    Woman in wheelchair scares off burglars by showing gun

    CLEVELAND – A woman, who lives on Cleveland’s west side, said she felt safe in her home until last week.

    “It was last Monday morning around 10:30,” Melinda Vandal told Fox 8. “I looked at the door and there was a man, right there, right outside looking like he was going for my door.” She said she saw another man cutting the screen on a window of her garage.

    Vandal, who is in a wheelchair, said she called police and grabbed her gun.

    “I put the gun up to the window of the door and I yelled, 'get off my property,'" Vandal said. She said the suspects dropped a knife and took off.

    Police were unable to locate the two men, but are looking into the matter.

    “It’s hard for me to relax or sleep because I keep seeing his face,” Vandal said.

    She said her doors are now locked at all times, and she is keeping her gun close to her.

    “It never used to be like this around here,” Vandal said, noting she has lived in her home for more than 20 years. “I don’t want to ever hurt anyone, but I feel like I need to protect myself.”

    A man was shot and killed in a Savannah home on Friday morning in what police investigators say was a self-defense shooting.

    SAVANNAH, Ga. —
    A man was shot and killed in a Savannah home on Friday morning in what police investigators say was a self-defense shooting.

    Thirty-four-year-old Marquice Allen was shot in a home on the 1100 block of West 49th Street at about 8:15 a.m. on Friday. Savannah-Chatham Metropolitan Police Department Investigators say the self-defense shooting occurred during a domestic dispute.

    Allen died at the scene. Police officials investigated the area until after 1 p.m. on Friday and interviewed a person of interest during that time as well.

    While some neighbors say this street is quiet and there hasn’t been anything like this there before, others say the neighborhood has gotten worse over the years and they aren’t surprised this happened.

    “I just think it’s very, very sad and unfortunate. I just can’t imagine why someone would have to kill someone. But it just goes along with the idea of the whole feeling that the neighborhood is really bad and it’s getting worse so I just feel more frightened and more afraid,” said Catherine Jackson, who lives on West 49th Street.

    Police in Lexington, Kentucky, found a man down on the front lawn of a house Tuesday morning and shot multiple times — and then they charged him.

    William J. Redd, 40, was charged with fourth-degree assault, domestic violence and violating a domestic violence order, WKYT-TV reported.

    Turns out investigators said Redd was shot by his ex-girlfriend in self-defense, the station reported, and that the shooting was an isolated incident.

    This one is from a couple of years ago but interesting. A couple of teens tried to hold someone up. He shot and killed one of the teens and was cleared. Another one of the teens was convicted of wreck less homicide for the murder under Ohio law.

    A teen accomplice of an armed robber who was shot to death by his victim outside the Dayton Mall has been sentenced to prison.

    Police said Keyan Moore, 17, was with Jawaad Jabbar, 16, of Middletown, and another teen when they tried to rob two shoppers at the Dayton Mall days before Christmas 2014.

    Police said the teens accosted the shoppers who were leaving the mall after buying limited-edition Air Jordan shoes on sale that day.

    The shopper, who had a concealed weapon permit, pulled a gun and fatally shot Jabbar.

    Under Ohio law, a suspect can be held responsible for an accomplice's death during a robbery.

    Moore was found guilty of reckless homicide last month and faced up to four years in prison.

    He was sentenced Tuesday to two years in prison and three years of probation, minus 79 days for time served.

    Judge Gregory F. Singer told Moore to take the time and think about the implications of the incident.

    "I want you to take some time now and think about all the implications this has for others, not just you," Singer said.

    Defense attorney L. Patrick Mulligan, who asked for community control instead of prison, said the sentence was disappointing.

    "He didn't have a gun and didn't cause the death," Mulligan said of his client, who had no prior record.

    He also said the teen was successful in school and the sentence jeopardizes his chances of completing his education.

    A statement from Montgomery County Prosecutor Mat Heck Jr. said the defendant's decision to become involved in the theft ultimately resulted in the death.

    "These teens went to the Dayton Mall, illegally armed, and attempted to commit an armed robbery," Heck said Tuesday.

    A third suspect, a 17-year-old boy, was cleared and released.

    The shopper, who remained at the scene and cooperated with investigators, was cleared of charges in the case. Prosecutors determined he acted in self-defense.

    D.A. says no charges in deadly attempted home invasion case

    JACKSONVILLE, N.C. (WITN) - Onslow County's district attorney says there will be no charges brought against a resident who shot and killed a would-be home invader earlier this week.

    Stacey Ross, Jr., 20, was killed Tuesday night after police say he and four others tried to force their way into a man's apartment at Carolina Place Apartments on Delaney Drive in Jacksonville.

    District Attorney Ernie Lee says the resident, who hasn't been identified, fired in self defense.

    Police were able to track down the other four people involved in the attempted home invasion.

    Joshua Cordts, 18; Sean Padgett, 18; Steven Lewis, 18; and Haleigh Noling, 17, were all charged with attempted armed robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous weapon.

    Police say the victim in an attempted armed home invasion shot and killed one of the intruders.

    Jacksonville police say it happened around 7:40 p.m. Tuesday night at Carolina Place Apartments on Delaney Drive.

    Officers say when they arrived, Stacey Ross, Jr. of Jacksonville was found laying in the parking area. The 20-year-old was shot multiple times and later died at Onslow Memorial Hospital.

    Police say their investigation showed Ross was one of five people involved in the attempted home invasion and a police department spokeswoman says the resident of the apartment shot Ross.

    Overnight police were able to catch the others involved in the attempted home invasion. They are Joshua Cordts, 18; Sean Padgett, 18; Steven Lewis, 18; and Haleigh Noling, 17

    The four are charged with attempted armed robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous weapon.

    Police say they are conferring with the district attorney about any additional charges in the case.

    Prosecutor: Firefighter shot neighbor in self-defense

    No charges will be filed against an Indianapolis firefighter who shot his neighbor after the man pulled out a gun while riding a lawn mower, Johnson County Prosecutor Brad Cooper said Wednesday.

    The June 27 showdown was captured on security video, Cooper said, noting it clearly shows Jeffrey S. Weigle, 59, raising a handgun just before Dean Keller, 49, shot him multiple times in the 1200 block of Campbell Road just east of Greenwood.

    Keller claimed self-defense. Cooper agreed.

    "The decision to not file charges on Keller was a simple application of Indiana law and should not be looked upon as condoning the behavior of either party," Cooper said.

    Cooper provided a copy of the video, captured by a camera on Keller's property, to IndyStar on Wednesday.

    The prosecutor said Weigle was the aggressor.

    Near a fence line, Weigle insults Keller and Keller's wife, Lisa, the video shows.

    Keller returns an insult as Weigle rides a lawn mower off camera, the video shows.

    Weigle backs the mower up, reaches into his pocket and pulls out a handgun, Cooper said.

    "Given the aggression shown by Weigle," Cooper said, "it was reasonable for Keller to believe deadly force was necessary to prevent serious bodily injury to himself (and) his wife."

    The video shows bullets zipping through a bush as Weigle returns fire. Weigle stands and quickly walks out of view.

    Keller, an 18-year Indianapolis Fire Department firefighter, was uninjured. Weigle was shot four times and suffered a "sucking chest wound," according to a police report.

    Cooper said Weigle rented a room in the home next door. The gun Weigle carried belongs to the homeowner, Nancy Phillips.

    Cooper said Phillips did not give Weigle permission to use her gun. She told investigators that Weigle took the gun from under her pillow before he went out to mow.

    "Whether Jeffrey Weigle shall be charged with a crime will be determined if and when he recovers," Cooper said.

    The neighbors have been in a long-running dispute. Keller and Weigle have clashed more than a dozen times since 2009, according to Johnson County Sheriff's Office reports.

    The men argued about a range of things, including the location of a fence, Keller's dogs and Weigle's motorcycle.

    On Sept. 9, 2011, officers arrested both men on battery charges after a fight. During the scuffle, Keller was stabbed in the arm and Weigle suffered cuts, scratches and bite wounds, according to a police report.

    Deadly Fairview Avenue shooting called self-defense

    DAYTON, Ohio (WDTN) – Police here said a woman was protecting herself when she shot and killed a man on Fairview Avenue Tuesday night. The Montgomery County Coroner identified the man who kicked down the woman’s door before she shot him as 53-year-old Darron Orr.

    Police said Orr was suspected of “serious crimes” against the same woman Monday night. Though they wouldn’t elaborate on those crimes, neighbors told 2 News the two individuals had a turbulent relationship and Orr frequently acted aggressively.

    Dayton Police Detective Gregg Gady spoke with reporters Wednesday. If you missed his comments live you can watch them here.

    Neighbor Dwayne Berry said, “(We could hear) him banging on the door, her not answering, revving his car up all loud in the middle of the night. That’s not normal.”

    Berry moved to the neighborhood shortly before the woman involved in the incident. He said their families have known each other for close to 20 years and he never knew she owned a firearm.

    “I’m super happy about it,” Berry said. “Like I said, I wouldn’t want anything to happen to my neighbor, so absolutely. I hate that it happened to him, but I’d rather it happen like that than him break in and actually kill her.”

    Some gun shops agree that being prepared and carrying a firearm can sometimes mean the difference between life and death. Gunsport Firearms in Centerville said self-defense weapons are among its most-common sales.

    Co-owner Ray Nickel said, “It’s become a necessity, at least in people’s minds, to protect themselves because somebody else might not be there to do it for them.”

    Nickel also added only responsible gun owners should arm themselves.

    “A gun that’s drawn and not used when it should be could become the weapon of an assailant,” said Nickel. “So there’s a certain mental set that you have to have if you’re going to own or carry a gun for self defense. If it’s not something you think you could do, maybe that’s not the thing for you to do.”

    The woman involved in the case is cooperating with investigators. 2 New spoke with her briefly Wednesday morning, but she declined to comment.

    Rockland man in wheelchair won’t be prosecuted for shooting burglar

    Harvey Lembo shot an intruder in 2015 with a gun he had purchased hours earlier.

    The state will not prosecute a 69-year-old Rockland man who shot an intruder in his home nearly two years ago, in a case that became a flash point for gun-rights advocates.

    Harvey Lembo, a retired lobsterman who is disabled and uses a wheelchair, shot Christopher Wildhaber during a Aug. 31, 2015, burglary at Park Place apartments in Rockland. Lembo had bought the pistol less than 24 hours earlier after several break-ins at his Wildhaber was wounded, treated at a hospital and released that evening. He was sentenced in July 2016 to 10 years in prison with all but four years suspended for the break-in.

    Shortly after the shooting, then District Attorney Geoffrey Rushlau said he had not ruled out charging Lembo in connection with the shooting, under a state law that outlines when it is permissible to use deadly force in defense of premises.

    “The evidence in this case would have raised issues of self-defense and defense of premises,” District Attorney Jonathan Liberman said in a statement Wednesday. “Mr. Lembo is disabled and uses a wheelchair. His home had been burglarized on several occasions, and he had purchased the firearm in question in response to these burglaries. This shooting occurred when Mr. Lembo interrupted a burglary of his home. The standard of proof in criminal cases is proof beyond a reasonable doubt, and I do not believe that we could meet this burden given these factors,” Liberman said.

    Liberman was appointed district attorney in May after Rushlau was named to a district court seat.

    Attorney David Weyrens, who represented Lembo during the criminal investigation, said Wednesday that his client would be relieved by the announcement.

    “Mr. Lembo never felt he did anything wrong defending himself. He is grateful that District Attorney Liberman came to the same conclusion,” Weyrens said.

    On the night of the shooting, Lembo called the public safety dispatcher to say he had a gun pointed at a man who had broken into his home. He told the dispatcher he instructed the man to sit still or he would shoot him. The dispatcher told Lembo not to do that.

    Lembo, however, came back on the phone to the dispatcher to say he had shot the man and that there was blood everywhere in the apartment.

    After the shooting, Lembo received a notification from Stanford Management LLC of Portland, which manages the apartment complex, saying he was in violation of house rules by having a gun on the premises and that an eviction process would be started if he did not comply.

    Lembo filed a lawsuit in November 2015 against the property’s owner, Park Place Associates of Rockland, and the management company, claiming they violated his Second Amendment right to keep and bear arms and violated the Maine Civil Rights Act. Justice William Stokes ruled against Lembo in that case, but gun rights advocates supporting Lembo appealed the ruling to the Maine Supreme Judicial Court, pointing to Lembo’s actions as evidence that firearms are useful for lawful personal protection.

    In response to some of the legal wrangling over gun and property rights that arose after the shooting, the Maine Legislature passed a bill last year that prevents apartment owners who receive government subsidies from prohibiting their tenants from owning guns. The law exempts owner-occupied buildings of four or fewer units.

    The appeal on behalf of Lembo was subsequently dropped in August 2016.

    Lembo remained in the apartment complex.

    Sheriff: Licking shooting was self-defense against home invader

    A home invasion Wednesday night in Licking has been ruled self-defense against an aggressive home invader, according to Texas County Sheriff James Sigman.

    Sigman said a 34-year-old man who lives at the Highway 32 home said a 28-year-old man was attempting to break into the home while cursing and challenging the homeowner. The man forced his way into the home, Sigman said, and the homeowner fired one shot from his pistol. The man said he was unsure if the bullet struck the person.

    Licking Police Chief Scott Lindsay said his department was called at 9:10 p.m. to the TCMH ambulance base, where a man had a gunshot wound to the abdomen. It was the home invader. He was taken to Texas County Memorial Hospital.

    “After investigating the scene and questioning witnesses, it was determined that this shooting was an act of self-defense,” Sigman said.

    LAS VEGAS (KSNV NEWS3LV) — A local store owner took matters into his own hands when a man attempted to rob his wireless store.
    Video surveillance inside Wireless Clinic near Eastern Avenue and Charleston Boulevard catches a robber kick out a showcase counter and smash the glass with his own feet. The thief immediately goes for the merchandise.
    Miguel Gonzalez, the owner, takes charge with his gun. The thief right away decides to leave the store with a gun pointed towards him.

    "A lunatic guy just came in. He had come in previously," said Gonzalez.
    Gonzalez says the attempted robbery happened right before closing time last week. He never expected he would have to deal with a thief, but he told his co-worker to be ready for this customer.

    "He had that look on his face. I told him to be prepared if something was going to happen," said Gonzalez.
    The robber made off with nothing. Gonzalez says he never had his finger on the trigger. He tells us he did not want to hurt anyone.

    "When he kicked the showcase I had told my coworker don't let him go because I'm getting my firearm," said Gonzalez.
    He hopes he never has to deal with another robber again.
    "I love what I do. I'm not going to stop," said Gonzalez.

    Kris Chanski with The Range 702, a local firearms retailer and training range, says her business is growing because more people are choosing to be educated about firearms.
    "People are concerned," said Chanski. "They want to make sure their families are safe and they want to make sure their business is safe, and along with safety comes education and training."
