According to investigators, Worth and a second suspect drove to the Foster Road residence in an apparent robbery attempt.

    During the confrontation, deputies said Worth and the other suspect fired multiple shots striking both homeowners. One of the residents returned fire, and Worth was killed. The other suspect took off, leaving Worth in the front yard.

    The homeowners managed to make it to the Davis Hospital emergency room in Statesville. Both were taken to Baptist Hospital to undergo surgery.

    Rowan County District Attorney’s Office has reviewed the case and has said that, based on self-defense, murder charges related to the shooting death of Robin Worth Jr. will not be filed.

    The investigation into the robbery and assault of the homeowners continues.
