    HPD: Neighbor shoots suspect who broke into home next door
    HOUSTON, Texas (KTRK) --
    Houston police are investigating after a neighbor shot a suspect who was trying to break into the home next door in southeast Houston.

    Authorities were called out around 7:40 a.m. Tuesday for a shooting at a home in the 4800 block of Ventura.

    Two girls, ages 12 and 14, called their mother to tell her someone was trying to break into their home. She told them to hang up and call 911, while she activated the alarm to the house.

    "The mom actually has (surveillance) video that she shared with us. (The burglar) came and knocked on the front door, as typical burglars do, to see if anyone was home. Then, you see him walk towards the back. There's no video after that, but he did make entry through the back side of the home," said Sheryl Victorian, an assistant chief with HPD.

    Police say the neighbor heard the alarm and went outside to investigate. He spotted the suspect coming out the back of the house, and fired two shots. When police arrived, he led them to the suspect.

    The suspect was in stable condition.

    "I'm hoping that other people may see this... and leave us alone, because we look out for each other and try to take care of each other," said Nita Gilbert, a woman who lives in the neighborhood.

    When the girls' father arrived at the house, he thought his daughters were still in danger and broke a window, pulling the kids from the bedroom where they were hiding.

    People in the neighborhood are calling the neighbor a hero.

    "I can't wait to see him. I want to give him a hug. It could've been my house and it was kids in that house, and that was the scariest part about it-- the kids being in the house, so he's very much a hero," said Trinetra Stephenson, another woman from the neighborhood.

    A grand jury will determine if any criminal charges are filed against the neighbor. Eyewitness News reporter Marla Carter looked into state law and found this:

    A person is justified in using force or deadly force against another to protect land or tangible, movable property of a third person if, under the circumstances as he reasonably believes them to be, the actor would be justified under Section 9.41 or 9.42 in using force or deadly force to protect his own land or property and:
    (1) The actor reasonably believes the unlawful interference constitutes attempted or consummated theft of or criminal mischief to the tangible, movable property; or
    (2) The actor reasonably believes that:
    (A) The third person has requested his protection of the land or property;
    (B) he has a legal duty to protect the third person's land or property; or
    (C) the third person whose land or property he uses force or deadly force to protect is the actor's spouse, parent, or child, resides with the actor, or is under the actor's care.

    Houston police are investigating after reports that a neighbor shot a burglar trying to break in to the home next door in southeast Houston.

    Authorities were called out around 7:40 a.m. Tuesday for a shooting at a home in the 4800 block of Ventura.

    Officials say the caller told them that the neighbor shot the suspect in the backyard.

    The suspect was taken to the hospital in an unknown condition.

    Homeowner holds burglary suspect at gunpoint

    A homeowner held an intruder at gunpoint Tuesday after early morning break-in in Woodland Forrest.

    A woman called 911 at 4:25 a.m. and said her husband had heard a sound and discovered a man in their basement, said Tuscaloosa Police Capt. Brad Mason, commander of the department’s Criminal Investigations Division.

    The husband held the suspect at gunpoint until officers arrived four minutes later. There were children asleep in the home at the time.

    John Tyler McDonald, 26, was questioned by police and charged with second-degree burglary. He could be responsible for other break-ins and could face more charges, Mason said.

    Deputies: Tampa man charged with murder after burglary accomplice shot dead by homeowner
    TAMPA — A Tampa man has been charged with murder after a November break-in attempt resulted in the death of his accomplice, deputies said.

    Earnest Cherry Jr., 36, turned himself in to the Orient Road jail on June 18 in connection to the death of 40- year-old Chike Tim, the Hillsborough County Sheriff’s Office reported Tuesday. He was charged with second-degree felony murder.

    The case against Cherry stems from a burglary at a Brandon home on Nov. 28. Deputies say he and Tim conspired to break into the home with hopes of stealing cash and drugs.

    That night, a homeowner saw a white Pontiac on front of the residence and a man, later identified as Tim, get out of the passenger side of the car and walk toward the house. Moments later, Tim forced open the door and the homeowner fired one round from a 9mm handgun, hitting Tim. Investigators found his body inside near the front door with socks covering his hands. Detectives also found illegal drugs and $66,000 cash in the house.

    A witness told detectives he was with Tim earlier in the day and overheard him on the phone discussing breaking into a residence in Brandon, deputies said. The witness said he heard Tim claim the home had a lot of drugs and money inside. Phone records confirmed the telephone number Tim called belonged to Cherry.

    Detectives learned from a witness that Cherry had borrowed a white 2005 Pontiac earlier in the day and that Tim was with him when he borrowed the car. Investigators found Cherry was driving the Pontiac when it left the scene of the burglary, according to the Sheriff’s Office.

    In Florida, someone can be charged with second-degree felony murder if another person is killed while the defendant is in the act of committing a felony. Cherry was charged because Tim died while they were committing a burglary they had planned together, the Sheriff’s Office said.

    Cherry was booked and released after posting $75,000 bail, records show. Records show he has previous convictions in Florida for cocaine possession, resisting arrest and driving with a suspended license. According to the Sheriff’s Office, he was on felony probation at the time of his arrest.

    CINCINNATI, Ohio -- A man on a walk with his wife shot and killed a dog Tuesday night after it attacked him and bit him twice in the leg, according to reports.

    The man and his wife were walking their own dogs when the attack occurred, WKRC Channel 12 reports.

    The dog, reportedly a pit bull, was unleashed.

    WLWT Channel 5 reports the dog's owner came outside but was unable to calm the dog, so the bite victim, a concealed-carry permit holder, shot the dog in the head.

    The victim was taken to a hospital for treatment of his leg injuries, reports say.

    Charges dropped in 2017 shooting

    JACKSON, Mich. (WILX) -- Court records show charges have been dropped in the case of a woman police say shot a man last year.

    Desiree Strother was originally charged with assault with intent to murder and a firearm crime.

    Police say she shot a man at Southridge Park Apartments on Francis Street in May 2017. Police say Strother told investigators she shot the man in self-defense during a fight.

    MLive reports the charges against Strother were dismissed because Jackson County prosecutors said the victim never testified and they couldn't disprove Strother's self-defense claim without the man's testimony.

    The charges in the case could still be refiled.

    NewsAlert:Hamilton-area homeowner found not guilty of second-degree murder
    HAMILTON — A jury has found a Hamilton-area homeowner not guilty of second-degree murder in the shooting death of a man who broke into his truck.

    Peter Khill, 28, admitted he shot Jon Styres but said he fired in self-defence, believing Styres was about to shoot him.

    The incident occurred in the dark, in the early hours of Feb. 4, 2016, after Khill heard a noise outside his home and went outside with his shotgun.

    Khill said he thought Styres was about to shoot him.

    The trial heard that Styres, a 29-year-old father of two from Ohsweken, Ont., on the Six Nations reserve, did not have a gun at the time of the shooting.

    Peter Khill has been found not guilty

    Peter Khill has been found not guilty in the shooting death of Jon Styres.

    There was no question that Khill shot and killed Jon Styres of Six Nations, but the jury had to decide if the shooting was in self-defence, or if he was guilty of second-degree murder or manslaughter.

    Styres was shot attempting to break into Khill’s pickup truck in February of 2016.

    In his closing argument, defence lawyer Jeff Manishen rejected the notion that race played any part in the shooting, saying it would have been impossible to determine that Styres was indigenous in the pre-dawn darkness.

    Punks Attack Pregnant Woman, Then Bystander Shouts ‘Drop the Gun or I’ll Drop You’

    Thanks to a responsible gun owner, one pregnant pizza delivery woman is alive and unharmed after a frightening ordeal.

    The woman was out on a delivery to an Atlanta home one evening when three people approached her from the back side of the house.

    One of them began hitting the woman with a handgun and demanding the keys to her car.

    “The victim advised that one of the males was holding a black handgun,” Atlanta police spokesman Officer Jarius Daugherty said. “At that time, the male with the gun started to strike the victim with the weapon and demanded the keys to her vehicle.”

    The delivery woman refused and fought off the attackers before fleeing, but they quickly caught up with her at a nearby home.

    Thankfully, Dennis Madaris heard the woman screaming for help and leaped into action.

    The man quickly pulled out his own gun and pointed it at the suspects, demanding they drop their weapons and step away from the woman.

    The attackers immediately dropped the weapon and ran off.

    “When I came around the corner here, I saw three people were beating on this lady. One of them had a gun,” Madaris said to Channel 2 Action News.

    “One of them turned around, and he had the gun in his hand. And I told him, ‘Drop the gun or I’ll drop you!’ And they threw the gun down, and all three of them took off.”

    The attackers didn’t get far though, and according to the Atlanta Journal-Constitution, police later detained a male and female, both 16 years old.

    They are currently in custody facing charges including aggravated assault, possession of a firearm during the commission of a felony, possession of a controlled substance, criminal attempt to commit robbery, and obstruction of officers.

    Being able to defend yourself and others is a human right. And when a responsible gun owner stops a criminal with a gun, it’s clear that right deserves to be defended too.

    An armed neighbor is being praised for coming to the rescue when a pregnant pizza delivery driver was attacked and robbed Wednesday night.

    The incident happened at Waits Avenue in Southwest Atlanta.

    Atlanta Police Department officials told Channel 2 Action News two 16-year-olds, a boy and a girl, were arrested in connection with the crime and charged with assault, possession of a firearm and attempt to commit robbery.

    The neighbor said he caught the suspects beating the woman with a rifle. He said he then pulled out his gun.

    Madaris said he didn’t back down.

    Officials said the victim suffered cuts and bruises on her face and was taken to the hospital as a precautionary reason due to her pregnancy. Police told Channel 2 Action News she was alert and breathing.

    A New Zealand man was shot outside of this home in Goochland County, VA after attempting to visit with a teen girl he met online. Apparently, the teen’s mom was upset about it, or that’s the impression you get from the headline: “Goochland mom shoots man who flew around the world to track down her teenage daughter” -- What the headline doesn’t say is that our Romeo also brought a “brick, a knife, pepper spray, and some duct tape” and was shot while breaking into the home to visit the 14-year-old girl. His real name is Troy George Skinner, age 25. The intruder actually threw a brick through the window before getting shot. Skinner is expected to survive: Sheriff says Skinner will survive. There is a deputy at his room. Has not been formally charged, and he has refused to speak to investigators. And the FBI is pursing federal charges at this point: Sheriff says man is still in hospital. He is not the victim. Says the family are the victims. FBI says they will pursue federal charges related to this man.

    She is 14.

    I asked if Skinner liked the teen romantically.

    Police: Victim fires gun at Spartanburg robber, stolen Mercedes later found on fire
    SPARTANBURG, SC (FOX Carolina) -
    The Spartanburg Police Department said authorities found a stolen car on fire on Tuesday night.

    Officers were called to reports of a robbery near Southport Road around 10:30 p.m.

    Police said the victim was getting into his 2007 Mercedes when a man with a gun walked up and said he needed the keys. Investigators said the suspect asked the victim if he had any money and then told him to get out of the car, at which time the victim got out and pulled out his .380 Taurus Curve.

    According to the incident report, the victim fired two or three shots at the robbery suspect and ran to a nearby restaurant to call police. When officers arrived, they said the suspect had stolen the Mercedes.

    The victim told officers he had a money bag inside the car, the report states.

    Spartanburg County deputies located the car on fire further down Southport Road and are assisting in the case.

    The suspect has not been identified.

    Suspect in alleged Madeline Street armed robbery that turned deadly charged with criminal conspiracy and aggravated burglary

    SULPHUR, LA (KPLC) -
    A suspect in a January armed robbery that turned fatal on Madeline Street was apprehended in Utah this week.

    Aaron Kern, 20, of Sulphur was apprehended by the U.S. Marshal Service Fugitive Apprehension Team on Monday.

    Lake Charles Police have been looking for since January after the deadly home invasion.

    Authorities say Kern had been hiding in Utah with his girlfriend and was getting his car serviced-- when suddenly he was taken down by three U.S. Deputy Marshals in plain clothes.

    U.S. Deputy Marshal Derryl Spencer says it was in everybody's best interest to get him into custody:

    "This is a real important case for Lake Charles. They've been looking for this guy for a while. So they were excited to learn that he was somewhere in the Draper area," said Spencer.

    Police say Kern is one of three men involved in the home invasion.

    Cpl. Larry Moss says they are glad to have him in custody.

    "We're very pleased to have Mr. Kern in custody. We look forward to him being extradited back to Lake Charles. He fled the area, we believe, very shortly after the incident occurred so he's been on the run since January," said

    Kern is facing charges of criminal conspiracy and aggravated burglary.

    "The individuals broke into the residence on Madeline Street and the homeowner, defending themselves, shot and killed one of the individuals involved in the break-in," said Moss.

    The man involved in the home invasion who died was, Isaiah Williams, who police say was shot and killed by the resident who lived in the home.


    A third intruder, Freddie Vezia pleaded guilty to home invasion and is serving ten years.

    "All the ends of the earth, LCPD, when a warrant is issued, we will do everything in our power, if we have to send it up to the U.S. Marshal Fugitive Task Force or we go do it ourselves, to bring that individual back into custody, or into custody and bring them to justice," said Moss.

    Police say they don't know yet if Kern will waive extradition. if not, they will get a governor's warrant to force him to come back to Louisiana to face charges.

    Kern had been a fugitive since the January 25th home invasion.
