    JACKSONVILLE, Fla. - Three Jacksonville-area homicides have been ruled justifiable by the State Attorney's Office.

    The cases include a 2014 deadly shooting at a Westside apartment, a shooting death of a man in 2015 in Oceanway and a man who was killed in a 2015 Orange Park pool hall shooting.

    Though the 2014 case was ruled justifiable in 2015 and the two 2015 cases were ruled justifiable in 2017, it's unclear why that information was recently released by the State Attorney's Office despite repeated open records requests made by News4Jax.

    Deadly shooting at Westside apartment complex

    On Nov. 2, 2014, Alton Finney, 25, was shot and killed at the then-Eureka Gardens apartments. Germaine Dubose claimed self-defense under the state’s castle doctrine, according to the State Attorney's Office review.

    Dubose told police he and Finney knew each other, and had been drinking and watching football. Finney left to visit a woman and she asked Dubose to get him out of her apartment, which led to a fight between the two men, the State Attorney's Office said. Dubose returned to his apartment, where authorities said Finney had left his gun. The State Attorney's Office said Finney came after him and kicked in the door. Dubose’s wife and child were also home. Dubose fired multiple times, and killed Finney with his own gun, according to the State Attorney's Office.

    The shooting was ruled justifiable by the State Attorney's Office on Feb. 17, 2015.

    Man shot, killed in Oceanway

    On Sept. 9, 2015, Patrick Fowler, 35, was shot and killed in Oceanway. Fowler had dated the daughter of 72-year-old Sandra Vinson. It was an abusive relationship, but the woman did not report it to the police, according to the State Attorney's Office review.

    Several months earlier, the review said, Fowler broke into Vinson’s house, and she chased him off by firing one shot in the air. Fowler was arrested in the burglary and his father warned Vinson's daughter he felt her life was in danger, the review said.

    On the morning of the shooting, a neighbor was at Vinson’s home working on her air conditioner. Fowler allegedly showed up, yelled at Vinson, “I got something for you” and slammed the man to the ground, the review said.

    Vinson got her gun again and fired several shots at Fowler, the State Attorney's Office said. He was found dead in the road.

    The shooting was ruled on Jan. 13, 2017, as a justifiable use of deadly force, according to the State Attorney's Office review.

    Man killed in Orange Park pool hall shooting

    On Nov. 6, 2015, Michael Rogers, 43, was shot and killed outside Park Avenue Billiards in Orange Park.

    Rogers was a member of the Outcasts motorcycle club. He was there with other Outcasts. Covelle Houston was a member of the Soul Brothers motorcycle club. As Houston and four other Soul Brothers left the club, they were surrounded by the Outcasts, according to court documents. The Outcasts ordered Houston and the Soul Brothers to hand over their vests, and when they refused, the Outcasts tried to rip Houston’s vest off, then grabbed his wallet chain, court documents show. Houston drew his gun and fired multiple shots, killing Rogers and wounding another Outcast, according to court documents. Both men were in possession of knives and other weapons, the court documents stated.

    The shooting was ruled justifiable under the "stand your ground" law by the State Attorney's Office on May 18, 2017.

    No charges to be filed in fatal Macon County home invasion
    NEAR CALLAO, Mo. —

    Macon County Sheriff Kevin Shoemaker gave KTVO an update on Wednesday regarding a deadly home invasion last fall.

    That fatal shooting happened September 25, 2018, at the Grant Cole residence on Macon County Route UU, northwest of Callao.

    Shoemaker told KTVO that, after reviewing the autopsy and toxicology reports for Jonathon Richardson, 37, of Gladstone, Missouri, County Prosecutor Josh Meisner decided no charges will be filed against Cole.

    Investigators said Richardson was high on methamphetamine and armed with a loaded handgun when he broke into Cole's home in the middle of the night.

    The sheriff said Cole shot Richardson six times, killing him. The intruder was pronounced dead at the scene.

    Richardson was shot four times in the head, once in the chest and once in the back.

    The sheriff's office said Richardson's weapon had been fired at least one time.

    The homeowner was not injured.

    HOUSTON, TEXAS — A planned attack on a family was thwarted by the son who was returning to the home with his mother. Upon arrival, chaos was happening inside the home as 3 armed intruders ambushed the father as he arrived home from work and forced him inside.

    Deputies: Mullan woman was acting in self defense when she shot man in the face

    MULLAN, Idaho - A Mullan woman was determined to have been acting in self defense when she shot a 50-year-old man in the face on April 1.

    The Shoshone County Sheriff’s Office said the incident began as a domestic violence incident.

    Deputies took Terry Ullom into custody on a felony fail to appear warrant for separate charges out of the State of Colorado. However, SCSO has recommended charging Ullom with domestic battery and attempted strangulation

    Ullom was taken to the hospital and is expected to recover from the gunshot wound.

    The victim, a 60-year-old woman, has not been named. She was taken to the hospital for injuries she suffered during the physical altercation. SCSO said she will not be charged in the shooting, as she was defending herself.

    Utah police investigating 2 shootings in Salt Lake City, West Jordan

    SALT LAKE CITY — A man shot outside a Salt Lake house Wednesday remained hospitalized Thursday and was being guarded by police.

    The incident is one of two shootings that occurred in Salt Lake County Wednesday night. The second was reported in West Jordan.

    Just after 10 p.m., a woman in the 100 West block of Paxton Avenue (1180 South) heard her dog barking and went outside to investigate. She was confronted by at least two men and an altercation ensued, according to Salt Lake police.

    During the confrontation, one of the men in the yard pulled out a handgun. That's when a man inside the house came outside with his own handgun and shot one of the men in the yard, police said.

    The gunshot victim was taken to a local hospital with critical injuries. Police say he is considered a suspect and was being watched by officers. Investigators say the couple at the house have been cooperating with authorities and no other arrests had been made as of Thursday.

    Police are investigating to determine whether the incident was a case of self-defense.

    York City Police chief: Fatal shooting could be a case of self-defense

    York City Police said they responded to 702 W. Princess St. about 9 a.m. April 10, 2019, and found a male dead of at least one gunshot wound. John Pavoncello, 717-505-5449/@Jpavoncello

    A York City man fatally shot Wednesday inside a west-end York City home allegedly assaulted a woman who lives there — and was released from county prison less than a week ago after posting bail on those charges.

    Christian Ivan Gutierrez-Rosado, of the 900 block of West Locust Street, was killed about 9 a.m. Wednesday, April 10, inside 702 W. Princess St., according to the York County Coroner's Office, which has ruled the death a homicide.

    York City Police Chief Troy Bankert told The York Dispatch the afternoon of Thursday, April 11, that the investigation is still active and that nothing has been determined for sure.

    "At this point the York City Police Department and the York County District Attorney's Office are evaluating the shooting incident as a possible self-defense (case)," Bankert said.

    The shooter has been released, and no charges have been filed against him so far, according to the chief.

    An autopsy determined Gutierrez-Rosado died of a gunshot wound to the chest, according to the coroner's office.

    Killed in former home: Gutierrez-Rosado lived at 702 W. Princess up until the time he was arrested for assault there in December, court records reveal.

    Had he lived one more day, he would have turned 24 years old.

    About an hour after the killing, York City Police issued a news release stating a suspect was in custody.

    Court documents reveal Gutierrez-Rosado was arrested late last year after allegedly choking and assaulting Misaelis Garcia-Lopez, 22, at that address. The two lived there together, court documents revealed.

    According to those documents, Gutierrez-Rosado and Garcia-Lopez argued over money about 11:45 p.m. Dec. 13 and he put her in a headlock then choked her with both hands.

    He choked her for about 30 seconds, to the point where she was unable to breath, according to documents filed by city Officer Gregory Schick.

    Garcia-Lopez was able to break free and ran to a friend's home in the 900 block of West Locust Street, where she called 911, police said.

    Arrested at scene: Officers found Gutierrez-Rosado at 702 W. Princess St. and arrested him, police said. At the time, he also had two outstanding warrants, according to court documents.

    He was charged with the second-degree felony of strangulation as well as simple assault and harassment.

    Longtime local attorney Bill Graff represented Gutierrez-Rosado in the domestic assault case and confirmed that his client and Garcia-Lopez had been romantically involved.

    "He was in love with this girl," Graff said. "She's just a nice young kid."


    Gutierrez-Rosado appeared before District Judge Joel Toluba on Feb. 6 and waived his right to a preliminary hearing.

    Graff said his client waived the hearing with the agreement that he would take anger-management classes.

    "(Prosecutors) agreed that if he took anger-management classes, we could resolve the case down the road," Graff said.

    'I'm done with you': At the hearing, Gutierrez-Rosado spoke with his alleged victim, his attorney said:

    "He said, 'I love you,' and she said, 'I'm done with you — I'm done,'" Graff recounted.

    Graff said his client also seemed like a nice kid.

    "It was a domestic dispute gone bad," he said of the assault.

    Gutierrez-Rosado was originally from Puerto Rico, moved stateside to Texas, then came to York from there about a year and a half ago, according to Graff.

    "He has family in the (York) area," the attorney said.

    Gutierrez-Rosado had been held in York County Prison until Friday, April 5, when he was released after posting $25,000 bail, according to court records.

    Armed Home Invasion Suspect Flees After Mom Opens Fire to Save Son
    A Burlington, North Carolina, home invasion suspect fled after the mother of a 10-year-old boy opened fire to protect her son.

    The News Observer reports that the incident occurred around 4 am Wednesday, after the mother awoke to strange noises. The mother grabbed her handgun and moved through the house, toward the noise, eventually confronting the home invasion suspect in the kitchen.

    The home invasion suspect then shot at the mother, according to the Burlington Police Department. The mother “was able to return fire and the suspect retreated back through the kitchen window.”

    Police do not know if the suspect was injured by the mother’s gunfire or whether he fled simply because she opened fire. But they do report that the mother and son were uninjured in the incident.

    Man charged after alleged shootout with Riverdale florist delivery driver

    A Clayton County man was arrested Thursday afternoon following an alleged shootout with a delivery driver at a popular Riverdale florist, police said.

    Justin Daniels, 25, was taken into custody after shooting at an employee of Riverdale’s Floral Boutique off Ga. 85 in the Riverdale Plaza, Riverdale police Capt. Nicole Rabel said.

    Investigators said the employee was approached by Daniels behind the store and shot at just before 11:45 a.m.

    Police said no one was injured by gunfire, but the employee suffered minor injuries when he fell trying to get inside the back door of the shop.

    The delivery driver reportedly ran into the shop, grabbed his own gun and returned fire when Daniels came around to the front of the store, police said.

    “It was very scary,” employee David Sorrows told Channel 2 Action News. “There were six employees in the shop and he kept shooting at different places.”

    Store employees were still cleaning up broken glass from the front window about 4 p.m.

    The part of the shopping center near Upper Riverdale and Springdale roads where the shooting occurred was closed as police investigated.

    Daniels is charged with six counts of aggravated assault, police said. Records show he had not been booked into the Clayton County jail as of 6 p.m.

    Investigators believe the delivery driver acted in self-defense and do not expect to file charges against him, Rabel said.

    Homeowner Fatally Shoots Teen During Break-in: Police

    A homeowner fatally shot an armed teen who kicked down the front door of his home in Riverdale, Maryland, Wednesday evening, police say.

    Prince George's County police said the homeowner called 911 about 5:30 p.m. and said he shot a man who broke into his house. The suspect ran off.

    About 20 minutes later 18-year-old Victory Mbeng showed up to a hospital in Lanham with a gunshot wound. He died of his injuries a short time later.

    Police say video of the break-in was recorded on a home surveillance system.

    SAN ANTONIO - San Antonio police are keeping an eye on local hospitals for any signs of a car burglary suspect who they believe was shot by a Northwest Side homeowner.

    The shooting happened around 3:30 a.m. Friday in the 13900 block of Hunters Hawk off Northwest Military Highway.

    Officer Carlos Ortiz, a public information officer for SAPD, said the homeowner called 911, saying that he had heard a noise outside and went to investigate, armed with a gun.

    The homeowner said he found a man inside his pickup, which was parked in his driveway, and confronted him.

    "As that suspect gets out of the vehicle, he lunges at the homeowner, and the homeowner fired one time," Ortiz said.

    The man who was shot ran from the home.

    Police said it appears he was hit by the gunfire because they found a trail of blood throughout the neighborhood.

    They believe he climbed into a vehicle at some point and got away.

    Police launched their Eagle helicopter to search the neighborhood, but did not find him.

    "Officers that worked the area also checked with local hospitals to see if we had any gunshot victims that, maybe, showed up." Ortiz said.

    Based on the homeowner's account of what happened, police did not arrest him and have not pursued any charges.

    However, Ortiz said the case is still under investigation.

    "We have to look at all aspects of the actual shooting because, in the end, this is a shooting," he said. "But at the same time, the state of Texas does allow you to protect your property."

    A decision will be made at a later time, Ortiz said.
