    Bystander uses gun to detain man suspected of assaulting Wenatchee store clerk

    A man suspected of assaulting a convenience store clerk early Thursday afternoon in South Wenatchee was held at gunpoint by another man until police arrived.

    Police responded at 12:24 to what at first was a report of a man holding another man at gunpoint at the 76 station at Ferry Street and Wenatchee Avenue, said Captain Edgar Reinfeld of the Wenatchee Police Department.

    While responding, officers learned that an employee at the store had earlier been assaulted.

    “Immediately before officers arrived it became a little bit more clear that the suspect in the assault on the clerk inside the store was the one being held at gunpoint by another citizen,” Reinfeld said.

    The unidentified assault suspect was immediately taken into custody, he said.

    He later was taken to the hospital for injuries suffered in the scuffle.

    Clerk hit in the head with can or bottle

    It started when the suspect attempted to buy alcohol inside the store “basically with his ID, he didn’t have any money,” Reinfeld said.

    “When he was refused he took one of the cans or bottles … threw it at the clerk, hitting her in the head, then came around the counter, shoved her to the ground and continued to assault her,” Reinfeld said.

    When he left the store, the clerk followed him out, yelling for help just as another man was pulling into the parking lot.

    “He stepped out of the vehicle to see what was going on. The suspect came at him in a manner where he thought he was going to be assaulted,” Reinfeld said. “He reached back into his vehicle for a firearm, pointed it at the suspect and told him to stop.”

    The suspect then went around to the passenger side of the man’s vehicle and appeared to be trying to get in the car, where the man’s children were inside, Reinfeld said. The man then knocked the suspect to the ground and held him at gunpoint until police arrived.

    When he is released from the hospital, the suspect faces potential robbery and assault charges.

    The man who held him at gunpoint was interviewed and released, Reinfeld said.

    The investigation into the incident is ongoing, he said.

    Police: 1 teen killed, 1 teen wounded while robbing convenience store in west Charlotte

    A customer inside a 7-Eleven shot and killed a teenage robber and wounded a second teen suspect early today, according to Charlotte-Mecklenburg police.

    The shooting happened shortly before 4 a.m. in the 4800 block of Brookshire Boulevard. Police said the customer, whose name was not made available to media, was licensed to carry a gun.

    Police also did not immediately release the names or ages of the two teens.

    Asked whether the customer might face criminal charges related to the shootings, Lt. Bryan Crum of CMPD’s violent crimes division said the investigation is in an early stage.

    Police said the teens went to the 7-Eleven with an apparent intent to rob the business. Both were “masked up,” said Sgt. Brian Scharf of the robbery division.

    According to police, immediately upon entering the store, one of the teens held a gun “within inches” of the customer’s face and demanded his belongings. The customer complied. The teen holding the gun then went to the store clerk and demanded money from the cash register.

    “At that point, the patron…perceived an imminent and deadly threat and he fired his own legally carried weapon,” Scharf told reporters.

    The teen holding the gun died at the scene, Scharf said. The second teen, who also was shot, ran from the store and was later arrested in the 1200 block of Saratoga Drive, more than a mile away.

    Police said the teen who survived the shooting will be charged as an adult with one count of robbery and one count of attempted robbery. Other charges may follow, police said.

    Scharf called the series of events “fairly uncommon.” He said the teens had no way of knowing that their intended target was armed.

    “I believe in self-defense, but it’s not something we certainly like to see,” Scharf told reporters. “It happened, and everybody has to make their own decision whether their life is in danger or not.”

    After CMPD completes its investigation, the department will ask the district attorney’s office to review CMPD’s findings, Crum said. “We’re investigating all aspects of this case,” he added.

    The killing was Charlotte’s 70th homicide of 2019.

    Less than 12 hours earlier, police were called to the 1500 block of West Boulevard to investigate an unrelated killing. Police identified that victim as 34-year-old Antonio Kirkpatrick.

    Police said Kirkpatrick was shot just before 5 p.m. Wednesday outside of a business complex in west Charlotte. CMPD released no information relating to a suspect or motive.

    Prosecutors: Minneapolis man who fired fatal shots at party in self-defense will not be charged
    The man is still charged with fleeing the police.

    Prosecutors will not charge a south Minneapolis man who fatally shot another man during shootout during a late-night party in the North Loop neighborhood last month.

    After reviewing the case against 27-year-old Robert Buckner, prosecutors determined that he was acting in self-defense, according to Chuck Laszewski, a spokesman for the Hennepin County Attorney’s Office.

    The review found that Buckner shot Pierre Watson, 34, to “protect himself and another” in an exchange of gunfire that occurred in the 1000 block of W. Lyndale Avenue on July 27, Laszewski said. When the gunfire stopped, Watson lay mortally wounded; a short time later, another man showed up at an area hospital with a noncritical gunshot wound to the leg.

    “It was a good investigation by the police and good witness statements and it was pretty clear what happened,” he said, without elaborating on what specific evidence helped prosecutors reach their decision.

    Buckner is still charged with fleeing the police, after he led officers on a high-speed chase through several North Metro cities days after the shooting.

    Robbinsdale police tried to pull him over after learning he was considered a suspect in the homicide and was likely armed, but instead of stopping prosecutors say Buckner drove off. He was arrested several miles away in the basement of a Fridley home.

    Intruder with semi-automatic weapons killed in Warren home invasion

    A Detroit man armed with two semi-automatic weapons was killed when a home invasion in Warren turned into a shootout,” according to a report by WWJ-Radio (FM 950).

    The incident began around 2:30 a.m. Friday at a home on Blancke Drive, in a neighborhood along Hoover Road south of 13 Mile Road.

    According to police a 20-year-old intruder broke into the home and got into a struggle with a 20-year-old man who lives in the home. During the fight, both men were shot.

    The suspected intruder received a fatal wound and was declared dead at the scene. The resident was shot twice, in the finger and thigh, and was taken to the hospital and is reported in critical but stable condition.

    Officers found the suspect near the doorway of the master bedroom. He was surrounded by several $100 bills.

    Police are also interviewing a woman, who was picked up by officers near the home claimed to know the intruder.

    Bailey Johns, who is a neighbor, said all the commotion cut through silence in the middle of the night.

    "My son woke up to go to the bathroom and we heard something that sounded, like, almost in my house and I got up to look out my window and I just seen swarmed with cops," Johns said.

    No names have been released and the incident remains under investigation.

    LAKE CITY, Fla - A Lake City homeowner stopped a burglary in progress Wednesday night and tried to hold the would-be thief at gunpoint until deputies arrived, the Columbia County Sheriff's Office said.

    The accused burglar, later identified as Elbert Gilliard IV, ran out of the house but was spotted coming out of nearby woods, deputies said. One of the responding deputies quickly recognized Gilliard, 32, because of his distinctive facial tattoo.

    Records show Gilliard has had previous run-ins with law enforcement in Lake, Suwanee and Columbia counties.

    According to his arrest report, Gilliard was found inside a Carpenter Road home about 5:30 p.m. Wednesday. When the homeowner discovered Gilliard in his house, he pulled out his .22-caliber pistol and tried to hold Gilliard at gunpoint while he called authorities, deputies said.

    When Gilliard ran, the homeowner followed him, the report said.

    After Gilliard was captured, the homeowner did a walk-through of his house with investigators and found two rifles had been moved and a buck knife that had been in his truck had been brought into the kitchen. The keys to the truck had also been moved and clothes were strewn about the house.

    The report said a cigarette found in a toilet matched the cigarettes in Gilliard’s pocket and that clothing found at the house that did not belong to the homeowner matched a distinct “strange” smell the deputies had noticed from Gilliard.

    Gilliard was charged with two counts of burglary, two counts of grand theft of a firearm and two counts of petty theft.

    Court records show Gilliard was sentenced to one year in prison in October 2010 for battery on a law enforcement officer and resisting arrest. He also served time behind bars in 2008 for criminal mischief.

    Gilliard remains in the Columbia County jail on a $190,000 bond.

    Man shot 8 times, killed on camera; DA drops charges
    Shooting death of Bryan Freidberg ruled self defense, defense of a third party

    SAN ANTONIO - The Bexar County District Attorney's Office last month dismissed a murder charge against a San Antonio man seen on camera last year shooting an acquaintance eight times, killing him outside a Northwest Side home.

    Prosecutors dropped the charge against Scott Ross, 36, on July 3, citing insufficient evidence, defense of a third party and self-defense.

    The early morning shooting of Bryan Freidberg in February 2018, which took place outside a home in the 8300 block of Exbourne Drive and was captured on a home surveillance camera, happened moments after Freidberg pulled a woman out of a vehicle that was in gear.

    As the woman hit the ground and the vehicle rolled away, Ross approached Freidberg and repeatedly fired a handgun at him.

    Ross cooperated with San Antonio police at the scene was actually the person who called 911 after the shooting, according to an SAPD incident report provided to the KSAT 12 Defenders.

    While Ross was not charged at the scene, records show a murder warrant was issued for his arrest in March 2018 and he was arrested weeks later.

    A grand jury then indicted Ross in June 2018, while previous District Attorney Nico LaHood was still in office.

    "When the case came for trial, I reviewed everything we had. I interviewed witnesses. I watched all the witness statements, spoke to detectives. I spoke to officers and it was my opinion and then concurred by the office that there was insufficient evidence to proceed on this case," said Lorina Rummel, first-chair prosecutor for 227th District Court.

    District Attorney Joe Gonzales echoed Rummel's decision.

    "It's her belief and mine that if the grand jury had the information that we have at their disposal, they might not have indicted this case to begin with," Gonzales said.

    43-second clip

    Footage of the shooting was obtained by the Defenders a day before the charge against Ross was dismissed.

    In the 43-second clip, Freidberg, 30, is seen standing next to the driver's side door of a truck while two other people, including Ross, stand nearby.


    Freidberg then reaches into the truck and pulls the woman out of it, causing the vehicle to roll away.

    Ross quickly approaches from the left side of the screen and begins firing at Freidberg, who falls down and disappears from view.

    After the initial barrage of gunfire, Ross circles Freidberg and fires one more shot.

    Ross' final shot came approximately five and a half seconds after he fired his second-to-last shot.

    "It was truly under the law justified," said Ross' attorney Bernard Campion during a phone call last month.

    Campion described Ross and Freidberg as friends.

    He said Freidberg was armed during the incident and that his client fired at Freidberg while he was on the ground because he was still alive and reaching for his weapon a second time.

    8 gunshot wounds

    An autopsy of Freidberg shows that he had eight gunshot wounds, a majority of them to his mid-section.


    Seven bullets or fragments of them were recovered from Freidberg's mid-section, upper leg and finger, while the eighth bullet struck Freidberg in the right arm and exited, the autopsy shows.

    An accompanying toxicology report shows that Freidberg's blood-alcohol level was .106, over the legal limit to drive a vehicle, and that he had cocaine in his system at the time of his death.

    "We just want the truth to be known."

    Freidberg's family members say the footage does not demonstrate a self-defense case.


    "We just want the truth to be known," a brother of Freidberg said via email in late June, less than two weeks before the charge against Ross was dismissed.

    Family members contend that Freidberg reached into the vehicle to stop the woman from driving drunk.

    "District Attorney Joe Gonzales got it right."

    Legal experts who spoke with the Defenders for this story were split on whether they believe the shooting constitutes self-defense or defense of a third person.

    "It's my opinion that our District Attorney Joe Gonzales got it right," said longtime San Antonio criminal defense attorney Adam Kobs, who reviewed the video footage and available details of the case.


    He pointed out that Ross did not aggravate the situation and was actually walking away as Freidberg reached into the truck to pull out the woman, "forcibly removing her from a vehicle that was in gear."

    He also said it appears that Freidberg reaches for his waistline, possibly to retrieve a weapon, as Ross moves toward him with the handgun.

    "Ultimately, my opinion is that this was a justified shooting," Kobs said.

    Differing opinion

    Geary Reamey, a criminal law professor at St. Mary's University School of Law, said based on the video, he sees major problems with treating it as a justified shooting.

    "The law doesn't want you to kill anybody until there's no other choice," Reamey said.

    He described the act of Freidberg pulling the woman from the truck as non-deadly force.


    "To use deadly force against him at that point looks more like retaliation than it does like justification," Reamey said.

    He said the footage is a great example of the "double-edged sword" video has created for law enforcement agencies.

    While video captured the shooting and what led up to it, Reamey said it shows only one angle and misses some details because of its quality.

    Five aggressive acts

    Rummel said the video shows the last of five aggressive acts by Freidberg in the two and a half hours before his death.

    Prior to being shot, witnesses said Freidberg:

    Committed assault choking/strangulation against a woman
    Pursued the woman as she left the home and broke out the rear window of a vehicle she got into
    Pulled the door off the hinges of a vehicle the woman got into
    Grabbed the woman by her head and shook it back and forth as she tried to leave again
    Reached into a truck and choked/strangled the woman as she tried to drive away
    "You can see his entire top half of his body in the vehicle," Rummel said.

    She said Ross intervened on the woman's behalf several times during the previous incidents, prior to ever pulling out a gun.

    She said Freidberg's criminal record, which included serving 10 years in prison for aggravated robbery of a woman using a gun, played no role in her dismissing the case against Ross.

    "Actually, in my decision making, that is the last thing I look at," Rummel said.

    Self-defense, defense of a third party

    The state's statutes for self-defense and defense of a third party are laid out in chapter 9 of the Texas Penal Code.

    According to the penal code, someone can be of the belief that deadly force is immediately necessary if a person attempts to unlawfully remove him or her from a vehicle.

    That justification applies to defense of a third person, if someone believes his or her intervention is immediately necessary to protect a third person, according to the penal code.

    Attorneys could argue that either of these sections of the penal code apply to the Freidberg shooting.

    Police: Man who shot intruder at Camden home should be protected by Stand Your Ground law

    CAMDEN, S.C. (WIS) - Police believe an early morning shooting in Camden during a home invasion was justified.

    The shooting happened in the 700 block of Maggie Avenue around 4:15 a.m. Friday.

    A lady was in her home with her boyfriend and several children when her ex-boyfriend tried to break in, police said.

    The woman called 911, alerting dispatch of the situation and saying she had an order of protection against her ex-boyfriend.

    A deputy with the Kershaw County Sheriff’s Office arrived within minutes, but the ex-boyfriend had already left the area.

    But a short time later, the ex-boyfriend went back to the home. When he forced his way in that time, the woman’s current boyfriend shot the man inside the home, police said.

    The ex-boyfriend ran from the home and was located by a KCSO deputy who called for EMS. Emergency crews rushed the man to the hospital and police say he is expected to make a full recovery.

    Police identified the man as Qurbbit Lewis Jones, 34, of Columbia. He is in custody. This story will be updated with his mugshot when it becomes available.

    Jones faces charges of burglary, first degree and violation of an order of protection.

    At this time, the current boyfriend, who has a valid concealed weapon permit, will not be charged with anything relating to this incident, police confirmed.

    Officials believe the state’s Stand Your Ground law will protect the woman’s current boyfriend.

    KCSO, Highway Patrol and Camden Police Department all responded to the shooting.

    Legal gun carrier shot suspect in 7 Mile triple shooting
    DETROIT (FOX 2)

    - Detroit police are releasing new details about a quadruple shooting on Seven Mile Tuesday night.

    Investigators now say the suspect was one of the victims.

    DPD says the suspect who shot three people after a dice game went awry, is in custody after a man with a CPL used a pistol to shoot him in self-defense.

    An argument broke out after a dice game in the area of Seven Mile and Harlow streets on the city's west side, at about 8:45 p.m.

    Three of the victims, 18, 23 and 24 years old, were hospitalized in temporary serious condition. The condition of a fourth victim, 61 years old, is unknown.

    Police have not released the age of the suspect yet.

    Police: Woman shot while attempting to break into home dies

    A 48-year-old woman who was shot while reportedly attempting to break into a home last month in the Jonathan Parkway area died on Friday.

    Twyla Marie Dillard was found lying on the ground suffering from gunshot wounds in the area of 2677 Jonathan Parkway just before 2 a.m. on Friday, July 19, according to the Columbus Division of Police.

    Dillard was taken to Mount Carmel East Hospital in critical condition.

    Dillard was attempting to break into a residence on Jonathan Parkway while actively violating a Civil Protection Order when the shooting occurred, police said.

    The investigation into the shooting continues, police said.

    Anyone with information regarding this incident, is asked to call the Columbus Police Homicide Unit at (614) 645-4730 or Central Ohio Crime Stoppers at (614) 461-TIPS.

    This is the 65th homicide in Columbus in 2019.

    Detective Jeff Brandt is the lead detective on the case and is being assisted by Det. Laurie Carney.

    Nude man who forced his way into Zachary home shot by homeowner, sheriff says

    A Zachary homeowner shot a nude man who forced his way into a home early Sunday morning, according to the East Baton Rouge Parish Sheriff's Office.

    The incident happened just before 1 a.m. in the 22200 block of Sutter Lane in Zachary.

    The homeowner told deputies that his dog started barking on the back porch so he went outside to see what was happening. There he found a nude man whom the the homeowner told several times to back up.

    The sheriff's office said the nude man didn't listen and forced his way into the home, and the homeowner shot him.

    The man's medical condition wasn't released. The incident is under investigation by the sheriff's office.
