    No charges filed in fatal shooting of Lancaster man: DA

    The Lancaster County District Attorney’s office said an investigation shows a fatal shooting in April 2019 was done in self-defense and no charges will be filed.

    Prosecutors say Tony Torrellas was shot after entering his ex-girlfriend’s house in Lancaster. The woman’s boyfriend shot Torrellas, authorities said.

    The district attorney’s office said the state law known as the Castle Doctrine states “that deadly force can be used against an intruder, but it does not specify how deadly force should be administered.”

    “Our office reviewed all evidence gathered by the Lancaster city police to include: physical evidence from the scene, cellphone evidence from the parties involved, interview reports, an audio recording, and other information pertinent to the investigation,” the DA’s office said in a statement. “Our office applied the law pertinent to this case - specifically, the Castle Doctrine - and determined no charges should be filed.”

    Evidence showed that Torrellas’ ex-girlfriend didn’t invite him to her home on the 500 block of South Queen Street in Lancaster on April 27, the DA’s office said. Torrellas drove to her house following a heated text message exchange. He and his ex-girlfriend have a child together, prosecutors said.

    Torrellas then pushed his way into the home, even though he was warned he was going to get shot, the district attorney’s office said.

    When Torrellas didn’t listen to the warnings, the woman’s boyfriend shot him four times. He then called 911, according to Lancaster City Police.

    Police rendered aid until medics arrived, but Torrellas didn’t survive. He was pronounced dead at the hospital.

    Blood from the gunshot wounds was found inside the house. And the woman and her boyfriend consistently re-enacted the scene multiple times for law enforcement.

    "The reenactments were consistent and supported by physical evidence at the scene, including shell casings that showed the boyfriend fired from the staircase area and Torrellas’ blood which showed he was inside the home when he was shot,” the district attorney’s office said.

    Once investigators made a decision, they asked for some additional time to notify other relatives and friends of Torrellas’ family before the announcement was publicly made. Prosecutors didn’t disclose the names of the woman and her boyfriend.

    The Castle Doctrine states that a person can use deadly force if someone illegally enters or is present within a dwelling, residence or occupied vehicle, or when an individual has reason to believe that the unlawful entry or act is occurring.

    Both conditions were satisfied in this case, prosecutors said.

    Police: Woodbine Resident Shoots, Kills Home Intruder


    A Woodbine resident shot and killed a man who was trying to get inside his home in the middle of the night, Howard County police said.

    The incident occurred at the14000 block of Carriage Mill Road just after 1 a.m. Sunday.

    According to police, the homeowner, Charles Dorsey, 56, of Woodbine, shot and killed Gerardo Alberto Espinoza, 46, of Chantilly, Virginia, as he was trying to get inside Dorsey’s home in the middle of the night.

    Espinoza, who was wearing no shirt or shoes, was reportedly banging on the front door of Dorsey’s residence.

    Police said Dorsey and his wife awoke and repeatedly shouted at the man to leave.

    As Espinoza tried to gain entry, the homeowner fired one shot, striking him.

    No one else was home at the time of the shooting and no one else was injured.

    The investigation is ongoing.

    CROSBY, Texas - A man who was assaulting his wife Sunday was shot by his teen stepson at a home in Crosby, deputies said.

    The shooting was reported about 2:20 a.m. at a home in the 1300 block of Tee Time Court.

    Harris County deputies said it appears the 17-year-old shot his stepfather, who was beating up the teen’s mother.

    The stepfather was flown to a hospital for treatment.

    It was not clear if the teen would face any charges in connection with the shooting.

    Man shot by homeowner after attempted break-in appears in court

    ALBUQUERQUE, N.M. (KRQE)- A man who police said tried breaking into a home in the heights before getting shot by the homeowner appeared in court Sunday morning.

    Isaac Andujo is charged with felony residential burglary following the incident Friday. Police said neighbors heard screaming and three gunshots ringing from the home off of Indian School and Tramway around 5:30 a.m. and then called the police.

    According to the criminal complaint, Andujo broke through a window in the back of the house using a spray can. Police said while he continued to try to get into the home, the homeowner shot Andujo in the hip and continued pointing the gun at him until APD got on scene.

    Sunday, Andujo’s attorney argued that the prosecution failed to prove intent to commit a felony saying that Andujo was simply trying to get into the home to get a glass of water. The judge did not buy it.

    “While his words say one thing, his actions say another,” Judge Brittany Maldonado Malott said. “The fact that he broke through a window to get into the residence, I think a jury could determine that he had intent to commit a felony.”

    Andujo was released Sunday morning. The judge said a preventative detention measure was not filed.

    Andujo’s next hearing is set for September 10.

    NOPD: Would-be carjacking victim shoots armed robber
    Police say a man was shot twice Friday night by the man he was attempting to carjack in New Orleans East.

    NEW ORLEANS — One second, a gun is in his face and a man is demanding he give up his car.

    The next second, a would-be victim of yet another carjacking in New Orleans takes a chance. He reaches for his own gun, turns and puts two rounds into the attempted robber. Bleeding, the unknown suspect runs off in the night.

    That's what New Orleans Police Department officials say happened on Friday around 9:15 p.m. in New Orleans East, at the 7600 block of Forum Boulevard near Paris Road.

    Instead of becoming the latest vehicle robbery of the hundreds under investigation in the Crescent City this year, initial NOPD reports show the attempt was foiled after the suspect was shot by the man he was attempting to steal from.

    According to those NOPD reports, a 35-year-old man was sitting in his car when an unidentified man approached him, gun-in-hand, and told him get out -- instead of complying, though, the driver grabbed a gun in his possession and shot the suspect.

    The police were called to the scene and an investigation into the armed robbery with a gun was opened. The unidentified robber was still at large as of Saturday night.

    The identity of the would-be victim and whether or not his gun was properly registered was not immediately known, and no other information was immediately available.

    A Canton couple told police they awakened to being pistol-whipped and then the homeowner grabbed his own gun and killed one of the would-be robbers.

    CANTON A northwest Canton couple awoke about 2 a.m. Monday to two masked men pistol-whipping them in a home-invasion robbery attempt — until the homeowner pulled the trigger of his own gun multiple times.

    Canton police say one of the robbers was fatally shot, driven to an area hospital by “an unidentified third party,” as police continued searching for the other robber later Tuesday morning.

    Nicholas A. Hug, 24, of 1815 Trinity Pl. NW, was pronounced dead at 2:10 a.m. Monday at Aultman Hospital, according to a news release from the Canton Police Department.

    Police Capt. Dave Davis said a couple who live in the 2600 block of Second Street NW was asleep when they were awakened by two men striking them with guns, one weapon being a rifle Hug was using. Davis said the victims did not know the men.

    At some point during the attack, the robbers left the bedroom and went downstairs in search of money, detectives believe. But by the time they headed back up the stairway, the homeowner retrieved his own pistol.

    He opened fire on them, shooting Hug several times, Davis said.

    As the other robber fled the scene, Hug was taken by another person in a silver Cadillac to the hospital where he was then pronounced dead.

    The homeowner told the officers someone broke into his house a week before. Details of that incident were not available.

    Davis said detectives did not yet know whether the two incidents are related.

    No one else has been charged in the robbery.

    “We are still investigating at this point,” Davis said, adding police are reviewing private surveillance video from homes in the area.

    Stark County court records show Hug went to prison last year for improperly handling weapons in a motor vehicle, having weapons under disability and obstructing official business. The court records also show he went to prison in 2015 for carrying a concealed weapon, driving under suspension, failure to comply with police, two counts of felony obstructing official business and three counts of receiving stolen property.

    Homeowner Fires Warning Shot at Intruder to New Hampshire Home

    Michael Thompson said he awoke to find the intruder inside his D'Amours Avenue home

    A New Hampshire man who woke up to find a burglar inside his Rochester home early Monday morning is recalling how he fired a warning shot at the intruder.

    Michael Thompson told NBC10 Boston he has only used his gun for target practice, but when someone broke into his D'Amours Avenue home at about 3 a.m., he was certainly glad he had something to protect his family.
    "I keep it under my mattress on the side of the bed I sleep on," he said.
    Thompson said he woke up to a strange noise.

    "I heard a scratching coming from our living room and I thought it was our cats," Thompson said.
    When he noticed a light on at the end of the hallway, he knew it wasn't his cats.
    "I grabbed my gun and went down the hallway as quietly as I could until I saw the guy," he said.

    A stranger was there, standing in his living room.
    "That's when I just shot and he ducked," Thompson recalled.
    Thompson's girlfriend Breana Hillsgrove woke up to the commotion.

    "I was freaking out," she said. "When I saw the gun hole it took me back."
    The couple said the intruder took off running and they called police.
    "That's the risk you take breaking into somebody’s house," Rochester Police Capt. Todd Pinkham said.

    Pinkham said the intruder is lucky he wasn't killed.
    "Somebody can use deadly force to protect themselves, a third person, from anyone breaking in or harming them," Pinkham explained.
    He added that it does depend on the circumstances.

    The homeowners say the man broke in through an open window that they now realize was an open invitation.
    "I think ours might've been slightly cracked, which is why he chose that point of entry," Hillsgrove said.
    They say it was a lesson learned the hard way.

    "Lock your doors, make sure your windows are closed all the way," Thompson said.
    The couple says they did not recognize the man and have no idea what he could've been looking for.
    Police said a K9 track turned up nothing so the suspect is still on the loose.

    Robber shot dead during Phoenix home invasion

    Durban - A Phoenix resident shot dead a robber during a hold up at his home on Longcroft Drive on Tuesday.

    It is alleged that in recent months a gang of robbers have been conducting a reign of terror in Phoenix by holding up homeowners and their families in the early hours of the morning said Marlan Naidoo a spokesman for a private security company, GBH Security and Training who had responded to the robbery.

    Naidoo alleged that one of the robbers wore a jacket that had been taken from a previous house robbery in Phoenix.

    Police spokesperson Captain Nqobile Gwala said is that at 2.20 am the family members were asleep in their house when four men brandishing firearms entered the premises.

    "The owner took cover and managed to take his firearm. A shoot-out ensued and one suspect sustained gunshot wounds to the body. He was declared dead at the scene. An unlicensed revolver was found next to the body of the deceased suspect," Gwala said.



    Charges of robbery, attempted murder and an inquest are being investigated by Phoenix SAPS.

    The Longcroft incident took place approximately 220 meters from the Phoenix police station.

    "This is definitely the same syndicate conducting a spate of robberies in the area," Deodutt said.

    On July 11, six men held up a family in Starwood at 4.30 am. They tied up the family and robbed them of household goods and took the homeowners vehicle. A day later a family were held up in Redberry Park at 4.45 am. Police said that a family member heard noise and went to investigate. Upon investigation, he was confronted by two armed men who robbed them of cash, jewellery, cellphones and fled with the complainant's vehicle.

    Jonathan Annipen an eThekwini councillor with the Minority Front and a Phoenix resident said crime was a daily occurrence and the fact that the police were under-resourced in terms of manpower and vehicles made it difficult for visible policing.

    "The community policing forums and crime Watch groups are limited in what they can do and so you get this kind of reaction from the homeowner who is trying to protect his family," he said.

    Annipen said Phoenix was not a wealthy community and any sort of attack on peoples livelihood will not be tolerated.

    "It is a stark reality and a clear indication of the poor functionality of our judicial system and its ability to pronounce appropriate judgement on perpetrators who are often repeat offenders in such crimes. This is further exacerbated by the ill-performance of the SAPS in so far as swiftly apprehending criminals, collating evidence which would guarantee definite prosecutions and ultimately prevent re-occurrence of similar crimes," Annipen said.

    Umesh Singh, Phoenix Community Policing Forum chairperson, said crime is on the increase everywhere but we he noticed was the time for robberies has changed to the early hours of morning.

    "Maybe the robbers fell like this because its winter and people are sound asleep. They certainly had a rude awakening at this home. I advise people to be on the look out and arm their alarms systems even at night when your at home. The alarms will pick up on intruders,"Singh said.

    Charges filed against Lehi man shot four times while reportedly trespassing

    A Lehi man is facing a felony charge after he reportedly broke into an apartment wielding a knife and was shot several times by another man inside the residence.

    Around 8:30 p.m. on July 13, officers responded to a Lehi apartment and found 26-year-old Ted Powell running down a flight of stairs and bleeding from four gunshot wounds.

    He was transported to the hospital and received treatment before being transferred to the Utah County Jail. He was charged on Friday with aggravated burglary, a first-degree felony, and criminal mischief, a class B misdemeanor.

    According to court documents filed in 4th District Court, Powell told officers he was trying to rescue his ex-wife whom he believed was being held captive inside the apartment.

    There were four people inside the apartment at the time of the shooting, police reported. The man and woman who live at the residence told investigators that Powell knocked on their door earlier in the day and refused to leave until police arrived.

    The couple did not know Powell and believed he was under the influence of drugs, police reported. They asked officers to trespass Powell from the area.

    Later that same night, the couple were playing games with another couple when Powell started knocking on the door again. One of the men reportedly looked out a window and recognized Powell from earlier.

    The two women called 911 and retreated to a back bedroom as the two men armed themselves with two handguns.

    One of the women said she heard “the front door handle being jiggled and loud knocking, followed by very loud banging on the door that made the upstairs level shudder,” court documents state.

    As the door broke, one man stayed in the hallway as Powell reportedly entered the apartment with a knife.

    “He yelled at the intruder several times, demanding that he leave immediately. The intruder refused to leave and (the man) feared for his safety and for the safety of his family behind him. When the intruder advanced toward (him), he fired two or three rounds at the intruder, advancing down the hallway,” police reported.

    The man continued to shoot until the gun was empty and then went to the bedroom and held the door closed until police arrived, according to charges.

    Neighbors also told investigators they heard one of the men shout “get out,” “this is trespassing,” and “you need to leave” during the incident.

    In interviews with police, Powell said he did not remember causing any damage or using force to enter the apartment.

    Investigators also found one of the bullets entered an unoccupied home to the south, going through three walls and broke a water pipe. Officials estimated the building sustained about $5,000 in damage.

    He is being held without bail and the next court appearance is set for July 23.

    Man Shot During Robbery Attempt in South L.A.: Police

    A man was fatally shot inside a vehicle while attempting to commit a robbery early Sunday in South Los Angeles, according to police.

    The shooting occurred about 4:10 a.m. at a location in the 7300 block of South Normandie Avenue, Los Angeles Police Department Officer Rosario Cervantes said. The area lies along the border between Manchester Square and Vermont Knolls.

    Cervantes said the man was fatally shot while trying to commit a robbery, and the person he was trying to rob was also inside the vehicle. It's unclear whether the suspected robber was trying to steal the vehicle or rob the man.

    No other details — including how the gun was fired or who it belonged to — have been released by police.

    The investigation is ongoing as LAPD units were still on the scene several hours after shots broke out, Cervantes said.
