    Dalton man fires on attacking dog

    A 74-year-old Dalton resident is not facing charges after shooting and wounding a dog in what is believed to have been an act of self defense....

    On Friday morning at 8:56 a.m., the Otter Tail County Sheriff’s Office received a call from the complainant, stating that he had been biking near the 200 block of South Central Avenue, in Dalton, when a nearby pit bull broke its leash and came at him aggressively. The caller described a tan dog with a white chest that had begun snarling and barking as the rider passed by.

    With enough effort, the animal was said to have broken its chain before running towards the complainant. The caller said he was afraid and believed the pit bull intended to hurt him, so he drew a handgun and shot the dog in the right shoulder.

    According to the report, the dog was in the middle of the street by the time the shot was fired. The animal moved back a few feet before charging the complainant a second time, but, this time, a shout at the dog was sufficient to cause it to retreat.

    A spokesperson for the sheriff’s office stated that the cyclist has a valid permit to carry, and attempts to contact the animal’s owner were unsuccessful.

    The condition of the pit bull is unknown at this time. Authorities say that it has not been located since the incident.

    Authorities identify home invasion suspect shot to death at Lewisville home

    LEWISVILLE — Authorities on Monday identified the suspect who was shot and killed during a home invasion and robbery at a Lewisville home.

    Horace Wayne Vanlue Jr., 23, of West 25th Street in Winston-Salem, died at the scene, the Forsyth County Sheriff’s Office said in a news release. Authorities are waiting on ballistics tests in the case, but believe Vanlue was struck by a bullet from an assault rifle fired by a neighbor of the home-invasion victims.

    The sheriff’s office declined to identify the other people involved in the incident.

    “We are not going to provide more details in order to protect potential witnesses and victims and to protect the integrity of the investigation,” Chief Deputy Brad Stanley said Monday. “We have unknown suspects still at large.”

    Vanlue’s body was taken to Wake Forest Baptist Medical Center for an autopsy. Another man was treated at the scene for his injuries.

    Horace Vanlue Sr. of Fort Wayne, Ind., posted a message Sunday on his Facebook page about his son’s death “Before your child leaves the earth, please let them know that you love them,” the elder Vanlue wrote. “Death has knocked on my door and took my son (Horace Vanlue Jr.) R.I.P I love you Jr.”

    The sheriff’s office is investigating the incident.

    No charges have been filed related to the shooting.

    District Attorney Jim O’Neill declined to comment on the case, citing the Rules of Professional Responsibility for lawyers.

    A law professor and a criminologist said Monday that the state’s self-defense law with its castle doctrine provision may apply in Sunday’s shooting.

    Deputies responding to the 2:27 a.m. call found Vanlue in the front yard of the home at 7201 Grainland Drive. He had sustained an apparent gunshot wound, the sheriff’s office said.

    People at the home told deputies that several men had forced open the door to the house, assaulted a man inside and stolen items from the home. Two men and a woman were inside the home when the home invasion occurred, Stanley said Sunday.

    During the home invasion, at least one person at the home communicated with a neighbor. Stanley declined to say how this communication took place.

    A male neighbor and another person went to the Grainland Drive address and confronted the suspects as they left the home.

    The male neighbor was armed with an assault rifle and fired several shots in the direction of the suspects, Stanley said.

    The neighbor surrendered his rifle, an AR-15, to the investigators after the incident, Stanley said.

    Deputies found a handgun next to Vanlue, and items stolen from the home. Stanley said he didn’t know if the gun found beside Vanlue had been fired or if there was an exchange of gunfire between the suspects and the neighbor.

    The neighbor has a right to claim “defense of others as a reason for using deadly force, said Mark Rabil, the director of the Innocence Project and a law professor at Wake Forest University School of Law.

    “This only applies to defense of people, not property,” Rabil said in an email. “The question is whether, under the circumstances, the neighbor/shooter shot the fleeing person because he had a ‘reasonable belief’ that (the) shooting was necessary to prevent death or great bodily harm to himself or to others, such as the occupants of the home.”

    If the suspect was pointing a gun at the neighbor or occupants of the home and threatening them with it, then the neighbor might have been able to legally shoot Vanlue even if Vanlue was running away, Rabil said.

    “If he was just running away, not pointing the gun, and not making threats, then I don’t think the neighbor had the right to shoot and kill,” Rabil said. “People have a right of self-defense, and to defend others, especially when there’s been a home break-in and an assault, but citizens cannot take the law into their own hands.”

    Kimya Dennis, an assistant professor of sociology and criminal studies at Salem College, said the state’s self-defense law also may apply in this case “if it can be proven the shooter did not ‘randomly’ go to his neighbor’s house but was, instead, invited to his neighbor’s house.

    “This means the shooter was defending and protecting the neighbor as well as himself.”

    Under that law with its castle doctrine provision, N.C. residents have the leright to defend themselves with deadly force in their homes, vehicles and workplace without a duty to retreat.

    COLORADO SPRINGS, Colo. (KKTV) - A Colorado Springs man was justified in shooting and killing an acquaintance who had barged into his home and was charging at him as young children were just several feet away, the DA's office announced Tuesday.

    Marital issues were the likely trigger behind 33-year-old Felipe Garcia breaking into the shooter's home in the middle of the night, based on the 4th Judicial District Attorney's Office's investigation.

    According to that investigation, Garcia had separated from his wife one week prior to the May 14 shooting. The separation came on the heels of an incident between his wife, the shooter and the shooter's girlfriend.

    Garcia later threatened the shooter over the phone.

    Two days after the phone call, the shooter said he heard a loud "boom," which investigators would later find was Garcia kicking in the door. The shooter ran to investigate and saw Garcia running up the stairs. He told authorities he yelled at Garcia to stop and that he was sorry, but Garcia kept coming towards him. He shot Garcia once in the chest.

    At the time of the incident, the shooter's girlfriend and three young children were home. The family lives in the Georgetown Square Townhomes on the 2000 block of North Academy Boulevard.

    The shooting has been ruled self defense. No charges will be filed.

    After first break-in, intruder returns to councilman’s home – and gets chased with a gun

    When an intruder returned to a southeast Fresno home early Sunday – only five days after allegedly breaking in a first time –he probably wasn’t counting on being chased by an angry Fresno City Councilman with a gun.

    City Council members are typically tasked with creating laws, not enforcing them. But the encounter apparently pushed the wrong button for Councilman Luis Chavez, who was determined that the prowler would not get away a second time.

    Chavez, 38, and his wife were on vacation last week to get married in Cancun, Mexico. Their vacation was interrupted on Wednesday when the alarm company and a tenant who rents a unit at the rear of the Huntington Boulevard property called to tell Chavez of a break-in at the home. The tenant said a man had followed her to the rear unit and tried to pry open the door after she locked it.

    When that didn’t work, the tenant reported that the man went to the main home and broke a window to get inside. “He took an old watch, change and some nick-knacks, nothing big,” Chavez said. “She got a real good look at him and called the police.”

    On Sunday, a day after returning from Mexico, Chavez was watching television at about 8 a.m. when he spotted a man peering through his front window who matched the description of the Wednesday burglar. “As I went to grab my gun, he goes to the house at the back of the property,” Chavez said. “I raised up the back window, pointed my gun at him and asked him, ‘What the (expletive) are you doing on my property?’ ”

    Chavez said the man muttered something about finding property with the address on it and wanting to return it. “I told him not to move, but as I went out, he bolted and ran,” Chavez said. “I grabbed my keys, got in the car and chased him down the street.”

    As the man ran down an alley, Chavez drove on the street and got ahead of him. When the man saw he was blocked, he ran through alleys and back yards with Chavez chasing him while on the phone with police. Fresno police officers ultimately caught him moments later near Tulare Avenue and Sixth Street, about three-quarters of a mile from Chavez’s home.

    “I know it’s not the protocol to follow,” Chavez said, “but I was so angry I had to do something. … I’m sick and tired of people who think it’s OK to break into homes and cars and steal property. It’s not right, and it’s so rampant across the city. I hear stories like this from constituents all the time.”

    As the man sat handcuffed after his arrest, Chavez said he asked why he scared his tenant days earlier. “He said he wasn’t trying to break in, but just wanted her to let him in,” Chavez said.

    The identity of the man arrested was not immediately available from police.

    Police warn that residents must be careful about giving chase to possibly dangerous intruders. “In this kind of case, where something happened on Wednesday and then he comes back on Sunday, it shows that this thief wasn’t too concerned about people being home – a ‘hot prowl’ case,” Fresno police Lt. Mark Hudson said. “These people can be dangerous.”

    “In this case, it sounds like (Chavez) was able to follow at a safe distance, and be on the phone to get the police officers to where this person was taken into custody,” Hudson said. “The first priority is to protect yourself in your home and call 911.”

    But if one decides to follow, “keep at a safe distance and be a good witness,” Hudson added. “In this case, it ended well.”

    Chavez agreed. “The good thing is nobody got hurt,” he said. “Everybody got to go away safe.”

    Chavez isn’t the only council member whose home has been affected by crime in recent years. In August 2014, a would-be intruder tried to kick down the door of Fresno City Councilman Clint Olivier’s central Fresno home. When he couldn’t get into the house, the man threw potted plants from the porch at Olivier’s car. Officers were able to arrest him, and he was later sentenced to jail, probation and an inpatient drug-treatment program.

    In November 2015, a burglar struck the Tower District home of Councilwoman Esmeralda Soria and made off with some jewelry, leaving behind a Raiders shirt in her bedroom and a tool used to pry open a window.

    July 5th shooting in Licking ruled self-defense

    On Wednesday, July 5th, the Texas County Sheriff Office received a report of shots fired at a residence on Hwy 32 East of Licking MO. It was reported by a 34 yr old male who resides at the residence, that a 28 yr old male was attempting to break into his residence where the front door was locked while cursing and challenging him.

    The reporting party stated he was standing in the living room of the residence when the front door was forced open and the male subject began to enter the residence. The reporting party stated he fired one shot from his pistol and was unsure if he hit the other male who was attempting to enter his residence. It was determined a short time later the other male had sustained a gunshot wound to the abdomen, and was transported to the Texas County Memorial Hospital.

    After investigating the scene and questioning witnesses it was determined that this shooting was an act of self-defense.

    Never bring pepper spray to a gunfight — especially in a gun store.

    The owner of a Brooklyn gun shop shot a thief who pepper-sprayed him in the face and tried to steal two firearms Wednesday, officials said.

    The thief, dressed like a construction worker, entered DF Brothers Sports Center on New Utrecht Ave. near 79th St. in Bensonhurst — one of the last remaining firearms dealers in the city — at about 10:45 a.m. and told 60-year-old owner Frank Taormina he wanted to “see the guns,” police sources said.

    When Taormina asked to see the man’s gun permit, the suspect blasted him in the face with the noxious substance, cops said.

    He then pulled out a sledgehammer and shattered a display case.

    The thief had just grabbed two pistols when Taormina grabbed his own weapon and fired off two rounds, hitting the crook at least once, police sources said.

    The crook ran off. Cops found a blood trail, but the thief got away.

    The gun shop’s neighbors were stunned that a shooting had taken place.

    “I didn’t see or hear what happened,” said a worker at a neighboring learning center who wished not to be named. “I didn’t know there was a shooting until the police came and told us to stay inside.”

    Taormina, of Staten Island, was rattled, but not seriously harmed. He was treated for pepper spray exposure at the scene.


    Police believe the robber was wounded and left a blood trail as he ran off.



    Flanked by a handful of friends, he said nothing to reporters as he was escorted to a car and left.

    No charges are expected to be filed against Taormina, who was defending himself, police sources said.

    Pistol permits for both himself and his store were in order, a police source said.

    The suspect was described as white or Hispanic and was last seen wearing a black cap, black T-shirt, khaki pants and sunglasses.


    State law allows storeowners to have a firearm on their premises and use it to defend their business as long as the weapon is legally purchased, never removed from the shop and the storeowner has the appropriate city licenses, officials said.

    DF Brothers sells firearms as well as other sporting goods equipment.

    There is also a gun range on the premises, according to the company’s Facebook page.

    The incident occurred as the city celebrates a 17% drop in shootings this year.

    As of Tuesday, police had investigated 351 shootings this year — 74 fewer than the 425 that took place over the same time period last year.

    SAVANNAH, GA (WTOC) -
    Officers from the Savannah-Chatham Metropolitan Police Department responded to a report of a shooting in the 100 block of Fairmont Avenue shortly after 8:30 a.m. on Sunday morning.

    Officers responded to the call of a person with a gun. They found Ahjae Williams, 22, suffering from critical injuries at the scene.

    Reports say Williams, armed with a gun, entered the home of his ex-girlfriend. Williams and another person at the scene got into a confrontation and gunfire was exchanged.

    Officials say all who were involved in the incident remained on scene and were cooperative with the investigation.

    Detectives were able to determine that Williams was the aggressor and others involved were acting in self-defense.

    Williams is listed as being in critical condition. Officials say charges are forthcoming.

    Man shot and killed during Dothan church burglary

    A man was shot and killed Sunday night after he attempted to rob a Dothan church parishioner, according to police.

    Police indicate Steffon Parreese Valentez Tolver died from a single gunshot wound after trying to rob a person of $50 at Crossroads Baptist Church, located on Westgate Parkway in Dothan. According to police, a church employee shot Tolver once with his personal handgun after Tolver tried to rob him.

    The incident happened around 10:40 p.m Sunday.

    “From the information I have received, two church employees were inside the building at the time the altercation occurred,” said Dothan Police Chief Steve Parrish. An additional church employee had left the premises to run an errand, and arrived back after the suspect had entered into the church.”

    According to Parrish, Tolver entered through the back door of the church. Once he was inside the church, Tolver robbed the parishioner of approximately $50, and then attempted to rob an additional staff member.

    Parrish said that is when the staff member fired his personal handgun once, striking Tolver in the upper torso. The suspect fled from inside the church building and collapsed outside from his injuries, Parrish said.

    According to Houston County Coroner Robert Byrd, Tolver was pronounced dead at 1:18 a.m. Monday morning.

    Dothan Police are still investigating the case.

    Court records indicate Tolver pleaded guilty to first-degree robbery in January of 2011 and was sentenced to 15 years in prison. It is not immediately known how much of his sentence was served.

    Tolver was arrested in April of 2010 and charged with robbing a person in the parking lot of an apartment complex near South Edgewood Street. Police indicated he used a toy gun during the robbery. At the time of the sentencing, Tolver's attorney said Tolver did not have any previous felony convictions as an adult, but had one as a juvenile when he was 12.

    Calls to Crossroads Baptist Church for comment were not returned.

    Alabama has laws that allow for the deadly use of force if a person feels imminently threatened. The law also does not require a person to retreat if that person has a lawful right to be in that specific location.

    Alabama's self defense law states, in part:

    (a) A person is justified in using physical force upon another person in order to defend himself or herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful physical force by that other person, and he or she may use a degree of force which he or she reasonably believes to be necessary for the purpose.  A person may use deadly physical force, and is legally presumed to be justified in using deadly physical force in self-defense or the defense of another person ... if the person reasonably believes that another person is:


    (1) Using or about to use unlawful deadly physical force.

    (2) Using or about to use physical force against an occupant of a dwelling while committing or attempting to commit a burglary of such dwelling.

    (3) Committing or about to commit a kidnapping in any degree, assault in the first or second degree, burglary in any degree, robbery in any degree, forcible rape, or forcible sodomy.

    (4) Using or about to use physical force against an owner, employee, or other person authorized to be on business property when the business is closed to the public while committing or attempting to commit a crime involving death, serious physical injury, robbery, kidnapping, rape, sodomy, or a crime of a sexual nature involving a child under the age of 12.

    The law further states:

    A person who is justified under subsection (a) in using physical force, including deadly physical force, and who is not engaged in an unlawful activity and is in any place where he or she has the right to be has no duty to retreat and has the right to stand his or her ground.

    One person was shot late Sunday night at or near Crossroads Baptist Church on Westgate Parkway in Dothan. Dothan Police have identified the suspect as Steffon Tolver. Tolver was shot by an armed staff member.

    Update at 8:30 a.m. Monday----Houston County Robert Byrd said the person shot did not have any identifying document on him. Therefore, forensics tests will be performed before the 30-year old man's name is released to the public.

    A suspected robber was fatally shot Sunday night inside Crossroads Baptist Church on Westgate Parkway in Dothan.

    Police Chief Steve Parrish, on the scene, said the shooting apparently involved a robbery of people inside the church. None were injured.

    Meanwhile, a first responder at the scene not authorized to speak publicly said offerings collected Sunday were being prepared for transport to the bank.


    The suspect encountered one church member outside and forced him into the building. That’s when the one shot was fired. The man killed was apparently armed, according to a police source.

    Initial indications are the shooting was in self-defense and charges are not likely though evidence could be presented to a Houston County Grand Jury as a matter of policy.

    Crossroads Baptist is a growing church that also has a Christian-based school that includes kindergarten though no students were present at the time of the shooting.

    Rancho Cucamonga homeowner shoots knife-wielding burglar

    RANCHO CUCAMONGA, Calif. (KABC) -- A Rancho Cucamonga homeowner shot and wounded a thief who advanced at him with a knife, the San Bernardino County Sheriff's Department said.

    Deputies arrived at a home in the 5400 block of Carriage Place around 6:15 a.m. Saturday after receiving reports of shots heard in the area.

    The homeowner told deputies that he heard noises in his garage and went to investigate the sounds. When he entered his garage, he saw a suspect burglarizing his car.

    The suspect got out of the car with a knife in hand and advanced toward the homeowner. That's when the homeowner drew a handgun and fired at the suspect, authorities said.

    The suspect ran from the garage, and a car was seen fleeing the area at a high rate of speed.

    While deputies were at the Carriage Place residence, dispatch was advised that a woman called from a home in Fontana to report that her adult son had been shot.

    The son, identified as Eric Hartwick, was transported to Arrowhead Regional Medical Center to be treated for multiple gunshot wounds.

    Deputies went to the Fontana residence to process Hartwick's car and also went to the hospital to collect evidence.

    Investigators determined that Hartwick was the suspect involved in the Rancho Cucamonga burglary.

    Hartwick was found to be on Post Community Release Supervision and was also in possession of narcotics, authorities said. He was expected to be booked upon release from the hospital.
